IR-1 / CR-1 Spouse Visa Process & ProceduresApproved
Thank you,

Tha child, ofcourse is mine. (I am sure you were asking if i adopted him or if my spouse had it before me marrying her. )

Everyone points me to Linches Shoritcuts, however it does not talk about someone in a situation like mine , ie, having not just spouse but an infant child.

Curious to know what others who have gone before me at NVC with similar situation had to do.

Thank s

2. Since i filed two seperate petitions do i have to file two seperate 864s , one is for my spouse and the other for my infact child ( 2 yrs old)

3. Do i expect NVC to assing two different case numbers
4. Can i simply email instead of sending in DS- 3032 and can i send it now

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE - How long can it take?
Dont know how long RFE review takes.......but I hope and pray for all that it does not take too long

My IV package was delivered on the 3 Aug, and was scanned on the 4 . Then I recieve a RFE email on 8th for DS-230, the operator says ignore it, becasue the package has not been reviewed.

on a seperate case, Checklist was returned on 9 Aug, and entered in the system 10 aug. The AVR keeps saying, "Document missing or incomplete..."

Frustrated here as well.........I can still login to the site. smile.gifsmile.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresCase Complete!
congratulations Mrs. Palmer. You are almost there. I remember you from our CSC transfer days

I still wait to hear anything and everything form NVC. I thought USCIS was worse but now find out, NVC is the worst. All they have to do is line up the documents and mail it to the embassy. They dont need to look into details of the applciation. Then why cant they just open an envelope entered into their system on Aug 4 and Review. I have spoken to the operators and all they have for me is, " the package is not revies, Takes 2-6 weeks. "

Now what???

very Frustrating ranting33va.gif

IR-1 / CR-1 Spouse Visa Process & Proceduresdo we send a cover letter with DS230?
QUOTE (savina @ Aug 27 2009, 12:08 PM) <{POST_SNAPBACK}>
hey trailmix thats exactly what i did...photocopied the originals and got them certified by a person who is in a position and designation to certify. We have a confirmation now frm NVC that its okay to send them.I will take teh originals to my interview. They can keep the certified ones.

Igg my hubby and I have been stressed with this so he just called NVC and they said certified copies are fine.So we are sending the original certified copies and an extra copy.

Hoping and praying that all goes well:)God willing!!

My take on this,

If you ask NVC if you could send a certified copy of the originals , then NVC will ofcourse say "yes" because they only know the word "Certified Copy". They do not know how the certified copies are made unless and until explained. For example , in the case of the russian documents it was , i am sure , explained why the certified copies were not available and therefore they accepted the "photocopies of the originals and notarized."

On the other hand , the word Certified copies of the original, in governmental term means a copy of the original that is certified by the issueing agency, not by a notary or some clerk or someone else not related to the issueing agency. It is very important to know this difference.

For exmaple, say a person was divorced and now gets married to a foreign spouse and is filing I-130 for the same. Then the Certified copy of the Original Divorce Decree is required. To obtain this, that person goes here in America, to the Circut court of the place where his divorce took place and was recorded. Then he requests a copy. The clerk will produce a Copy of the Final Divorce Decree and will Sign and Seal it with whatever that Steelmade Pinching Stuff, that creates a Raised Seal. when signing, The Clerk writes "Certify Copy of the original as maintained in this court"

Now on this doucment becomes and will be accepted as the Certified Original Copy of the Divorce Decree fo that person. He can submit this to any government Agency as the Original, because the original Always and always remains at th Circuit Court.

Therefore, the word here, Certified Copy of The Original is not to mean a photocopy of the original and thence Notarized by any Notary. NVC will not accept that.

Hope this helps....smile.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresBirth Certificate Example - Nepal
Sherpa Bhai , Tettile pugla ra smile.gif

mero bichar ma you can go to eithr Kathmandu Nagarpalika or the place she is from, and have them make one. her mother can claim the date of birth. besides, she can use her Nepalese citizen certificate have them register her birth and create a certificate. once you have the original, get it tanslated in english and notarize it . mero bicharma Kanun Kitab Khanale tranlate garna chodeko suneko chu. tetti bhay NVC lai pugcha.
There was no system to register Nepalese birth at the time. Sabai lai tha bhayekai kura ho. Tesaile yeta pani herau:

Birth Certificates
Available. Reporting of births is voluntary, and records are not standardized. The best available evidence is a typewritten or handwritten letter with rubber seal issued by the secretary of a Village Development Committee (VDC) or mayor of a town where the applicant was born. If the child is born in a hospital, a hospital birth certificate can be issued upon request, but this document usually only records the date of birth, sex of the child, and the names of the child's parents; the name of the child may not be included. Effective April 13, 1977 the Government of Nepal required birth certificates to be issued from the Local Registrar office for the first time in ten districts of Nepal. The districts covered are Banke, Jhapa, Kathmandu, Kanchanpur, Kapilbastu, Mahottari, Morang, Rautahat, Saptari, and Sarlahi. This requirement was later extended to other districts: Bara, Dhanusha, Parsa and Sunsari on January 15, 1979; Siraha on February 13, 1979; Nawalparasi and Rupandehi on March 14, 1979; Bardia, Chitwan, Kailali, Kavrepalanchwok, Kaski, Makwanpur and Palpa on April 14, 1979; Bhaktapur, Lalitpur and Surkhet on February 13, 1980; Dang on March 14, 1980; Dhanding, Nuwakot and Tanahu on December 15, 1980; Dhankuta and Ilam on January 14, 1981; Jumla on March 14, 1981; Gorkha on October 17, 1981; Sindhuli and Udayapur on December 16, 1981; Syangja on January 14, 1982; Sindhupalchowk on February 12, 1982; Rasuwa on March 14, 1982; and eventually covering remaining districts Achham, Arghakhanchi, Baglung, Bajhang, Bajura, Baitadi Bhojpur, Dadeldhura, Dailekh, Darchula, Dolakha, Dolpa, Doti, Gulmi, Humla, Jajarkot, Kalikot, Khotang, Lamjung, Manang, Mugu, Mustang, Myagdi, Okhaldhunga, Panchthar, Parbat, Pyuthan, Ramechhap, Rolpa, Rukum, Salyan, Sankhuwasabha, Solukhumbu, Taplejung, and Terhathum on April 14, 1990. Births after the effective dates corresponding to the districts must be reported to the Local Registrar office in order to obtain a birth certificate. The certificate generally contains the parents’ names, applicant’s name, date and place of birth and the signature and stamp of the issuing official. The certificate is a printed form in which the birth information is handwritten. The birth evidence prior to these effective dates is usually documented by the VDC or a ward office of the locality by issuing a certification to that effect. IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Clearance certificate from Nepal
These days, the only two places you can get PCC from nepal are Naxal and Maharjgunj. However, any one that needs to get a PCC from goes to Naxal, and fills out a form. It will take a day for you to get that.

here is the link for the Nepal Police, and I beleive , it is called ChalChaln Certificate. You can take a look at the format. http://www.nepalpolice.gov.np/

Sherpa, Do you have any idea how long the PCC is valid for ? Is it 6 months or a Year. Cuirous to know, an will appreciate any help in this regard. I am waiting for any news from NVC at this point for my spouse case.

Thanks
