I am starting my efforts by working within the system - I posted my letter to the USCIS Ombudsman on another thread, but I watch your thread closely to see if anyone in March is being processed. Copy and paste anything if you like.

The Letter I Sumitted to the USCIS Ombudsman today:

To Whom It May Concern:

In April of this year I applied for a K1 visa for my finance. Because I am a resident of Virginia I was required to submit my application to the USCIS center in Vermont. Since I have applied for this visa, the processing times at the VSC have slowed dramatically (to over 180 days).

When I contacted the USCIS today, they said that the VSC was processing applications from December 30, 2008 and that my application would not be reviewed until October 22 of this year in the best-case scenario (more than 180 days after I submitted my application). Meanwhile, residents of states that feed into the USCIS servicing center in California are being processed within 66 to 100 days.

I find this inequity unacceptable, given that all applicants pay the same application fee. After having researched this issue, I do not think that it is caused by a difference in the efficiency of VSC employees versus CSC employees, but more likely by a misallocation of workloads vis a vis resources by either the USCIS or its subcontractor Northrop Grumman. Furthermore, I do not understand why processing times are increasing while the volume of applications is decreasing (as your office itself noted in its June 2009 report to Congress).

Unless steps are taken to remedy this inequity immediately, which is unlikely given my conversation with USCIS today, I will be forced to cancel my wedding in November of this year. My parents will incur significant financial losses, as well as my family and friends who have already purchased tickets to attend the ceremony and reception. As I am sure you are aware, these misfortunes pale in comparison to some other people standing in line at the VSC under far worse circumstances, while May and June filers begin to be approved at the CSC.

I realize that my application is currently within the USCIS' “normal” processing time. Nonetheless, today when I called for the first time I was told that my application will be adjudicated around October 22, more than 180 days after my submission. Further, it is not "normal" for residents of one state, like Virginia, to arbitrarily receive such significantly inferior service from the USCIS than residents of California or Oregon. Why isn't the I-129F workload distributed more evenly among these centers and why can't files be sent from one center to another when one center falls significantly behind another?

It is infuriating to see large numbers of people who filed their petitions in May and June being approved by the CSC before all of us who filed our applications in January, February, March, and April at the VSC. While I know that the membership of the primary tracking site for I129F petitions (VisaJourney) does not comprise the entire pool of I129F applicants, its membership pool does represent a statistically valid number of applicants and it is therefore possible to ascertain broad trends in visa processing extracted from its data. On top of this, USCIS' own bulletins display the existing inequity, albeit on a more publicly digestible magnitude.

Ironically, my fiancé is more peaceful about this issue, noting that the USCIS seems to me no more equitable or effective than its counterpart agency in his largely corrupt country of the former Soviet Union. In fact he advised me to not to send this letter, for fear of the type of retribution one would encounter in his country for voicing concerns about a what seems to be a systemic problem that no one has an interest in or incentive to correct.

As a patriot and former federal government employee, however, I assured my fiancé that things were different in America. I sincerely hope that your office will propose and implement a long term solution to this problem, rather than simply add my letter as a tally mark on a count of "Top Ten Complaints in the Ombudsman E-Mail Box" for inclusion in an annual propaganda piece, like they would in the former Soviet Union. It is hard enough to wait six months plus for adjudication. Adding the knowledge that people in different states are waiting half the time you are for no apparent good reason is like adding salt to an open wound. I hope that future customers do not have to suffer from inequality that does not seem too complex to solve.

Calm down :) The G-325a is used for many different things and so some of its questions will be irrelevant or worded confusingly. Don't stress too much about it!

1) No white-out. Try to change it, err, manually.
2) Yes you can write "present time".
3) On that particular question, I'd say don't write anything. Because it does say "IF" blah blah then complete this. If a question says to say "none" then do so, otherwise it is entirely up to you whether you want to write N/A or not.
4) No staples! Every packet they receive contains little photos and other odds and ends, they're used to somehow controlling a pile of paper, it'll be ok!
5) Assuming you didn't put a whole through them...no it shouldn't be.
6) Having copies of everything is always good, whilst you're at it photocopy the completed forms. I didn't do this personally, but it is always good to have copies of important forms you send off...

You don't need to tell them about the mortgage. If you had a low income and owned real estate which you were going to use as an asset, then you would have to disclose the mortgage on it. But as you do not need to use assets, and don't own the house, there is no need to mention it. Your income is sufficient.

wow wth :blink: i didnt know that at all. before i discovered this site few days ago, i was getting my info from a romanian site. they didnt have anything like that in there. still all the girls on that forum that sent their petitions in march in dallas got their emails and noa1 in max 2 weeks. so i guess now we'll have to wait for it to get in cali or vermont, then they have to check it, see we dont have a check but debit card, and send it back to my fiance in virginia? that will take forever, im so afraid this will affect our relationship.....

Not to be pessimistic, but even if you have this issue figured out in a week, it will most likely take them (at least) 5 months to work on your case and send you a notice of action. Add the rest of the time and the interview...I'd be planning an October/November wedding. :crying:

thank you for your response. i have a question regarding phone calls. I am using a prepaid celfone here in the philippines. which means, i dont have a monthly bill. so theres no way for me to have a list of people who calls me and whom i am calling. but she got a line phone. meaning she got monthly bills and billing statement. my question is, will my number appears as exactly as the number i have? because there was an instance wherein she tried calling me, and the number that appeared on my screen is just like this (+0000) and nothign else. im worried what if, everytime i call her, the same thing appears on her billing statement. could that be possible?

In regards to phone calls, I use the Yahoo Messenger chat and voice calling. In Yahoo Messenger there is a "call history" feature, that you can see and copy. The call history shows both parties email address, amount of minutes talking, time, and date. I print a sheet of the call log, for each month, which in my case, is usually 30 calls a month.

Maybe she didn't like the fact that I am black and muslim and wear hijab..... She only asked a couple of questions about my parents and my siblings only asked 1 question about me and that was why did he want to marry me.....Kept our photo album for 3 days.... Didn't even ask for any of the other evidence.... I don't know maybe she was just having a bad day :blink:


Same with our K1. We did alot of work to make our case as good as possible. Often the interviewer is just a

My parents are 40 years apart. They have been married (very happily I might add) for 30 years next year. They have four children together. They married when mum was 22 and dad 62.

So... your theory is quite wrong. YOU might feel that way, and personally I don't think it's for me, but I do know it works for some people. Exceptionally well in my parents case.

I am very glad for your parents. Friend of mine is 61, with wife 22, very happy 2 years now. She goes to college now, they travel the world together very much. Another friend 64, and his wife 26, very happy several years now. They all are honest with each other, and themselves.

Have you been to Asia? I have been there 2 times. I met very many very nice girls, good looking, well mannered, working, easy going/pleasant, and all divorced. I may have been too blunt, but I ask them why they were divorced, being that they all had so many good qualities. Most of the reasons were that the former husbands way of spending their leisure time was at the bars, with their buddies, or wanting a younger girl. Does not sound much different than alot of guys I know here.

What I mean when I mentioned the I-864, is the Visa Officer or our government is looking for a couple that has the potential of withstanding a long commitment together. The visa process ask for all previous marriage and divorce documents. The NVC may read these documents also as a reference to a bonafide relationship.

Wow!!! I am so happy with site from all the responses I am getting both good and bad...I will share and continue to share this info with my fiance in China. As for me, I would have to grin and bear it to live in China.. Its a pain for foreigners to live in China if you dont know the language.. I was there for 2 months and honestly I prefer to live in the good old USA..But for her I can live there a year or so-- sounds like that is going to be a given from what I am reading...AND from some of you, even after that, its not 100%...

You may want to read alot here and get a good understanding of the Visa Process. You are correct that its not 100% in any of the cases, even if your case was 110%.
I am 62 now, going through this process again. I believe the age difference is not a problem. I believe in your situation, the difficulty will be in the long term marriage commitment. If you look at the I-864 Support Form, you will see it is a 10 year commitment.

One option that you might consider is moving to China for an extended period, marrying her in China, and filing Direct Consular Filing. I'm not too familiar with the Guangzhou consulate, but we went through one of the highest fraud consulates in the world, and from my personal experience, living in your SO's country for 6+ months under the same roof with them can greatly increase your chances at interview, regardless of the situation. And DCF filings are notoriously more successful than filing from the US. If you're already willing to move there, this might be a good option for you.

After calling them after my 5 month period, I put in a request. I called them up today again saying what is happening, the call was escalated to tier 2 and ended up speaking with an Immigration Officer Morales.
He said right now Vermont is processing July 10, 2010 - this is absolute BULLSHIT. I saw someone wrote on visa journey about a month ago where he was informed the same date. They are big fat liars.

I was told my case is under review, what the hell they are doing for last 5 months now. And I got an email few days ago saying I will get something within "60 days" - what should I do? Any suggestions??

Did anyone get any NOA2 lately for July filers?

My timeline is as follows:

I129F sent - 7/23/2010
NOA1 - 7/28/2010
Touched - 10/3/2010



If you check out June, May, April, March Filers, you can see many of us have to wait 6 months. Anyone that calls in will get the same BS information. It seems, it just good or bad luck of where our package is in the deep boxes at USCIS, or NVC........

It isn't going to change until congress changes it. I would recommend that everyone write to your Senators and Reps about how dysfunctional the system is and encourage them to address this first rather than focusing on immigration issues like the Dream Act. IMO they should be helping the people following the rules first. It is time now for all of us to tell them this.

Congress has passed the buck, giving the final decision to the discretion(person opinion) to the Interview Officer. Maybe we should pick a certain date for as many as possible to write their Congressman. :yes:

An extra $1000 is a very small amount to pay to not go through alot of months of waiting. Read recently that outside the China Consulate for $5000 you could get your Visa Petion approved, "guaranteed". I would gladly pay an extra $5000 to not go this process for as long as my girl and I have done. $5000 would be a small amount compare to another trip to China, and running two households instead of one, for the past year, since our denial in dec 09....

Finally some movement! John emailed his elected representatives in Ireland on tuesday for help regarding the police cert. One of them replied yesterday that she got in touch with the superintendant's office at the station on his behalf. This morning John got a call saying his police cert is being mailed to him today. Unbelievably useless police force...argg. All it takes is a call from a TD and the matter is sorted right away. I'm grateful for their intercession, but it shouldn't come to that.

Also finally got a medical appointment booked. The doctor actually called John personally to ask when he could come in because the doc was going to be leaving on vacation soon. Shocked and amazed that he did so, considering what an a**hole he was last time John talked to him.

So HOPEFULLY after next week we'll have everything and be able to send off the checklist to Dublin and get an interview date.

And the doctor's office that does the medical is completely useless as well, not replying to emails or calls, and giving out to John when he finally does get in touch with them. :bonk: :bonk: :bonk: Even John is getting really angry now, and he's a very laid-back kind of guy, so it takes a lot to get him worked up. He also has exams he needs to study for, so this daily distraction is a major nuisance.

Congrats to all who are moving forward.

Still no NOA2. We filed over four months ago. No Request for Evidence either. Very frustrated and distraught.. our plans for the Fall are falling apart.

Since we want to move together this Fall. Does anyone know if it is possible to apply for a different Visa or to cancel the K1 Visa and apply for something else (like an au pair visa) so we can live together. I am very aware that it is illegal for us to marry on a non k1 visa..

I don't know of any other visa that's going to give you a long-term solution. I think France is a visa waiver country, so she could come for a 90-day visit, but that's about it. Unless she can get a work-sponsored visa, but hunting for a place to sponsor her would be very time-consuming, with no guarantee either. The only other option would be a CR-1 spouse visa, but that would be starting all over again, with a similar wait time as a K-1. I would definitely not cancel the petition at this point. 4 months is not as long as some other people have waited, and certainly not time to give up yet. You'll get there!

And for the record, it's not illegal to marry. It's just illegal to marry and have the intent for her to stay and apply for adjustment of status, without having entered on the K-1. So she could come without the visa and you could get married no problem. She just can't stay indefinitely afterward.

But he was here for a visit last week! He came on Weds and left on Sun. Not a very long one but I couldn't take off any more time from work. He was here for my annual family reunion, so he got to meet a lot of my extended family for the first time.

So even after Dublin dragged their feet with opening our package and sending John the packet 3, we're now just sitting and waiting for John's police clearance. It's supposed to take "up to three weeks", but it's been 4 weeks now. He went to the station yesterday and found out just how ridiculous the police force in Ireland is. Despite being able to look him up in a database on demand, they have to send requests about him to every local station for places he's lived. That's three stations within one city, plus his hometown station, which is only open one day per week because it's a tiny village. We have no idea how long this is going to take. I wasn't stressing about our timeline because we're not planning on him coming until the end of September, but with this issue, who knows how much longer we'll be waiting.

They just told me if it isn't delivered today, to call back tomorrow and they'll put a trace on it. Ours has been "on the way" to London Heathrow from East Midlands for 30 hours, compared to the other Lebanon package from the day before us that took only 3 hours. :(


Mine was stuck somewhere between East Midlands and Dublin for three days! But it got there eventually.
