My fiance and I met in August of 2008. We did most of our contact via telephone. Only problem is that I have switched carriers since then and am unable to get phone records dating back that far. Is this going to be a problem? We didn't know that we would need phone records until we actual started to research the two of us getting married and bringing him here.

My fiance has a daughter. We listed her on the K-1 petition. But he does not have legal custody of her as of yet. So our plan is to get him here and then work on the legal steps that we need to take, so she can come and live with us here in VA. Has anyone been down this road before? Can anyone offer any advise?

My fiance and I are gathering all of our forms as well. From my reading of the K1 Visa Guide, you should make a copy of the (one page) form and have your fiance sign all four copies. At least that is what we have done. Hope that helps you out some. Try reading that Visa Gude though. It help clear up a lot of things I had questions on. good.gif

Before you send in your 129, have a very good understanding of what the Visa Process is all about. The better your 129 Petition is, the easier the interview will be. Keep in mind, the Visa Interview Officer is not bound by any rules or regulation, only his Professional and Personal Opinion, that you have a bonafide "real" relationship. Read as much as you can on denials here, and you will see what not to do, as well as what to do, in regards to getting a Visa. An "EOR" , evolution of relationship, letter with photos, showing your relationship from when and how you first met up until you send in your petition may help the Visa Officer get a clear view of your relationship. Having met in person 1 time is required, but more than once is better. I had my "Intend to Marry" document notarized at a bank. Problably no need for notary, but did it anyway. I ask this question on the site CFL, Candle for Love. CFL is for people applying for China Visas. We were denied K1 29 December 09. I ask on CFL if anyone had just applied again for k1 after denial. There was no replys to yes. Most said better to Marry and apply CR1. Later one person did post that they were denied K1, applied again in a very short time, had another interview in 7 months and got Visa. I am going to China in March, get married , and then apply CRl in April. I now wish I had applied for K1 on 1 January. Would possible have an interview July or August. Now it will be who knows how long for an Interview. I too only had 1 trip of 3 weeks to China, My Girl missed on one question as to what my former job title was in 1994. Good Luck............

Hi all,

I got a PayPal debit card with my fiance's name so she could use it in China - not that she needs/wants to. I'm also adding her as the primary beneficiary on my life insurance policy from work. Plus I'll wire her some money (for studio photos) before I see her again.

While the documentation from these can be used as financial evidence for I-130, could the same be used for proof of relationship the K1 process?

If it's beneficial, would it be better for PayPal debit card transactions to occur at regular intervals - ie weekly grocery purchases?

At my Fiancee's December Interview, she was asked 2 times, "How many times did I send her Money". She said 5, which was correct, 1 time at december for Christmas, and 4 times using Western Union anfer my April visit until December . I did not send any large amounts. It is very difficult to read how Guz thinks on any given day.

Arg, yes, lol. If it weren't for me being such a high-stress, nitpicky, plan-ahead kind of person we'd probably be in an even bigger mess. I was in Ireland with him for nearly two years but I came back to the US last June because I needed to get a "real" job. We were going to have him come over on a new 12-month intern J-1 deal that the US and Ireland made. Then I came to VJ and started reading all around the place and discovered the possibility that he'd be subject to the 2-year foreign residency requirement. So I made him call the embassy info line and, lo-and-behold, he would have been slapped with that restriction if he did that visa. Thank goodness we realized that. Now it's just become "simpler" to get married. We've talked about marriage a lot, but weren't planning on doing it for another while. But now it's reached the point where we just need to do it if we want to be together and give up this long-distance BS for good! But it's a long road ahead still!

Well where do we start.

Yes, he needs his Social Security Card, once one is issued to someone that is their number for LIFE.

He had to fill out tax forms and should have kept them for 5 years ?? Does he know where they are ??

HHHuuummm next question or two (laughing)

1) Can he get and E-visa to visit then go to the SOCIAL SECURITY office and have them look him up ?
They won't do it online or over the phone .. only in person and he has to have I.D. Passport and another
picture I.D.
2) Have him think think and think if he has anything online or on his computer that may have it.

The other choice is to not mark anything in that spot and hope he is approved for the K-1 Visa and when he
gets here he can go to the Social Securty office. Problem is then you will have to say it is your mistake not his
that you didn't know he had a Social Securty Card OR .. he will be in trouble and could face Deportation for not
answering the questions Honestly.

If you say you filled them out mistakes can be correct. TOUCHY though you have to be smart and remember it is
and was always your fault thinking he didn't have one until he tells you differently when he got here.

The UK can come here on a visitor Visa very easily... to me that is the best way. The Cost is tough but it would be the best.

(LAUGHING) for us that had someone half way around the world the cost from the U.K. to the U.S. would be a blessing.
Mine is from the philippines and have been the 4 times in a year. COST 1200 to 2700 round trip as well as the cost of staying there.

Thanks for the reply. It's even more of an awkward situation actually, lol.

He never filed taxes after that summer. Yeah. Smary guy, eh? He was 20 and just came to have a wild and crazy summer in America, not thinking he might meet an American later that year that he'd ultimately want to marry.

So yeah, he doesn't have an tax info and doesn't even know what a W-2 is. He's going to check at his parents house to see if he happens to have any documentation from his job that summer, but I'm pretty doubtful he'll find anything. Could he call his old employer and ask for a W-2? Would that have his SSN? (I haven't gotten my one from this year yet, co I can't remember if that's printed on there).

He's in the Republic of Ireland, which is not a part of the UK, but yes, he's still able to come on the VWP and he actually gets cheap flights through his dad, so it wouldn't be a total disaster if he had to come here for a quick visit.

And now that I've mentioned it, is the fact that he didn't file taxes a reason to be denied the K-1? In reality he would have been entitled to a refund rather than owing anything, but still, he should have filed.

I'm new! Been lurking for months, but I just formally joined a few days ago and this is my first post.

Anyway, my boyfriend (Irish) and I (USC) are soon to be officially engaged and I'm planning on filing the I-129F in April. Yeah, I like to plan ahead, lol.

On the I-129F under Part B. Information about your alien fiance, there's a space for the fiance's U.S. Social Security #. My boyfriend did come to the US for a summer work/travel J1 back in 2005 so he does have a SSN. Problem is, he doesn't remember what it was and doesn't have a card. :unsure:

Do we need to figure out what his ssn is? If so, how do we do that?

Would he be required to use this same ssn when he comes over on the K1 or would he be applying for a new one?

My father is sponsoring my British fiance and I, because I fall beneath required income lines. The Affidavit of Support calls for the past 3 years of tax information, and responding a little too enthusiastically, my father dropped a hefty pile of papers on me. My question is this: what tax forms, exactly, do I need to submit? I have an obnoxious amount of paperwork, but I don't want to leave out anything, and risk getting delayed.

Hopefully someone more knowledgeable will come and reply, but I don't see anywhere on the I-134 instructions that asks for 3 years of tax returns. It asks for bank deposit info, letter from employer, other proof of assets, etc. The only reference to tax returns I see is for self-employed individuals and even then it only requests the last year's return.

But I haven't actually filed yet, so I don't have first-hand experience with what's necessary.

Start with the guides, go from there.

In my humble opinion, you might want to work on building the relationship longer before jumping in the deep end. It doesn't sound as though it would be an easy move for her and you're right, it would take 60-90 AFTER getting married and filing her Adjustment before she could travel (or work) using her AP (or EAD).

Communicate via instant messenger and webcam, write letters, get to know each other better and plan another trip out there in a couple months. Take your time getting to know each other. It can only help you along every step of both your visa and your life journey as a couple.


I agree. I'd really extend this relationship beyond two weeks before committing yourselves to each other for the rest of your lives. Many people on here have done the long-distance relationship thing for a couple of years. Better safe than sorry.

We will be doing the civil ceremony and the formal event/big party a year or more later. I plan on making the civil one about "just us" and going out to a special dinner and a fancy hotel for a night. While I originally felt cheated at the thought of having to get married in a courthouse I've come to cherish the idea of beginning our married life with just the two of us, focused on each other and no one else.

We'll be exchanging rings. I'll be changing my name. We'll be putting bills and all that in both of our names. I'll refer to him as my husband. It's a real MARRIAGE whether or not there's a conventional WEDDING. So I honestly haven't thought of what other people will think when we become a married couple sans the big party. No doubt our families and friends will become very familiar with the process we're going through so it should just become every-day to them. I assume you're not planning on keeping the whole K-1 process a secret from family and friends? So they will know and understand. There won't be a surprise all of a sudden that you're married out of nowhere. And it won't be odd for you two to refer to each other as husband and wife after the civil ceremony. Everyone will know it's coming.

I don't believe she needs to leave and come back on a special visa. A quick Google search yielded this page:

Which says "If you or your future husband, wife or civil partner are not nationals of the European Economic Area (EEA) or Switzerland, you can visit the United Kingdom together to get married or register a civil partnership as long as you intend to leave the country within six months."

Click around the rest of the links on there and you should be able to get most of the info you need. If she wanted to marry you and STAY in the UK, that would be more complex. But I THINK it's like the US in that you can come over, marry, and go back home with no problem. But do your due dilligence to find out all of the regulations and laws.

I don't know UK rules intimately so don't quote me on anything. I just know how to use Google most of the time. :thumbs:

I'd just get married now and file for a CR-1 spousal visa if I were you. The CR-1 takes about the same amount of time and gives the beneficiary a green card and the right to work upon entry into the US.

I'm pretty sure you can begin the filing process while she's in the UK with you and finish up the process after she goes back, but someone else should be able to confirm that more definitively.

I have essentially the same situation - living with parents right now but plan on moving into an apartment right before my fiance comes over.

I just put my parents' address. I'm pretty sure you can make address updates later on, and use the new address after the fiance enters and you apply for AOS.

I agree. The caveat is that there's no guarantee he'll be allowed to enter the USA for the wedding. Expect a problem if when asked "purpose of visit?" he answers, "to get married". He'll want to give a truthful but more generic answer to that question, like "holiday" or "to visit family and friends". He should also bring evidence he's expected back at his job etc. It's a very frequently discussed issue, so you can read up on it.

I know personally of one example where the groom was sent to secondary inspection upon arrival and they say a marriage license in his briefcase. He was denied entry, couldn't attend his own wedding or go on the paid for honeymoon trip because the flight left from inside the USA. Be very careful about planning weddings with foreigners entering as visitors. It's legal but entry is never certain.

Hi, everyone! So far I'm finding this forum VERY helpful.

So here's the situation. My fiance is from the UK. We have been planning our wedding for nearly a year now and have everything booked and set to go for July. Now, up until about two weeks ago, our definite plan was to get married in the States and have him go back to continue working and find us a place to live while I applied for a UK spouse visa. Just recently, I was given a promotion at work and we have decided that financially speaking it would be better for us to live in the States for a couple of years until I can work my way into a transfer to the UK through my job. Based on your experiences or your understanding of how this visa system works, should we even bother applying for the K-1 fiance visa or should he go back to the UK after we get married and just apply for a spouse visa or a green card? Our only worries about him going back and waiting for a green card is that he is currently a student and has to move out of his current housing arrangements by June. Since we're not planning on moving there any more, he will not have a place to stay unless he lives with his parents (which is not a problem but is still not appealing to him for various reasons). Based on what I've seen, green cards are taking a very long time to process, which is another concern of ours.

Anyways, the question again is: Should we apply for the fiance visa since we are locked into our wedding date and it is less than 5 months away (the current processing time according to the visa website)? Any advice is welcome!


You really can't do the K-1 if you're unwilling to change your wedding date. He has to be your "fiance" when he enters the US on a K-1, not your "husband". I would not apply for the K-1 with the hope it will be approved in time for your June wedding. I think that's unlikely.

Wait until you have your wedding and then apply for the CR-1.

Or you can go ahead and get married now in a quickie legal wedding, apply for the CR-1, and still have your bigger wedding in June for friends and family.

The fiance and the spousal visas take around the same time roughly but things change month to month based on USCIS workloads. To be on the safe side I'd plan on a 6-9 month wait for a visa, whichever way you go. If it takes less time that will just be a bonus.

Okay i'm assuming that your fiance is the foreign one and if so, he is correct and you are wrong. His form has his current address listed as Ireland, therefore any job "abroad" is anywhere other than in the country where he is. On my K1 I had nothing to list, now I am in America I must list my last job in Australia.

Re the date, yes. Neatly write the additional 0.

Re blacking out the details, even if it WAS wrong, you cannot alter it like that, looks like you're hiding something. He would need to send another IF it was wrong. It's not.


Really? It seems to me that since it's a form addressed to a US government office IN the US then "abroad" would mean outside the US.

But I will leave it untouched anyway. Even if I was right it's probably not a big deal. I'm just so annoyed at having gone over and over these forms and still having niggling mistakes like the date missing the zero and having other confusion. Too much stress!

I'm so annoyed because even after going back and forth repeatedly over the documents my fiance needed to send me, I still manage to find errors after I get them from him in the mail. :angry: It's as much my fault for not noticing when I was focused on other mistakes, but grrrrrrrr so annoyed.

Anyway, I'm thinking this won't be a big deal, but on his G325a he answered the question about "Last occupation abroad if not shown above" and put in a two-month job he had here in America on a summer J-1. I took this answer off when he sent the first version to me but he stuck it back on and I never noticed. Obviously "abroad" means outside of America, but to him he automatically thought "outside of his own country".

I met with a Columbus field officer today who told me the following:

We can get married when she comes to visit. Then she can stay as we apply for a green card, a work permit, and a travel document all at the same time. When she gets her travel document and work permit, which he said would be before Christmas, she can go back to Australia or anywhere else but not before. We can vacation there over Chstistmastime, and come back while she waits for her green card.

Here's what he told me:

Get married
File I-130 Petition for Alien Relative ($355) (all of these filed at the Chicago Lockbox)
File I-485 Application for Permanent Residence or Adjust Status ($1010)
Including: G-325, I-864 Affadvit of Support, I-693 Medical
File I-765 Work Authorization
File I-131 Travel Document
Wait for I-131 and I-765 which should come fairly quickly, within three months - then free to travel or work
Wait for Green Card

I hope this is right, this would work for us really well by minimizing purchases of plane tickets. The one missing link is we think she has to show that she has return transportation before entering. Would a train ticket to Canada be good enough? And we have to declare that we didn't intend to marry until she got here, right?

You'd be LYING if you said you didn't intend to get married before she came. See the problem there? Lying is not the way to start off your immigration journey. You'd be committing fraud if you did it this way. Since you already plan on getting married you need to file for the correct visa. Period.

I'd stick with the K-1 plan. It's only April right now. You can probably get the I-129F petition in the mail next month and get the ball rolling. If you do the CR-1 you have to wait until August (when she comes to visit and you can get married) before you can even think about starting the immigration process. That's just adding more time apart in the long run. I would start the K-1 process asap. She will probably not get through that whole process before August, but if not, she can come visit you and then go back to Australia to finish the process up and get the visa. Then she can re-enter the US on that.

(And to clarify, yes you are allowed to marry if she just comes on a visit. She's just not allowed to stay indefinitely afterward. She has to go back to Australia.)

It's my understanding that once he has the actual visa in his passport he has to use it the next time he enters the US and then has to stay put until either AOS is approved or he receives advance parole. Hopping in and out is not going to be an option.

The case number will be written on the 1st NOA you'll get from USCIS. I never heard of it being on the check.

For my information : how can you look at the check you sent after it was cashed ? Do you work at the bank where USCIS cashes their checks ? I'm confused about that but maybe I didn't get it right.


If you use online banking sometimes your bank will post images of checks you wrote that were cashed. This is how people get their receipt number before receiving the paper NOA1. They view the check image in their online banking, which has the number stamped on it.

Okay, so I checked my bank account today and I see that the USCIS cashed my check. So I have a couple of questions now:

First, I was expecting them to forward my petition to the lockbox, but they only received my petition last Friday and already they've cashed my check. Plus, on back of the check, it is stamped "Vermont Service Center" Does this mean my case was not/will not be forwarded to the lockbox? That should save me the 6 to 8 week delay that was mentioned in another thread if so!

Second question: Which of the numbers on the back of the check is my case number? I see no numbers that start with any letters.

I-129F petitions for alien fiances are only processed at Vermont Service Center or California Service Center. They are not forwarded to any lockbox. It will stay at Vermont until it is approved.

Your receipt number that you can use to check your case status on the USCIS website should start with EAC.
