IR-1 / CR-1 Spouse Visa Process & ProceduresWhy is the 2nd NOA taking so long

It is not as painful as it seems if they have a good scanner. We have scanners at the hospital I work at to scan and save as a PDF patient charts, audits, etc. They are really fast.

Could be fast as long as many of the documents are not bound together in many different ways, with paper clips, binders, staples, etc...

IR-1 / CR-1 Spouse Visa Process & ProceduresWhy is the 2nd NOA taking so long

I saw the following reply in another forum, but I think it's applicable here.

And we can see that some filers think it is best to send in an enormous amount of documents, like 5000 or 7000 pages note booked, stapled, paper clipped, glued, sealed, and tabs at one end or another. Can you imagine how much time it would take a Visa worker to scan 5000 pages into a computer?

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of Eligibility to Marry in China

Thanks for the replies Darnell and Greg,

@ Greg, I actually also plan to marry in Chengdu! Hope you and your wife can reunite soon~

@ Darnell, I am only going there for a week and I read that it may take 10 days (even with rush processing) in order to have the Affidavit translated into Chinese. Is that true?

In March 2010, My girl and I went to the Consulate in Chengdu to get the Marriage Affidavit document, no problem. Got married 9 March. Good Luck....

"they are currently processing March 29, 2010 application" sounds like their, "tell everyone prerecorded message". You call back in 10 days, and they will say, "they are currently processing March 30 applications"......

So what if the person does not know english, this one that I looked up is in English. Can my mother inlaw write it in my language, or does it have to be translated then before taking it to the interview?

You can have someone that is fluent translate it, and have them state, "I certify that I am fluent in both languages", and sign the translation.

IR-1 / CR-1 Spouse Visa Process & ProceduresTo much evidence

I didn't send a single sentence of chat or even a single picture of us. I didn't even send a cover letter like everyone else here seem to do. This is all I sent

  • I130 form
  • G325A for me
  • G325A for her
  • Copy of my citizenship certificate
  • Copy of my passport
  • Copy of our marriage certificate
  • Copies of our birth certificate
  • Her passport sized pictures

I received my 130 approval in 158 days. The conversations between my wife and me are personal. No one, absolutely no one, has the right to see them. To want to see them is gross violation of our fundamental human rights. Marriage certificates are legal documents admissible in all courts of the world as proof of marriage. That is what's sufficient for USCIS.

I understand it's different if you are applying for a fiance. The burden of proof lies on the person since there hasn't been a legal/civil marriage yet.

Well, there are "gross violation of our fundamental human rights", and there are people that often do not get a Visa. Getting a Visa comes down to the "descretion" or "personal opinion" of the Interviewing Officer. USCIS, no conversation samples, probably no problem. NVC, no conversation samples, probably, no problem. Interview, who knows.

Of course nobody is going to read it. The whole purpose of it is in the case the CO asks how often we communicate and she says every day, she can easily show it. No explanation necessary. It's all in the books. If we had phone records we would use those, but in our case we don't. Let's face it, our photos are ours, our certificates are ours. Nobody is entitled to see them if we don't want, but then again nobody is entitled to a visa either.

I have read on some of the K1 China Interviews, that the Interviewer read and did not like some of the reading, like using the words husband or wife, on a Fiancee Visa type. So if you submit chat samples to show that you can communicate, one must be careful of the wording.

If you're sending out your I-130 this week, why does your timeline say you started Sep 8? I sent nothing like this to USCIS, but my wife has about 1,500 pages of chat printed and bound for her interview. Cost a little for ink, but I think it is much more convincing than just call records. Besides that, we want to keep it for our own reminiscing. Only thing I sent to USCIS as proof of real relationship were a few witness affidavits and some photos of our marriage and my prior visit.

1500 pages, wow. I bought a 16 ounce bottle of black ink, as I figure I would need it.

Not long ago on here, someone had ask if 7000 pages were too much.

The 29 pages, of chat on yahoo. How did you manage to get into 29pages since 2008? I hope it's not to small.

We usually have 30 chats each month. The Yahoo Messenger call history show, time, date, amount of minutes talking. 1 log shows 30 chats on 1 printed page. I use a program, "captura", that will save a screen shot of us talking, using webcams and headset. I print 1 or 2 of these on 1 page.

that we can talk to each other with ease. I have 29 pages as of this month.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat can be the Bonifide marriage evidence?

Technically true, but I'm filing a CR-1 for my future husband also. Only thing is, he'll be my actual real-life husband by the time we file :) Just getting all the paperwork ready now! Semantics, I know....

Anyways, to the OP, we're going to send in Skype/cell phone call logs (no chat transcripts - too long and private), copies of airline itineraries for past and future travel (already booked holiday travel), a couple pages of photos over time, money transfers and a copy of our wedding invitation & program. We don't have any joint accounts/property either!

I had forgotten about copies of wedding invitations. We had a sign in sheet at our wedding banquet, with all guests name, address, and phone numbers. We later had Sworn Affidavit from some of the guest to add to the sign in sheets as evidence.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow weird is this??

It has been more than 5 months and 3 weeks since i sent my I-130, since im doing this process with a lawyer i decided to have him call USCIS to find out what is going on with my case. mind you that i have not gotten a RFE not a single update what so ever. So today my lawyer e-mailed me saying that my I-130 has been approved on OCT 12, how weird is this? today is the 21st and status on the webpage stills the same. I have not yet received my NOA2 by mail nor any type of notice from USCIS. Should i have my wife call USCIS to find out whats going on since is the one petitioning me?

Some advise will be helpful.

The US Mail, USCIS, and NVC often moves slow. It may take a few more days to receive your NOA2 in the mail. It may take about 2 weeks before NVC will have your case number. Maybe just wait a few days and call NVC and get your case number.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to print chat logs
I use a computer program named, "Captura by Hernda", that will captura and save to my documents a screen shot of what is on my computer. I use Yahoo Messenger for chats and calls. I can bring up on the screen the chat logs, or the call history logs, hit the captura to save and print later. I have a call history log for each month, that shows the email addresses, amount of time of chat, and date.

IR-1 / CR-1 Spouse Visa Process & ProceduresAny Bad Interview?

For those people who have completed the process and went to the interview. Can anyone share any bad moments during the interview or even a nighmarish interview.

Sorry hate to ask, only want the best for everyone. I'm trying to think the worst and hope for the best for my wife and everyone on VJ.

Share your experiences and it could help many others...

My girl had the Interview, Dec 2009, denied. What I think is important is that my girl needs to understand everything I submit for the Visa, and knows how to explain the answer, not just give the answer. The question was asked, "what was my job title". My girl said, "sales". I was a supervisor for a Sales Company. The Officer was looking for the word, "Supervisor". My girl was well aware of what I worked at 28 years. Question #2 that was asked twice was, "how many times I sent money". Answer given, "5", which was correct. I had sent 1 wire transfer, and 4 Western Union. I believe the Officer did not see the receipt of the wire transfer, only the 4 Western Union receipts. Giving correct answers is not always, just enough.

Went to my congressmans office today, and they are doing a congrssional inquiry. Hope this will get positve results on our delay.USCIS is required to respond to this kind if inquiry within 10 days verses 30 days with a service request that I also have put in myself.

Do not worry, your NOA2 will come soon. With USCIS and the whole Visa Process there is no such thing as
"Normal". It is dishearting when you see others receive their NOA2 in a very short time. The USCIS does not process in any type of order. Hang in there, and good luck...........

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE confusion : Checklist not recieved yet AVR says it was?

This morning at 3:30 am I received an email from the NVC which stated the following, and haven't been able to sleep since.

"The NVC has received the requested Affidavit of Support form (I-864) for this case. However, we are
still waiting for the Immigrant Visa Application (DS-230) and corresponding civil documents for each
traveling applicant to be returned to National Visa Center for review. You will find the DS-230 form
along with complete instructions for submitting the civil documentation required for this case at
www.ImmigrantVisas.state.gov under the Applicant Document Processing link.

We urge you to send in the DS-230 form(s) and required civil documentation for each traveling family
member in one package to the National Visa Center (NVC). Sending the information in separately may
cause delays in the processing of the case"

However I sent my DS-230 on the 27th of October which got there the following week. (USPS delivery confirmation etc). As many of you will probably know I'm stressed to the gills. It doesn't help that the email got sent on a day that I can't contact them directly to sort things out. So I did the next best thing and called the NVC AVR to check on the status of things, and the AVR said the following. "The NVC has received the checklist letter response on Nov 8th". Now I'm just beside myself in confusion. Does this mean that they have received my DS-230 and this RFE was sent on accident?

If so why am I getting the email today if the documents were received on the 8th. I'd obviously call in and talk to an agent but they're closed today. So I'm hoping to get some sort of an answer from all of you wonderful people :)

Thank you in advance for any replies.

Early morning stresser

Do not get stressed. What the NVC email to you should say is:,,,,We received your I-864, and are waited on the DS-230 to get from our very slow mail room   to someone for processing....

On the bank question my husband has a Suntrust and BBT bank account joint and in his own name without a SSN he had to sign some forms and produce all ID but no problem once he explained the situation?

IR-1 / CR-1 Spouse Visa Process & ProceduresHELP WITH 1-130 FORM

Hey Guys,

We are looking through the form I-130 section 22 and this is what it says...

22. Complete the information below if your relative is in the United States and will apply for adjustment of status.
Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in: _________(City)____________(state)

If your relative is not eligible for adjustment of status, he or she will apply for a
visa abroad at the American consular post in: ___________(city) __________ (state)

--------

So my question is...does this question apply to me at all...as I am living in Canada...and my husband is a USC whose filling out the forms...I am not in US and I will not apply for AOS etc...I know this doesn't apply to us...and we should put N/A on both parts of the question ...but my darling husband wants a confirmation!...so please advise!!

Thanks!!

My wife is a USC and I'm working in Saudi Arabia. Here's mine:

...for adjustment of status to that of a lawful permanent resident at the USCIS office in: ____N/A_____(City)_____N/A_______(state)

This refers to the petitioner. My wife (petitioner) is a USC already so no need for her to change her status to permanent resident

...he or she will apply for a
visa abroad at the American consular post in: ____Riyadh_______(city) __Saudi Arabia______ (state)

This is for the applicant. This is the embassy of our choice where I (applicant) want my visa to be forwarded.

We had no problems in our I-130. Hope it helps. Good luck! :)

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Appointment

I have read that they usually give you the results the same day, worst case next day. The thing is we received the appointment letter saying that my medical was to be done on the fourth, but my son who has his appointment on the same day as me (Jan 14) hasn't received any letter about his medical appointment or his appointment.
The medical can only be done in Bogota.

In my case, I only received the interview appointment letter and no medical appointment date was mentioned. When I called the hospital they told me to bring the interview appointment letter (of course other docs like passport, etc) when I go for the checkup. You can call directly to the hospital about this to better be sure.

Medical exam are usually done at least a week before the interview date. The results are then forwarded to the US embassy or sometimes you have to bring it with you on your interview. Having it done 2 days before your interview might delay your visa approval. By the way, is it only in Bogota where you can have your medical exam? Did you check if there are any other accredited clinic near your place?
