If you are on active duty you only have to make 100%, which for 3 would be $18,310 for the 2009 guidelines. See link:

He has to have a job at the time of the interview and be able to show that he makes the minimum by an employer letter and recent paystubs. 2008 essentially doesn't matter if he doesn't meet the requirements now. Hope he can get a job soon!

As others have stated, if he included his birth certificate then the passport pages he sent should be fine since they are only trying to prove you have met within the last 2 years.

As far as the letter of intent, this is almost exactly what I did - I answered "how you met" on a separate sheet of paper and at the end wrote "we plan on getting married at the courthouse in Such-n-such, Virginia soon after his entry." I did not say within 90 days or have anything signed by him, but they approved us without RFE. It all depends on who adjudicates your petition. Don't worry about it until you hear from them, though. good.gif

We met 7/10/08, talked a bunch and hung out a little, our first official date was 7/24/08, then we were together every day til I left 8/14/08. I returned for two weeks 12/17-12/31/08. I am going back 4/9/09 and hopefully he will be coming back with me on 4/19! We talked about marriage before I left the first trip.

So, 7 weeks face to face, 5 of those weeks officially as a couple.

(They could probably power up a whole country from the amount of 'energy' between us when we both finally meet hehe) The amount of red tape they make you go through and having to prove a relationship the way they do kinda goes against how natural a relationship should be, but I suppose that's just how it is. But for that one week, I'd like to not get USCIS involved so it can be as it should be. I would rather pay the postage and wait to send the documents later just so we can enjoy our time together simply for what it is. Maybe I'm being wishful but I'd like to strike a healthy balance if possible.

And after that, the chaos that is a K1 can begin.

I've been seeing trends in the progress forums that show Vermont has been speeding up, so that's good I think.

Congrats! Hope your trip goes well as planned. You're right about the red tape, but as far as the meeting requirement I'm glad they have that because if you are going to be with this person forever, you will want to see the chemistry in person first!

As far as what I bolded above, I wouldn't worry about the baggage tags. Just make sure he keeps his boarding passes, and take plenty of pics of the two of you, with your family and friends too if possible. If he was just planning on taking a carry-on, more power to him! Checked bags add more waiting time to get in and out of the airport and sometimes added expense too, depending on the flight.

And I understand about you wanting this trip to be "us" time, but I do recommend going ahead and getting those forms signed. If you are planning on sending the package in in a couple of weeks, you can post date the letter and the forms, or date them for when you sign it, either way is fine. But it is going to be a hassle later to get them, so take 10 minutes to fill them out and sign them. There is a sample letter of intent here on VJ and you just change it to put in your names and addresses, won't take but a couple minutes, but it could move the date up of your fiance sending in the package several days. Once you get to waiting, every second counts.

My passport pics from Walgreens came in a little card that had little slits for the corner of the 2x2 size photo. Mine came with 2, so I put mine in and Josue's in the other, and taped them from the back. I didn't even label them as I felt I looked enough like a female and him like a male, but I did label the 4x6 pictures of our time together in person.

I sent about 4 or 5 photos of the two of us in addition to the passport photo of each of us, and a copy of one letter from him, and a copy of some phone records. For the initial I-129F app you do not really need evidence of an ongoing relationship, only evidence of having met within the past 2 years. Be sure to date and explain the photos. Save the rest of your phone records, emails, chats, etc. for the interview, and make sure for the chats you don't just copy and paste into a Word document because anybody can do that, take screen shots so it is original.

From what I understand, having a lot of unpaid child support can prevent you from getting a passport, which is apparently why he can't travel to meet you. Have you two thought about meeting in Canada? If he can't get a passport he won't be able to go to Mexico either, but Canada may possibly be an option, I'm not entirely sure about the rules for travel. I know years ago my family and I went to Canada to the Niagara Falls and we did not have a passport. This might be something to check into.

You must have ALL your bases covered before saying that there is no way for you to meet in person.

Not to mention if he is not caught up on back-owed child support, how does he propose to support you and do the financial information needed for the I-134/I-864???

When I sent in my I-129F package, everything was in English except a letter from my fiance, which I only included as extra proof of our relationship. Will this affect the approval of our application at USCIS?

Also, for his interview we plan on printing out some Yahoo messenger chats, which are also all mostly in Spanish. I am assuming that his interview will be conducted in Spanish (at Embassy in Guatemala City), but since it is a US consulate, will we need to get these chats and other documents requested like his Birth Certificate into English? Or for the purpose of the interview (if it is in Spanish) will I need to get my BC and my Divorce Decree translated into Spanish? I'm so confused! wacko.gif Thanks!!!

You should be fine and I wish the same for myself! I was also separated in January 2007 and although we did not have any kids, we sold the house fairly quickly, and did not have anything but debt to separate, he refused to sign the final divorce papers and so it took 3 times as long as it should have. By VA state law we could have been divorced in July 07 but it was not final until September 08. As soon as I got those papers we began gathering everything else for the K1 app and sent it in Oct 08. Pretty sure they can't argue with that because the fact is, as the others have said, you are free to marry on or before the date you send in the application. Good luck! good.gif

They provided an envelope with a different PO Box number than where my K-1 petition was sent (and the envelope says "ATTN: RFE").

My question is whether I should send it certified mail, return receipt requested.
The last thing I want is to mail it back and have it get lost obvioulsy.

What u should do it whatever the amount u need, u should ask ur family to make "MONEY ORDER"/or write the "CHeck" and send it to u
By either EXPRESS MAIL/FED EX,to be safe.
