I am obviously not in the same boat as most who replied to your post, yet!, but I am concerned and do care about all of you who have been made to wait so incredibly long for a process that obviously can be done in a matter of mere weeks.

Hang in there, hopefully approvals for all March/April filers will come soon!

I'm getting closer to be your new friend:&

K-1 Fiance(e) Visa Process & ProceduresHas anyone who submited an I-129F in July been touched?
I filed my 129F petition on june using the new form with the new questions from IMBRA and I recieved the stupid RFE same as the one everyone from before march. I dont how they work in these petition since every case is different. I"m still wating for my NOA2 and I havent get even a touch. I"m in the VSC
ANDRES_MARINELMale02006-08-19 19:41:00
K-1 Fiance(e) Visa Process & ProceduresI feel like crying. Guh.

Don't be jealous, not everyone at VSC gets a speedy approval to presume this is ridiculous. My petition was received by VSC in June and I still have not been approved. I am not jealous I have realised that there is nothing I can do to speed up the process but be patient.

I know there are people that have been waiting a LOT longer than I, but I just got to the point where there are VSC people that sent in their petitions at the same time I did that are getting approved and it's making my stomach turn.

I am SO happy for people getting approved, but I am SO jealous. I feel guilty for being so jealous. I should be excited and giddy for people heading towards their next step, but I can't help but feel resentment.

I just got back last night from Canada, and seeing my Craigory for 4 days didn't help the situation. I'm grateful for being able to see him so often, but at the same time, it makes it harder. Because just as I start to get used to daily life without him, I go visit and I get reminded of how amazingly glorious daily life is WITH him.

Guh. CSC. C'mon now. Give us all a break.

:star: Cass (bebop the great)

I FEEL YOU, I'M AT VSC AND I'M STILL WAITING FOR MY NO2 OR WHATEVER BUT NOTHING HAS HAPPENED. MY CASE IS PENDING SINCE JUNE 22 AND I'M WAITING SO BEING AT VERMONT DOESNT MAKE YOU LUCKY IN MY CASE I HAVENT SOME PEOPLE WHO JUST SENT HIS PETITION HAVE BEEN APPROVED IN A MATTER OF DAYS AND IN MY OPINION THATZ NOT FAIR BECAUSE MANY PEOPLE HAVE BEEN WAITING MONTHS.

Congratulations!!!!!!!!!!!!I am truly happy for you and your hubby. So glad that you will be able to spend Christmas together. I agree, that is the BEST present ever!!!!!!!!!!!!!!!!!!

IR-1 / CR-1 Spouse Visa Process & Proceduresmedical for CR1/IR1

Hi all,

My medical is coming up, and i was wondering if anyone knew how much it will cost for me and my 4yr old son?
we both are missing one shot.so take that in consideration when you reply, if it helps. i called the medical
facility that will conduct the medical and was told by the lady on the phone to take $50,000 jamaican dollars
that is roughly us$700.00 but i think that is way too expensive. so if any one can share any info that would be
appreciated, and anyone from jamiaca who had their medical done already would be an assett.

thanks guys.

Vett, correction. My husband paid approximately that amount for several shots and a urine test. He stated that he paid approximately $1200 for one shot.

Vett,
The cost depends on where you are going. Montego Bay Hope Medical Center charged approximately $100 for the physical but the center in Kingston quoted us a fee of $200. The shots, if you have to get them at the center, are expensive. I think that my husband paid between $3000-$5000 for the shot that he needed. Hope that helps.

IR-1 / CR-1 Spouse Visa Process & ProceduresSending Pictures with I-130 Petition

Hi VJ, did I tell you that I love you lately? :D :luv:

Question:

Is it best to put all the pictures in a ziplock bag with the dates written on the back of each photo, or should I put them in a photo sheet protector so that each picture can be viewed individually without having tot take them out?

thanks in advance for your experience/thoughts!

Hey JAPrincess...Honestly. We just printed our pics from our wedding and other pics from trips. They were regular 4 x 6 printed at the local Walgreen's Pharmacy. They were in no plastic protectors or anything else but just placed in the package. No request for further evidence received. However, we did provide quite a few pics. Hope this helps but I don't think that there is any need to jump through any extra hoops. Take Care..

K-1 Fiance(e) Visa Process & ProceduresLots of Questions and 1st Post

Second thoughts??? Are you thinking of NOT going to the philipines for Christmas?
You should count your blessing and make the trip. It only helps strengthening your relationship with him than not. The speed of approval in VT is known, they are pretty good! However, the big time waster is the Consulate's interview. I don't know how bad it is with marriage frauds in the Philipines, but in Vietnam it's pretty bad and that causes so much delay and denies for the vietnamese petitioners.

Good luck and I say: have a merry christmas in the tropical weather!

Thanks for the reply. Believe me, I would love to be with her then (and probably will). However, a new company has just taken over my contract, so I will have to go on vacation with unpaid leave. But that is OK. I just came back from there in June, and although we talk every other day, and Web Chat on the weekends, we miss each other greatly. However, we both agreed that if it looks like she might be here around Jan or Feb, then it would be better for us to save the money. I have been to the philippines more times then I can count (retired Marine) and I have found no other place that I feel more comfortable in (except Texas..:) I love it there.....and am actually thinking about us retiring there in 3-5 years....(first things first though). Take care, Stacy.

K-1 Fiance(e) Visa Process & ProceduresLots of Questions and 1st Post
Hi everyone. I have really, really enjoyed reading everything I can on this site. Thank you all for taking the time to post your experiences and time lines (I will post mine soon). My Fiancee lives in Makati (Philippines) and we had a wonderful visit together in May-June. All is going well, but I do have some questions. I have been reading soooo much on this site, that I feel like it is 'information overload', but that is a good thing! I sent my entire package (I-129F) into the Vermont Center on 9 Sept. and they received and signed for it on 11 Sept. I was expecting it to take a couple of months to either be approved or disapproved, but on 26 Sept, I received 4 emails from them saying it was approved! Wow! Is this the normal speed it take to get approval? Needless to say I was shocked, but estactic! When I started this process, I ordered a Fiancee Visa package off of the internet (PDF forms, instructions, binder with word for word examples, etc.) and it really has helped me a lot. However, it didn't mention anything about the NOA. Of course being new to this site, I was able to understand what 'touched' means, NOA1 and NOA2, etc. Today is the 28th of Sept. I was planning on visiting her for the Christmas holidays, but we are having second thoughts because of the speed of the first approval. I have come to believe that the two slowest points of this entire process will be the action at the NOA (forwarding to Manila Embassey) and how long it will take the Embassey to send her the packets (3 and 4), and to finally set up the interview. With all of that said, is it far fetched for me to think that it is possible for her to be here (here being Va with me) between a December-February timeframe? She has all of her paperwork with her allready (passport, NBI, birth certificates, etc., except for the medical requirements (I guess we will have to wait for what the Medical examiner will intstruct her for what she needs). My completed AOS and all other certified documents will be mailed to her express on the 15th of October (just got a new job, so need to get a pay stub, etc.). Again, I want to thank you all for your very detailed and thoughtful input on this site. I have had so many questions answered already. Thank you for reading my 'long' post. Take care, Stacy.

Quite surprised by the hostility here. Everyone has some experience that they can provide. Degrading someone for their appearance is childish and serves no purpose. There is no stupid question asked but the one that 'is not asked'! God speed you all and can't wait to be with my sweetie once again!

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp with interpreting NVC letter
If a Philippines police certificate is cheap as you say then I would advise getting a new one. It will not be much use asking if you need to, because if they say "no" that doesn't mean that you won't get to the interview and be told that you do need a new one. I would advise you to get it and then send it to the NVC with the Canadian one when you get it. That way it won't get lost or anything.

According to the OP's past posts, he is from Canada, so hopefully you can answer his question!

As you will have only just been married, and you will still be living in the Philippines, most of your evidence will fall into "6. Any other relevant documentation to establish that there is an ongoing marital union." which will be all the evidence you already have and were planning to show for the K1. You will also want to provide the affidavits from other people. (Item 5.) The first 4 items on the list of evidence for the I-130 are the preferred ones though, so it would be good to provide something from there. You don't have children or live in the same country, so that leaves "3. Documentation showing co-mingling of financial resources." Try to provide something: eg. evidence that you both paid for items relating to the wedding. Also if your fiance can get your name on ANY kind of document in America, for example vehicle insurance.

I SHOULD have done AOS. I'm a screaming idiot. Now I'm stuck terrified of a medical that if I'd done AOS, I wouldn't have had to do.

There is a medical required for the AOS. (Except for when you have done a K1 visa and already done the medical with vaccines.) Medical with AOS would've involved finding a civil surgeon in a foreign country (aka America). As it is you know exactly where you will be having the medical in the UK, and there are tonnes of reviews out there so you can know what to expect. I was anxious about the medical for months because I don't like people poking around with my body, especially when I have no control. (Ie, I had no choice, immigration was in control.) But honestly? It was no big deal. The doctors who do the UK medical are very discrete and non-interventionist.

I know the feeling of second-thoughts, there were two times I was in America and could've filed for AOS. But, I didn't have all my documents and stuff in the US, it seemed a less sure way to go, and I don't really like to do things the non-proper way. Would've made me feel like I was jumping ahead of all the people who were stuck abroad filing K1s or CR1s. But I could've avoided those times apart from my husband! (To be fair, I spent the majority of the time in America anyway.)

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting married on a tourist visa

The problem with this is that lately, people who are trying to adjust status from the VWP have had a lot of trouble. Lots of cases aren't being adjudicated but rather are still pending while USCIS decides if they want to change policy on this issue. A few years ago, this wouldn't have been an issue at all, but now, it's a lot more risky to try to adjust from the VWP.

I said something to this effect in another thread and someone jumped on me saying it wasn't true. I guess if they are still pending we don't know if they'll be successful or not, we just know it will be a slow process. (Which may result in failure, but right now I guess those people are together in America.) Does anyone have any concrete evidence of both people with pending cases due to this or USCIS thinking of a policy change?

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting married on a tourist visa
As far as visiting after you are married: yes you can. There are no guarantees on whether the US will let you in. Personally I spent a lot of time visiting the US whilst my CR1 application was being processed, no problem. As you say you have work commitments you should be fine as you would have evidence of that plus as you have to work you will probably be spending less time visiting the US than you will be working. BUT there are no guarantees. Once you are married having the CR1 application will be a positive because it shows you have plans to move there legally. After all, if you were gonna overstay and try to file AOS then you would've done it the first time you visited.

It is perfectly legal to enter on VWP/visa and marry. How easy it is, I don't know. Bring as much evidence of your ties to home as possible. On the visit which I married my husband, I just said I was visiting my fiance. Perfectly true and I wasn't asked any more questions. I was very OCD about the whole thing and made the wedding as spontaneous as possible, I didn't even tell my parents the date until I had gotten to America!

IR-1 / CR-1 Spouse Visa Process & ProceduresName Question + Criminal History Question

Hi all - I have exciting news, my husband and I have decided to live in the U.S.!
He is English and currently living in England, I am American and live in Georgia but am visiting England at the moment. We are trying to get everything in order to start the visa process before I return home. I have three questions, and insight would be wonderful.

1. I'm not sure what name I should put at the petitioner. For example - lets say I was born Jessica Kate Mayer and my passport and birth certificate both reflect this. Then last year in October of 2009 I legally changed my name to Katie Hugh in order to share my step fathers last name(fully dropping the Jessica). I did not get my passport changed. I then got married and my name is now Katie Hugh Wellington. I would like to eventually get my passport changed to Katie Hugh Wellington but don't have the funds at the moment and am passed the 1 year free name change timeline. So what name so I put on all the forms and do I need to include my October 2009 name change in order to understand the drastic change from starting out as Jessica Kate Mayer and ending up as Katie Hugh Wellington?

2. I am currently facing a criminal charge that I expect to be fully dropped - it is a felony. I am awaiting court which is part of the reason my husband has decided to come to America as I am stuck in America until all of the legal/civil trials conclude. Will my arrest affect my husbands chances of entering the U.S.? He has no record himself.

3. Can I apply to any USCIS service center or does my location limit me to a certian one? I'm sorry if this question has already been answered - I looked but didn't see it however Visa Journey has so many pages that I assume it was over looked.

I'm so excited to have found this community. Thanks so much for your help!

1) If you legally changed your name to Katie Hugh Wellington then that is the name you will use. I don't know if your marriage is sufficient to make your name change legally from Katie Hugh to Katie Hugh Wellington; depends on the state I think. Yes include the name change, else they won't be able to link you with your proof of US citizenship!

2) If you end up convicted of some kind of violent/sexual crime then that can have ramifications. Otherwise, it should be ok.

3) You will send off your petition (I-130 et al) to Chicago, and they will then forward it to the correct service centre. The address is in the instructions for the form. (USCIS P.O. Box 804625 Chicago, IL 60680-4107)

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about Medical...can't get a straight answer...
Sorry, don't know why I thought you were in the UK.

I think the Philippines, for example, is stricter on any drug use. I haven't seen any Canadian actually say "I admitted to using pot once and couldn't get my visa for another 3 years." I've only seen "I saw someone say somewhere that they were denied for 3 years..."
Given that a conviction for drug possession can be waived, the penalty for use (and arrest) is not going to be greater.

Just tell the truth, don't waste time worrying about what might happen until it's happened. (If it takes a little longer for him to get approved, then you will deal with that when it happens. No point in fretting about it right now.) At least once it is all over you KNOW that in 5 years times no-one's gonna say "wait, you lied, that means you need to go away."
JoannaVFemaleUnited Kingdom2010-10-06 20:43:00
IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about Medical...can't get a straight answer...

Is it true if you admit to trying pot once in your life at the medical... it's a automatic denial?

It can be grounds for a denial. It is not an automatic denial.
Depending on what/when exactly the drug use was, it might not even come up. You may be asked about drug convictions, and current drug use, both of which you can say no to.
Some Embassies are stricter about drug-related things than others. The UK is not so bad.

Looking at the questionnaire I had to fill out for the UK medical before arriving, there was a question asking if I had ever misused or abused drugs. I guess you can interpret this in two ways: any illegal drug use is "Misuse" so you should say yes OR that misuse/abuse are not exactly the same as use, and so trying it once in your life does not count. (Same way as drinking alcohol does not mean answering yes to the abuse of alcohol question.) Personally I'd think you'd be ok to say "no" and then only if at the medical you are asked "have you ever in your life tried any drug" you would have to say yes. (The pre-medical form is not immigration related, so wouldn't be viewed as misrepresentation in case you're wondering about that.)

Someone in the UK was denied a visa for a conviction for marijuana possession and not declaring it on their I-94 when visiting America. They prepared to file a waiver but then it turned out that it was a mistake and they shouldn't have been denied because these things happened when they were a minor.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan Canadian marry in US before application process?
To make it easier for him when going through the border: tell him to bring his birth certificate or whatever other documents he would need to get married, but don't tell him why. Then he won't even know he might be getting married so it will be easy for him to answer questions without feeling worried :P

And I would add, that if you have nothing preventing going the CR1 route (eg unable to visit each other to get married as are in countries where visiting one another is hard, or really really don't want to have to be apart after marriage, or whatever) then the CR1 is, in my opinion, the best option.

Maybe your husband's doctor requires a form to be filled in before releasing any records. But that is something specific to the doctor so we cannot help. Get the doctor to specify what form he means. There shouldn't be any need for any kind of form for release of vaccination records, he should just be able to give them to your husband.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisa is in!!!! WTF!!!

Hoping everything goes well at immigration what would be our next step? Apply for a SSN? How long until the actual green card arrives? We will only be in the states for 2 weeks since I am stationed overseas and had to make the trip earlier than expected because of how long the visa is valid for. Thanks

You can try to have your wife apply for her SSN but it might be too early to do so whilst in the US. I haven't heard of the green card arriving within 2 weeks, it usually takes a month or maybe more. (They tell you something silly like 6-8 months, but most people get it in 6-8 weeks lol.) So you might need to make sure someone is able to access your mail at whatever address you gave to have the green cards sent to.

You will be fine. Just include what you have and don't worry about it. They know that you cannot be living together or paying bills together yet. If you have any American family/friends who can quickly write an affidavit then you might want to get a couple of those. They just need to give their name, date and place of birth, and then write a short paragraph about how they know you and how they know of your relationship. Tell them to do it in 10 minutes. The affidavits we got were completely lame: "I'm J's brother and was at J&J's wedding" and weren't notarized, but they seemed to work.

IR-1 / CR-1 Spouse Visa Process & ProceduresI just want to be with my fiance! Please help

Thanks guys,

I'm just worried that if I don't say that I'm intending to get married, something will end up happening and I'll be accused of something. If they say I can't come in can I just say ok, I won't get married then, I still just want to go for a visit? I really don't want to not even get to visit either way!

Always tell the truth and answer any questions asked shortly and succinctly. If you are unlucky enough to meet an evil border agent then he won't let you in whatever you say. If they decide not to let you in and you say "ok I won't get married, can I come in now?" the answer will be no. Maybe they'll just ask you why you are going to America, you answer to visit fiance and that is that. If they then ask "What are your future plans, when will you marry, etcetc." then you will have to answer. You can say that you are thinking of marrying on this trip and then returning to Canada to apply for CR1, and then having a big wedding celebration once that is approved. This shouldn't be a problem unless the border agent is evil. You must tell the truth, but you don't have to broadcast all your plans and life story. You are visiting your fiance anyway, so it would be a lie to say that the reason you are coming to America is to get married :)

When I visited America to marry my fiance my POE was actually Ottawa, and no questions were asked. Good luck!

Take as much evidence as possible, just in case. But only answer the questions that you are asked. You are going to America to visit your fiance for Christmas. If there is no need to mention the marriage then don't. Hopefully you will get a friendly border agent who will quite happily ask to be invited to your eventual wedding but won't ask when it is. :-) Maybe you don't even need to know yourself when you will get married, (ie if any planning does need to be done in advance your fiance can take care of it) so could quite honestly say, "I don't know, but I need to finish school in Canada.)
