I'm assuming that even though we are Oct/Nov filers that if we received our NOA1 and it says received January 2008 then this is the date we should be going by for processing times?

On my printed NOA1 it says - received date October 10th - notice date January 10th

On the online system is says they 'recieved' my application on January 10th

I'm not sure what that makes our date to go my for processing times but I'm sure everyone will still be processed in order so it doesn't make that much difference in the long run


The received date will be the one they will use, I was told when I called them.. tho they are now saying it will take 9-10 months for processing mad.gif I think its best to go by what they are doing, and VSC is processing August petitions.. so the august petitioners are getting adjudicated in 6 months!


what do they mean its taking 9-10 months? just at vermont?
It seems that people that got the NOA1 right before we did are beginning to get approved. I dont listen to anything anymore. blech!

Don't be hopeless.. Check out my timeline..

I sent my I-130 on 5-19-07 to the Vermont Office
Notice of Receipt was on 5-21-07
Notice of Approval was on 6-7-07

I didn't request no Expedite service.. I also I sent my application via Priority Mail only..

Today I just got my IV Fee Bill of $380.. After paying this, I am going to be on my last step which is the DS230..


You got very lucky what can I say! We are not lucky at all. USCIS stopped processing I-130 it seems like for a while. My husband called California Center they said it is going to take them 15 weeks before they issue NOA1. Very much looking forward to it! I just decided to look for a new job in Russia, since it seems like it is going to take some time before I get my interview. I hate to be pessimistic here, but it is not looking good at all so far with processing delays.

I still have not even received a notice of receipt (unless you mean by sending it certified mail..which I did and I also have that receipt) I have heard NOTHING from VSC yet sad.gif

When I was going to the process of the I-130 I also wrote about 20 letters to everyone I could think of (and spent numberious hours reseraching names and contact information. My congressman, senators, First Lady, Director of USCIS, Duty Director of USCIS, Director of Secruity checks, Assistant to USCIS Director, Chief of Stuff of USCIS etc... But the only one (beside my Congressman) that responsed back with an answer was VP Cheney and becasue of the inquiry from his office USCIS responsed as well! My job isn't temporary - I work contract-to-contract at my school in this school district but next year will be my last year and I'll have tenure.
When the county gave me that letter it stated that I have been employed since XX/2005.
Even before last summer I received my offer to work this school year.
Enough proof of your current job (salary) along with supporting documents should be fine.



Hey! My job isnt "temporary" necessarily, but I think thats what they call it unless you are already tenure. If I stayed in this same city one more year I would be tenure as well, but I live about 8 hours from my family and I think I am ready to move home, plus living expenses at home are WAY more reasonable and it will be nice to be around family while we are getting on our feet!

I agree about trying to stay in the school! I just wasnt sure if the principal would have the salary amount and all the "formal" dates. I would much rather stay in the school than go "downtown" haha. I wont mention that it is "temporary" either. My only thing is that I may be moving next year and the summer is HOPEFULLY when the interview will happen..or be over!! haha but either way I run that time as being the risk of one contract almost if not already over and the other one (hoping I have one by then!) not starting?? Who knows. sigh. so complicated, haha

I'm a teacher too - 2nd year in the U.S. (I did one year in Brazil). I don't think we have to worry about the affidavit of support because we are currently earning enough and we can always show proof of graduating from college and that is why we didn't earn as much before.
I will be taking my tax returns to the interview with me as well as W2s and my contract from last year and this year (to show my raise) and that I've been employed since 9/2005.
I have my letter (and the listed contracts) from my employer and will be able to take my W2s from this year with me as well. I have pay stubs and bank statements and my life insurance policy.

Get together as much proof as you can that you earn enough, and remember you still have your W2s from this year to show that you earned above the poverty line for 2006.
I was told that what is most important is that your current salary is sufficient.
I hope this helps.

Hey guys!
I have some questions. I dont think the answers are here obvious anywhere..haha... I am going to file for my fiancee..and how big of a "proof of relationship" issue is it that we have only been physically together one week? I met him over the summer while I was in JA on a mission trip with my pastor and I am an elementary teacher so it is hard for me to get time off during the school year to go visit him. I am planning a trip for Spring Break but hope to have started paperwork before then. I have a card from him. phone bills. a couple of pictures but unfortunatly they are mainly of just the two of us. my jamaica agenda and my flight ticket..anything else I might have and wouldnt think of??
Also- he tried to come here for Christmas but wasnt approved for the visitor's VISA b/c he didnt have "adequate community ties to show return"...will that mean anything in the paperwork process like.. will he have a hard time being approved??
I am a 2nd year teacher (just graduated) and my income is def. above poverty level but I dont have 3 years of returns so my sister and brother-in-law are sponsering us - do I still need to have MY tax returns for the past two years?
and finally- where is says "intended adress in the U.S." what if I dont know it yet?

Oh we use Windows live call for video chat, I just use my phone because its something that USCIS can see, we dont email each other at all really maybe, 4 times a month, but i talk to her several times a day on the phone and when i am at my house we just do the video chat for a few hours. We should have raised a stink before now and we might not be right here.
I think our focus should nto be on the crappiness of the USCIS but our focus shoudl be on the lack of focus on FAMILY...that a country BUILT from immigrants now allows the illegal ones to stay...TAX FREE... but the legal ones get destroyed..not only that but those fiancee VISAs and work VISAS and all kinds of other things are moving right right along while those of us in a family COMMITMENT wait.
Im going to pray that God open the doors for ALL of us an opportunity to change this process.

We got an RFE last Wednesday 30th April. Today our lawyer received the letter from USCIS and all they wanted was a certified copy of our marriage certificate. I believe we sent a photocopy of the original. This has already been sent back to them so hopefully we will be back in the game asap. I'll keep you all posted.

Shrewdgal, I was having a laugh .... This system is hard for all of us, and I'm just trying to lighten it up.
The approvals are happening and hopefully there will be more this week (it's only monday today) .... you've got a January NOA1, and you know that they are processing those currently as the timeline shows exactly that.
If you don't have your approval by the end of the month then I'll be very surprised.

Im with you Shrewd, and they bad thing is that no one can do anything, even if someone filed their application on Aug 1st nothing can help it. According to USCIS people are not even allowed to make a service request until 30 days after the posted processing times. Congress men can do nothing until you are current or past their processing times either. The most frustrating thing of all is to see so many people after July-Nov. getting approved. Its very good for them and I am glad that things worked out for them but I cant help but feel like my life is always going to be as it is now, I have gone from 155 pounds to 120 in 3 months so its easy to see im not eating anymore, I dont sleep but maybe 3 hours a night no matter how much I drink, and pretty much I have just given up on life. Sad really that im so weak that I let a process control the way I am but that process is my life right now. I really just cant take it anymore, works out better for my wife if she is a widow really, she gets to be near the person she will marry afterwards and no one in her family will look at her funny because she got a divorce.

It is really affecting our marriage. I dont know how it will work out. Everyone says stay hopeful..but that only worked for me up until about a month ago. now I just feel out of control and lost.

I am also like everybody else, impatient, frustrated, depressed, angry and helpless.

One thought that keeps me going is, if my wife doen't come here, then I will go to her. My wife and I have given ourselves until Dec 31, 2008 for her to come here. If that doesn't happen, then bye bye USA!!

The H1-B influx was couple of weeks back, they should be pretty much through it by now
Anyhow, NVC and TSC also deal with the H1-B, so the workload will have been split up considerably ..... surely the only reason VSC would still be working on H1-B's would be if all of those applications were for New York ??? .... we all know it would probably be a split between LA and NY ..... CSC are through theirs and are rocking though I-130's

If you're talking about the backlog around July/August .... they are totally through all of that. That would've been finished up around January/February looking at the approvals .... the fees went up in July 2007 right? We don't have a lot of June 2007 filers on this site do we ??? they are what would've been the backlog.
Sadly the backlog did delay our NOA1's. more so for the August - October filers ..... and if these guys are definately going by NOA1, then it's a bummer!! ..... but if you look at Delicia's spreadsheet which I've pinned a couple of postings back, the approvals are without a doubt coming through for NOA1's in December/January

Yes, Kitty, there's a lot we don't know about. Delica has been checking everyone's timelines and has been religiously updating her spreadsheet, even if they announce their approval or not. She is a star star_smile.gif



I dont think Delicia's timeline shows NOA1 order indicating approval order at all.

but I am a USC...natural born...does that make a difference ya think?

if you look at Delicia's timeline then it is not going by NOA1 at all.. there is NO consistency with the approvals in the last 2 months or so from VSC.

The problem that i am seeing with the congressman is that there is no time that they use to act on now, there was once the 6 months rule, meaning that if you were past 6 months contact your congressman and they can put a request in for you. This just isnt the case anymore. They are holding to the processing timelines posted by USCIS. It is amazing that USCIS is now contradicting their own estimated time lines, they said that applications filed after July could expect a 9 - 10 month wait, May 30th will be 10 months from their posted estimated processing times. And California, all I can say is WOW, they are doing some work over there. To me I feel like after July at vermont they just got so many applications they vowed to never open the closet the shoved them all in in hopes to ward off the work as if it was some type of evil spirit.




I think they have lost some...and wont move the processing dates until they can get them "found"

However .... I did make a copy of some fax numbers off a posting on here a couple of months back just incase .... it was from a guy called Mohgli I think .... these are the numbers he faxed and got an approval soon after .... don't moan at me, I've only just found the document I copied it onto.

also, you can try faxing MULTIPLE times in one day.. fill them up fast.. send a super-strike of papers to all the offices (haha).. They will get annoyed at you as well as USCIS.. and that is why Mr. Director over there is calling it quits.. I don't think it is because he is far away from his family.. I just sent a batch Monday, and I'll wait until Thursday (5 days for my request).. to see what is up.. if not, I'll just tell the person over the phone that I will continue to send faxes until I get a decision.. President Bush did send a letter to me (mail) saying that he forwarded my letter to Dept of Justice.. then they forwarded to FBI.. and that's how I got my letter from them"


Maybe there's a reason why I couldn't find this before .... but now I have .... have fun guys yes.gif

Dear....... Thank you for your service to this nation and its citizens. Your work has not gone unnoticed and for your concerns I am thankful or something nice here...haha. As one of such said citizens, I have a serious concern.
My name is __________. I filed a I-130 petition with the Vermont Service Center on __________.
That was 205 days ago.Today, May 21, the USCIS processing times were updated (with a May 15 date) and the I-130 petition for spouse, child under 21, and parent remains unchanged with a date of July 30, 2007.
This is the third month the Vermont Service Center states they are processing I-130s filed on or before July 30, 2007. The month before that they were in August and then on ________ does anyone have this date? the processing time for this petition went backwards.
Can NOTHING be done??
I miss my husband. Families are being ignored. I wake up everyday hoping that it will be my turn. I serve my community. I love my country, yet there seems to be no tangeable hope for me to be with my husband. I am not even asking for special treatment. I just do not understand why there is NO accountability in this department. Where are the checks and balances? Where is the accountability that this SERVICE center has to the U.S. Citizens? How is it that a Service Center can do no progressive work on a particular petition for months and noone speaks on our (the citizens and permenant residents) behalf?
Fiancee Visas (K-1 and K-2 Visas filed by the I-129F petitions) are into a November processing date at Vermont.Special work Visa's are being processed almost immediately after petition. Those of us separated from our husbands, wives, parents, and children..we are the ones getting
lost in the shuffle.Why the discrimination? I feel that you, as our liason between this service, you may have some answers.
We teach our kids that we have a government for the people by the people and all I can think is that when I call my the appropriate people to as for help that I am seen as a nuisance, or in some cases, not even intelligent.
I have heard numerous times about the backlog and the amount of unexpected petitions received before the fee hike that took place in July 2007. Why is this still an acceptable answer? As long as the Vermont Service Center leaves their processing date at a standstill we are told nothing can be done because we are "within processing times." Is this the representation of our government and it's services that you want your citizens to see and be treated with?
