Middle East and North Africacairo packet 3
My Fiance noticed in the Packet she received from the embassy that it had (2) DS-156 forms but not the DS-156K form. She took pictures of all these forms so she was able to send me what all was included in the packet.

I also received the letter stating the 10 day notification for an interview appointment and then the part of the packet talking about the 6 weeks for a interview from part of the package.

Middle East and North AfricaVisa Interview At US Consulate in Cairo
Hey all,

Sorry it took me so long to be back and write. Just to let you all know, I have my immigrant visa to the US approved. I arrived at the US embassy in Cairo on June 6th 30 minutes before interview scheduled time and it took about two hours of waiting inside until it was my turn. The interview went smooth and the consular office was friendly.

The questions they asked me were:

- How did you and your fiance meet?
- How long you been knowing each other?
- What does your fiance do for a living?
- What's his position in his current job?
- Did your fiance meet your parents?

The interview ended with the last question answered with "Yes" and showing some pictures of my fiance with my parents along my answer. The consular officer smiled and congratulated me saying that I will receive my passport with the visa in it within two weeks.

While you're there at the embassy, you will have to pay at the DHL for your passport to be mailed back to you with the visa in it. They have the DHL office there at the embassy. 48 L.E. were the whole fees.

Good luck to you all,

R. :)

I was going to say...WOW 4 DAYS!?

That is quite an incredible result to get it all approved and returned. Even if one prepares everything ahead of time, realistically t would not take 4 days for normal people.

Middle East and North AfricaHow did your MENA SO propose marriage?
I am friends with my husbands brother and sister in law and I seen a picture of Khmais about 5 years ago. I said oooo, he's cute he is going to be my husband and we all laughed whistling.gif;. Well in November of 2008 his parents came to the US to visit and I would come to visit them and see how they were doing. Khmais brother said to his mother Candace says she is going to marry my brother. His mother looked at me and said I like her she can marry him. I thought she was playing and personally out of her mind but then she called him and said I met your wife. I couldnt believe it we started talking from that day on and I loved him immediately. I didnt get a formal proposal but being chosen by a mother, you truly cant get any better than that!

Middle East and North AfricaThe women that marry mena men?

call me cheezy but my man uses tons and tons of smileys and I started doing it back. :)

My family calmed down a bit now that I've been there and back alone, it was the weeks before I left that we were making worst-case-scenario preparations (as in the "Mom, I don't want to be cremated and dammit if you cremate me I'll haunt you forever!" talks). hahaha

The biggest change in me has yet to be discovered by them--it's easier to admit you're gay in my family rather than admitting you're Christian!

Hang in there, Sparrow! Good luck with everything.

I'll write more on this later as I'm at work

Middle East and North AfricaThe women that marry mena men?
I feel that the women who are truly gutsy are the ones who embrace the culture by going and living in the MENA country with their man. Not too many people are willing to do that. Now that takes guts!!!! And true love.

I've been in approximately 35 different countries including MENA ones. I don't consider it that gutsy when as an American you know if there is trouble all you've got to do is get to the nearest embassy or consulate.

Have you noticed that this board is a little more animated and full of action than the other forums? Why is that? I think it takes a little bit of guts to go to MENA countries for the average american and to embrace a new and exciting culture. I think the women that marry mena men and meet them in their countries are a little more gutsy than some of their friends. To go on a plane half a world away, especially one engulfed in controversy ( world politics and opinion) perhaps takes a little bit of a spitfire. How have your friends and families reacted to all the phoning, planes, traveling and changes in you as a mena marrying woman? I often wonder about this.

Middle East and North AfricaI gotta say Thanks to you all
I wish you well. I am concerned about the abuse you say you are experiencing. I know that adjusting to another country is hard but couples are usually still in the honeymoon period this early on. If he's treating you badly now then this may be an indication of how he handles stress, etc. and will probably only get worse. Life is full of stress and you will need a partner that supports you and your children.

I had a good friend who loved a man deeply for years. It was long distance. Once she got to know him she was shocked to find that she had been taking what she knew about him and filling in the blanks. He was not the person she thought he was at all. The person she had loved didn't really exist.

I hope things work out for you and your children. You're right. Your home should be a santuary.
Best Wishes

I have to say thanks to all of you MENA/ VJ'er.. I got a huge amount of PM's showing me support.. Thank you SOO MUCH for the support.. and the offer of a "shoulder"

I actually was surprised at the amount of people who say they are dealing with the same thing :(

I never really thought this would be life life once he got here :(

Nothing has gotten better.. maybe i guess worse. I'm on the verge of loosing my job.. I couldnt even go in today.. and I am calling out tomorrow too..

I finally cornered him to speak to a religious leader (imam).. and my out look towards our future in Not a good one... but God knows.. I DO love him... but I will NOT tolerate living how I have had to live these past 3 weeks :(

I got a few comments that I should be grateful that atleast my man is here... And believe me.. I was Very thankful things went as quickly as they did... BUT abusive behavior.. mental, emotional and physical will NOT be tolerated.. even if this is supposed to be an "adjusting period" of our life together/ getting used to living in america... ESPECIALLY infront of my VERY impressionable 5 and 6 year old boys....... my home is NOT supposed to be a war ground.. but my santuary.

for all of those who confided in me about what they are dealing with now... or what they feel might happen in the future..

Please think with your head and not your heart.. IF he is NOT even hear yet and MY story makes me nervous that this is your future... think LONG and hard BEFORE he comes into the country.. ESPECIALLY if you have kids...

anyways...

thanks everybody

Middle East and North AfricaConfused About Visa Types...Help Please

Hello fellow VJ's.

I am new to this site and I am so glad I found it. It appears to contain a wealth of information. I have a question that may have already been asked before but I was unable to find such a question during my search on this site. Here goes....

My current fiance and I have met via the internet in October 2006 but have never met in person physcially. We do however, maintain daily contact via webcam, Yahoo IM'ing, emails, telephone and text messaging. He proposed via webcam, I accepted, and he Fed-x my engagement ring...*lol* We would like to be married in Nigeria in December 2007, and then file for a K-3 Visa for him to join me here in the U.S. in 2008.

Since this will be our first time ever meeting face-to-face, and I have to have a Visa to travel to Nigeria to marry abroad, what is the best Visa for me to apply for? If I understand it correctly, in order to apply for a Fiance Visa you have to show proof of having met at least once in the past two years? Should I apply for Tourist Visa in order to see him for the first time, although we plan to marry during our first face-to-face visit? We both realize that I will come back home after we marry in December, but I plan to apply for his Spoual Visa upon my return.

Any information you can provide would be greatly appreciated.

Thank you.

You will probably need a "visitor visa" to enter the country of Nigeria. I recently visitied my Fiance, I had to have a entry visa. I am sure you will find the information you are required to complete once you marry your fiance.

I take it your question is about the visa you (the USC) will apply for to visit and marry your fiance in Nigeria. That's not what we deal with here. We deal with the process of bringing foreign fiance(e)s spouses and family members to the USA. For information on visas to visit Nigeria, go here.

http://www.nigeria-c...mmgrat/visa.htm

Google "Nigeria Tourist Visa" for an agency to assist, if needed.

Be aware. Somebody going through the visa process to bring a fiance or spouse from Nigeria posted this morning something to the effect of....There are some countries from which it is easy to obtain a fiance or spouse visa and some from which it is extremely difficult. Then there is Nigeria. Be assured there is a reason for this.

I advise you to become very familiar with the process and Nigeria issues before your trip.

Hello.

I am really hoping to get some help. When we filed documents, they asked for my husband's address in Egypt. He is just renting a room and gives his Grandmothers address as his mailing address. The Embassy sent someone to check on his address and His 85 year old grandmother told them he does not live here - Any advice on how to handle this?

Thank you ,

The original poster of this thread is not exactly prepared to help you, they are just beginning this journey, and they found this on a link. There are a few people here that have gone the process to completion. These are the people that can help guide you. Each case is different, but there are basic steps you need to get started on preparing. First start by reading this link.

http://www.visajourn...?showtopic=3896

It is filled with much research and knowledge on returned petitions. Read this, have your SO contact her senator/congressman to assist you. There is much work ahead of you, and you need to be prepared.

Thank you for the information, but I have tried many timed to ask for help with my representative - and they are useless!!!! I know more then they do. What is an SO?

Sorry it took me awhile to respond - thank you anyway,

Hi Abdo.

I am new to this site, but hoping you can help me. The freedom of information act form - Our case has been sent back and my Husband received a letter from Embassy - saying they are not convinced our relationship is real or valid. They sent the case back in Aug 07 - I have called 2 x's to find out when I will be notified. They said they updated the file and I should hear soon. Do you think I should request the FOIA form? I am not sure how to proceed.

Thank you soo much for any advice you can offer -

Here is what is happens when a petition is returned :
•221(g) is issued to beneficiary at conclusion of the interview stating the application and/or petition is being returned to the United States.
•Petition is returned to the United States by the interviewing consulate for "further review" in what is called a diplomatic pouch.
•Returned petition is received by the NVC. It is reviewed and entered into the fraud database by fraud management.
•Returned petition is sent to the local service center where the petition was originally filed.
•Local service center receives returned petition.
•Local service center who processed the original petition sends a notice of receipt to the petitioner.
•Local service center reviews the returned petition and consular officer notes on the case.
•Local service center then sends either a NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also asking for more proof of the relationship, many cases have specific consular objections to rebut.
•Petitioner is given 30-60 days from date of NOIR/NOID (depending on the service center) to respond with additional evidence of the relationship or other specific evidence. The timeframe to respond will be provided in the letter.
•Local service center receives evidence...if in the timeframe given (30-60 days) the case is reviewed and either reaffirmed or denied.
•If the petition is denied the local service center sends the petitioner an 'official' denial letter. This can be be appealed if the denial letter states such.
•If the petition is reaffirmed the local service center sends the petitioner an official notice of reaffirmation.
•Local service center sends the reaffirmed petition AND its evidence provided in the rebuttal directly to the consulate along with a recommendation to issue a visa.
•Consulate notifies the beneficiary of a new interview date.
•Beneficiary has interview for the reaffirmed petition and the visa is either issued, or the case in placed in Administrative Processing which after cleared a visa is issued, or worst case scenario it is denied via 221(g) and returned again to the USCIS.

What can you do immediately when faced with this issue:
•Immediately have the beneficiary send a scanned copy of the 221(g) issued.
•Contact the consulate directly (immediately) and attempt to have the petition reviewed by the senior consular before it is returned.
•If you are unable to get through to the consulate on the phone, contact them via email, and if you're mail has a "read verification" use it.
•Contact your congressman/senator, get them involved immediately. You will need to sign a release form giving them permission to make an inquiry on your behalf.
•Provide your congressman/senator with as much information as possible about your case, the interview, and the result.
•If your congressman/senator is top notch, they will not just send an email or letter to the consulate, they will call on the phone and try to get the petition reviewed again before it is sent back.
•If they are not successful, they can request the diplomatic pouch number the petition is being returned in. This number will allow you to track the petition until it is received by the local service center.
•If you do not know who your congressman/senator is, use the following links to find out who represents your area:
US Congressional Representatives (By State) US Senators (By State) If the petition is returned, you are in for a wait. The diplomatic pouch the petition is returned in is sent from embassy to embassy picking up other returned petitions along the way. It could take up to 2 or 3 months for it to be received by fraud management at the NVC...then the NVC has the petition for about 1 month before sending it to the local service center where it was originally filed. One thing to also know is that returned petitions do not take priority...they are reviewed in the order they are received...that is after new petitions have been processed.
What you can do in the meantime while you wait:
•Continue contacting the consulate to get an actual reason for the return...not the blanket "validity of relationship" response.
•Stay in contact with your congressman/senator, they can assist you in getting the actual reason for denial.
•Immediately file a Freedom Of Information Act request for the Department of State asking specifically for the consular notes on your returned petition: DOS FOIA
•Immediately file for a Freedom of Information Act request for the USCIS asking for the same specific consular notes on your returned petition: USCIS FOIA
•Continue to document your relationship, emails, letters, phone bills, visits to their country, etc.
•Be ready for the opportunity to rebut the consular findings.
•Contact a good immigration attorney...preferrably one who has experience in returned and denied petitions.
After a period of 6 months or longer has passed and you do not hear anything from the local service center regarding the receipt of your return, or the results of the review, you can contact the CIS Ombudsman. While the Ombudsman cannot make the USCIS reaffirm your returned petition, they can assist when processing times are outside of guidelines..

Now, there are some differences between returned fiance petitions and marriage petitions. The K1 is especially at risk due to the expiration of the original approval, many returned K1s are not given the opportunity to rebut, they receive a notice telling them their K1 has expired and may file again at any time...this is why the FOIA is so important. You need to know the exact reason the petition was returned, just filing again is a huge risk if you do not know why the petition was returned in the first place.
While the K3 does have an expiration date also, they are treated more seriously. I have not known anyone who has had a returned K3 not being given the opportunity to rebut. Obviously the CR1 does not expire. Still, it is very important to file the FOIA, not every service center will tell you exactly what the consular office findings or objections to issuing the visa are. Some people are only asked to provide more evidence of their relationship.

Middle East and North AfricaUpdate on the denial

To,
Everyone who was interested in our case being denied... (L)
I retained an attorney to appeal our case this morning . Of course, there are NO guarantees of an approval.
We felt it was our only recourse at this point, so this is where we are at as of right now.
We want to thank those who sent us PM's and were concerned, and also those who posted encouraging words in my recent thread, and the many prayers that went out to us out of brotherly/sisterly love.
There had been some questions concerning this denial. I can tell you that when we filed , we filed under a hardship. I do not want people thinking their case will be denied because ours was. Each case, as we all know, is different in it's own right.
Keep us in your prayers, it is going to be a rough road ahead.
God Bless you all ! (F)

Yeah NOA1 dates aren't the sole thing determining when you get approved. Like say March 10 petitions, they are spread out throughout VSC adjucators and some of them have petitions dates way before March so those people may not get to the March petitions till later on.

Good thing is since last Saturday, according to Igor, we've had 6 VSC March approvals so we are inching closer and closer!

they are working on february 16th now, it sux big time since csc is approving april. i still think they work based more on the dates they receive the petition not on noa1. but im a non lucky one since i got my noa1 later , my 100 days will be july 5th i think, and from that moment i expect noa2 around middle july or the beggining of august. but u guys should already be planning tons XD

LMAO DEEDEE!! I surely want to be your friend now hahahaha  Well, as long as you have the police certificate with you at the interview, I don't think things you did when you was a teenager would cause any harm. Something to ask in a new post to experienced members? or if somebody went through the same thing? LOL I'm still laughing at the punched girl

the ###### called me a satanist i throwed my pencil after her during english class, when i went to take my pencil from the floor she jumped up suddenly and i punched her cause i thought she was gonna hit me lol. it was a REFLEX (well a very ugly reflex indeed). police didnt buy it obviously, but they didnt do anything to me cause our principal said if she doesnt withdraw everything she said SHE will get expelled LOL (my luck). i posted a topic on the forum, someone said that doesnt sound good........

wow things started to move pretty fast in here it seems. guess we're all getting closer now huh? im worried about my police certificate. ive been a runaway for 3 months when i was 14, and got a fee for drinking beer in public (a park) when i was 18. also i punched a classmate at 19 and she lost a tooth but she took her acuse at the police back so they stopped messing with me...wonder if they'll deny me for that -_- i was young and restless lol

Looky at this USCIS trend graph the VSC NOA2 approvals in april were twice as much as those in March, and as there's no reason it won't follow the past trend, the rate of approvals will stay very high till end of July, hopefully!

omg lol u imagine how slow they are? there are like 13.000 people waitting at vermont, and they only complete few thousand a month, and more come from behind. they definately need more staff to help out with the petitions. it seems in 2009 it was way faster than 2010, maybe the summer was not so hot and they didnt need as many coffee breaks >_______<

Yeah you filed in March but unfortunately they screwed up your case but hope they realize that and get it done for you sooner.

DeeDee yes nice and creative and keeps your mind occupied while we wait.

So far this week VSC got 16 approvals and CSC 9 and last week it was 45 vs. 24. According to the Igor list stats, most weeks VSC is approving more than CSC the last couple months. http://cse.ssl.berke...data/stats.aspx

Also on Igors timeline list I remember the first time I checked we were in the high 600s, as far as the VSC VJ waiting line and now the list only goes down to 471 so they reduced the backlog.

I'm in the high 260s now so we all have come a long way!

heh thank you ^_^ how did u see those? it gives me link error when i click the link
