The only way to help you avoid RFE is to provide all kind of envidences which you are having now, you will have to classify the proofs you have first. And for every kind of proof, you should supply just enough.

Thanks for your comments and advices.

- Yes, we keep all our emails from Dec 2005 till now. I did submit them in the first interview, not all but randomly (2-3 emails/per month ). I also printed all folders of our emails with sorted date and gave them at that time. Also his first email to me by asking me to remember him...etc.. and some emails in 2006 to ask about my hometown, my family ..etc.. But you know, of course, they didn't have time to read and verify in the interview even i pointed sad.gif.
- They also kept all our pictures in engagement ceremony and trips.
- We are lucky to have all our parents birth certificates in hand (my fiance's father is now 79 year old)
- Yes, we will bring more evidences to the next appointment.
- Our families, absolutely, are not connected but how to demonstrate to CO except parents birth certificates as they required. Please help to guide me. (My fiance's family in US. My family in VN . No one in my family either my farther site or my mother site is in US as well. We and our parents were born in totally different places in VN)

Dear All,
I got blue sheet in Nov 24 after 40 mins interviewing with CO. I felt very sad and dismayed and so did my fiance

1. My case

- We are all IT engineers. Neither of us has been married nor sponsored for immigration.
- We met in person at Cafe shop for the first time at the end of Nov, 2005 basing on our friends' arrangement. After that my fiance went back to US and sent the first email to me from begining of Dec, 2005
- We kept mailling together during 2006 and 2007 in term of friendship as we all tried to work, study and understand more.
- During 2008, our mutual affection grew overtime and the proposal was given in Dec 2008
- In Apirl 2009, my fiance had the trip to VN with his eldest brother and we had engagement ceremony in begining of May 2009 (meeting 2 weeks)
- After that my fiance returned to US and processed K1-visa for me at the end of May, 2009
- We are both no longer young. We want to have babies at the earliest


During the interview, i did answer all questions from CO well.

After that he looked at my passport very carefully since he asked my why my fiance not visit me during 2006, 2007 and even 2008. I answered that he worked for startup company during that time, he just had 10 vacation days but his boss did not allow him to take a long vacation. I also traveled some (Europe, Asian, Brazil) as my job required. I forgot to inform CO that we were in the time to try to understand each other .. sad.gif

And CO asked me to write a sworn statement in paper that I and my fiance are not relative. i did not have any relative in US as well. He also asked me to raise my right hand for swearing. I did because it's true. Does anyone have the same as my situation, to do like that at the first interview?

(My mother and my fiance's mother have the same last name, it's NGUYEN. But NGUYEN is the most popular last name in VietNam sad.gif )

Finaly, he gave me the blue sheets with three items

- A signed, sworn notarized statement that lists names of those living with me at my current address
- A sworn, notarized statement that details chronology (timeline) of your relationship
- Original birth certificates of my parents and my fiancée's parents

2. Our next plan

- My fiance will come to VietNam and will go to the next appointment
- I don't know it's good if he meets the CO in advance (before one week) or not?


Could you help to give me some advices and ideas? How can i get PINK in the second appointement? I really want to be with my fiance in ChristMas and New Year. Please help me

Senator Fienstien. Contact Martha Flores. First go to web site & download the form & send it. They will not respond to calls until you do that.
In my case she tried to help but really didnt do anything in the end.
You can also use Senator Boxer.
They all have offices throughout Ca but best to use the S Fran offices.

You can work abroad while the K1 visa is in process. You just have to return to your home country for the medical and interview.

I know that for Thailand, neither the packet 3 nor the packet 4 instructions said anything about needing tax returns, except if you are self employed (for the I-134). I sent tax transcripts for Pao to take to her interview, just in case they asked, but they never did.

For the initial I-129F app you do not really need evidence of an ongoing relationship, only evidence of having met within the past 2 years. Be sure to date and explain the photos. Save the rest of your phone records, emails, chats, etc. for the interview, and make sure for the chats you don't just copy and paste into a Word document because anybody can do that, take screen shots so it is original.



I did the same. Don't forget you need a signed Letter of Intent from each of you. Also remember photos of your meeting are secondary evidence; primary evidence are passport stamps, receipts, airline boarding passes, etc. Good luck.

If by miracle they believe that your wife is nontraditional (more likely they will believe that you have been married once and just don't want to do the whole thing all over again), but they will not believe that her parents and family are. To not have a proper wedding and engagement is disrespectful to her family. It will be very easy for them to toss your application to the side. You don't need a 300 guest wedding, but at the very least a small party at a hotel with her parents (yours too preferably), her family and close friends, and your friends.

Girls in Vietnam are so typically loyal to their foreign bf/husbands that they would never do anything to make you suspect them of infidelity. I would not apply western standards of women to vietnamese women. There are so many women who will never give you a single red flag, so why settle for one that gives you 10.

We are in the NVC process and in a few weeks will mail my wife's birth certificate. Now her birth certificate is old and handwritten, basically not that easy to read, though we have a legible certified copy and translation. Is it necessary to obtain a new birth certificate or is the original ok to send to NVC? Also, the I864 instructions say that I need to submit either a copy of my passport or original birth certificate (I wasn't US born) or original certificate of naturalization to prove citizenship. Do I really need the certificate of naturalization for the I864 or for the interview? A copy was already sent in with my I130.

You can get a Vietnamese passport in order to own property, but it's going to make it nearly impossible to resell at market value. The officials know who the viet kieu are and will make you pay an arm and a leg when doing a transfer.

This is actually a better idea. Once you pay the AOS/IV fees to NVC, you have 1 year to send in the i864 and ds230.

Please Note: If a period of one year passes without communication to the NVC, all submitted fees and
documents expire and must be resubmitted to resume the immigration process.

Well, from this moment you will have about 9 months until her visa expires (6 months from attaining visa). Once the baby is born you will have about 3 months to get the CRBA and passport and leave the country. Since you are married there's no DNA test required. If you need to stay here longer, then I'd stop the process now before you have to pay the AOS/IV bills and redo it at a more convenient time. The main issue with having a baby here would be if you have the baby before your interview and your name is on the birth certificate, you would need to get the CRBA before your wife gets issued a visa.

I was very surprised to get it because I called the NVC this morning and they said that December was filled.

My wife's interview date is scheduled for January 14, 2013 at 8:00am.

I had tears in my eyes when I saw the date. I am very very happy to finally have something to look forward to, because I want to be there for her interview.

Congrats! It seems that the interview dates for HCMC are around 3mo's from NVC case completion. I was hoping for a Jan interview date but now it looks like we'll get one in mid February.

Did she receive an Email or did she get an actual letter? My wife so far has not received a single letter from NVC/USCIS, only e-mails. Is this normal?

She needs to go to So Tu Phap to obtain the police certificate. So Tu Phap will do all the legwork verifying her information at previous residences. That's how it was for us however, every province is different. Some will require you to go to each police department first.

Do I need to give my wife a birth certificate (or affidavit of birth) if I wasn't born in the US? I have a copy of my certificate of naturalization (possibly can get the original too) and can get an affidavit of birth if required.

I would just do another translation. To be safe than sorry.

I sent it in as is. Hopefully everything's ok. Looking back, yes just another day to do the translation like my wife wanted would've been the smart thing to do, but I was stressing out so much. I handled the police certificate like a piece of gold when I sent in the IV package, without remembering to include the translation.

I rechecked my files and apparently I did not send in the translation! But after removing the translation from its stapled photocopy, there is now a small 2x4mm tear on the top left of the original translation. Is it still ok to submit it or do I need to make a new translation?

VietnamGot RFE for police certificate
Just got an RFE for a police certificate that we already sent in. I sent the original #2 that we got a week prior to sending it in, a photocopy, and an English translation, all of which were mentioned on my checklist. Should we get another police certificate? Or should we call them and ask them to recheck the file?
