USCIS is quite lax on the beneficiary's passport photos submitted with the petition. So lax, you can actually do without them. You'll need the correct format and size for the visa interview.


Really, trust me on this.


Ok, no offense meant, but while you are correct that there are petitions that have been approved with different size (or possibly even no photo), I think this is bad advice. The adjudication process is done by individuals who do not all make the same decision as other adjudicators. There have also been RFE's based on incorrectly sized photos. It is a risk to submit this and it is a choice for the petitioner to make. I would get the right pictures FedEx'd or emailed and then printed out. A couple of days to correct is better than a couple weeks to deal with an RFE. Again, it could be ok either way and is a personal choice and acceptance of risk.

I don't know that anyone here knows exactly what background checks the FBI does or may do. I do believe they include "name checks" which may likely involve checks vs. various "bad guy" lists using your name. This may result in a hit and require more stuff to be done to see if you are one of the "bad guys". I know that my name was on a list, and i had problems in airports for a few years and this was admitted to me by an airline. I am worried that I could end up in the same situation, but who knows.

I would not hesitate to contact your Senator as well. Even with the above, 1 year is too long. Also it is worth noting the USCIS and FBI have publicly stated "All USCIS requests pending for six months or more as of February 28, 2009, have now been responded to by the FBI’s National Name Check Program (NNCP)." (see the news on the home page). This means yours should have responded to or will be very soon. Maybe call the USCIS and ask specifically "When was my case been submitted to the FBI NNCP?". If it was more than 6 months was there any response and what was it. Not that the USCIS will do what they should to respond to a constituent, but sometimes if you ask the *right* question.

Hope you get your NOA2 soon no matter what!

My attorney recommended trying to see each other at least once after the NOA2 approval as a measure of caution. Aside from boarding passes and additional passport stamps, a few pictures together will show some effort to maintain an on-going relationship. I would love to go to the interview but the contracting economy will make that tougher since I am putting together the money for her flight. (hopefully by mid-April)

My attorney generally deals with cases for Latin America and Asia, so I will take it that he has some experience in trying to make things flow smoothly in that regard. So far, no RFEs! (knock on my wooden head) headbonk.gif

When I applied for the CIA several years ago, having a wife that was a non-US citizen was a deal-breaker. I had the background - Military Service, Speak 4 Languages fluently, & International MBA from Duke. They were ecstatic about my application until the moment they found out about my wife. They dropped me like a penny off the Empire State Building.

I don't know for which agency you are working. However, my guess is that once they find out about it, you are likely to run into a truckload of bureaucratic chicken S*%& on this one.


Yet they have thousands of FNs working all over the world with clearances on-site? Its a logic free zone.

K-1 is a pain in the butt, aggravating, and tries your patience. But it's not rocket science, and all of us (ok, most of us) get through it just fine.


I don't think it should affect your application unless it causes you to lose your income when they suspend your clearance. That will be the real issue you will need to worry about! Be very creative in what you can do to stay working. This will be a "lifestyle change" event that will have security all over you. Your security office will need to run separate background investigations on her and her immediate family before you get the all clear and reinstated.

If you haven't yet done so, you need to get a read on how they will treat this at your job. Be prepared for this worse case scenario depending on your security level.

Yes, I traveled to the US while on the process of the K1, you can do that as long as you dont stay longer than the permission they give to you. Try not to give extra information at the Port of entry if they dont ask you, but always say the true, it is fine if they ask you
if you are on a K1 visa proces. But bring documents with you that make evident that you will come back when you said you will come back.

Hi MrsJibowu, I would go back to marry in Nigeria after all else fail. My K-1 expires May 30, 2009. Stephen went back on Thurs, Mar 26th and after putting up much of a fuss and them attempting to literally THROW HIM OUT of the embassy, he remained FIRM and the embassy finally gave in and gave him an Inquiry form to fill out and told him to come back on Monday, Mar 30th for his next interview date.

He said he told them that he saw (as he was coming in) Scammers laughing (because they just got their visa) and here he is, TRUE, and they have him coming up there (for a second interview) as well as him crying out to God on his behalf, he said he told them it just wasn't right. Stephen commented to me that he's former military (more than 20 years service in the Nigerian army) and never had the military knock him down (emotionally) like the tactics of immigration!

Lord's will I plan on being there for the next interview.

If it weren't for the fact that I have a business I would move to Nigeria to be with Stephen (that will prove the relationship is bona fide). Anyway, I am asking for your advise, if all fails (already submitted the paperwork to my Senator's office for his assistance), should I return to Nigeria, get married then file an I-130. Can anyone who's filed an I-130 give me their timeline for that process. Also, would that have a negative affect because I filed a K-1 and it was sent back.

I can't believe I spent so much money on an Attorney (found out about visajourney AFTERWARD) and when I called her today to inform her of the denial, she was out sick! She's always out sick ... Unbelievable!

The answer is in the instructions for the I-130 and again in the instructions for the I-485. If you haven't read them, that's a big mistake.

Your interpretation of "first come, first served" would mean that all of us have to wait behind people with incomplete or incomprehensible petitions. Fair? Should we all wait behind the people with RFEs that don't reply for months at a time?

So imagine you are at the checkout line and the checkout line police assign you to a cashier, first come, first serve. You are assigned to line 23. Then someone down at line 46 has a problem with their debit card. So now everyone in all lines has to wait? I mean the guy at line 46 was in line before you, so YOU and all other people would have to wait while they check with his bank. Correct?

Use this time wisely. You have all your documents for the interview prepared? Translated? (if applicable of course) What are you doing to speed the process, not just the NOA2, along? Or will you wait until the consulate sends you packet 3 even though you can download it today? The surprise you may be in for, after all your grousing about your NOA2, is when you find you wait even longer to clear NVC and get an interview. If you do not have your documents ready for the interview, your wait will be extended by another 3-4 weeks.



Just seems kinda funny this coming from someone who was approved for there NOA2 in 2 months !! Now i know its not going to be first come first serve it does seem like the VSC could do a better job of distributing cases so someone doesnt have to wait extra time because the luck of the draw put them with an incompetent case worker that takes longer then the others.

I disagree. It could hurt you severely unless you provide a notarized letter explaining how your plans have changed. The K1 path is intended for those who plan to become US permanent residents. It is not designed for the purpose you described in your petition. Where do I mail such a letter? Or should I call? Or would it be best just to leave it and wait for them to challenge it??? Really, as long as our intentions are truly to marry then we are using the K-1 visa correctly, and even for him to stay here 2 years we would have to apply for permanent residency, right? Technically we still haven't decided 100% one way or the other because there are so many "what ifs" involved.

When I filed the K-1 visa I wrote on the "how we met" section, and also the part where you're supposed to explain you're intents to marry, that we would probably live in the US for about 2 years and then go back to Guatemala. Now we are leaning more towards staying in the US and either way we will have to apply for his Green Card. My question is will this hurt us in the interview process if they think he will not be staying? Or even before the interview when they are going to approve the application here?

Question about the whole photo in the plastic bag thing - I read the instructions from the USCIS website and bought a book and neither one said anything about attaching a plastic bag. The first I saw anything about this was once I ran across this site (almost 3 months after I sent the I-129F package in the first place. What I did was put them in the passport photo holder that I got with my pictures from Walgreen's. I only labeled the other photos that were from our time together to show a valid relationship. I hope this won't be a problem?!?!

I'm quite sure every consulate is different, in Canada (we are doing a K1) its $131 US dollars I think, and I have to pay it the day of my interview. The info came in the package from the consulate. Good Luck!!


When the time comes (I hope soon!) my fiance will have to pay $131 USD ahead of time at a specific bank in Guatemala, and then bring the receipt to the interview. It is different for each country. Click on Embassy Info at the top of the page and then find the US Embassy in your country, and everything is explained to you. I imagine that info will also come in the Packet 4 with your interview date & time. Best wishes!

Your own words are fine but there is no need to prove plans. You simply state your intention to marry within 90 days of the beneficiary's US entry and sign the letter.


I did include a copy of my divorce papers to show that I am "able" to marry. But my fiance did not sign the aforementioned letter, only myself. blush.gif Why is this such a daggon technical process? You don't do one little thing correct and they might reject it or just draw it out to even longer grrr.

I saw this in the guides to file K-1 on VJ (I filed in October 08 before finding this site) and I never knew about this! mad.gif I followed the directions from the USCIS website as well as used a book from 2008 with all the requirements for a I-129F application. I put in my letter of how we met "We plan on having the judge at the Circuit Court in Lynchburg, Virginia marry us shortly after he arrives." Does anyone think I will get an RFE or has anyone gotten an RFE for not including these letters in their app? Also, are RFEs not usually sent out until getting ready to process the NOA2? Thanks!

and just for anyone debating writing, it's easy, and I would have never thought that this particular senator or his office would be at all concerned with our puny little K-1, let alone be a proponent of immigration.


Congrats and good to know! I sent an email to my Senator also but mainly just to complain about VSC being sooooooooo much slower than CSC. We'll see if I get a response!
