K-1 Fiance(e) Visa Process & ProceduresVisiting with a twist
from my past experience...i am from canada.....and 40 mins from vermont border.....when we filed, i went all the time...no questions were asked....but when i finally recieved my noa2...we called the border and asked if we could still cross, and he said no problem, but just bring your noa2 with you, and like ready4you mentioned some paperwork that shows you still have toes with canada. thats what we did, and had no problem. its just a feeling with me, that you are not in their system untill recieving your noa2. could be wrong. but....good luck and all the best on your journey (F)

K-1 Fiance(e) Visa Process & ProceduresCan we start K1 application while travelling abroad?
hey,

i'm also begian. we filed in February and got approved in 20 days at VCS. it still takes some people 6 months to get approved, but it's hard to predict. we just assumed the worst case scenario and got lucky smile.gif

assuming you'll file in Vermont, you should have your approval by August (the NOA 2 is valid for 4 months). if it for some reason took longer you can think about going to the US on a VWP untill you receive NOA 2.

my fiance is in med school in boston, his cousin will co-sponsor our affadavit. according to this website that should not at all be a problem. but i'll let you know in a couple of months when i'll (hopefully) get my visa wink.gif

K-1 Fiance(e) Visa Process & ProceduresTwo Receipt Numbers
hello,

we never got 2 receipt numbers, but we did have a similar situation. they returned the whole package because of payment problems. we didnt get a NOA1 though (if heared more stories like this). makes me think the second one is the 'real' one.

K-1 Fiance(e) Visa Process & ProceduresAffidivat of Support
we're in the same situation. i've probably already heard 15 people here say it isnt a problem, so i'm hoping they are right. my fiance filled in the I-134 with all zero's, his cousin is our co-sponsor, and filled one in too, with the evidence.
i'm just hoping that will do, but i might contact the embassy first to make sure...

K-1 Fiance(e) Visa Process & ProceduresVisit in US
neither was boston 4 weeks ago. they asked the purpose of the trip, i answered 'vacation'.

and i always hoped that it's not just 'one guy with in a bad mood' who can deny an entrance. i' always assumed if they're really gonna deny somebody they'd run it through their superior... no??

K-1 Fiance(e) Visa Process & ProceduresColor copy of the Certificate of Naturalization
filling an I-129F means you have authorization, dont worry about that. we just took a black and white copy from front and back (even though there's ntohing on the back).
we had no problems, so i'm guessing that was the right thing to do.

about the number: you need the red one as your certificate number. the other one (A) is you green card number (i think) and you need to fill it in on the I-129F and the biograph form. (where it says A number)

good luck

marjan

I know I asked this before but I just noticed that on the Certificate of Naturalization it says in bold red letter on botton left corner "IT IS PUNISHABLE BY US LAW TO COPY, PRINT OR PHOTOGRAPH THIS CERTIFICATE WITHOUT LAWFUL AUTHORITY"... I was planning on sending in a color copy of the certificate as proof of my citizenship.. Has anyone had a problem with this in the past? Can I send it in?

Also, which number do I use in form I-129F .. the cert has two number one is in RED and all it says is No. ######### and other says CIS REgistration number and it begins with A########.

thx

QUOTE (Randy and Olga @ Apr 8 2008, 02:50 PM) <{POST_SNAPBACK}>

We dont know if we should leave blank for those questions where it is needed, or "No", or "N/a"?
Thank you for your help!!

put "none" or "N/A". the example forms are very handy.

congratulations on you approval. it's funky in what order VSC approves... absolutly no way of telling when NOA 2 will come... i'm always happy to see people who filled before us getting approved (it feels wrong to get approved so fast when other people have to wait so long).

congrats!!!

hope the rest goes fast too good.gif good.gif

K-1 Fiance(e) Visa Process & ProceduresIs applying for Green card Lottery considered applying for immigration?
i agree, one can apply for an immigration visa AFTER winning the lottery. so playing the lottery isnt an application.

K-1 Fiance(e) Visa Process & ProceduresDoes too much documentation slow the process down?
it sounds right.
but when we gathered our documentation (i hadnt discoverd this amazing website yet) i called USCIS and asked a lady what they wanted. she said pictures and wedding invitations. as we're still nowhere even close form invitations i asked what else was possible, she aswered ANYTHING that shows you have a relationship (including emails and letters) . seems to me that even the people at USCIS dont know what they really want.

K-1 Fiance(e) Visa Process & ProceduresNOA2
if you went to the uscis website and created a portfolio with updates via email you'll get an email first, a week or so later you'll get the hardcopy in in the mail. updates (so called 'touches') are not sent trough email, you only see those on the website (and just means the last updated date on your portfolio changed)
good luck

K-1 Fiance(e) Visa Process & ProceduresIs it legal?
QUOTE (eric_and_teresa @ May 2 2008, 02:33 AM) <{POST_SNAPBACK}>
Its not legal, but you'd be surprised to know how many immigration lawyers tell their clients to use a non-immigrant visa wait 30 days, get married and apply for AOS. headbonk.gif

i had a immigration lawyer advice me this exact thing!! i never went to see her again. there's no way in the world i would want to lie at POE. IMO it's just way to risky.

K-1 Fiance(e) Visa Process & Proceduresk1 just mailed...but boy did I screw up
we had the same thing happen to us. also the check. we called and they said it could take up to 60 days for them to return it (boy, did i freak out). but within a week we had the whole thing back in hand. you get a rejection notice (already has a tracking number) and send it back including the check.

you might think about redoing package, it might be faster, but if you have to receive things from your fiancee abroad it might take just as long.

good luck

K-1 Fiance(e) Visa Process & Proceduresliving abroad and g325a and relationship evidence...one last question, promise!
for the living abroad: if you left for russia for 10 months i would put it in as my address for those months, it might not be permanent, but you were living there, and i assume you registered even if you only studied. i dont think it's necessary to put in short trips (assuming you meant short trips)

as for the pictures, i dont know if it'll work in your situation, but we too lost all of our pictures of the beginning of the relationship because the hard drive crashed, so when we started collecting our evidence of relationship we emailed all the people we knew back when me met, asking for pictures w/ the 2 of us in. (people who study abroad tend to take a load a pictures, and hang out with other exchange students who take just as much pictures, so we ended up with more than enough evidence in the end.)

but ofcourse, you only need those at interview stage... hope that helps...
your visa put's you in Russia, so you should be set for the evidence of meeting.

QUOTE (anka @ May 3 2008, 04:01 AM) <{POST_SNAPBACK}>
Last irriations before I mail in the petition...

Last year I lived abroad (Russia) for 10 months (I had an internship and went to University while there)... Is it necessary to include this since it was neither my permanent address nor did I live there for 12 months or more?

And does the question about working abroad apply to me even though it was an internship for study-not pay? Should I just leave it blank?

I also stayed in Russia a few times prior to the last time, though they weren't quite as long...I probably can just leave those out, right?

And, though my fiance and I lived together for the 7 months out of the 10 I was there for, I don't know if there's any "real/official" evidence of this. Ideas? Only I signed the initial rent contract and we always paid in cash--In fact everything we did together was always paid with cash--- which brings me to another question...

I am afraid we are really lacking in serious evidence to prove our relationship, even though we've been together for almost 2 years! Minimum romantic/kissy pictures to show after having my hard drive die in Nov. 2007. We never used credit cards when we went out or bought anything together ---- most everything is usually always expected to be paid in cash since credit cards are normally a hassle there or are simply not accepted as a form of payment. I mean, twice, I had flights from back to the USA that was paid with in cold cash! So...seeing that any other ideas I can use for the initial evidence to show that our relationship is "bona fide" and that we did live together? Maybe I should just send in all I have now and then (if more is required or am RFE'd) have my fiance track down our old landlady to write a statement about us living together, etc.? would this work? And we do have copies of each other's boarding passes/visa stamps/etc. from when we visited in one another's country...

Sorry for the dumb questions and for rambling on and on--- I'm just really nervous! Plus it completely sucks having spent practically every day and night with my fiance for close to a year yet having little to nothing to legally show for it! crying.gif Grr... I mean, why would we write emails to each other when we lived together?

Thanks so much everyone and, again, I apologize for these repetitive questions!!! blush.gif

Anna

K-1 Fiance(e) Visa Process & ProceduresPregnant during K1 Visa
congratulations to all the pregnant couples!!

and most airplane companies let you fly without any problems till 31 weeks pregnancy (you'll need a doctor's note for that). but you should definitely check before you book, different companies have different policies.
after 31 weeks some still let you fly if your ob/gyn agrees.

good luck

i agree with fogga4000. i flew in to boston 3 days before i got my NOA 2, it sure didnt delay my case. keep your employer letter with you. and your return ticket. but they didnt ask me anything. if they ask you cant lie ofcourse. just dont say anything unless they ask, and give minimum information.
as for the prove: we use skype aswell and i made printscreens of the whole skypehistory. more people here have done that. that way you can use that too...

good luck.

we taught, if that's the room they give us, we're gonna make it fit in there (where, when en what we were doing there). i think one paragraph is fine, but if you met online or so, you might want to clearify when you met online, and when you met in person.

good luck on your process

K-1 Fiance(e) Visa Process & ProceduresNOA1? K-1
most people get their NOA1 within the first 2weeks but every once and a while it takes upto 2 months. no idea why that is, and refilling might actually be faster in that case... one never knows when it'll get through ofcourse... if that's the way you want to go, make sure to cancel your first check and send with a delivery receipt.
IMO, you cant' do wrong with giving them a call, but chances of them giving you a real answer to your question are small.

Nice to find you over here at VJ. My fiance has visited the USA 31 times so far.

whaaw 31 times. that's crazy smile.gif

i flew over 9 times in 2year, once only leaving the US for 2 days. all short trips and once after filling the K1. the never gave me any problems. we got our approval while i was in the states, and P3 was waiting for me by the time i got home. (very nice welcome back gift )
as long as you spent reasonable amount of time in your home country, you should be fine.

good luck,

K-1 Fiance(e) Visa Process & ProceduresK-1... Immigrant or Non-Immigrant????
I was sure that the K-1 was a non-immigrant visa yet while at the consolate in Frankfurt yesterday for our interview appointment we were told otherwise. First while waiting in line outside a consolar employee came around making sure that everyone had their appointment letters and asking people if they where there for immigrant or non-immigrant visas. We replied non-immigrant but when he saw my fiance's letter he said ours was for an immigrant visa and to move to another line.
Once inside we were directed to a window labled "Immigrant".
So is a K-1 an immigrant visa??? If it is not then I don't understand why people at the US Consolate said otherwise.
What gives?

Anyway our interview appointment was successful.... to those who will have an interview in Frankfurt, check out the full review of interview that I wrote up here.

K-1 Fiance(e) Visa Process & ProceduresK1 / German Birth Certificate
We went through this process recently. My wife (then fiance) showed me the copies and I thought the same thing. I told her that she needed the origional and she said that this was as good as it got as the origional was actually a page in some city ledger book in the town where she was born.
She has(d) a both the plain one and the international but I think we just sent in regular one. We did however send in a translation that my fiance did hersef as well as a self typed certificate of translation.
Let me know and I may be able to post or send you a copy of the cert. of translation.

K-1 Fiance(e) Visa Process & ProceduresG-325A Questions
My fiance and I are in the process of filling out our G-325A biographical information forms and preparing our I-129F packet. I was wondering what we should fill out on my fiance's papers regarding his parents. They both died while he was very young and their places of birth and birth dates are unknown. Do we just put "unknown" in that section of the form? Also, under city and country of residence, do we put their last place of residence or state "deceased" in that section. Thanks guys!

I have a question to ask, my SO has had a k 1 visa and came to the usa in june 06,
then she had to leave because the relationship was not working out. and she did not over stay the 3 months.
and they did not marry, then they decide to try again, and they filed another k 1 in jan. 07 and got an interview date in june.
Then she had to cancel that because he started seeing somebody else.
We applied in april and are waiting for noa 2.
Now she is worried and doesn`t know if we will get the visa.
any idea`s ?
best of luck to everybody this week !

Too late now but I would have suggested sending a brief letter of explanation with the petition. At this point, I'd put that brief (Did I mention brief?) explanation (maybe a paragragh) in her updated letter of intent for the interview and a similar recap explaining you're aware of the situation in yours. Then visit as often as you can, including being in Bangkok at interview time. If you can attend, fine, if not let her carry your passport into the interview to demonstrate you're there suppporting her
