If your going to tag urself as the comment police, let me enlighten you that your comment was completely inappropriate and out of line when you say STFU. We are all here for support, and your not exactly falling in that category. No one wants to listen to comments like this. Something I learned in kindergarden btw... if you dont have anything nice to say, dont say anything at all.

I disagree...I think he was completely in line in saying STFU.....but that's just my opinion. He wasn't attacking anyone with his remark...whereas the poster that was making horrible remarks about all Ukrainians was being highly inappropriate and violating TOS if I'm not mistaken...

For 2008, the most recent figures available 2,457 K-1 petitions were "withdrawn" 386 of whom later regretted the decision in a poll with a 78% response rate. ALL of them had subsequently married American women and were miserable...but no distinct correlation in the misery index was related to marrying American women in this survey.

I wish to marry my fiancee from Ukraine. I am a U.S. citizen living in Europe and can not return to Ukraine for 6 months. She is a widow with a young son, owns her own flat and a business (on paper). Ukraine does not let single woman leave easily. These are my possible options: Marry her in Ukraine by proxy (not present) and then get her a visa to USA (not likely). Get her a visa to go to her brother in Spain and marry her there. This seems to be the best option, but how do I get her to USA afterward? Does getting married first make it easier to get into the USA? What would be necessary to accomplish this? She is not in a safe situation in Ukraine and needs to get out. Please help.

The best way is K1 visa, you ask for permission, you wait and go through all the stuff like the rest of us. or
You get married now, and get K3 visa and wait and go through all the stuff and then bring her here or
She comes to the US with a tourist visa and you get married here and then you do the paperwork and tell them she's not leaving, but you might need a lawyer, I don't know how that works, but I heard that they don't like it when you do it that way, you might have more interviews if you do it that way, but if she is in danger, then what can you do.

Either way, it's very expensive, the prices have really gotten high

By way of example, and not as a limitation, you agree that when using the Service, you will not:
• Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.

when nessa and i was going thru this, vermont was the fast one - 30 days average. cali was about 90 days. give it another few years and it may be back to the speediness it was in 06.
i'd suggest the op start researching the consulate phase as that can advance fairly fast - nessa's case took about a month and a half from approval at csc to consulate approval. there is a brazil thread here for conversations and advice in portuguese.

So i have someone willing to be my affidavit but on question 3 im not sure whether to put in my name or my fiance's? and do i fill out one as well even though i have no current income? help me please!

You do not need the affidavit of support until your I-129f is approved. If your just at the beginning stage submitting to the USCIS then you don't need the affidavit of support yet.

it won't be needed until the interview, which is anywhere from 3-4 months or more after i-129f approval.

samir shannon - Thanks! I was given a bit of grace. I'm hoping the March NOA1 folks and all of the recalls get their well deserved approvals. What's up with that!!!

dunno what's going on with the ones prior to april. it does seem like they are up to 13 jul 06 imbra receipt date though.

and no approvals today.....hmmm. i'm starting to wonder if they are doing assemblyline processing - one checks for this, one checks for that, all into a big stack and then the next day do the notices.

K-1 Fiance(e) Visa Process & Proceduresfree to marry

Hypothetical situation:

Someone is 18 years of age and living in the United States. They sign a document that states the following:

I am legally able to and intend to drink alcohol within 90 days of my reaching the age of 21.

in the case of the above, the writer's english teacher would use lots of red marks on that

i am legally able to (present tense - and wrong as the person is 18)

a more accurate statement would be: when i am legally able to i intend to drink alcohol within 90 days of my reaching the age of 21.

Actually, the 'I am legally able to' can be equated to saying 'I am legally entitled to'. Now read it again with that word replacement. The two sentence fragments actually mean the same thing... or, if we wanted to make it more clear but grammatically incorrect, as a double-negative is a 'no-no'...

I am not legally unable to...
.

You get an 'F' :)

yawn. i am legally able to. i am legally entitled to. as the case above assumes the writer is 18 at the time of such, his entitlement is in the future and as such is conditional upon him or her reaching 21. as the writer has not yet reached 21, the entitlement does not yet exist. for all we know, the writer could be in jail on his 21st birthday and so much for that "entitlement"

Charles you get an A for not only being able to decipher simple sentence structure but for being able to read a government document. Which admittedly is sometimes a daunting task.

Hey people, this is crazy.

I have to go pick up my man. He's spent a long hard day slaving on the phones. I don't have to any more time to invest in this debacle.

The only reason I entered this thread in the first place was to suggest that one use caution when making what sould like bottom line unequivocable declarations of knowledge on VJ. It can gravely impact the life of posters who don't spend as much time here as we do!

A little humility here is in order. NOBODY on this board knows everything. And a search for the truth is not always what matters to USCIS/DOS anyway. They are the man with the gold and therefore they make the rules.

And that's one thing those of use who have been here a long time can attest to.

See the word AND?

I'm getting a huge headache......

Reminds me of Clinton saying 'depends on what 'is' is'.

karen, since you're the teacher on board.........
"I am legally able to...."
does that statement not apply to when they sign the document, meaning they are able to as of the date of the signing? as it don't say "i will be legally able to........" i'd think this means one must be legally able to marry on the date said document is signed.

K-1 Fiance(e) Visa Process & Proceduresfree to marry
from reading all of this, it would seem that desert fox has a very valid point. john, what is your take on things?

If there were no papers signed that in effect state that they agree that they will wait 6 months before they will be free to marry again, or that stated in more generic terms something along the lines of "they will abide by the terms and conditions set forth by applicable state law", then they are only bound by the laws of the state while they are physically within the borders of the state, which means that a legal marriage can take place elsewhere.

It really comes down to having a real attorney look at this, and, if they believe the petitioner can legally marry as of today, then let the attorney file the application as well (being sure to include the additional documentation that indicates such representation).

i believe in the situation you cite above that the state retains jurisdiction in the divorce case and if there is a 6 month ban on being remarried any other state will honor that. it's just like child support cases, the state filed in retains jurisdiction.

Wow, everybody's an expert. I tried to tell my friend that I didn't think I needed to show support for my fiance at the I-129F stage. I told him that it's not in the I-129F instructions.

and BOOM!
He got honked off a bit. I think he wanted to be the expert since he has done this once. But it just made me appreciate the collective wisdom here even more. One person's experience is valid, but the majority of experiences are even more so.

I wonder if anyone knows if delays on NOA2 approvals could be because they are running police checks at USCIS. I don't have a problem or a record but I've been married a couple times and I was just wondering if they do that on some cases to make sure there's no domestic violence in the petitioners background.

Thanks all. Getting antsy for that NOA2.

It is hard to know what USCIS is doing sometimes. Doesn't take much to cause a "delay" at one of our fine USCIS service centers. Could be anything. Weather, flu season, debates over favorite M&M color........anything. This is our Government at work!

I am glad none of you ever have to lay in a ditch and strain to see and hear what's happening over the embankment next to someone 'working' as a Marine. I can't even comprehend how that statement comes out of a Marine's mouth. When you are 'working' you have a job. When you have a job, you can quit. When you quit you will die. When you die next to another Marine, they are likely to die too.

Yes, my undies are always in a knot about some things. What comes out of your mouth is what was in your mind. And some 'jobs' aren't jobs to some people.

some of us have. and have the blue id card that goes with it ;)

Jim,...

You can spend your entire career in the Army and never leave the USA.

I dont know what Army your talking about. But my Husband has been in for 14 years,..and had to commit from the get go, to at least one term of service overseas, or overseas deployment. Best you keep, your Military knowledge, or advice to that of what you know best, The USMC.

And for the record,..my Hubby has deployed twice to Iraq, and twice to Bosnia, and also served twice in Germany, as an MP. he just recently indefinately re-enlisted to retire from the Army,...and he does give a damn about his soldiers, thats the main reason he re-upped. He goes out on convoys daily, with his life on the line every single day.

it comes down to commitment and who you are.

That is the same for any branch of the Military, Not just the Marine Corp. This is why people get so damn riled up. It seems like every Marine, has the opinion, that the Marine Corp, is the Best and ONLY, and nothing else comes close. This Once a Marine, always a Marine, may be very much true,..but the attitude you display, is not commitment to your core, nor simply trying to teach this young man a lesson (which is not your job regardless), its disrespect to all other corps. Everybody has a "job" to do, or a commitment to fulfil, if thats more your wording of choice, no one, irrespective of title, job description or core or branch of service, is less important than the other. If you think otherwise, your judgement is clouded.

And times change...what once was YOUR marine Corp, may very well be different thing today, in this politically correct world. So what if the word contract was used,..Shiatttttttttt, maybe it was a poor choice of word, but who cares,..Really??

The USCIS offers military service members being deployed an expedited service. Do not follow bad advice here.

Chat up the others that have gotten it done. It all depends on where you are being deployed.

Best of luck and we appreciate your service to our country.

The Military does not help expedite the process whatsoever.

In fact, when we went to the Base Legal aid, they told us that they were too busy with wills & estates for people who were deployed at the time, to even look over our paperwork.

actually, she's right. the military does not help expedite the process. and you're right also in that the uscis will expedite if one is in the military and being deployed.
