hi,

This e-mail is not for me it is for my sister's case. The case is in US embassy located in Pakistan.

The embassy sent us an e-mail with packet 3.5 in it on September 24th. We did not recieve it. We have three main question

* Are we going to recieve a paper copy of that in mail?
* What is the contant of that e-mail if it is for packet 3.5
* Does a police department require any decuments from the packet 3.5 inorder for them to creat a police report?

I will highly appliciate any feed back.

Ok, here is the situation. This question is from my sister and her fiance.

My sister is in Paksitan and her fiance is a US citizen. He has applied for a K-1 visa for her. They have recieved a 3.5 packet. Which requires for them to collect a police report for my sister from every city she have lived in for more then 6 months since the age 16.

My sister went to china as an international student and she was never a resisdent there. She pretty much stayed on campus during her stay in china. She never made any friends or know any relatives. She has no contacts in china. At this point she can't obtain a police report from china unless she travels back to china. Her police report for Pakistan is clear.

Is there a way to wave her requirement for a police report from China? Since it is almost impossible to get it.

Any information will really help. We are really worried.

y2catalyst -- Think about how long you spent on waiting and processing this stuff. The one poster is right -- immigration is not a right and another is right when you say you can overcome. Waiting a little longer will be worth it if you can focus. Don't waste energy on the blame game of events occuring at the interview or events in centeruies past. You need resolution on what the denial was for:

a. Chinese National doing interview? We are required to hire so many nationals when we have an embassy in foreign countries? I know normally on military bases over seas there is that requirement. If so, Chineese sentiments towards the US are not always good--could be the issue (which is reportable and fixable).

b. Maybe something was discovered in her background (previous marriage not dissolved--criminal record) could be something (lets pray not). If, god forbid there was, then the process saved you time, money, and future potential problems if this is the case.

c. Don't assume anything--there is a way to find out and report any abuses of the system by the interviewing official.

Best wishes and refocus your energy to taking positive steps towards getting the woman you love here with you--don't waste too much energy on unknowns.

For employment letter he can just go to his Personnel Office and ask for a "Statment of Service" it is a standard form that states he is still on active duty in the Air Force.

As far as apartment/house... if he lives off base it will be shown on his Leave and Earnings statement as BAH or Basic Allowance--Housing. If he lives on base or government barracks then he could have the Personnel Office include a sentence on the 'Statement of Service' stating that fact and that "If married and residing on the economy the service member will draw $0,000 in basic allowance for housing based on zip code 12345". Not sure if that matters to immigration since he is military and has an exception to the income percentage above poverty level requirement.

Honesty is always the best policy. People meet others while separated and if there is concern or question about the facts then as in my fiance's interview they will ask for more info where you can explain the circumstances.

It is always easier to remember the truth then it is a string of even little white lies. Not even sure what the 'white' in little white lies means but something mom always said. Think it was her way of getting me to tell on myself :)

Hi all. I haven't been here in a while... Just waiting for some sort of answer. I have been to Ukraine 3 times now. It is so painful to be apart from her. This feels like we are wasting so much good time right now.
We filed our I-129F on July 8th. We are currently on the "decision" button.

My question is: When we get our "decision" and assuming it is accepted, What is our next step?

And 1 more question: On the "Proof of income" Since I am self employed, What do I need to show? and more important, when?

Oasis? Why so hostile? I DO have patience. I am very patient. We both are. But when we see someone elses petition get processed in 1/2 the time, we start to wonder. We have been extremely patient. Just very anxious!
Why did we file? Hmmmm. Maybe because we are madly in love, and want to be together forever... And this is the only way. And if for some reason, our visa gets denied, Then I decided I am moving to Ukraine. We must be together, there is no other way.

I can tell you, our immigration attorney advised us that: Please note that the immigration filing fees will decrease after November 23, 2010 so we could definitely hold off on filing until then.

Not sure when you filed, but maybe that was the issue. It went from $455 to $340 (if I remember correctly).

Hi everybody !
I am French and my boyfriend is American, we plan on doing the K1 visa one day but would like to live together for a few months without being married before deciding this.
The best place would be Ireland because he could get a Working holiday visa and I could live easily there because I am European.
The K1 visa taking at least 6 months, we were thinking about starting it while in Ireland after a few months to be able to live together in USA directly after.
Does anyone know if we are allowed to do the whole procedure while in a foreign country or if it requires a lot of paperwork ? If just a little paperwork, we could follow our mails to Ireland.

Been through on that too..... I must say its bureaucracy. I am not even so keen with their standards. On my xray during my medical, they told me I have scar in my lungs and have to go Sputum Test... and blah blah which took 2 months. That was so damn 'coz a month before having medical, I have over-all check-up at St. Lukes Medical Hospital which is 100x better than them.

Maybe if US embassy will have at least 2 choices on where do you want to have medical, then you have second opinion, and they will be more critical with their diagnosis.

Philippines has a prevalent TB situation, hence, everyone WILL most likely get s positive test. Were her employers specifically testing for TB then as well? How long ago was this?

There is no such thing as handling it Filipino style, St Luke's is 'governed' by the US Embassy/US Dept of Health/CDC. When I had my sputum test there, both DOH & CDC were there to observe their procedures to make sure everything was being done as they want it.

Lastly if you already have an interview date, yes, STL will reschedule for you. If not then you would need to handle that yourself.

The odd thing here is that she spent 71 of 72 months in Taiwan between 2003 and 2010 and received biyearly exams, including chest xrays just like the one last week at st. lukes, without any issue. She has only been back in phil for 6 months so it seems unlikely there would be scarring already or that it wasn't previously noticed.

First, if she even offers to grease the wheels with cash (which I assume is "Filipino Style" then she will never get a Visa for the US.

In the Immigration process the only thing you should ever handle this was is expediting getting paperwork, not changing the contents of that paperwork.

Regarding "Knowing the scar is BS", a few points:

1. Why would you trust a medical from an employer who is financially motivated to keep her health records clean over a medical for US Immigration purposes that is motivated to protect the US from infectious diseases?

The company is motivated to keep there employees healthy and there production lines moving. It is not likely they would let something go and risk infecting a highly trained workforce.

2. Wouldn't you prefer to know if she is positive for TB and have it treated ASAP?

My concerns are it is a false diagnosis considering the frequency of the situation based on others in visajourney and elsewhere.

3. I understand is sucks to be apart for any length of time but it this was someone else's fiancée wouldn't you want to know they were properly screened/treated before entering the US and coughing next to you at a museum?


I'm not condoning exposing americans to an illness and certainly urged my fiancee to accept the situation but this smells of something and I am only hoping to hear from people you have had similar experience. Judging by the many other similar threads this does not appear to be a rare occurrance.

Just received the "scar tissue" diagnosis on the X-RAY from SLMCEC. It seems this is commonly a mistaken diagnosis, for whatever reason. So it is on to the Sputum Testing next week and another 2 months wait. I personally believe this to be BS since she was an OFW for 6 years and had medical exams and x-rays every 6 months by the employer. My fiancee wants to "handle it filipino style" to get her approval. Would like to hear any comments from others who have been caught up in the same BS. Also, my fiancee said SLMCEC will take care of rescheduling the interview. If anyone can confirm this I would appreciate it since my deadline is Aug. 9th for rescheduling. Thanks.

My fiancee was flagged for a sputum test during her medical exam at st. lukes in August - a 2 month delay. In a couple of weeks we should be getting the call with the results. Assuming the test is negative, should she travel to manila to coordinate with st. lukes the reschreduled US Embassy interview or can that also be done by telephone? We don't want to uproot her son from his classes to travel to manila and then wait however many days until the interview is rescheduled.

If you have a US passport, you should have gotten your passport stamped when you entered Vietnam.

A lot of people are here saying "here is a sample letter of intent," well a lot of good that does you now that you have already sent the one you wrote in your original post. Just as an idea, you can have your fiance sign one and go ahead and send it to you in case you do get an RFE. That way, you will have it ready to send right back to them.

To the OP, is this your letter of intent or how we met answer (Q 18)?

If it makes you feel any better, I wrote a long letter for Q 18, including a few romantic moments, and at the end wrote "We plan on being married soon after he arrives at the Circuit Court in ****, VA" and I signed it. This was my #18 AND my "letter of intent" combined. I did not have a letter of intent signed by my fiance. Of course, I also hadn't found VJ when I sent in my I-129F package. However, I just received my NOA2 and did not get an RFE. If anything, depending on who adjudicates your package, you may get an RFE, but most likely not denial.

This topic seems to be well answered, but just wanted to add that all I had was phone records and a screen shot of IMs over a several month time period (after I figured out how to save them in the archives). Oh, also a couple letters of snail mail with envelopes back and forth. We didn't really email each other that much, we did a lot of text messaging and phone calls. So as long as you have communication and can prove some form of communication you should be fine.

That could be - they didn't check the rest once they figured out one was missing. Send the originals (and make sure it is obvious it is the original, sometimes with black gel ink it looks like it could be a copy).

You don't have to have known each other for a full 2 years, just have proof that you have met in person within the two years prior to your filing date.
For example, you start dating May 2008
He visits you/you visit him/whatever July 2008
You can file immediately after July 2008, you do not have to wait until July 2010 to file, but you have to file within 2 years of the last time you saw each other.

We didn't have any problems at all. Just make sure you get the official divorce papers, that all the dates are correct, etc. For me, this was after a 21 month separation (and my state only requires 6 months with a Property Settlement Agreement and no kids but the ex wasn't cooperative with all the papers).

Also, if you have only met once, I would recommend you go again or at least plan to before the petition is filed; I had already bought my ticket for my second visit when we filed for K-1.

That is fine. The divorce just has to be final before filing K-1 and you have to have met the K-1 beneficiary within two years prior to filing K-1. I had the same situation as you (met July, divorce final Sept, filed K-1 Oct)

DCF only works if you live in that country and I think you have to have lived there for a good while before you can file.

My mother-in-law was 14 and father-in-law 21 when they got married. They just celebrated their 27th anniversary.
I graduated high school at 16 and never went to prom.

As has been mentioned, he did not come here to ask for advice on whether they should get married now or wait, he was asking about the legality of the situation. He needs to check with his local courthouse to see the laws on marrying an underage (less than 18) non-US citizen, and not file K-1 until those conditions are met.

I wish you two the best and just pray about your situation before you make such a life-long decision!
