Take as much evidence as possible, just in case. But only answer the questions that you are asked. You are going to America to visit your fiance for Christmas. If there is no need to mention the marriage then don't. Hopefully you will get a friendly border agent who will quite happily ask to be invited to your eventual wedding but won't ask when it is. :-) Maybe you don't even need to know yourself when you will get married, (ie if any planning does need to be done in advance your fiance can take care of it) so could quite honestly say, "I don't know, but I need to finish school in Canada.)

Hi Everyone

I am planning to go to my country (India) at the middle of december to get married. I will be back in mid-january. I am a US citizen. I have many questions regarding what to do and how to get my spouse in US:

1) Do I have to file the I-130 in India or in US?

2) What documents should I take it to India, if I am filing there? OR What documents should I bring from India, if I am filing in the US?

3) Although the girl I am marrying has a psssport, do I need to get a new one for her since she will be changing her name and marital status?

4) Apporoximately, how long does the process take for her to come to US?

5) Besides I-130, what other forms would I be filing?

You will be filing in the US.

With the I-130 you will need to send a cheque for the fee, proof of your citizenship (so your birth certificate or copy of your passport), your marriage certificate, proof of any divorces either of you have had, US style passport photos of both of you, any other proof of your relationship (such as affidavits), and a copy of form G-325a for both of you. So you will need your marriage certificate from India, obviously. You should also sort out the correct photo of her whilst there and it would probably be a good idea to fill out her G-325a whilst there as well, so that she can easily tell you all the information needed. You could also get an affidavit from her family about the relationship, but affidavits from US citizens are better.

Yes you should get her a new passport.

The process can take from 4 months (for very lucky people!) to a year, or longer if there is additional processing or other complications. I don't know anything about the Indian Embassy, although checking the recent historical trends on this site I would say 8 months would be a good estimate.

You will submit the G-325a with the I-130. Read the Guides on this site if you want to read about the later forms.

We've only been married for 11 days...although our relationship began well back into last year...but how come our lawyer hasn't asked for any of this? He has been really thorough in getting all the documents ready so we can file, but never has asked for anything evidence related....should I put my husband's name on my house? Is all this evidence really needed right now? I am stressing. I just want this FILED so I can hunker down and settle in for the wait.....:blush:



When the US citizen lives in America and the foreign citizen lives abroad and they have only just gotten married, obviously USCIS understand that you won't have much, if any, co-mingling of financial resources. However if there is any evidence of joint finances then do include that. Also, you should include three affidavits from friends/family who have knowledge of your relationship. Recently they have started to request these from any newly-weds who don't provide them. These don't have to be anything extravagant. (Also, if either of you have been divorced recently then you may want to include an affidavit explaining the end of that relationship. These have also been requested recently by the London Embassy.)
You can look into putting your husband's name on the house, but don't worry if it doesn't get done before you send off the I-130.

Experienced lawyers are helpful in very complicated cases, for example when there are crimes or the such involved. However, they are not always aware of what is happening on the ground in the immigration offices and Embassies right now. For example, affidavits didn't used to be requested but now they do seem to be asked for if not given. He might not know that, but forum trawlers will :D

No problem - just dont bother with the 'premium' service like I did! Its double the price - and isnt as quick as I had expected, its still closer to two weeks!


I did premium service, sent it off on a Thursday and received it back on the Tuesday. They issued the certificate on the Sunday. So I guess it's worth it if you're desperate.

I'd basically agree with Mustafa. As the individual concerned is an infant there can be no concerns about her having done illegal activities under the name they previously didn't know about, so they shouldn't have to do additional name checks or anything. This is however based on common sense, not on any knowledge about what the Embassy actually does. And I personally know nothing about the Pakistani Embassy.

If I remember correctly, your mom will need to send the 1040s showing her schedule D and E in addition to the transcripts. I think that's what the instructions say but it was a week ago I read them. Other than that the transcripts are sufficient in themselves.
If, when it is time to send off the I-864, you/mom have gotten some of your W-2s etc. for 2010 but not all of them so can't file taxes yet, then send copies of the 2010 W-2s etc. that you do have.

It's great that you are so prepared! Please try to enjoy your holiday without worrying about this at all :)

A Tax Transcript is an official IRS version of your tax return. It is free, and what the Visa Officers perfer, rather than a copy of a tax return, with W2s. If possible have the 2009 tax transcript. If not possible, have a copy of the 09 tax return, with W2s. You can get tax transcripts about a week or so after sending in the Form 4506-T. Once you send in your 09 tax return, wait a week or so, and send in the Form 4506-T.

Your financials are fine. You are well over the minimum. A couple of recent pay stubs may be a good idea also.

Hello everyone!

Due to the blessing of God i got married on January 16th 2010. I love my wife and i want her to come to the U.S. as soon as possible. However, there are a few things that worry me. First of all im not quite sure what the fastest way to get her here is, i know that i have to file a i130 and upon receipt i can file an i129F spouse, but since 02/01/10 there have been a few changes and i dont know what to do now. Also FYI i am a US Citizen

The things that worry me are,

A) in the past 3 years that ive been working, in 2007 i made 15k in 2008 i made 27.5k and in 2009 i made 20k and 2.5k in medicare (Short term disability).

I know that ive met the minimum poverty requirement, but nonetheless i want make sure that i will be ok with the filing of the i130.

B) i dont have a joint account open at the moment, but will be opening it soon (in 10 days, i will file after i open it). Her father gifted us a house in india which is under both of our names, will that be enough to be covered as an asset for us AND will it prove a bonafide relationship?

C) I have copies of boarding passes and my tickets and proof that i went to the Airline office in India.

D) I have a marriage certificate from the State board. is that ok?

E) Pay stubs, i dont have 2 from every month i have
2 from july
2 from august
1 from september
2 from october
2 from november
2 from december
none for january
2 for february (when it comes to the end of this month.)

F) i also have an employment letter stating that i am FULL time which is 32-40 hours and that i have been employed at my employer since 10-2-07 and my current wage.

The process.

I understand im supposed to file an I130 and im going to submit my i130, I864, Copies of my 2009-2008 tax return (should i submit 07?), (no IRS transcripts? how long does it take to get them and should i?) i have 1099 for 2009 and 2008 (cancellation of debt). do i have to go to an interview? what are the biometrics?

I have proof that i made ATM withdrawals in india, i have photos of the wedding, i have photos of us in random places. I have my boarding pass, ticket etc.
I have emails going back and fourth (which i prefer to not submit)

Am i missing something or am i ok? Please advise me of anything, tell me what i should do or if i am missing something.

Tax transcripts for 2007, 2008, 2009 would be great. You can get them in a couple of weeks. The tax transcrips,,,,Form 4506-T is the form. Do a yahoo or google search to find the site. Use the PDF version, fill it out and hit , print, or just fill it with pen. There is no costs for the transcripts.

"No. The sponsor just has to sign the form. You should know however, when the sponsor signs an Affidavit of Support form, he/she certifies that the information provide, transcrip and/or photocopy of tax documentation is true and correct, under penalty of perjury."

I dont agree. It is like anything else in life. If you cant fly first class, then you fly coach. If you you cant afford or you want to economize then go to McDonald's instead of the steak house.

There is premium processing for business for $1000. I would pay $1000 right now if it meant I could be with my wife in a few weeks instead of many months.

You would pay the $1000, and so would many others, if not just about everyone, so we would all be where we are today, at the same point in the process, but with less money............
