I called the NVC this week and my case is now complete. I looked at the visa bulletin but dont see any thing for US citizen sponsoring foreign spouse. I asked the NVC they wouldnt' tell me. So now I have no idea when the interview date would be.

I just want to know a rough estimate when that would be. It's not too much to ask, is it? I'm not asking for an exact date, i'm just asking for a rough estimate.

My priority date is March 20 2012.


The wait at hcmc for cr1/ir1 visas is 2- 3.5 months at the moment. so if your case complete date is 1/1 you would be notified around 2/1-7 with an interview date on 3/1-4/14

According to the VJ timelines, interview dates for January are full and there are a couple of interview dates for March, but none for February. I know VJ doesn't represent 100% of the world but I'd figure there would be at least one Feb interview date. Our case completed on Dec 21 and we are hoping for a Feb interview date. It's more likely to be at the end of Feb-April since we're near the middle of Jan now, but I just find it odd that nobody has reported a Feb interview date yet.

You can email your DS-3032 after NVC has received your case. Read the links above. USCIS/NVC will contact you through e-mail for everything (in addition to snail mail) so there's no need to wait for snail mail. Using your foreign address was correct in that it may speed up receiving NOA2. The only thing is that you will need to prove your docimile (did you send proof with the I130?) in the US. It's a good thing to have a place to live set up before coming to the US. The last issue you will deal with is AOS/I864 where you would want 1-3 years of tax returns. If you had not paid taxes since you were living overseas it'd be a good idea to file back taxes immediately. Depending on how picky your consulate is, 1 year of returns (2012-2013) will be good enough.

My wife had her medical exam two days ago. The dr asked if she had any prior illnesses which she replied no because she has no infectious diseases. However, we have been treating her for an overactive thyroid for a little over a month. Her thyroid is noticeably large and so the dr asked if she knew she had a thyroid problem. She replied yes. The dr immediately chastised her for lying when asked if she had any illnesses. She did not lie. It just slipped her mind. The size of her thyroid isn't exactly something she can or had any intention of hiding. My wife replied that she thought only spreadable diseases were any issue so that is why she said she had no illnesses. She had nothing to hide because a thyroid issue isnt going to prevent her from entering the us. The dr however insisted she lied to cover up a sickness and claimed she would write in the report that my wife lied and could possibly have a fake marriage to enter the us. The dr asked why she didn't bring any medical reports. We didn't bring any of her past medical reports because I had not heard of anyone advising us to do so on here or anywhere else. She accused my wife of lying about the fact that she's currently under treatment.

The next day, my wife returned with her thyroid test results which showed that she is suffering from minor hyperthyroidism, which is an improvement from moderate hyperthyroidism that was on our tests back home (we are 8 hours away from the consulate and medical examiner). Before the dr (different one from yesterday) looked at the results, she asked if my wife brought her medical with her. She wasn't asked to bring her medication with her, so she did not. The dr called my wife a liar. She did not believe that my wife was currently on medication. The dr then threatened my wife saying that lying to a medical examiner is a big deal and that she would write in my wife's report that she lied to a medical examiner and that she lied to get into the us. That was option 1. Option 2 is to bar my wife from entering the us until her thyroid treatment is complete in 6 months. In reality, based on the test results, her thyroid will be at normal levels in 2 weeks or less. My wife cried and insisted she did nothing wrong. It was a minor slight on her part. She is quite intelligent but sometimes an airhead. Plus she only completed education to grade 9. And also, her memory has been quite terrible since the day she got pregnant and even worse after coming down with hyperthyroidism. Forgetfulness is a symptom of hyperthyroidism.

Can the dr really do this? Will it become an issue at the interview? My wifes medical came back all clear btw. I just don't see how the dr can accuse my wife of such a thing when she clearly admitted to having hyperthyroidism when asked specifically about it. If she had any intention to lie she would've kept on saying no. It honestly did not even cross her mind that she is currently battling a disease. This disease is also technically a genetic defect and not necessarily a disease. It runs in her family and is very common in Vietnam. The dr claimed she would not write on the report that my wife is lying, but my wife is afraid that she would do it anyway, and is afraid that it's already on her report from the dr the day before. Is there anything we can do? We've been together physically for 4 years and have a daughter together. She's studied our timeline and paperwork so thoroughly she knows it better than I do even though I'm the one who filled out all of the paperwork. It seems absolutely unfair if my wife is denied a visa based on honestly forgetting to mention an illness that isn't even an infection disease. She did not lie. Aren't you allowed to be forgetful? She forgot that she had an illness when asked "have you ever had any illnesses or diseases?" so she answered "no." But she did not forget she had hyperthyroidism when she was asked "did you know that you have hyperthyroidism?" so she answered "yes".

All of those issues will come up at the interview. The consulate is aware that first cousin marriages are frowned upon in Vietnam. So you have to prove that both her and your family approve of the engagement. It's definitely a red flag as they're worried you're only trying to help out a family member. If you plan on moving to another state, 6 months prior to filing would be good as they will want to know where you've lived for 6+ months for the past 5 years... though it's not necessary to live there long to use that address on the application as it would be your present address

Okay, what's NC? - dumb question?

Second, you do know that after you get the visa, you have 6 months to enter the U.S. and get married within 90 days in the U.S., yes? In case your case is approved fast - it can happen! - you could find problems in moving to the U.S., since your fiance is living abroad.

You mentioned the notary public. I-134 is the only documents that needs to be notarized, as far as I know. Documents can be notarized by consular officers in U.S. consulate/embassies abroad.

I think it is a good idea, because my fiance is temporarily working oversea, he has one year left of contract of working oversea. So, hiring a lawyer is very wise decision at the moment, don't you think so, Arazia? However, because not all of the lawyer can handle his clients'case effectively and successfully, so that's why he and i should be careful to search the best lawyer to handle our situation.

Just like you, i'd like to find a good lawyer who can handle our case in the beginning, but my fiance didn't agree. He said that he could do what a lawyer could do, then why he just wasted money for something he knows. But later on, he changed his mind because he found out that it would be more difficult for him to do the whole process by himself, and because he is currently living oversea and work, then it would not be easy for him to contact with the notary public to solve the unexpected problems during the process. And i am really glad he changed his mind at the end. In my mind, a good lawyer can manage the case easily and responsibly. However, finding a good and responsible one is not easy, is it?

I feel like i was survived in this forum when i have just posted my problem and all possible answers were shown up for me. Thank you soo much guys. I really appreciate your help.

You know that, in the beginning when i first watched in the Guides for K-1, it is said that G-325a should be filled out by both of persons, the beneficiary and petitioner. But when i clicked to the "for example", leading me to an example of G-325a, i found out that two examples of G-325a filled out by american citizen and his/her fiance(e) are just the same. Maybe that is a mistake from the person who made a list of things there. If you still don't understand what i am trying to express, you can simple go back that page and click it, you will know what i mean. And that's a problem, and no wonder why i felt so confused about it. But now, thanks to you guys, everything is clear now, and i will do exactly what you have just advised me.

Another question is: what do you think if my fiance has an idea of hiring a lawyer to do everything for us? Any suggestion would be highly appreciated.

Let me introduce to you first about my situation so that you can understand what i am trying to ask here. My fiance is an usa citizen, and he is going to file in fiance case. I read on the Guides, but still can not figure something on there, especially on G-325a. In the Guides, it is said there are totally two sheets of G-325a, one filled out by us citizen and other left will be filled out by foreign fiance. My question is those two sheets just similar to each others? I mean, there is nothing different from the sheets of G-325a filled out by american citizen and foreign fiance, right? If so, only one person can complete the G-325a and then make it two? Is it possible?

What about the signature? In my case, i am now living in asia, and i am not there to fill the form, my fiance is going to fill out the G-325a, and is it possible for him to sign on the behalf of me?

I still have some questions and hopefully those will be clearified by one of you - those who have so many experiences on this.

Yodrak is a very knowledgable member of the forum. the directions for the 129f state if living outside th US, to file with the Service Center of your last residence. the G-325a asks for residence for the last five years. has he had no US residence for over five years? He has had no address to which any mail has been sent to? does he now use his mom's address as a mailing address?
i don't think he should file from a state where he intends to reside. if he is using his mom's address as a US mailing address and hasn't had a residence in the US for over five years, i would think it should be submitted to the the Service Center which has jurisdiction over his mom's address.
i could be wrong. hopefully someone will correct me if i am.

Before living and working in oversea, i think he has his permanent home address in America of course. But now, he doesn't have. According to what i have just studied from school in my American Culture class, it is said that Americans are very mobile, they are not sticked to live at one place, and every American often moves from place to another at least few times in his/her life. And so does my fiance. He lived in different places when he was in US, and the last place he stayed before working in oversea was NC. According to what you said, should my fiance write down the address that he was staying in NC for last time? Yes, i think he will use his mom's home address.

And of course, he will file K-1 for me here. And my question is that is my fiance allowed to file K-1 visa for me at USCIS in NC with his mom's PA home address?

But, i should tell you this, my fiance will come back to work oversea when his vacation ends, then, how can he keep in touch and get mails from CIS in oversea while they will send mails to his mom's home address?

After that is it possible for him to continue finishing the whole process while he is in oversea?

We submitted our K-1 petition before ever finding this website, and we had nothing to go by. So we both wrote our own letters, both basically saying that we both are free to marry and intend to get married within the 90 day timeframe. No embassy/consulate address, nothing. Just dated and signed. The letter you've posted is fine, and just substitute each other's names in the appropriate slots. When you get to the visa interview stage, that's when you put in the appropriate mailing address of the consulate you are dealing with if you wish when you submit updated letters of intent.

Hello there,

Even though i got the example of Letter of Intent, i still don't know how to write it. I have to admit that i am so silly and stupid and i really need your help.

As in my case, i am a beneficiary while my fiance is petitioner for me. And one of members in this site already made his posted here about this. Below is a post of his letter of intent for his fiancee:

Fiancé Letter of Intent

-USCIS address-

-Date-

To Whom It May Concern:

I, -Foriegn Fiancé-, do hereby state that I am legally able and willing to marry -USC-, and intend to do so within 90 days of my entry into the United States using the K-1 Visa.

Is it correct? And if so, what about this part " or when submitting for interview - United States Department of State, United States Consulate, [name of country where Embassy is located][embassy address] " ? Why didn't he fill in that part? If we don't mention the address of embassy here, then why do they put it there? What for?

And if the letter of intent for beneficiary above is correct, then how is the letter of intent for petitioner supposed to be?

Hi there,

In our case, we didn't attain an attorney at all. Before finding this useful websites, my fiance planned to hire one to take care paperworks for us cos he thought process would be difficult and demand a lot of time. Since i found the site, he gave up hiring laywer because i collected a full list of instruction on how to prepare and file paperworks, i also received so many helpful advices from VJ members. They are so kind and ready to help you when you face problem in filling your paperwork.

So i think you don't need to hire laywer and i believe you can do it by yourself as long as you follow exactly what the instruction is written on Guides item.
