Again, I would agree with this being one of the best threads on VJ!

I generally agree that good quality SMS and voice communication several times on a daily basis is the best way to help maintain a long-distance relationship. We have found that occasionally, we should take a comms break for a couple of days a month and go out with friends (she does girls night and I boys night) that way we can also maintain our network of friends and not live alone in the pressure cooker of wishing while we wait for the approval process. In addition to our greater understanding of each other has smooth out and made things better. We have reduced fights to talk-able disagreements that are usually just communication misunderstandings. Quite frankly, the cultural words and the different use of English has set off more skirmishes than I can count not to mention bad phone lines. We have put a policy in place to call back if the line is not absolutely clear and to never put into writing anything in anger. Most importantly, keep talking until we find a solution. (Thank God for Skype! we have the world record of 34 straight hours for a very emotional and transitional conversation).

We are more in love each day and are hoping and praying things will begin moving in the next few weeks in VT per their original web post.
Finally, if at all possible, try to see each other in person for a week or two as often as possible. We spent 2 weeks together at Christmas (our first one together) and it has gone a long way in releasing stress and allowing us to float and firm up plans. We had planned to do a lot of things but spent 95% of our time loving and talking with each other alone. Just build upon everything you two found in each other and keep a positive outlook together. good.gif

Just happened to read your previous post about a question on I-130. Sorry to hear you had trouble understanding it. As this petition is designed to be filed by a US citizen or Green card holder therefore any mention of an 'Alien Relative' refers to anyone OUTSIDE the US. I am afraid you have messed it up if you have put the beneficiary's name there instead of yours.
Please correct this so no one else stays doubtful about these terms.

Alien Relative = Person being sponsored by the US Citizen/Green card holder

The thing to look out for in your NOA is for the beneficiary name. If the beneficiary name is correct in your NOA then I think question 17 should not slow the process.

Question 17 (Information about your alien relative (continued)) if you are the petitioner (husband) than you should put your wife name here and not yours. In my opinion if you put your name here then i think the beneficiary name on NOA1 would be your and not your wife. I mentioned it my earlier post about this typo on a vj sample I-130. Some people have mentioned that the beneficiary name on NOA1 were reversed. I think it is due to the fact that they followed vj sample I-130.

I was about to make this mistake too but upon a close scrutiny I read "Information about your alien relative (continued) several times to clear my reasoning that it is about beneficiary and not about the petitioner information.

My advise is to give 15 days for NOA1 to arrive and see who the beneficiary is. And stop worrying it does not solve any things. Keep yourself calm and explore your options.

I have also send everything that cmnb has mentioned in his post except passport photocopy & affidavit from bank. I would also like to make one recommendation for would be filler to send your photographs in a protactive plastic cover.

Besides money, are there any disadvantages to filing K3? I was under the impresson that I-130 & K3 petition are independent and we have a choice to choose which ever is approved first.

Could someone please look into I-130 sample form posted here on VJ website and look into quetion # 17 under "Information about your alien relative (continued)" section -- Is this correct or did they make a typo here. In my opinion this information is about your alien spouse who is not a US citizen.

I went to a lawyer and the lawyer said theres nothing he can do for me.... I cant file for the fiance visa because they will reference this case and it will be the same problem....
I have went to India 3 times and Im going this 4th time for 6 months... the first time i went was for 3 months second time was for 5 months and the third time was for a month and now im going to 6 months.

what else should i do ? im soo sad....

What did you submit with your I-130 & DS230? Is your husband faimily related to your family in any way?

What exactly did they ask your husband? How long was his interview? Did you go with him to the interview? Did you submit marriage photos, marriage invitaiton card, showed them gift/card exchanges, Your e-tickets or your passport arrival stamps.

I am not sure if staying in India for a long time would help or hurt your case because of affidavit of support.

Have you tried to get information under FOIA act on your case. I am not sure if FOIA will help but you will know what information is in your file. Maybe other VJ members may have more insight into it.

I wish everyone to be united with their wife/husband/children soon.

2. This one is the one i'm concerned about: The whole year of 2009 he was traveling abroad so this will be a gap in both his residency and occupation. He didn't mark this down on the 230, but there's room for me to fill it out myself. Would this be okay or do I need him to refill it out and type up an explanation or something?

3. How strict are they about marking down all previous visits to the US?? He just marked his 3 most recent, but he has a handful more, but doesnt remember them all. Does he need to put this info on a separate piece of paper? And if so is there a specific template for this or can we just type it up ourselves?


2) Don't worry about the gap in occupation. Did he not have a home address whilst travelling? If he really did have NO address then yes explain on a separate sheet of paper.

3) Yes he needs to write them all down, you can do this on a separate sheet of paper. Just write his name, case number, and DOB on the top of a sheet of paper then give the same information for the other trips as they ask for on the form. If he can't remember them all then that is fine, however make it as close as possible. (For example, if he remembers going there a couple of times in the late 1990s, then write that, with a vague estimation of how long he was in the US for.) Other UK applicants have done this successfully :-)

Oh and yes you can write "N/A" wherever you want.

Really sounds like you have nothing to worry about. Just remember to answer all the questions based on where you live (eg UK), except for the question that asks if you are currently in the US, as you will be, but make sure to indicate that you will be interviewing in London. We filed our I-130 whilst I was visiting the US, and everything went smoothly :-)

As for your list of worries, no worries! The only one that could potentially cause a delay is your work in countries such as Libya, in that it might cause a slight delay, but it shouldn't actually be a problem. If you're a nuclear engineer it might take slightly longer again ;)

His mother is a widow who lives alone. We are planning to live with her only for a few weeks when we go to the US until we can get an apartment of our own. She won't give us money or anything, but we're just staying in her house for a short time. Now does that make her household 4 people or just her and I? it's important as it makes all the difference in the financial requirement

Do you have $116,136 in savings? If not your husband will either have to start working a job in the US before you get visas, or you will need someone in the US who is willing to sponsor you. Does your husband have any family in the US who would be willing to do this?
Start researching the I-864 sponsorship requirement before researching the rest of the immigration process :-)

He will need to backfile taxes for the past three years. If he earnt under a certain amount he won't have to actually pay anything.

He only has to prove that he intends to establish US domicile at the same time as you, so there are ways to do that without having current ties :-)

Unless you're actually in the military or on official government business abroad you are not considered to be domiciled in the US. I had looked into this when my husband was considering a similar contract to yours, as I needed to know if there would be a problem with me accompanying him and living away from the US as a green card holder.

You can just show that you intend to take up residence in the US at the same time she does, she can't move over before you though. So affidavit and lease to show this yes.

Have you worked out how she will stay with you in Kuwait? When I was looking into it it seemed like I could maybe stay for three months at a time but we'd have to rent a place outside the base.

You must travel to the US before Jan 3rd 2013. When you arrive they will stamp your visa and it will be a temporary green card valid for one year from when you enter. You should receive the real green card before that year is up :-)
