I know this is a very trying time but NEVER EVER EVER lie to the government...BAD BAD BAD idea. It angers me that your lawyer has given such terrible advice. Keep your chin up and keep looking for your answers. As for the NOA2 sign to have it emailed to you or set it up online so you can see the progress of your petition. If your NOA1 went to the lawyer then just go in and file a change of address. I'm sure if it is possible but if one of your family members could do it until your financial situation improves perhaps they can be removed at a later date..This I don't have an answer for you.

1. do I physcally send the I-134 at the same time with my I-129f package? NO YOU DON'T. YOU WILL SEND THIS TO YOUR FIANCE IN THE FOREIGN COUNTRY.

2. What is the difference between an I-864 and an I-134? MOST CONSULATES USE THE I-134. THERE ARE A RARE FEW THAT USE THE I-864 FOR K1. YOU NEED TO COMPLETE YOUR PROFILE SO WE CAN TELL WHICH EMBASSY YOU'LL BE DEALING WITH. :-)

3. Will I need to use both the I-864 and the I-134 at some point(s) in the future? 99% CHANCE YOU WILL USE THE I-134 FOR YOUR K1. ONCE YOU ARE IN THE US AND MARRIED, THE I-864 WILL BE USED FOR AOS.

I agree with most of the answers and there are always more than one way to do things. I purchased a step by step guide which was AWESOME it left nothing to chance. Giving lots of evidence on your relationship... a very smart thing to do. I was also prompted to make sure there were family photos taken with you and your fiance(e). they said these are like gold. I was instructed to send everything with the K-1 as the information will be requested anyways. If only I had known about the final divorce order needing to be a certificate we would already have our NOA2. The Consulate will want all the info on the I-134 so best to be prepared. The other will be needed but not until you get married. I say concentrate on the task at hand and good luck in the journey.

packet 3 gives you all the information for your medical appointment. You should research what vaccinations you need. There are few for sure, Best be getting started they can take a bit as you can't have them all in one day and there is the hep B series of 3 shots but you can squeak by with 2 if you get the others when you arrive in the USA, Hep A is a 2 shot series, polio, need blood work to prove you had MMR, DTAP (diphtheria, tetanus, pertussis), Flu shot that is the newest one with 3 different strains meningococcal, pneumococcal. If you have had chicken pox you need to give the year you had them. you will need 3 passport photos 2" X 2" in color, your letter of approval with your new case number on it, a photo copy of the identification page of you passport. you need to check out the requirements for the medical clinic that is USCIS approved for your area. Basically it is a checklist to prepare for medical. When you have done it all you make your appointment. Good luck and get a start on your vaccinations.

You have to wait 4 weeks for a divorce certificate to arrive? Yuck! Whatever for? My local court mails them out very quickly once you figure out what the "trick" is (letter to the "copy office" with the fee), but it was very confusing what was really wanted from VSC, so I took the train down to the court office and chatted with them in person. I hate calling... much prefer speaking to an actual human in front of me.

I originally had sent them a copy of the one page divorce decree (with stamp) that the court sends when you pay them $20. They said photocopies were fine, so that's what I sent. And, it was the "divorce decree" as they said they wanted. The RFE said they wanted the "divorce decree" but didn't elaborate about what they really wanted since I had sent them a divorce decree. So, this time I sent them every document with the original stamps; I hope that satisfies them. I also included other stuff like copy of marriage certificate and lawyer's bill to prove I paid someone for this, and the quitclaim deed to prove she transferred ownership of house fully to me.

I had signed up for electronic notification and got one for the NOA1 but not RFE... not sure which events get an email sent.

So, how do I put in a "service request" exactly?


Boy I hear ya loud and clear. They also sent us the infamous RFE 5 months to the day of filing. And again it was to do with a stupid divorce certificate, even though all the needed info was there in the final order. Now it will take 4 weeks (already made it through 2) for it to arrive before it can be couriered to them. then the waiting for NOA2 and so on and so on and so on. Some days I just want to scream at the top of my lungs, but most days I don't want to see anyone because I'm tired of explaining the same thing over and over again. I had a little venting to do today as well.

I am at a total loss. It has been over 3 months since my fiance filed the petition in California and we have not received an NOA1. He finally called them last week and the lady said they're backed up and he mentioned something about them not processing petitions that are not standard size? What is that??? I'm sorry to be sounding like I'm ranting here, but let me just say it, I am VERY frustrated!!! We know they haven't received it at all because they didn't charge the check he sent in. Why is this happening? Have any of you ever heard of something like this? I'm ready to wait a long time for NOA1 to NOA2 but to wait this long for Filing to NOA1, it's absurd and so disheartening. :-(



there is something amiss here. The NOA1 is sent very quickly. As it is just to let you know it was received. The red flags are definitely flying on this one. You need to get more info from your fiance as it is your life being affected as well. Waiting will achieve nothing.

Hello everyone,

My husband and I had, just about a year ago now, been through the whole K-1 visa process. But I have a slight issue, and I am unsure of what to do. I searched the forum for like questions, but I didn't find any.

Anyways, my husband recently went back to Japan and doesn't plan on being back until around January or February, due to some family troubles. I moved in the meantime, just a few towns over from our original location. My husband isn't physically in the country, but me being the wife, should I update his address to my new one, even though he hasn't even lived/arrived in this new location?

I am very sorry for the dumb question, I was just very curious as to what is the best thing to do. I don't want immigration to think I'm lying or trying something sneaky, saying that he has moved within the U.S when he isn't even here currently. Maybe I am over thinking? My marriage, husband, and his visa mean the world to me, so it has got me worried!

We didn't hire anybody to do it. As a matter of fact I am the one who prepared everything. My guy is just going to sign, mail and go get anything I tell him to get.

That info about "6 pages only divorce decree" is from a guy from cleark county's office. The one that will issue him the cert true copy of the divorce decree.

He got divorced 20yrs ago, didn't remarry so he lost his own copy. We got it from his lawyer's office, a secretary just mailed us 10pages of it. We thought it's all just to find out it's actually 20+ of them!

I am kinda pissed because I reviewed the application 200x before I send it to my fiance just to avoid RFE. I was very specific on everything. Got POST IT pad on every paper with clear instructions, I call my fiance 5x a day so no mistakes, then I will find out we will get one because of this divorce decree. :crying:



Just remember that IF you get the infamous RFE you are ready to send by fastest method possible, AND DON'T SEND IT UNTIL YOU RECEIVE RFE as they get LOST somewhere...

I sent my final divorce order which stated the my divorce was final but they want the certificate that actually states the date you are officially free to marry as our divorces are such that there is a waiting time of 31 days from the time we are divorced before we are free to marry.

My fiance is in OH and was divorced 20yrs ago. We got a ordinary copy of his divorce decree but I told him to get the certified true copy of his 10 pages divorce decree and he was told that "he only needs the 6 pages of it", the guy seems certain because he had done it thousand times when my fiance is insisting to give him all the pages. the part where everybody signs, stamped dry sealed plus, he needs something else on top of that (he can't tell me what's the name of it). The guy said that the divorce decree doesn't make any sense because he could have remarried between 1991-2011 specially when marrying a foreigner.

Any thoughts? For those fiancee's or fiance of a divorcee, ever heard something like it?


i'm not sure if the same document is required or available but I got an RFE and asked for a " divorce certificate" that was the only piece they want. hope this helps

Hi - I've filed for a K-1 visa for my fiance who is an Indian citizen (also a resident of India) in July, 2011. We are currently waiting for NOA2 approval. Recently, my fiance and I decided to get married in November and sent out the invites to family and friends. Will our K-1 application still be valid if we get married in India? or do I need to submit a brand new application for K-3 visa and start from scratch? or is there a way for us to retain the July 2011 priority date if we change our visa category from Fiance to Spouse?




you are so very close... Don't get married and risk denial as it will be because it will be considered the wrong paperwork. It is so easy to get wrapped up in the wedding. But you will then have to be apart for that much longer. Stay strong and continue on this path of K-1. Family and friends will understand.

If I'm not mistaken the visa is good for 6 months, or until you use it then you have 90 days to get married as it expires 90 days after you cross into USA.

Hi All,

My fiancee would like to come visit me in the States next month. While we're hopeful her visa will be approved by then, we're thinking about her entry to the US pre-visa approval. We've read the forums that recommend what documents and proofs a person should bring in order to prove they will be returning home.

My question is what are people's most recent experiences (pre-K1 visa) at the Los Angeles Port of Entry? I've read the reviews of the LA POE on VJ and they've mostly (if not all) been positive. Has anyone been turned away trying to visit their fiance(e) before the K1 visa has been approved?

I went through POE Seattle, WA. When going through I was taken aside and asked many questions. The only reason they allowed me to enter was because I could show without any doubt I was returning to Canada. But he also said that once the process had started we are technically supposed to remain in our own country. I took my tenancy lease, my NOA1, a copy of the identification page of my fiances passport, a copy of a recent bill with my home address. He also said that because he ran my passport and saw my usual travel to the US to visit my fiance he would let me go through. But it is totally up to the person who talks to you and how you present yourself. After all this nail biting session he said go have a great summer...lol

oh yes it is a very important piece of information. there is much information needed to be gathered for that and you will need it before your interview. It is one of the main things they (USCIS) need to see as it shows their eligibility to support the beneficiary. And there are few that need to be notarizes.

Hi. I sent a letter to my fiance in the philippines via postal service and she never recieved it. After waiting for over a month she went to the p.o. and tried to collect it herself. However it is long gone and no where to be found. It made me think. If I have to send important papers/documents how should I do it? Use an American company like Fed-ex or hire a courrier? I know there is scan and then email option but there are so many papers. She would be charged for each page she has to print. I have never sent a PDF file before. Not sure I know how. My next concern was when time for her to get her packet from the Embassy how will she get it if its mailed? She'll need that to follow the directions and schedule her medical and interview. Then, the visa; it gets delivered. I heard they use some courrier service called 2go or something. So hope no problem there. Just want to know what others have done in this matter. thanks VJ MEMBERS. my thoughts to you and your fiancee... NEVER count on snail mail. When it must get there use a courier service. Well worth the extra dollars, pay now in money or pay later... much later with lost time...lol... pdf are easy. But you can also fax. Find any other method for your paperwork.

people, I am worried about my birth certificate..because My parents declared they were married, in my birth certificate, when in fact they never were, just so I can have my father's last name..i do have my father's last name, and My mother of course doesnt take my father's last name, but declared they were married..help..Will this be a problem??? greetings to everyone here in vj. our noa1, noa2 and nvc letter have my family name written with "s" at the end. my fiance called USCIS from NOA1 and corrected the mistake. they sent us a confirmation letter about the typo error. but then, when we received our noa2, there it was again, as if like we didn't called. same mistake. so, my fiance called uscis again and corrected the mistake. they sent him another confirmation letter about this. but when we receive our nvc letter, the same mistake again.
would this pose a problem for me during the interview? because we need to show the appointment letter and a valid id to be admitted inside the US embassy? or can i correct it with my appointment letter since i'll be the one to schedule it.
we're really confused. thank u sooo much for those who will reply. we really appreciate it.



I wouldn't sweat it. just go to your interview with the confirmation letters and if asked explain the problem and that you name is ....... . You will have your passport which will clearly state the correct spelling. I really don't think it will you any grief..

You need to put your names (both names) on any attachment but it does not need to be a signature. Simply include it in the printing of the page at the top...

They are not legal documents and do not have to be sigend or dated.

They need to be clearly marked what question they are in answer to, should be separate paper for each additional answer and you need to have BOTH names on the paper but you do not need signatures.

To suggest so is preposterous. You are answering a question, you do not need to sign each question on the form. The signature on the I-129f form suffices.

You will get conflicting answers because some people are wrong



FWIW signing will not hurt anything, but it is not needed


the signature is not wrong on the attachment it is just another way to do the same thing. I put it there in case the two forms get separated.

Hello! I am just about to email the forms that my fiance will have to sign and mail back to me...so before I do this I just want to double check:
-If his previous employers/residences need an additional sheet - I would write 'see attachment' in the box and provide an additional sheet...but does he have to sign and date the 'attachment' or only the G325 form?
I've been searching the forum and am finding conflicting answers...what do you guys think?

Also, don't get tied up in knots over the case status... it is often not accurate/updated and in many cases doesn't move out of 'Initial Review' until long after the I-129F is approved, if at all.



I read that USCIS status board is updated usually on the 15 th of the month.. Not sure if this is true but it makes sense....

I booked at the start of Sept. My interview was on Oct 7th. They told me 6-8 weeks. A girl I met at the medical booked her appt. after me and she had her interview the same day as I did. So... it really depends. If you e-mail them they are great at emailing you back within 2 business days :)

I got my packet 3 in June and had my interview in October. I took a long time because I had to get 3 vaccinations (damn you chicken pox!)

So here's our back story:
I entered the UK on a student visa in August of 2010. I met him October 26th 2010. I moved back to Chicago at the end of May (2011). He came to visit me for the 2nd time from August-October of 2011. He proposed to me.

We now want to file for a K-1 visa. BUT, we really want to see each other while it's processing. Is this possible? He entered the US on the VWP. I've been reading the boards and it says he needs a B1 or B2.

I haven't mailed the I29F yet because I need to renew my passport >_<.

My questions:

1. How can he come visit me for the 2011 Holiday season?
a) If so, how?
b) Is it better for him to apply for the B2 visa BEFORE I mail the I29F forms?
c) Can he still come and visit once I send the I29F forms with the VWP?
2. How long for the K-1 visa to be processed?
3. Should I get a lawyer?
4. This "BURDEN OF PROOF" that needs to be met when he visits, how is it done? With what papers?
5. Is it better for him to apply for the B2 visa BEFORE I mail the I29F forms?

This is all I can think of for now, but any help and stories of your personal experiences will be greatly appreciated.


Here is my experience.
I have been going back and forth to visit my fiance for over a year now. All was fine until we sent in the petition. On my last visit I was stopped at immigration and questioned at length about my visit. They told me technically we are to remain in our own country while the process is ongoing. BUT I took with me proof I would be returning to Canada. I brought with me my rental agreement (lease) recent bills with my address on, my NOA1 copy, my fiance's ID page (copy) of his passport, and also explained that my father had recently passed away and that I was the executrix and needed to return to finish up his estate business. . After all this he said he ran my passport and could clearly see my travel history stamped my passport with a B2, handed it back to me and said "Enjoy your summer"... which I really did. So what is of utmost importance have proof for the return. If he has his return ticket that is also a plus. I told the immigration officer that I always buy my ticket close to my travel date for a better price, but it may be different for you.

Hello! I a new member but have browsed a bit in the past! I need some advice on my K-1 situation.

General Situation:
Engaged to a wonderful woman from Switzerland. I live in Hawaii. We had originally decided that we would get married in the US and that she would immigrate here. I submitted the K-1 Petition in July. I received the NOA 1 so it is in process. Upon receiving the Visa, we would get married right away and petition for the work permit and permanent resident status.

However, my employment situation has changed for the worse - found out that I would be losing my job next July due to federal budget cuts. So after a recent month-long trip to Switzerland and many discussions, we changed our mind and decided that I would immigrate to Switzerland instead.

So my immediate decision to make is do I CANCEL the K-1 Visa process or not? Not sure if that is still the proper path given that we would still like to get married in the US next Fall? Or do we cancel and get married on a tourist visa? What is the most proper and legal route?

In this new scenario this is our ideal process:
1) she comes to visit in November and March (with proper documentation of desire to return to Switzerland)
2) she obtains a special 6-month tourist visa for July - December 2012 (she has a cush federal job that is willing to give her six months of leave given her situation and if she decides to stay in Switzerland...they obviously like her very much :)
3) we get married in the Fall of 2012 sometime in Hawaii
4) We file the necessary petitions to get me into Switzerland as her husband
5) she returns to Switzerland in December and I follow in about March.

Does all this sound possible and legal? What is the proper path? Any advice would be greatly appreciated.


food for thought... You still are an american citizen, what happens if plans change again and the two of you want to live in the USA?. I suggest that as you are still working that you complete the process, then if your plans change again in the future then wouldn't you be one step ahead? She would still have to have a visa for USA.. just another thought.

I am stressing out a little on this, and feel so stupid! My lawyer wrote my letter of intent. I read and signed it. I was updating it so she could take a copy of her interview, and I discovered I did not read it good enough :(.

At the top of the letter the lawyer wrote the wrong state and zipcode, in the main body it had my wrong birth date. The day itself was wrong. The main body did have the correct address. I don't know how I could not have noticed this. Was it nervousness, excitement, or foolishly trusting a professional? I can't say other than it was stupid of me.

My fiancee's I-129f was approved and we are waiting for her interview appointment date. Can these two errors come back and bite us? I am thinking the address thing will be alright, but I am not sure about the error on the birth date. How much does the letter of intent come in to play at the interview? My fiancee will most likely need a waiver anyway, so I am worried this may ruin things for us. Did I mess up something so important?

It has all be accepted at USCIS but why not ask the lawyer to write a statement saying he made a couple of errors add the corrections send to fiancee, as well have yourself write an updated letter of intent anyways for the interview.. I really don't think it will be a big deal if all correct information is given .

I am stressing out a little on this, and feel so stupid! My lawyer wrote my letter of intent. I read and signed it. I was updating it so she could take a copy of her interview, and I discovered I did not read it good enough :(.

At the top of the letter the lawyer wrote the wrong state and zipcode, in the main body it had my wrong birth date. The day itself was wrong. The main body did have the correct address. I don't know how I could not have noticed this. Was it nervousness, excitement, or foolishly trusting a professional? I can't say other than it was stupid of me.

My fiancee's I-129f was approved and we are waiting for her interview appointment date. Can these two errors come back and bite us? I am thinking the address thing will be alright, but I am not sure about the error on the birth date. How much does the letter of intent come in to play at the interview? My fiancee will most likely need a waiver anyway, so I am worried this may ruin things for us. Did I mess up something so important?

hi all vjer's!

me and my fiance had filed for our k-1 visa a few months ago and hopefully are expecting it soon! im the beneficiary and i was wondering if throughout this entire k-1 process does MY income matter? or will it be looked at? my fiance who is petioning for me will be having a co sponsor to help show support for the process. I know me as the beneficiary must pay for the medical, adjustment of status, police certificate, boarding pass once we are approved and our marriage license. but all of that my fiance and i are both paying for together..


so will my income as the beneficiary be of any importance other then that? im only asking this because I dont have that much money right AT all right now so, just enough to skim by all of this for the visa...it just started to worry me.

your income is not questioned as you will be working in the USA not in your country. No worries as long as the person co sponsoring you has enough to sponsor you.

I have a contact who works at VSC. I asked them about why the sudden explosion of approvals of K-1 visa's.

1. They were behind on K's and reassigned some people to start knocking them out. Also they were understaffed and just added about 40 positions to get the allocation of people per work load corrected.

2. What typicaly happens at the service centers, is that the Visa's that are the most time senstive and generate the highest revenue get the most attention. So if the H-1b's wich are more time senstive and generate much more revnue get behind, people get pulled off the K's. Then when they get ahead they will catch up on the lower priority Visa's like K's.

This is why you see the big cycle in processing times. It appears VSC is running 90-100 days average right now. as they have hired people and reassigned people to work on k Visa. For all of you waiting on NOA2 I hope the trend keeps up. I know how it feels to have gotten you NOA1 and settle in for the long unknown wait.



here's hoping then our RFE will be processed lickety split and then can get on with the next set of waiting...lol.. any move forward is a good move and appreciated.

When people ask me over and over again" So when are you leaving?, why is it taking so long? BLAH BLAH BLAH I just want to scream...lol.. so it is a normal thing. I just say "when the government allows me to go". No answer on the when anymore. My fiance and I talked last night and have decided we will have a secret wedding when I get there and marry a few months later when the weather will be nicer. I wasn't sure at first and the more we thought about it the more fun it sounded. No one will know we are married we can start the paperwork and then poof have the wedding we were going to have. As for the when should they book their vacations??? you just don't know..

Are the medical and interview appointments assigned or does the beneficiary have flexibility in making the appointments?

I just found out I can return to visit her again and we might want to slow the process down by a few weeks if necessary to assemble more pictures.

looking at your timeline you have a bit of waiting still to go. The worst thing that could happen would be you would have to go home early. But if you have signed up for checking your case online you can do it from there. I say take the opportunity to build your petition for the interview she will undergo.

I am in BC and I got THE list of required vaccinations. If you have any other questions I probably have the answer for you...

If you don't have any written proof of your vaccinations then you go to the doctor and ask for a blood test to be done as in for MMR, if you know the year you had chicken pox (varicella) then that is good enough. You only need the flu shot if you believe you will be heading down there in flu season. Make sure it is this years vaccine. Oh yes and very important... MUST HAVE THE D-TAP vaccination. it 's the tetanus,diphtheria,& pertussis.

So I've got pretty much everything done and ready to go, but i'm thinking adding a couple more things I wanted to get some feedback on.

I saw that some people were adding an "Evolution of Relationship" letter (about a page long) to tie everything together.

I was also thinking of having my mother write a brief letter that says the family knows about our relationship and approves. This also could help two-fold because my mother is a college professor who teaches English and is more than willing to help with any questions / tutoring my fiance needs.

Aside from those two things, my packet (i'm combining "proof of having met" and "proof of ongoing relatinship", already had plane tickets, itinerary for my future trip, receipts from my previous visits, moneygram receipts, calling card receipts, an itemized phone bill/statement, copies of a few emails, and scans of cards/letters we sent via regular mail.

Any other tips or advice?

You need a few photos that show the two of you doing things together, together with family and friends are very important if you can send. Think of someone seeing this information for the first time does it look like a relationship or just two friends meeting?..
Just something to consider, but yes the photos are very important.

Hi everyone!! We have been reading different posts regarding police checks from Canada. My fiance has lived in Toronto and Hamilton. Will he need a police check from each city, as well as from RCMP? We keep reading conflicting info. Also, do you inquire for these in person, phone, or online, and how long can we expect it to take? Thanks for any advice!!


RCMP police certificates cover all of Canada. He can go to his local RCMP detachment and fill out the request. It only takes about 10 days. Some cost $50.00 some are free. I had one done at the local police station and it cost $50.00 while the RCMP report was free. If you need it sooner you can request it but there may be a fee.
