Hello-
We just got both our 129F and out I-130 approved yesterday. Everything I have read on here says that I can now choose which to pursue (K3 or CR1)--is this correct? If so, because they have both been approved, will they take about the same time if I choose the CR1 (everyone seems to agree this is the better path)? If so, how do I pursue this one instead of the k3?

We were approved for both 21 days ago!! Thank god! Now, I know what everyone has said about doing CR1 and I agree it seems a MUCH better visa. However, our problem is that my husband Tom had to leave 3 weeks after our daughter was born to stay in status on VWP. He has missed 5 weeks of her life so far and we want to get him here sooner even if it's more expensive and we take the K-3 route. I received the letter about K-3 with our case #. When I called though our case is in "additional processing" after 18 days of being there. I received the DS-3032 form and I want to know if I should pursue both and see which happens first??? can I even do that?? Please help---he is missing too much!!

Tom's medical was less than 1 month before his interview. we got very lucky to get a CR1 interview as fast as we did. good luck with yours as well...i am so relieved we got the CR1 instead of K3

Forgot to tell you that the vaccination certificates should be both sealed and signed by the doctor who your husband was seen by for the shots.

Your husband can go to Vacsera clinic and get vaccinated there and they do give vaccinationg certificates. It's located by the end of 6 of October bridge on Al Batal Ahmed Abd El Aziz street as you head to Mohandiseen. Very good and clean clinic there. If he's wiliing to get vaccinated against hapetites A&B, then he should ask for Twinrex vaccine that's one shot for both A&B together instead of doing one shot for each.

Hello all...I am back LOL with yet another question.
So technically still working on the I-130 file. Will be traveling to see my husband, and while there he will sign all the paperwork so it can be finally sent off.
With the changement of the DCF and my status changement, we have decided I will move to my husband's country for the duration of the visa wait. My question is:If I send it off now, with my US address to Nebraska....then move to my husband's country in the summer, how will this chnage of address slow down our petition or make it more difficult. SHould we sent it now with my US address, or wait until I move there and send it off with my foriegn address to Rome, the office assigned to my husband's country? Very confused here...any info appreciated Thank you very much.

I'm surprised no one has answered you on this. I don't know for certain how you should proceed, but I was wondering if you are going to be in Rome until all this is done than have you considere a DCF instead of the I-130? Otherwise, I would just put your address for Rome from from the beginning. With filing times what they are these days you will be there before the 130 is approved, but you must be sure not to leave any of your required documents behind or that could make life difficult.

My case was completed 02/28/07. My question are if my wife's interview is April 12, how come i haven't recv anything from NVC? When's the medical schedule? I saw Riblet's timeline and he's was completed 2/20/07 and he doesnt have schedule yet. I checked IV visa interview online and it say there is no schedule yet.


Have you tried to contact the embassy directly? From what I've read that would seem to be the next best thing to do.

As you can see my time line below I just had my biometrics done. When my husband called USCIS 2 weeks ago asking about our I-130, the girl whom he's talking to told him our case I-130 was still in pending so our AOS might be pending also. So we are just waiting to find out.

so, my dear friends, I'm back and I don't have any good news!

Hubby called his congressman and he called him back after getting in touch with VSC. The congressman said that VSC has a huge backup (was that the word... it was back-something) and they had to take all people from VSC off their cases and fix the problems, reorganize and retool everything. That is why they have so much work now. But, and this is the funny part, the hope to approve our petition before it hits the year mark!!! Are they kidding? But their goal is to approve petitions within 90 days.... HAHAHA. The congressman said that there is NOTHING we can do but wait. He doesn't recommand me visiting the states but Hubby can come here to see me (because every man has 365 days paid vacation or what???).

Long story short: I'm expecting my visa by February 2008 as NVC wants to work on it too and then send it to the embassy over here.

Does anybody of you has any better news? I'm so frustrated... and I'm glad that I got a new job because I was tired of sitting at home and waiting for my visa.



I just heard back from our Senator's office today and they said the same thing. VSC has a huge backlog and even though our I-130 has been assigned to an adjudicator it will be "months" before it is approved. I'm glad I went the K3 route, at least I'm here with my wife. Hopefully everything will be fixed soon, for all our sakes.

Hi Dezzy&Dan. Please keep us all informed of your AOS application. This topic of submitting the AOS without an I-130 approval has generated some interest on Brtishexpats forum. The general feeling is that you can't do it, and you run the risk of USCIS cashing your check, deciding you don't qualify, sending the I-485 back and you lose the money. I called USCIS my self and asked and they told me I could not file for AOS without an approved 130. Another poster said that at his AOS interview the ajudicator told him he could have ajudicated the 130 at the same time he did the AOS interview. If it makes you feel better, VSC was closed yesterday due to a holiday - so no touching for anyone. When is your anniversary? Dont worry I'm sure after this first one - you will be sharing 2nd and --->

It really does seem that some of those with NOA1 of between the last two weeks of Aug and first 2 weeks of Sept has been caught in Vermonts black hole. At least one of us did manage to get NOA2 about a week ago so that's encouraging!

If we dont get anything by the end of next week, we will start looking for our senators help.

I hope we all get some kind of update soon.

When I filed at VSC it took almost 6 months for the 2nd NOA and then after that another 6 months to complete the medical and visa interview. The whole process took a year. VSC can be slow. I wrote the congresswoman Thelma Blaire. They contacted the VSC for me and updated me with in depth information about what was happening. I also was in contact with someone who formerly worked there who said it takes lots of times to document all the information on paper into the computers. They kinda sit there for awhile, in boxes until they can be entered into the computer. But overall, itll happen.


Rete, who moderates Britishexpats also suggested using the House Representative first when looking for information. Perhaps I should go that route instead of John Warner, although as long as I get an answer...:-)

I hope you get your petition to NOA2 once and for all. Thats ridiculous to be waiting from mid last year. Where can you get the form to apply for help from a senator? Goodluck with that! I just read a post where someone was approved like a month later - and thats really great news but for people like yourself and the rest who have been waiting a unusually long time in comparison to the recent approval times - I wish they would "get to it" already.

Knowledge is right -- we are a moody bunch lol. But definitely supportive!

We got our form from the Senators personal website. He had a link for asking him for help which included the form with the pertinent details of the USC, and then we included a letter briefly explaining the circumstances and what we wanted.

My 130 has sat at VSC since July 12, 2006 with no movement at all and people with dates in August, September and October have approvals?? I'm glad for them but this is getting a bit ridiculous. And what's this about calling USCIS after 6 months have passed? I reread my paperwork and it only refers to them having to complete it in the processing time posted on the web which still sits in March 2006. My wife called the info line and they said the same thing. Am I missing something?

Hi Tom, welcome to the support group lol...or agonizing group, depending of the mood we are into...I try to be objective...each case is different...If i go to the sources of the infos they give in instructions or general (info)...if the background of the person is bigger than others, i.e., divorce-s, etc, origins, well, we can expect to be longer...
Reading you, i have a question: did you get touched? and how many times...usually after 2 touches approx, people get approved...I'm sorry you waited longer than us on here....so, therefore i believe you might get approved soon!...and good luck to all of us!!!



Hi Knowledge. Our 130 was received on July 7th and touched on July 12th, but nothing since then. When my wife called the info line they said there was no flag on the file, they simply hadn't gotten to it yet. When she told the operator that other people were getting approved who had filed months after us, they said there was nothing they could do until the processing dates have passed. My wife downloaded the form to apply for help from our senator and we plan to draft a letter this weekend to see if he can help.

Hey Tom! This is where it gets a little iffy...technically, we should defer to the processing date that they post on the website HOWEVER sometimes you'll get one of them on the phone who will actually tell you, it normally takes 180 days to process an I-130. It's sort of an unspoken guideline that 180 days is how long you should wait before doing any inquiry whatsoever, and I don't recommend continuing to try and do it yourself-you'll only keep getting the same answers and not much info. Your Senator can get much better info for you-I would recommend requesting an inquiry with them asap.

I assume I was removed from your list since I gave up and went the K3 route, so just to add a little information to the discussions I finally had an email notice my 130 was approved April 27th, after sitting at VSC untouched since July 12, 2006. I see that your I-129f was already approved. Would they still approve your I-130?



The I-130 has to be approved regardless of the 129. You need an approved 130 to apply for AOS from K3 or to just continue with the 130 process.
