The I-130 has to be approved regardless of the 129. You need an approved 130 to apply for AOS from K3 or to just continue with the 130 process.

My husband and I went to the SS office a few weeks after our marriage to apply for my SSN instead of using my married name i used my unmarried name in the application..but when the office staff checked the records he told us that my name in homeland is different I mean they had omitted one letter..Now while waiting for the respense from the SS office we are now ready to file my AOS... Can I use my husband last name in the forms even though i used my unmarried name in applying for the SSN..

Happy New Year to all the visajourney friends and thank you for all your input. I am now married to a Thai woman on my trip to Thailand in December last year. I am back to the States alone and have filed a petition both I-129F, petition for Alien Spouse and I-130, petition for Alien relative on Dec 29 2009 and is now waiting for NOS.

My wife remains in Thailand. Our child will be born sometime in April 2010. My question is what is the procedure to register our child with the US embassy in Bangkok so that our child can travel to US with a US passport. I understand that the approval process for my wife can take up to six months. I plan to go back to Thailand again for our child birth and would like to process the paperwork for our daugther at that time.

I was recommended that if I can be in Thailand during my wife interview in Bangkok, it will be helpful. Just not sure that it will be around the same time as when our child is born though. I would like to process the US citizen for our daugther when I return to Thailand (it will be my short visit). More than likely, my wife may have to go to US embassy for her interview alone. Will this be a problem?

You say she is your wife but you also say you want to get married.? If you are married you can file a 130 now. You may want to look over the differences in K 3 & C R 1 visas. The C R 1 is a better visa. Study the guides.
There is no chance that she will be given a tourist visa. Read & understand the " strongest ties" rule . The embassy told me they would view a applicants strongest ties to her spouse as soon as she entered the USA & therefore she would have no reason to return to Thailand. Every applicant is presumed to be attempting to become an immigrant.
A pregnate women entering the USA to have a baby is never going to convince them she will return.

Sorry I should have said my girlfriend. By the time in Thanksgiving we will be legally married under Thai law. She already has a toursit visa which is valid for 10 years. Last time she was here was in March this year and she went back in July which we found out that she is pregnant.

All we are hoping for is the POE will allow her entry with a maximum 6 months stay as a tourist visa for the baby to be born here. Hopefully we can file for one more extension of a tourist visa if needed. It is our intention for her to be in the US as long as the tourist visa will allow and she will remain in legal status the whole time when she is in US. While she is in the US, that's when I will start filing either K3 or CR 1 as you suggested and she will go back and wait for a visa in her home country.

I agree we believe you but what you want to do isnt going to be allowed by a USCIS officer in my opinion based on my experiance.
The problem is that your wife will be entering the USA on tourist visa with the intention of using that visa for a different purpose. That is actually visa fraud.
She will be asked the reason for her visit. They will see that she has been here in the recent past & is now pregnate. They will ask how long she wants to stay. When she gives a truthful answer she will be denied entry. If she lies her tourist visa would be taken away & she could be charged with visa fraud. That could cause a ten year ban. These officers are very experianced , well trained & have seen it all.
The only way you will ever know what will happen is to give your plan a try. We can only offer you an opinion based on experiance & our understanding of the law.
If you are attempting to have the child here because you want the baby to become a US citizen you can do that in Thailand at the embassy.

Thanks for all the comments/input. I have to decide what is the best course of action for my case. Definitely do not want to compromise the Fraud intent and the family reunion in any way. I have made an appointment to speak with the immigration officer at the local USCIS office via infopass and will go from there.

Well, I guess you can put me on the list too...My I-130 was approved first and not sure which path I will choose (K-3 or CR-1).. Really confused and frustrated.. Lots of other people having both of their petitions approved on the same day..Only one of mine was approved..Also, it's been since July 12 and my case hasn't been received at NVC. I check every day..Frustrated there too, since I notice a lot of others are at NVC before me or in less time...:(

4/24/07...Check cashed
7/12/07...Received email saying "I-130 Approved" (100 days)

Michael, count your blessings. I sent my I-130 in Aug of 2006. Just got a NVC Case # in July of 07. Consider the monetary ramifications if you continue with the fiance visa. $1,100 for adjustment of status if you go this way. If you use the I-130 only then your wife can come in and get an automatic 2 year green card. Just food for thought

If you can believe this, I filed my I-130 in August of 2006 at the Vermont Service Center, first NOA was August 23. THen nothing until May of 07 saying that my case had been transferred to CSC. June 20 07 i receved approval, then sent to NVC. Case # from NVC in July, now waiting on DS-3032 and I-864 bill. Looks like it will be way over a (start to finish) before my wife gets her interview in Manila. I think that VSC just did nothing until they transferred case to CSC

You have to consider the names she used for her passport, on the INS application itself, visa that will be issued to her, and also the green card that would appear once approved.


The original I-130 was submitted and approved in her maiden name. NVC case # also has her maiden name. When we sent the choice of agent we used married name with maiden name in parenthesis ( ). She signed document with her married name. Maybe I should call NVC and see what they have to say?

By the way, thanks for the quick response. I appreciate it. I grew up in NY (Long Island) and still have family there. Maybe when this is all said and done we can keep in touch.

Having August 16th as case entered in the system, I would think that 8/27th will be the DS3032/AOS Fee Bill generated date. But just to make sure, take note of the message that you have now, and then compare that on the message that you have on the 28th. You would know the difference I bet.


I just heard on NVC message that my IV bill will be sent out in a couple of weeks, should I expect it next week? I have sent out the aos fee bill and they received it, however I have not received my instructions for my i-864 yet. Is this normal?

The photos that I've sent in so far have not been the 2x2 size, but rather the ID photos that you mentioned.

I've had no issues with what I've submitted....which are about the a passport photo size, but not a 2x2.

You can ignore that comment. You can use transcripts or copies of the 1040's. Make sure you include copies of W-2's if you filed jointly in the last three years. It has always been three years, if you download the full form, the instructions and checklist calls for three years tax info. Until it changes on the checklist, I would include three years as you never know what uninformed worker will check the packet.

That should be fine, you are just proving his citizenship. I just sent my birth certificate and I was fine, but the passport also shows his visits.

Depending on the country, you have to have the interview letter for the medical exam. Also, the Embassy cannot deny entry into the building to a US citizen, he just won't be able to go with you to the interview itself.

I love my soon to be hubby because he is truly the best thing that has happened to me. I was married before and so I knew exactly what to NOT look for. I wasn't even looking and I found him, though. And sure enough he meets all the requirements that I wanted in a man. He respects me, my opinions, my likes and dislikes. He pays enough attention to gather his own conclusions about all of that. He is completely selfless, and knows his priorities: Jehovah God, then family, then friends, etc. He is very family oriented and has adopted my family as his own. Even with his limited English and among my translating, the other night on speakerphone with my mom he says "Good night, Mom!" We have the same goals: we want to have a good conscience in a relationship with God and to serve him first and foremost, we know that this life is not all there is and so we live accordingly, he is not focused on material things or pleasure, just wants to be happy in a simple way. He has taken care of me when I was sick as a dog, and appreciates the work that I do in and out of the household. I could go on and on about how connected we are, how we like almost the same things, etc., and how we met 1900 miles away but we are "la pareja ideal" - the ideal couple. I only hope for this type of love for everyone out there!

But since ur case is already at the NVC, She could change her last name after she arrived in usa.


It will not affect coz woman can KEEP her madien name even after they are married .

You are asking about filing an I-130 for a visa, moving this to (CR-1 /IR-1) forum.

If you do a search of this site you will find MANY, MANY threads of people having negative experiences with lawyers, and wishing they found VJ before hireing a lawyer.

VJ for the most part is a DIY website, if you use the guides you can file the petition without any problems. A lawyer is useful if there is something complicated in your or your spouses past.

If this is Cr/Ir, You could do it urself.
Read The Guides here , which tells u step by step and if u have questsions , u can post them. Ppl here VJs , will help u along.

Even u get lawyer, all he will be doing is filling out the infos that he requested n get from u.

THis VJ has saved lots of money for many ppl here.

I recieved that, via email, that was from the letter the list i provided. I just get confused cause on the web interview prep, it says to bring all the documents i already submitted to the NVC that they then forwarded to the consulate. This process as you all know has been just so nerve racking we just want to be done with it.....

I'll be going to wife's interview also.I know they wont let me in the interview room but will just go with her and wait at the waiting area.
Just bring the copies of document they request.

But the Embassy already have all our CR-1s.

main things are

1. PAssport
2. Two 2x2 inch passport photos
3. Medical exam Report
4. Proof of Relationship
5. INTERVIEW LETTER

If she doesnt have it , it's ok too.
Not to worry.
If she has record of vaccination, she doesnt need to get the re-vaccination.
if she needs vaccination, the DR. will give her that.
