That was confusing me. I was not certain that I had to fill in one for me as I am a USC.
I was thinking it was just my husband that is clear then 4 for him and 4 with for me!
So when I go to the form it auto fills in 4 times that is the 4 times I need then sign them and repeat with husbands info inserted?

no, CR1 is a visa, K-3 is a visa, you only need one visa to enter the USA...

AOS is adjusting status from non-immigrant to permanent resident from inside the USA. This occurs after you have arrived on a non-immigrant visa

I think we are planning the correct route.

Once again NO... You do NOT AOS (I-485) to a visa... The USC can PETITION (I-130) to determine eligibility for an alien to apply for a visa...

Or since your hubby is in the USA are you thinking of submitting AOS to GREENCARD (he never leaves the USA)?

A CR1 is a visa... A visa is a document to request entry into a country. If your husband is already here he does NOT need a visa.

You can adjust from VWP by filing the I-130 (petition to determine he is an immediate relative of a USC) & I-485 (application to register as a permanent resident) at the same time. He remains in the USA until he gets the greencard

Yeah...my logic wants to argue that once she enters on the K-3 she will be a permanent resident thus her residence will be in the US, so, she should be able to take her IR-1 here. Hehe...I obviously have not edured to really learn the whole AOS process.

Hi. I just sent the DS-230 packet to NVC this morning. As I read some information here in VJ and in NVC website, I came to realize that there is a slight difference between the mailing address mentioned in the cover sheet and the mailing address mentioned in NVC website & VJ Forum.

The barcoded cover sheet says:
Please attach this cover sheet to the front of
the documents for this case and mail to:

National Visa Center
Attn. CMR
32 Rochester Avenue
Portsmouth, NH 03801-2909

while the NVC website & VJ guide says:

By the way, I sent the mail to the address mentioned in the cover sheet. Do you have idea why there is a difference in the mailing address given?

I think your main problem is how to produce a CENOMAR (Certificate of No Marriage) as it is one of the requirements in Philippine marriage, a proof that you are still single or not previously married to anyone else. The term CENOMAR is applicable to Filipino citizens only as this is the proof that the he/she is not married to anyone as issued by NSO here in the Philippines.

As for your case, since you are not a Filipino, you must provide its (CENOMAR) equivalent from your country proving that you are still single. You can ask your relatives back in Ghana if there is any authorized document in your country that may prove that you are still single/not married. They can get it for you back there and send the document to the Philippines.

She (beneficiary) must sign the form and not you (petitioner). It is better if she will fill up the form by herself and send it to you after signing (first part only) it for you to save time.

The instruction is on top of the form itself. The questions are self explanatory so you can easily fill this out.

You can NOT save the filled forms as this some kind of protection over the form. Make sure of the information first before printing & closing the form to avoid retyping everything in case some corrections are found.

NBI clearance will suffice all the police clearance requirements in the Philippines. And if ever she worked/stayed abroad for more than 6 months then she should also obtain police clearance certificate of that country. Police clearance is required regardless if she has a criminal record or not.

Better use a 2"x2" picture since that is what is on the instruction. You can ask your fiance to have the photo taken in a digital studio where she can take the file (soft copy) of her picture. She should tell the photographer that it is for US visa or just simply say 2"x2" picture and not passport size. She can then send to you the file thru email and you can print it by yourself.

Your wife can file the IR-1 and provide only the truthful information in the application . You are legally entitled for the petition since you are legally married but as for the effect of the "mistake" made by your wife is another thing. As you have said you both wanted to give each other a chance and hoping that this time it will work out to both of you.

Just tell them the truth, don't claim the child as yours coz the child is not really yours. I guess it's just a matter of proving to them that you are both willing to straight things up. Besides, if you will be approved for telling all the truth then it is a sign that you are meant for each other. And if you're wife really meant to give your relationship a second chance, then she'll do everything to have you back, and not just by naming a child to you. Good luck to your journey.

Did you submit all the original documents along with the DS-230? Checklist & instruction is included in the interview appoinment letter so you can refer to it if you might be missing something. You need to bring some proof of relationship like photos, emails, chats, etc., for they may also ask for it during the interview.

Did you still try to log in on to the system to check if your payment is updating? If it's not, you can just have a regular call to NVC to ask about your case status. And yes, they will send you email (interview appointment) once your case is approved. Good luck and happy 2010! :)

I am working here in Saudi Arabia. Fortunately, I was able to dig out the physical address of our location, no building or house number though. :D I used my physical address in all the forms we filled out and everything went fine. All correspondence (hard copy) from NVC was sent to my wife's address in US as I assigned her in the DS-3032 form. I receive some emails from NVC too but no snail mails.

It is confusing. I went to the American Embassy in London while I was visiting my husband in England. The man that I spoke to there, an immigration officer, said my husband could travel on the visa waiver program while the K-3 was being processed (without jeopardizing the K-3). He said that he must travel with ample documentation showing that he plans to return. He did say that it really all depends on the person you deal with at the Port of Entry. Hope that helps...

We just got both our 129F and out I-130 approved yesterday. Everything I have read on here says that I can now choose which to pursue (K3 or CR1)--is this correct? If so, because they have both been approved, will they take about the same time if I choose the CR1 (everyone seems to agree this is the better path)? If so, how do I pursue this one instead of the k3?
