Well here I am one of the fortunate ones who can visit their USC fiancee/fiance. I'm allowed to stay until August 27. I've been looking at the last 15 approvals for Vermont / K1 process and here is just info and stats. It shows country has no influence on time until approval. It DOES prove how an RFE really messes things up.
here are the stats.
Brazil - no RFE - 134 days
Korea - No RFE - 144 days
Philippines - no RFE - 115
Sweden - no RFE - 128 days
Jordan - no RFE - 128 days
Columbia - no RFE - 153 days
Philippines - No RFE - 81 days
Philippines - YES RFE - 298 days
South Africa - no RFE - 145
Jamaica - no RFE - 131
Canada - no RFE - 153
China - no RFE - 129 days
Finland - no RFE - 125 days
United Kingdom - no RFE - 126 days

So taking the RFE case out the average amount of days until NOA2 is 130 days
Pretty darned goo for those I think.

Not at all they just put in the papers you give them so you still do the work for them. Sometimes even get RFE's so if you can do it yourself it is cheaper and no faster results. And having to do the work yourselves you actually learn more about each other and the families. A good thing for interview time.

Ok, I finally got my divorce decree. Do I have to copy and include all 46 pages or just the top page with my name and date of dissolution. I have seen other visa sites and the only one I saw with a divorce decree, the guy copied all his pages showing the agreements between him and his ex, I don't feel it is any business of the USCIS what days I have my kids or what property was divided.

Thx for anyone who knows the answer, please only if you know the answer, I don't need an opinion, I need a fact.


What country or state you live in has different rules and what you need as documentation. Also be careful on filing too soon if there is a waiting period before you are free to marry. We needed a divorce certificate that states the date I was free to marry.

Hi I'm Jak, and my American fiancé and I are starting the process of filing for a K-1 visa. We've both fully read through the site and the example forms, the tips etc, but there are still a few things that are confusing me...

I'm currently filling out my G-325a form and have been really struggling with what to do with the employment history section. I have a couple of issues:

First; no matter what I try, I can't even get the address of the first place into the allocated box. There's just not enough room. I'm unsure whether I can just put "see attached" in that first space and then provide the whole history on a separate sheet of paper? Or do I have to get as much as I possibly can into that box? In that case it would end up being half filled out addresses and occupations and would just look a mess and, I feel, be much more confusing to decipher.

Second; I am coming to the end of a full time 3 year degree course and during term time I've not had the time to work, but over the summer periods I have. Do I put down that I'm a full time student as part of the employment history?


You need to make it as clear and easily read as possible. On several questions I had to just type "see attachment". It's fine to do this. In my opinion I would add about your being a full time student to the attachment and then list your employment. Just keep in your mind if you don't meet the poverty level you will need to secure a co sponsor. On all my attachment papers I also put beneficiary name, petitioner name, birth dates and the form it is attached to just in case they get separated.

When we hear back from Vacnouver they require we send the DS230 paper first which is step 1, then they say for step 2 to send fax in that checklist after everything is collected on that list and then they will send the interview instruction. How important is it to have everything on teh checklist before sending them the fax? Especially because we are close to the NOA2 expiration date? Can we just submit teh checklist and collect the things after and schedule a interview date? what is the problem with doing that?



Well it would depend on how imminently you will have those documents because you can get an interview very quickly in Vancouver. So if you aren't ready don't send. IMO
May I ask what the delay is for you? I'm ready to hit the road running when we get to that stage.... :rofl:

also just take a check on your forms for the expiration date which you find on the top right corner. I just checked my forms this morning and the DS-230 was outdated already.

IMHO do a very quick legal ceremony and then if the wedding is what you want, do it when you can, but keep in mind that heck happens when you least expect it and you don't want anything happening that shows a wedding date after the 90 days. We decided to have our marriage within 3 days of my arrival and our JP has been on speed dial, and we have planned another wedding for family and friends for a later time.

On our NOA2, it shows an expiration of 12-03-2012. Due to my work schedule we are trying to plan my fiance's interview in Montreal for like the 3rd week of November so that I am able to go with him.

Is this going to cause an issue with the NOA2 expiration so close? Should we just try to get an interview asap? We aren't planning POE until after Christmas, so we just wanted to take our time with this part of it so that we can guarantee that I can go to Montreal with him.

Any opinions/advice?

If it was me I would do the interview as soon as you can. You have 6 months to activate the visa after you have the visa in your hot little hands.

As Canadians did you answer yes to being issued a visa before? It has the choices in the drop down menu and lists B2 Visitor for pleasure only.
Seems simple until you really read it.

Gowon can't tell you what to do but if it were him he woudl at least put the petition on hold (withhold critical documents necessary for a successful interview) while you reevaluate.


I think this is very good advice. Your relationship is fairly young and sometimes we get caught up in "the happy ever after " moment when our emotions are running rampant. If he is "the one" he will be sad but will understand and agree with building a little more of a base for the relationship.

All the best, be strong and don't let emotions get in the way of your clear thinking.

As most know I lost all my parents during this awful process which started April 2011 and is drawing to a close at this stage. I have been helping to close up their estates and it has been overwhelming on top of the process. At what point have you just let go and had your melt down? I'm a teary mess today. missing parents, missing my Honeybun, and seeing the "last times" differently now.

Maybe make a copy of the original I-94 in your passport before you get this changed. This way you have a copy of it in case you have any problems or issues with it.



So here is what happened yesterday. I drove up to Bradley International Airport. When I found the deferred Inspection place, I spoke with a CBP officer who told me I wasn't in the system yet. How could I be because they have the wrong information. He then told me I needed to fill out an I-102 (to correct errors, for lost or stolen or mutilated documents). That it would cost me a fee of 350.00 because ultimately it was my fault for not catching their mistake and it is our responsibility make sure it is correct before we leave. so upon this news and feeling frustrated I burst in to tears. Sheeeesh, I felt like such a goof at this point. He then said to call USCIS when I got back home and ask to speak with a supervisor and explain my situation. I did call but she would NOT connect me to a supervisor. I told her she obviously didn't have the information I required and finally she gave me another number to call. I then explained to the fellow the situation and he told me to fill out my I-102 and put with it a cover letter explaining how it was not my fault. He was kind and apologetic for the officer who made this mistake. So all I can do is wait and see if it is resolved in time for me to apply for my SSN before my (wrong) I-94 expires..
What a dogs breakfast this is.
LESSON LEARNED: CHECK YOUR I-94 BEFORE leaving your point of entry.

You CAN get the I-94 reissued if it is obviously wrong, and an I-94 with your husband's name stapled in your passport is obviously wrong.

Take the passport with the I-94 still in it to the "Deferred Inspection" office of the CBP section at the nearest international airport. They can redo your I-94 and make sure it's all accurate and everything. They may try to charge you $$$ for this but don't pay them and ask for a manager if necessary. They have to replace it if the mistake was theirs.

You mean the actual I-94 card stapled to your passport has your husband's name? Well, who filled that out? I find it hard to believe that wasn't caught by the CBP officer. I don't think you can get the I-94 re-issued but you should also have a stamp in your passport for filing your AOS. US citizens do not need to fill out an I-94 upon arrival so it seems strange your husband would have filled it out.

Or, are you referring to the actual K-1 visa where under annotation it says:

FIANCEE OF (Husband's Name)?
That is what it supposed to say.



yes the actual I-94 has my husbands name on it. I'm thinking they grabbed the wrong one and didn't realize it. When we came through we had been up all night on the flight and then I was also in a wheel chair which caused some confusion in the line up. My fiance at the time filled it out by mistake and I told him it was for me. He was trying to help me out. The first officer who did the finger printing was the one who took the cards and gave one back to him. So not sure what to do. I have made a note on my application form though. It has my correct A# on though.

This is probably not anything, but possibly a big ooops on the poe. When looking at my passport to make sure my I-94 was there so I could start my AOS I noticed my now husbands name there instead of mine. Is that correct or was a mistake made? If a mistake who do I contact to fix it?

I hired a moving company, they told me the cost and said ok then when they arrived they said they had to changed trucks because the one they were using was too big, then they charged me 2500 more for a total of 6000. I say if you can do it yourself. the money would have been better spent elsewhere in this process.

He needs to have the long form of his birth certificate, original divorce certificate, they also asked to see my certified copy of marriage certificate from previous marriage. If your W2's show that your income meets the required amount then even though it is contract work it's the total income that you need to show. Make sure you check to see the marriage requirements first. Some states require a 3 day wait, not Vegas though I think. Plus to get your marriage license some take 3 days. You just need to make sure of these things. Plus will they mail your marriage certificate to you if you don't live there? Make sure you get 2 originals because some places require them some require only a copy.

Hello,

I've read many discussions here but my situation is a bit different. I'm a Canadian citizen residing in Canada and my fiance is a US citizen residing in FL. We're both of Indian descent and have decided to get married in India in Dec 2013. My plan is to leave Canada in Oct and go to India to do wedding planning. I'm not sure how to start the paperwork as I want to come back to Tampa and live with him in Jan 2014.

It is now March, if we apply for a K-1 visa, will it come in time for me to leave Canada in Oct? I understand we have to get married within 90 days of us receiving it in the US. The wedding ceremony in India is only religious and we may not sign papers on the same day.

Once I get the visa and come to the US, can I live legally in the US? Or would I have to go back to Canada/India?

We've been dating for 2 yrs and he proposed to me in Jan 2013.

If someone can please help me out, that would be great!!!

I may not be totally correct here but if you are going to marry in India then a K1 visa probably isn't the way to go because it is so you can marry in the USA. Thought.... why not get married now and start the paperwork for the married one and then go to India for the religious ceremony. I think it would be very chancy to hope for a K1 to be done in time. You have to remember that sometimes paperwork doesn't always go according to plan and an RFE could be sent.

Just my 2 cents worth.

I was curious in finding out what is the usual processing time from NOA1 to NOA2. I'm seeing avg of 106 days based on the members that provided their data on this site. Usually, if there are no RFEs, i'm guessing that 3.5 - 4 months is realistic to get NOA2? Got my NOA1 on Aug 19...and considering thanksgiving and holiday season...can i get NOA2 approved by mid december? Or chances are i may have to wait till Jan?


In a perfect world I'm thinking you have a good 2 months to go.
I've been waiting since April some have been approved in a short time. I wish you a quick journey as this is painful when it drags on so long.

Hello everyone, long time no talk, busy busy busy. Happy upcoming holidays. As we sent our application end of August, we haven't heard anything since NAO1. I am getting worried since we are coming up on over four months soon. The timeline says between December and January, my concern is that I leave to see my husband this coming Tuesday, and I'll be there for a month. Where does the paperwork go? To my address in the US or to his in Spain??? I'm so anxious that it won't be in time for him to go to school. But I think since it's been four months, the likelihood of ROA is unlikely, am I being too optimistic?? Any suggestions? Thank you all in advance



Set up your account at USCIS online. You can track your case status from there. But in my opinion... Go and enjoy yourselves, take lots of photos together with family and friends. You have a ways to go yet.

Try to get wedding picture for interview. It is very important. Try to find that photographer, generally photographer keeps all pictures in their records.



As a photographer I can say honestly that we don't keep all photos as it is too much. We keep them for a certain time limit and let our clients know this. But truthfully if a wedding photo is what you desire then get all gussied up grab some flowers and have some done. Explain at the interview that the originals had been stolen but wanted to have something in your album to represent the ceremony. Do you still have the clothes you wore for your wedding. Just remember to be truthful at your interview about the photos after the fact.

When Glenn and I are apart it's SKYPE for us as well. We have date nights and share as many meal times as possible. When we are just hanging around the house it is comforting to hear each other puttering doing normal day to day things. We even sleep with SKYPE going so I can hear his breathing and even his snoring lulls me to sleep.

It is a very trying time for all of us in the times of separation so that is why reaching out to others here is a good plan....
We all care about each others outcomes. We also have the commonality of this process.

Worrying will just elevate your blood pressure. Your numbers are not in the range for medication, but changing certain eating habits (salt intake) will help to keep it in check. Some people get (white coat syndrome) in which the patient only has elevated numbers when facing a medical professional.
Relax, you will be fine in my opinion.
