My fiance' is planning to visit next June and stay as long as possible - like the 90 days allowed. What if the call for Interview comes during that time? Will he have to go home for the interview? I just mailed the packet finally - had to wait for one little piece of paperwork I didn't realize I needed until the last minute. We don't have a lot of extra cash for plane tickets but hate to delay his visit. It's so long between as it is. I may have missed this post somewhere before. If so, I apologize. Thanks for any advice. :wacko: :help: :thumbs:



On my last visit state side the very nice man who asked me many questions asked me what I would do if I had to do my interview. The answer is... they go home and complete the process. plain and simple. And he better have a lot of documentation giving a tie to his country or he will be sent home.

My friends have even told that he will change once he gets here I have heard some horror stories about how people was treated after they finally arrived. I have seen some situations too. A lot of them even got deported back home after their spouse reported that they had been used. But even though I have heard all that ..My loyalty still stands behind my man . So be strong and no that if the lords sends him to you then it was meant to be,and if he doesn't then its the best thing for you. I will keep you in my prayers.



There will ALWAYS be horror stories but only you know the strengths and weaknesses of each other and your relationship. Don't let those stand in your way. I know ours is not the same as any others.

Well I don't work and my days can be very long and very lonely. We are never further away than VJ. We actually sleep with SKYPE on so we can hear each other breathing (and even the snoring helps me to sleep) crazy but true. We have been waiting for our NOA2 for 7 1/2 months and I live in Canada. I have used up all my days allowed across the border and he works many hours at the hospital. Days turn into weeks, weeks turn into months... but we are still planning for THAT moment when our "forever together) can begin.

Funny how people will take offense to what they want to take offense to. I sometimes wonder if they read forums in order to be offended?

As I said (you have to read ALL the post) money transfers are either benign or a bad thing. I did NOT say "They are a BAD THING!"

In fact I provided them at our interview which I was present for and also at the interviews for our two children which I was also present for. There was -0- interest in even looking at them and our visa was approved with -0- questions. For that matter they did not look at any of our phone bills, emails, travel documents and only FOUR of the hundreds of photos. They "flipped through" the affidavit of support, literally. No way they could have read any of it.

Now I COULD say "When you go to your interview, just bring four photos and nothing else" But I do not. I actually am one to say "bring it all and let them sort it out" bring back what they do not need.

I also mention that you need to be cognizant of the trends of the consulate you are using (someone missed that) You do this by communication with others that used this consulate and the regional forums come in handy for that.

Money transfers have overwhelmingly had the effect for members here of being either benign or a problem. If you are going to present them I hope you have lots of other evidence besides them.

They are not needed for the petition.


Again it was explained why to include in the guide we purchased. I see now that it was set up to front load the petition. Live and learn I guess. It also stated to put in all financial information as well. Ho Hum...

As our case is taking forever we are trying to find out all the possible reasons for the delay. In reading this thread it has made me a tad concerned. Even before we became engaged we had talked about how our relationship would go. I was at that time fine with spending my summers down there and winters here. When he bought the house we had already discussed doing a remodel when I sold my home here. I live in an apartment now. I used my half of the sale of the home here and financed the remodel and enclosed the copies of the checks used to do the remodel.

Am I now correct in my findings that this may have screwed us in some way?

It's nothing personal on their part. They are a faceless, unaccountable bureaucracy. Some here insist that the worker bees actually work hard, and that the real problem is mismanagement and insufficient staffing. Hang in there, you will eventually get through USCIS. And keep this experience in mind when some politician campaigns advocating a government solution to a problem. :)

We thought so also. The difference was on the final divorce order the person reading for info had to figure out what the date I was actually free to marry. It stated when the divorce was granted and that I was free to marry in 31 days. The divorce certificate says I was divorced on ?? date and was free to marry on !! date. That was the only difference both came from the court house.

In my opinion that would not be a good idea. I hope no RFE comes your way as it has delayed ours over 2 months. Heck happens all the time. Just to give you a heads up, we are now at 249 days since our NOA1 into our 9 th month). So my point is, making definitive plans before you have your visa probably not the best decision. Many couples have a quick court house marriage and get started on the next step of paperwork, AOS, and then plan a "formal" wedding for everyone when the timing is better. So much stress already. But you will know what is best for you.

Hi, since my Petition for Alien Fiance' was received by the VSC on September 12, I have re-visited my fiance' in Ukraine in October. Should I send evidence of this second meeting to the VSC at this point? Anyone have any advise on this? I dont want to hold up the process but I want to maake sure everything needed is there. Tom Petty had it right in the words of his song "oh, the waiting is the hardest part!". Sometimes, it really feels like torture, but we'll wait as long as it takes. Happy New Year, everyone !

Your extra evidence probably will never meet up with your petition. I would keep it together to show at the interview stage if they ask for it.

Our petition was put in April in VSC.
It took 5 months to receive an RFE.
They received the required document Oct 18.
We have done the service request - twice
Infopass in Hartford
Congressional inquiry once but the second is waiting for the person to get back from vacation.

Not really sure what else to do.

255 days and counting - 8 1/2 months

We're are considering a expedite request due to USCIS error.

Hello everyone...im back again and iv got one more question to ask...as i said before, my fiance received an RFE...tomorrow he will be sending those documents to USCIS...my question is, how will we know that those docs he sent were received by USCIS? are they going to notify him that they already have it or we will just have to wait till we get the decision from them?

Send the package with the request for signature. Then when they process the package they will give an update stating they have been received. This is what it will say when you check your case status online.

After trying to process the news of our petition being denied at USCIS level we are trying to find information on what would be reasons. I have dissected our entire petition and have found 3 things that may be the cause.
For those of you who have first hand knowledge I would appreciate your input. Not looking for judgement calls or telling us we were stupid.

1) there is a 5 day shortage of being free to marry. Not sure how it got by me. :bonk:
2) When we filled out the application for I129f I wasn't in the USA but when he sent it off I was. :bonk:
3) AFTER our petition was sent fiance had an issue with having too much fireworks and was arrested and given probation. :(

We front loaded our petition because of the directions from our guide we bought and it said we had to send in all the financial information. So while trying to work through all the events that have happened in the last week I feel like a petition virgin again. So you are saying that ONLY the I-129F. G-325's with photos and proof of ongoing relationship get sent first????

Please could someone confirm this information here as we don't want to get RFE'd again for anything.

ok so as you know our petition was denied at USCIS level. We are going the K1 Visa again through Vermont. So we are preparing a new petition. The issue for the denial will of course be rectified.When we sent the first packet we used a guide we purchased. The method of preparation isn't the reason for the denial but on here I read the guide and it doesn't say anything about the I-134 and all the financial papers. When did you (who were approved) supply that information, how many copies did you make and what all did you have notarized. This time we don't want to provide more documentation that we don't have to. hopefully get an approval quicker. Thinking of not front loading this time.
Please reply from experience in this matter.

So guys, we're close to getting the NOA2 (hopefully this week). He suddenly got offered some great upcoming work in May / June in Australia that would pad our savings a bit more before he makes the big move BUT he wants to come here for a few days in May and then go back and continue the work then move here right after it finished in June. The thing is, after reading through the forums I'm pretty sure he wouldn't be able to do it OR it just wouldn't be advised at this point. One... the interview will probably be sched before then and once that happens etc. he'd be issued the K-1, once that's issued, he can only enter the country and if he leaves we'd have to start the process over again :-( Two... it'd be up in the air if he'd be allowed into the country if they find out he's planning on immigrating here. He wants to see if we can delay things. Maybe the interview or ?? But honestly I just don't want to risk it and just mentioned that we should continue on plan and he could either come here permanently at the end of May OR at the end of June but forget about coming here then leaving then coming back again. I feel it's cutting it a bit close and have read others who asked for delay of interviews got pushed down to the bottom of the list so I'd rather not try to mess with the system.

Hoping this makes sense? I guess my overall question is, would he be able to try to enter the country before the K-1 visa is issued? Or is it cutting things a bit close? It'd be nice to have the extra cash padding but not at the expense of having any difficulties in our visa journey.

How long is the work for? Remember there are things that you can just not do quickly and then of course I think you have 6 months to use the visa once issued. Please someone step in and firm up the facts.

A fellow Canuck here. I was lucky to have my old passports to go back into but I listed as many as possible and stated I could not give the rest as there is no record of the crossing in my passport when I drove across or took one of the ferry's. I believe they have a complete log somewhere of all our crossings. I sure hope so ....

Do the best you can and be prepared to explain more if needed.

I want to move from where I live now. I am the beneficiary and wanted to know how long it takes USCIS to make the address change to the file. Does it slow down the process? Does it matter if I have a temporary change of address put in? I can save some money if I could move in with my sister without if it wouldn't cause a delay.

I received my NOA2 a couple weeks ago in the mail and there was an expiry date on it (August 4th, 2012). Is that the expiry date for the petition? I have to mail in the forms for package 3 before that date?



Take a read through the guides. You can get going on the other forms needed for the interview. Read about the medical that is required and the vaccinations you need to have proof of for your medical.

It looks, from your timeline, that you're waiting to for your NOA2. NVC should send a letter to you, but I'm not sure if the beneficiary gets one (I didn't, anyway). In theory :lol: Montreal will send her packet 3, although all it is is a list of what you'll need for the interview (which you can find here), which forms you need to send in now (which you can find here) and your new case number (which will be on your NVC paperwork or you can call either NVC or DHS to get that number). Having said that, Montreal often doesn't get that packet to your beneficiary at all or it takes several weeks from the time NVC will tell you it's been sent out so you don't actually have to wait for it to be in your hands to take the next steps. Other than that, after they receive her packet 3, they'll send packet 4 which is just instructions for how to book an interview online (although it's really not complicated and if you do have trouble, lots of people in the Canada forum would be willing to help her out).



Thanks a bunch. I am going to just do the email thing and not trust the mail here as quite often our mail goes into the wrong box.. YIKES.. anyways I have already set up my account to book interview when it gets to that point here in Vancouver. They are pretty darned quick with appt dates. We are sure hoping this time goes better and faster than the last one.

In this waiting time there is much you the beneficiary can get working on. Become very familiar with the paperwork as there is still much to gather. Get you vaccinations done as there are some that are given in 3 shots spanning 6 months. I went through all this last year to be denied. But we are on the right track this time. Your RCMP police certificate is good for 1 year. I had to get another done because I can't see us being past that stage by June 8. Start making a file for your medical, your interview, and I have even started the researching for AOS. Which area are you in? I'm Victoria, BC so I will go to Woking Clinic in Vancouver as well as the interview taking place there. Interview times for Vancouver are much faster than Montreal. I have even set up my account for when the time comes to book my interview date. When we get the chance I'm hitting the road running...lolol

ok So because I got a denial in this area contact Untie The Knot and get your "DIVORCE CERTIFICATE" if you don't already have it. You will need to bring it to the interview. So when you receive it make a copy to leave with the consulate. You need certified true copies of ALL marriages terminated. I'm not sure if we have to bring marriage certificates of previous marriages but I got them just in case and have put together a package to leave of all copies of documents. (birth certificates, including children, even if they are not immigrating with me, divorce certificates and marriage certificates showing start and end of previous marriages. Remember any of the originals you want to keep make a copy to leave with them. Hope some of this helps. It takes 3-6 weeks to get the divorce certificate.

We were denied the first time on a stupid technical error on our part. We filed again Feb 2012. We were told it is not a problem just correct the reason for the denial. Breath and move on forward.

I cannot say the time it takes in other countries to get the police certificate but I was told that mine was good for a year of issue date if that helps at all. So I would see hw long it will take and if yours would be the same year and get it ASAP.

I did something similar out of interest a few months back, and found no real statistical difference in time depending on country. Keep in mind though that all numbers on VJ will include expedite cases. Some countries may have higher numbers of expedites. The only statistical significance I found was Japan, which had an average NOA1 - NOA2 time of 90 days. My best guess is that because Japan has a very high US military presence (and I would imagine very few FBI "name hits"), a larger than normal portion of petitions are military petitioners, who get expedited.

Well here I am one of the fortunate ones who can visit their USC fiancee/fiance. I'm allowed to stay until August 27. I've been looking at the last 15 approvals for Vermont / K1 process and here is just info and stats. It shows country has no influence on time until approval. It DOES prove how an RFE really messes things up.
here are the stats.
Brazil - no RFE - 134 days
Korea - No RFE - 144 days
Philippines - no RFE - 115
Sweden - no RFE - 128 days
Jordan - no RFE - 128 days
Columbia - no RFE - 153 days
Philippines - No RFE - 81 days
Philippines - YES RFE - 298 days
South Africa - no RFE - 145
Jamaica - no RFE - 131
Canada - no RFE - 153
China - no RFE - 129 days
Finland - no RFE - 125 days
United Kingdom - no RFE - 126 days

So taking the RFE case out the average amount of days until NOA2 is 130 days
Pretty darned goo for those I think.
