We are getting married in Italy in January and so we will have to fill out for the spouse visa which is the K-3 or the IR-1 or is this the same thing? I was told that we had to fill out the I-130F first then wait for the NOA1 and then fill out 1-129, then go from there.... We have picture,(hopefully enough, because I was there in Italy back in Sept. 12 this year for 3 weeks) we have plane ticket, train ticket, cause we caught the train alot!!:) we are trying to pull up record of our chatting online, but we do alot of skype and oovoo and messenger, can I pull up a record of us being on webcam as well as our chatting? How do we pull that from skype and messenger? Any help is appreciated because I am not that good with these computers....:unsure::)

At the POE the petitioner becomes a permanent resident. The paperwork is sent to the government form the officers at the POE and the Green card is sent to the petitioner at your USA address.

If I were you, I'd file the I130 immediately.
Just look at the time lines. I filed in July and we are still waiting for approval!

VSC (Vermont Service Center) handles most petitions for the east coast, Georgia included. Her NOA1 should show which service center it gets routed to.

Really? I live in Virginia and was sent to California Service Center!

Wow! Yes it is a big thing to bring your spouse over and yes that document puts a burden on you if you decide to split up but surley this can not have come as a surprise to you?

This topic causes me to wonder, if you were to get a divorce, does the I-864 still obligate you to financially provide for the person? I know the way my marriage is set up if I was to divorce, I pay her family approximately $6000 and that's it. A lot different than USA divorce!



YES!!!! this is a contract between you and the US Government and the government will only release you of providing for the person, once they become US citizens, you die, or after they have contributed 10 years into the system!

Where in the vows do you agree to provide for your spouse forever ? regardless of divorce... until they decide to become citizens. Heck... I don't have to legally provide for my children after they are 18!

For us over 50... with good jobs, adult children, homes in two countries and a mutual prenuptial, this document is still flawed!

No, you do not have to file the I-129F after you receive the NOA1 for your I-130 and I suggest that you don't file the I-129F. If you do, then your I-130 will be pulled from its current place in the queue and placed with the I-129F you will have just submitted, that is how USCIS ties the two petitions together.

Filing an I-129F in conjunction with an I-130 is for a K3 visa. Most of the time, the two petitions arrive at the NVC at the same time, per NVC policy in this scenario, the I-129F for K3 will be administratively closed leaving only the I-130 for CR-1 active.



PLEASE HELP ME TO "UNDERSTAND" all this ... what's the difference in paper work when filing the I-130/CR1 vs the I-129F/K3 (I hope I'm putting them together correctly), also, are there applications for CR1 & K3? I know there are forms for the I-130 & I-129F ... I consider myself to be intelligent but this got me scratching my head and saying ... "so confusing!"

Completely agree with you Anh map. I also suggest that you read as much of the information available here on VJ and even contact some of the members who have been through the same experience and get their input before proceeding. Yes you can have an attorney or this particular company prepare your case, but you can do it yourself as well by using the information and the resources here on VJ.

Yes it is time consuming at certain stages of the visa journey but you can do it and save a lot of unnecessary expenses.

With Nigeria, the more you spend time with your husband/wife or fiance(e) the better. It establishes a stronger bond and bona fide in the CO's eyes. So I say it is false that the more time spent will decrease your chances of obtaining a visa.

Please take in consideration that Nigeria is one of the hardest consulates to deal with. Take your time and do your homework before you proceed to file your paperwork.

I have ALL documents (birth certificate, divorce papers, etc.), completed I-130, G325A (and even "optional" G1145). Do Inyang have to sign the G325A or should I do what I once read (on VJ), to request that Inyang sign the documents at the interview. Also, what information should I request from our bank (in Lagos) showing "Evidence of a Bonifide Marriage?" The information reads ... "Documentation showing co-mingling of fiancial resources." Lastly, from my "understanding" (of what I read), AFTER I receive my NOA for my I-130, I must then file the I-129F (and submit the same documentations) and which ever one moves quickest, abandon the lagging one, is that correct? This is so confusing!

I was in Lagos (for 40 days), married the love of my life and am back in the U.S. (for now). After reading the various information regarding filing the K3/CR1, I read the advertisement at EasyFianceVisa.com and have submitted their requested information (I'm considering letting them do my paper work). I have a time consuming business and will not be able to put in the what appears to be long hours for this process, this is why I've decided to do a consult with EasyFianceVisa.com. Has anyone done business with them? Can anyone refer me to someone (who's not pricey), I want to start the paper work before I return to Lagos (in 8 weeks). Also, is it true that my constant visit (to Lagos), having a bank account and flat together could hinder Inyang's chance of being granted his visa? I was told by someonewho knew a couple in a similar situation as mine and when her husband went for his interview he was denied because the C.O. said she was constantly in Nigeria so there was no need to approve her husband's visa ... smh. I don't want to do anything to hinder Inyang's process. Your advice & opinion will be grately appreciated. Thank you.

I actually traveled to the US after I got married in Austria and before we filed for the CR I. I had no problem, I just traveled using he VWP. I got asked at the border control why I enter the US and I said "to visit my husband". And once I arrived in the US, we filed for I 130. So, as long as you don't travel to the US with the purpose to immigrate and leave before your visa ends, I don't see why you can't do it.

My husband and I were married while he was in immigration detention (with VD under safeguards). Our atty, I assume, submitted many supportive documents of a bonafide marriage (including our daughter's birth letter, our apt lease, our bank account, bills, pictures, etc).... is it pretty much 100% that our case will take longer than the norm since we were married while he was in proceedings or...??



Your situation is very similar to mine, from what I have read it takes about the same time if everthing is clear with USCIS; it doesn't matter if you are married. The problem is the process documents take from one end to the other.

Administrative processing could just mean regular administrative processing, ie receiving your extra evidence and processing it. Just slower than you like. So right now I don't think you should start worrying too much, but by all means keep trying to get word from the Embassy, and confirmation that they have indeed received what you sent.
