Well today about 15 minutes after my long call to USCIS the mailman came bearing the infamous letter. It of course states that my application for I-485 was identified as a potential interview waiver case and that we could expect a decision or other notice of action within 6 months. One can only hope. I really wanted to have my citizenship in time for me to vote in the next presidential election. We have to have had our green card for 3 years.

How's everyone else doing?

I filed the I-130 and the I-129F for my husband in Jamaica in September. I live in California and I wanted to know how long it will take for any one of these to process. From the topics I've read it seems as if it may take 106 days from the first NOA letter.
Please help I'm missing my husband.


The I129F is a fiance/fiancee visa, not for people already married.

Take a read through and ALWAYS be 100% truthful. If you have been denied it may not be a big deal (it will depend on the reason) they just want to know.

Hi everyone. I met my fiance through a mutual friend online in late May. Since then we have been chatting everyday for hours online. I just got back from a 2 week trip to HCMC to finally meet her and we decided we want to get married and be together. How important is it to have the engagement ceremony? I don't think I will be able to get back to VN with enough money to do it until April next year and we don't want to wait that long before applying for the Visa. Do you think we should wait or do you guys think we have a chance if we apply now? I already made a trip with her to her hometown and have pics with her and her family.

It' s very much about being able to prove your relationship. Photocopy all receipts, plane tickets, boarding passes, restaurant receipts while you visited. Hotel receipts. And yes the photos with the two of you with family and friends is an important part. Give a read through the guidelines on VJ and if you feel you have all that you need and you are sure then proceed forward. BUT it is important to know what you will be needing. This can take quite some time and does have costs involved. Just be sure..Good luck... Love and happiness is a true gift to have...

Ok so after yet MORE internet surfing I found out a little tidbit of info on our case numbers. Only those interested need respond...This is just another brief distraction.

NVC giving case number

example only: MNL - 2011 - 503 - XXXX(X)

first 3 letters: represent our consulate city

next is the year it was received

next is the day of the year it was processed +500 so this example is January 3. 3 being the 3rd day of January plus 500.

next is your case number which in the lineup they have processed YTD. 05789, means there have been 05788 numbers assigned before yours....

OH PLEASE GIVE US SOME NEWS.
I'M DREAMING IN STATISTICS NOW.....

Not sure how the xxx is read regarding the month it should be worked on being there are three digits and month references are two digits. Is one number a day? are the first two numbers the month? Then what is the third number for? :help:

So I had a boring weekend spent shredding old papers, getting things together to send to charity. I also did reading about immigration things and came across a site that explained how our receipt number is given.
I know I really need to get a life, but mine is in Connecticut working his butt off. :rofl:

So here is how our numbers are made up
EAC - xx-x-xxx-xxxx
EAC is just the example: It refers to our service centre
xx : refers to the year it was filed
x: is a secret code USCIS uses for who knows what. ( mine showed a 9) which just happens to corresponds to the month they actually picked up our file.
xxx: refers to the 5 month mark ( if your 5 month mark is oct, nov, dec, you drop the "1"
xxxx: refers to where you are in the cases example 4968 would be the number your case is of the total they have received to dat. Not just visa or application specific.

It is an odd coincidence that the number on my receipt number is the day after they "received" my RFE. Especially since we are given our receipt numbers within a few days we send in our petitions.

I entered the US on my K1 fiancee visa through US customs at the Calgary airport on December 16, 2012. Today I went to apply for my SSN and discovered they stamped my passport and I-94 with December 16, 2016!!
I called Homeland Security, emailed them, called the US customs at the airport - so far no one has any idea who I should talk to or what I should do.
Does anyone have any advice? Maybe it isn't a big deal since I have my boarding pass and I am obviously not a time traveler... Or maybe this will cause me all sorts of problems with AOS, marriage license, SSN etc.

I was told you have too file an I-102 and send off all your AOS as well. You have to write a letter stating why it wasn't due to your error but the CBP officer. That is what I had to do... What a pain in the butt

The numbers of K petitions change. Is there something difficult about what I am saying? Work visas do not wait so long of course. Temporary work visas are processed very quickly. No FAIR, right? Wrong. Work visas are not for permanent residency like a K or CR visa and are for temporary employment, which employment may vanish before a visa is issued. Do you want your fiancee to apply for a work visa instead? She will get it faster. But she will not be able to marry you and adjust status.

B-1s and B-2 do not go through service centers, they are not petitioned. Visitor visas are done at the consulates.



Gary could you please give me some direction on how to contact someone who has authority to discuss our personal file? I understand the reason for delay because we were given some information on what had to be submitted (paid for a step by step guide) and were given our RFE but the timeline is way off. We are going into our ninth month since our NOA1. What we want is to talk to someone who can actually answer questions. By admission of the person at the infopass appointment we are "way out out the normal processing timeline, and that SHE (Me) is only from Canada for Heavens sake". Can't find someone to talk to.

Hi There
We are also still waiting for the denial letter but feel 99.9% that ours was for "not free to marry" Missed by under a week. :bonk: BUT stay committed to each other and the process to be together. We have already compiled our new petition and my fiance is flying up to Canada next Friday so everything can be signed triple checked and mailed off. USCIS told me the petition can be mailed from Canada.
So hang in there and just make the corrections and carry on. So our plans got messed up. Everything happens for a reason I believe and in it's own time.
We will make it and so will you.
Looks like we will be hanging here together as well for this year.

Chinaamending forms
This is not researched but I think that you will have to take amended forms with you to the interview. I'm also not certain about the legalities and documents needed from your fiancee to take children out of the country. So many things we don't even think about until they tell you and let you sweat through some more time.Hopefully someone with absolute knowledge will chime in with some info. I wish you all the best in your journey.

You know I want everyone to have their happy ever after. But truly as a mother this screams warning :unsure: warning :unsure: warning :unsure:. The flags are up and my stomach turned over reading your post. PLEASE however well intended and as good as this may feel now every relationship lives in a "honeymoon" phase and the ONLY way to move past the happy endorphine filled phase is to spend time together and really learn each others daily life and habits. It truly is much different. I would not be comfortable with my daughter going off like this alone. I commend you on your planning and researching but please think this over deeper. He might be a most loving caring and your Mr right, but then it might not be all it seems.
I hope you will do as others suggested and not do this alone. In any country it is not the best situation. The people here care what happens as we all have a very tough road by having long distance relationships heed their words and learn from their experience.

Ok, we just want to make sure we have the correct police check. My fiance went to the Hamilton Police Station and requested the CIPC. He received it in the mail a couple of days ago, and he just wants to make sure he doesn't need to request a different police check from when he lived in Toronto. I think his confusion is because on the bottom of the form he received it says National Repository for Criminal Records in Canada. He has only lived in Hamilton and Toronto, and I understood that if you request the Canada wide police check, that was sufficient. Does that one include local police records as well? Thanks to the Canadian peeps :thumbs: :thumbs: :thumbs: :help:



May I ask if you got the police certificate from RCMP or just the local that charges a fee? I did both but was later told only need to go through RCMP because they do a country wide check. I did mine earlier because I was going to be away and then our case is taking forever so now I need to have it done again. Hoping the free one from the RCMP here in Sidney, BC will be all I need.

Got this on 11/4/2011, 11 days later I went myself to the USCIS local office to drop off the documentation requested, one day later I've got my RFE letter/request, it took them 11 days to get my info?

Anybody knows about how long it usually takes for them to make a decision?
am I getting an update on Line or they will just mail the decision once made?
anybody going thru the same situation?
any info will be greatly appreciated!

Do you have to exchange your Canadian money to US "before" leaving (POE)to avoid any taxes or penalties on the monies? I was going to see if the exchange rate might creep up a bit more where it was a while ago before changing to US. I am planning on leaving here mid December but thought I'd wait until the New Year to exchange the money. Any information is appreciated. Thanks



If you will be closing out your bank account before leaving then do the exchange then. I know when we cross the border and fill out the declaration form it asks about bringing more than 10 K into the country. Not sure if that is relevant to you or not. Secondly remember that the next phase in the process has time sensitive forms to fill out. My friend just went through the process last year and her K1 visa expired before the papers were filed. And still hasn't received her green card. So just keep that in mind also.

Revenue Canada wants to know her exit date as per her stamp in her passport for sure. BAD idea to cash the cheques, she is to send them back to Revenue Canada. Then in Feb you can download the tax return forms 2011. She has to file a hard copy not efile and it has to be mailed to International Services which you can find the address at the site link I sent earlier. If you try to pull the wool over Revenue Canada things can be made difficult for your new wife .

My wife just emigrated here via K-1 from Ontario. We are still waiting for her green card but we have her EAD/AP.

I have some questions about her tax status with the Canadian government.

  • What are the implications of filing or not filing a Canadian tax return for her this year? How about in future years where her residence is 100% in the US?
  • In the months following her entry to the US, she has received a couple Ontario Sales Tax Credit cheques at her old address which have been forwarded to us in amounts from around $50-$100. What are the potential implications of cashing them?
It's tempting in some sense to just cash the cheques, or to say "We've left Canada, so they can just live without any more returns/info from us," but I don't want to do anything that will come back to bite us later on.

I have always done my own taxes here in the US but I have next to zero knowledge of the Canadian tax system.

Info from those who have actually emigrated from Canada to US and have actual experience is much appreciated. I don't need speculations from people without first-hand knowledge in this area, I can speculate without your help already ;-) thanks!

CanadaCrossing border to the US to visit bf

I am going to visit my bf in the U.S this Sunday for 5 months. The longest I have spent with him is 3 days. We do plan to marry, however have not yet filed for the K-1, therefore I will call him my bf at the border. I am going by plane from Canada, and have a return ticket as well. I know it is possible that they will require proof of my ties to Canada. I currently live with my parents, so I have no lease or any bills in my name. I worked as a full time teacher last year for a 1 year contract, and this year am working at the same school as a supply teacher. These are some things I have collected to use as proof of ties. Is this enough?

- Some pay stubs from last year
- Pay stubs from this past September, and from early this october
- Record of employment from last year
- My phone bill history and contract date (it ends 2013)
- Visa payments? (I have my visa bills, however not sure how useful this is?)
- Info showing my students loans and that I am paying them every month (not sure if this is useful as well?)
- I purchased travel insurance for the duration of my stay (it expires the day I fly back to Canada), so I will be showing that

I don't have too many other ties besides that.. would this be good enough? Should I show my tax papers from last year?

Just to add, I did not really think of this possibility until today (I know it's a bit last minute!). I am phoning my employee tomorrow to see if he can write me a letter, however if I don't have that letter, are the pay stubs good enough?
Also I know people say to pack light, but I have two suitcases, wouldn't it be weird to travel for 5 months with only one suitcase packed? Is two suitcases too much, would they be suspicious?


They will ask you how you can afford to go away for that long without working. If you aren't his fiancee then don't mention it. You are going to stay with your BF and even that makes them raise their eyebrows. I know, I am Canadian and traveled back and forth many times to visit my then boyfriend. It did make them ask more questions. If they ask if you are going to marry you just reply you have no idea on that as you need to get to know each other better, hence the extended trip there, but make sure you have a letter from your employer stating the day you are to return back to work. You still may get turned back.
Heck for 5 months I would need a suitcase just for my shoes....lol

I ask this because my fiance will go with me, if he is not allowed to interview with office but just companies me in line for hours i will feel sorry for him.

Thank you guys for your replies. I checked her DS-160 form I made the same mistake there too because I was trying to make sure everything matched the G325a at the time. She never caught it because I was filling out everything I knew and only asking her when it was a question that I didn’t know about. Should she fill out another DS-160 also. I just don’t want them to deny her visa because of that. My fiancée will kill me!!!!

CanadaPregnant and hoping to travel home to Canada for Christmas

Hi everyone... It's been so long since I've posted here but I haven't had any new immigration related issues recently. This Christmas I was thinking about travelling home to Canada to visit family, however, I will be about 32 weeks pregnant at that time. I was wondering what types of immigration issues we might have if I went into early labour and tried to bring our baby back into the USA. Does anyone know the process or how long it takes? Oh yeah, for a bit of background, I'm a Canadian citizen and a conditional permanent resident of the US and my husband is a US citizen and Marine who is currently deployed in Afghanistan (he'll be back about 10 days before the due date so he wont' be here for christmas).

are you wanting to have the baby here in Canada?...Not too sure what the immigration implications would be if you have Baby in Canada... I would be doing a lot of research first though... Good luck.. looks like I will still be here in Canada for Christmas... Hoping my Honey might come up here for a visit.

CanadaLooking to be with my boyfriend but not ready for marriage...
This process is not for the faint of heart. It takes serious commitment on both parts because the separation from each other on top of the very details involved make me think that it might not be the best time. Start the relationship slowly. Maybe go visit for a couple of weeks there and then he can come to visit you. I have seen more than one relationship end during this process. It is very difficult. I'm sure looking forward to the day when we can actually be together without the sad goodbyes at the airports.

Hi there.. I had my blood pressure taken at the doctor today and it was 130/85 which is high normal. Do you think that will be an issue at the medical?? Anyone out there with high normal blood pressure that got through the medical?



My girl friend went through this process last November, When she went for her medical her BP was a little high but they understand that this process can give you an elevated reading and it isn't in any danger zone so you will be fine.

If you are in the Vancouver area, you can open an account with RBC because they have an account where you can have a Canadian and US account. I can transfer money back and forth and has made it a breeze to pay Canadian bills while I visit in the USA. When I move down I will keep this bank account because I have other stuff to deal with in Canada so it maybe worth looking into. I'm over in Victoria.
