IR-1 / CR-1 Spouse Visa Process & ProceduresHOW'S CSC DOING WITH THE PETITIONS?
CSC will not talk to anyone other than the USC from what I understand...from Canada, the number isn't even available to me. My husband called yesterday and couldn't get anywhere with the dumb*** that answered the phone!
By the way, the 6 month/180 day processing time STARTS the day of your first NOA1, NOT when it was sent...I know it's a bummer...check my timeline! There's STILL VJ members from June that are still waiting! Those processing times on their website mean NOTHING! C'mon now...this is USCIS we're dealing with...they don't answer to anyone!

K-1 Fiance(e) Visa Process & Proceduresquestion 18 on I-129F
My husband & I met online as well and only in February. I provided letters from 2 of my friends that knew about the relationship from the day Jim and I met as well as some copies of messages sent online, copies of phone bills, pictures and I wrote my own letter explaining how we met, how I felt about the whole thing, the first time we met, etc. If you send as much evidence as possible with the petition, there's not a lot of reason they should doubt you or send you a RFE (Request for more Evidence). Good luck!

K-1 Fiance(e) Visa Process & Proceduresvisit US, get married, then stay and file papers??
QUOTE (princessdeidre @ Jan 25 2008, 06:57 PM) <{POST_SNAPBACK}>
HELP!
I live in Vancouver and my fiance lives in Montana. I have a daughter who was born in the US from a previous marriage to an american 15yrs ago. (I didn't become an american citizen during the years I was there)I want to move us to be with my fiance as soon as possible. We were thinking of putting my stuff in storage, going to 'visit' for a while in Montana, and marry while there. If we file paperwork from the US can they come and track us down and kick us out of the US once we are there even though my daughter is an american? Is it wiser to stay engaged and file the fiance visa instead?? It is very near the Canadian border so if necessary I could go to Saskatchewan for interviews, etc. Would it be wise to keep an address in Sask. and return for brief stays or would they deny re-entry to the US ???? Oh man, what to do???? How long can we 'visit' for legally? Is my daughter being american of any help to us? There is no town within 2 hours on the Sask. side or we would try living there and just commuting back and forth while the paperwork gets done! So basically, is it wiser to 'visit' and apply for a fiance visa or 'visit' and apply for a spouse visa? Can they force my american daughter to return to Canada?? Would they let me stay in the US with her in the US because she's a minor while the paperwork is done???? lol. Help answer any of this if you can, please!!!! Thank you!!!

HI Princess....it is not wise to "visit" while the process is going on...your best bet is to wait to get married (apply for a K1 visa for fiance) as there's talk of the K3 visa getting cancelled. If they ever discovered that you're actually living in the states illegally, you may never get approved for a permanent visa or for that matter, a visa of any type as they frown upon these tactics. We are all going thru the same thing here on Visa Journey...it is a long process & we all miss our loved ones deeply but it's what we all have to go thru to be legal and never have to face deportation or legal issues. Apply NOW for the K3, the longer you wait, the longer it will be before you can move. At the top of the site, there is a link to Guides, do as much reading as you possibly can...get educated on what you have to do ASAP! Every day that passes is wasted time to be with your love. When going the K3 Visa route, the consulate you'd be dealing with is in Vancouver, Montreal for easterners...there's no US Consulate in SK and no medical examiner here either, nearest place is Calgary. Good luck to you!

K-1 Fiance(e) Visa Process & ProceduresCancelling I-129F at Embassy-Best Option
QUOTE (FlyRK @ Feb 2 2008, 02:17 PM) <{POST_SNAPBACK}>
Hello,

Months ago I successfully filed a I-129F thanks to all the help from the VJ members here. It made it to the embassy in Kiev, and then due to some unfortunate circumstances based upon my ex-fiancee's dishonesty, I will not be executing the visa. The NOA2 was official on Oct 20, 2007 and if I recall correctly, it has a 120 day validity. I had not done anything official at this point, as to make sure this is what I really wanted/needed to do. It is. So, how should I go about doing this? Notify the embassy before the expiration date? Should I do nothing and let it expire? If I just let it expire, what happens with the petition? Do I need to do anything with USCIS?

Any feedback, pros and con's of one way versus another, etc. would be greatly appreciated. Thanks in advance for all your help.

Hi Krystyna, so very sorry to hear about the dishonesty...but, am glad you found out now, rather than later! I do believe you should contact the Consulate in Kiev: http://kiev.usembass...ctinfo_eng.html ... good luck to you...

very sincerely,

ja-ja, I know there are dozens\hundreds who are not VJ-ers. And those who are careless or delay with their timeline updating. But still.
The contradiction is in the fact that K1 processing seems to be proceeding (even improving a little) - according to this site again - but no approvals among VJ-ers.
Who said the approximate processing times are based on our timelines? blink.gif Contradiction. Where do they get these processing dates? Who said it's Jan 20th for Vermont today? VJ-ers' timelines that are exactly the same as they were 10 days ago? huh.gif
Hey, I am not being driven nuts, not yet, it's just annoying..

K-1 Fiance(e) Visa Process & ProceduresA silly typo on G-325A. What to do? Sit back and wait for RFE?!
Hello everyone. Recently noticed the mistake my fiancé (the applicant) made when completing the forms for K1.
G-325A. “Applicant’s residence last five years. List present address first.”
The fisrt two lines not impossible to be overlooked. It looks like this: he lived in such and such place from Sept2008 to Dec2009 (should be 2008!!!!) and then in such and such place from Dec2009 to Present time.
It’s obvious!! One can see it’s a stupid typo. But I bet the bureaucratic officials are as faultfinding as could be.
What do we do? We are 1,5months into the K1 process at Vermont. It’s annoying to sit back helplessly and wait for a RFE when you know you had made a mistake. Or is it so crucial?!
Vermont is taking ages these days just like that and a RFE would hold us back even longer than that!! cray5ol.gif
Please say what you think. Thank you.

K-3 Spouse Visa Process & ProceduresEAD or Work authorization granted at port of entry?
What I just found on the website: http://www.americanlaw.com/fiance.html

"Aliens admitted to the United States as K-3 or K-4 nonimmigrants are authorized to work incident to their status as are K-1 and K-2 nonimmigrants. However, like K-1 and K-2 nonimmigrants, K-3 and K-4 nonimmigrants must still obtain an employment authorization before commencing their employment.

Aliens classified as K-3 or K-4 who are seeking to renew their employment authorizations will be required to show that they are pursuing the immigration process. They will have to show that Form I-130 has been filed on their behalf and, if approved, that their application for an immigrant visa or their application for adjustment of status has been filed with USCIS or Department of State, as applicable."

Why aren't there many POE's following this?

K-3 Spouse Visa Process & ProceduresMy Canadian Wife
QUOTE (MsZ @ Jun 4 2008, 10:38 AM) <{POST_SNAPBACK}>
My husband comes to the US several times per month to visit. If she's got proof of her ties to Canada she's in good shape. While a guard could choose to turn her back as it is at his discretion solely, there's also a good chance he won't.

When asked the purpose of his visit he says "going to see my wife" and then they ask for how long. They've asked him a time or two about visa status or if I'm a US Citizen and he answers honestly. I am a US Citizen and we have filed for a visa but it takes forever, etc. He's never had a problem with roughly 20+ crossings.

And further, you didn't break the law getting married. In fact, you probaly could have had her stay in the US and adjust status because you didn't use her work visa solely for the purpose of getting married. But that opportunity has past. You're doing the right thing now.

File your K-3 or CR application as soon as you can. It takes a lot longer than any of us prefer so the sooner the better.

Hindsight is 20/20 and I NEVER would've filed the I-129F knowing how much it slowed down the whole process...I would file the I-130 and then leave it alone, it's on it's way, the I-129F will start the 180 day waiting process all over again. Good luck!!

PS....made 5 trips to California, was NEVER asked WHO I was visiting just "is your trip business or pleasure"...I replied with "pleasure" and I was on my way....that was the only time I was asked anything but always took my most recent pay stub, rent receipts, letter from employer, utility bills in my name, son's school registration.

QUOTE (waitingforwifey @ Jun 6 2008, 10:22 AM) <{POST_SNAPBACK}>
Hi All,

I have a couple of questions:

1] I have filed both I-130 and I-129F for K-3 visa process. However, if I want to choose just the IR-1 route, do I just call USCIS and ask them to cancel the I-129F? Or is there some paperwork required to do this?

2] My wife's birth certificate does not have her first name on it since in India, it is not required to name the baby right after the birth. Only the birth date, sex, and time of birth and name of mother and father are recorded on the certificate. So we have provided her school transcripts which show her name, her father's name and her date of birth as additional supplement to her birth certificate. Does anyone know if this could be a problem?

3] As far requirements for providing police certificate is concerned, I read that the benficiary must provide police certificates from every place they have lived since the age of 16. My wife has lived in many different cities in India after age of 16 so does that mean she will have to obtain police certificates from ALL those cities??

Thanks in advance for your assitance.

1) Yes, I would cancel it immediately as it will slow down the process...your 180 days (the time limit USCIS is supposed to follow) will restart when the I-129F is received.
2) Maybe a fellow VJ member from India can assist on this answer
3) Police certificates are from the country, not the city so not to worry, it is a federal check not just municipal.

Hope that helps a bit...I'm sure someone from India will chime in with more info for you...good luck!

Yes, the procedure is the same for K4 as K3. If no approved I-130, you'll need to file that too. I'd file it all together. You'll need three separate checks.

Thank you pushbrk, so I file an I-130 for my son, AOD & EAD for both of us. Do I not have to wait for NOA1 & NOA2's for his I-130?

jen

I-130 is filed first or concurrently. No need to wait for the NOA1. Like I said, file them all together with three separate checks. Treat each petition or application as a separate submission but put them all in the same envelope.

Not having file the I-130 for the child long ago will delay the AOS process and possibly result in two separate interviews.

Thank you once again pushbrk...and Donna...for your input, always greatly appreciated!

K-3 Spouse Visa Process & ProceduresUSPS-anyone have knowledge of how mail works?
Thank you everyone...the package is in Vancouver Customs! as of 5:55 tonight! I'm gonna try to see if I can have it redirected to the Consulate & info that I also posted in the Canadian forum:

As per the DOS website (http://travel.state....grams_1399.html):

Processing/Issuing K3 Visas
---------------------------

23. Standard IV processing is followed, including NCIC namechecks, police certificates, pertinent birth/marriage/divorce/death certificates, standard IV medical exam minus the vaccination requirement, and relationship bonafides, Ref E, 18-25. Unlike K1s and K2s, the IV system will not yet accept K3 as a visa class, and so the systems processing takes place exclusively in NIV. K3s must be issued in the country where the marriage took place, unless there is no IV or NIV issuing post in the country, see Ref E, 15-17. Applicants fill out two copies of the DS-156 NIV application form; they are not required to submit the new DS-157 form. Note that neither an I-864 or an I-134 is required; K3 applicants must present the I-864 when they adjust status in the United States with USCIS. Posts should not routinely require an I-134, except in those cases where the consular officer deems it necessary to overcome any public charge considerations that might arise from documents presented or the interview
I have read absolutely every little detail when it comes to a K3 visa and the requirements...

K-3 Spouse Visa Process & ProceduresUSPS-anyone have knowledge of how mail works?
Hi all, this is a bit off topic but wondering if there's anyone on here that works for USPS? Or knows exactly how the US mail system works? My husband mailed me, via registered mail, the I-134's last week along with his income tax return (self-employed as well as regular job) pay stubs and letters from banks. He wouldn't have waited so long but his bank took 3 weeks to get a letter to him regarding his deposits, etc for the last year (WaMu and in the end, wasn't exactly what he asked for!) He mailed them registered with USPS and I still haven't received them yet, which I should have 2 days ago for sure! Any time I mail him anything, CanadaPost tells me 7 to 10 days and everything has always reached him within 5 days. We have a tracking number but the last detail says "left Los Angeles on June 7"....no one seems to give a ####### when he calls...(typical customer service these days!) We don't even know if they'll ask us for the I-134's as they're not asked for on the checklist but you have to have them just in case they do. That's all I don't have at the moment for our interview on Monday...thinking that if I don't get them, I would tell the Consulate officer this & forward the doc's when/IF I DO get them...who knows when that would be!
1) Does anyone know if there's anything else we can do or is it out of our hands?
2) Has anyone NOT been asked for the I-134?
3) Since it's not "required", would it be a big deal to ask this of them without a denial? I have absolutely everything they've asked for & ready to hand over all of it...

Btw, we didn't go with DHL, FedEx or any other courier due to problems we had with a courier company previously...

Thank you in advance...

I just checked everything on the list, faxed it to the Consulate and got the requested date (the window I gave them was from June 3 to 17) which is June 16 for the interview. Make sure to allow enough days to receive the medical results back...I didn't realize that it takes them 3-4 days to prepare then at my cost, they will courier them to me. K-3 Spouse Visa Process & ProceduresK3 & K4 visa approvals from Canada
Woohoo! Had interview yesterday in Vancouver and heading HOME to California next week!

Showed up at US Consulate at 12:30pm, interview at 1pm...they let us in early, no problem...I was shocked at the security, worse than the airport! Vancouver airport has a Storage Consigne area, located on the Arrivals floor, that is very cheap to store a backpack, etc. We flew in yesterday morning so we didn't have a hotel room to keep anything.

First, an officer came into the waiting room and gave me a list of everything to have available in order, originals and photocopies. About 20 mins later I was called to Window B and we went thru all the documents...very nice lady I have to say. We waited for about another 20 mins, then I was called to Window 1 to do fingerprinting...had to wake my son up to get his done! lol...they had a real comfy loveseat in the waiting room & being that we had already been up since 3am, he nodded off...they all laughed. Then about 10 mins later, I was called to Window 2 were I had an absolutely WONDERFUL woman asking me stuff about how we met, which website (as she might be interested! lol), when we first met, when we got married, what did we do after (had brunch as we both LOVE breakfast & put together a patio swing!) if he has family, how much money he makes, THEY DID NOT REQUIRE THE I-134 (as I suspected and stressed about the I-134 from Jim getting stuck in Customs!) They spoke to my son for about 90 seconds, that was it! She said, "how can I not approve you? you look SO happy!" I told her that I've never been happier in my life after being a single Mom for 13 yrs!
Asked me to have a seat, 5 mins later, got called back to Window B where she explained to me what I would receive in the mail. That was it...my son & I got in the elevator and I just hugged him and cried...it's OVER and we're going HOME!
Thank you to everyone on VJ for all your help & support...may all of you have health & happiness with your cherished spouses, make every day a new day as we only have one try at this thing called life...
I will be back for AOS & EAD advice...till then, good luck & take care!!

In my case, I got a requisition from my family doctor for a Titre's test...then went to the local lab & gave them the printed off list of what I had to have the tests for (what immunity I had to what...they will test & rate if you need a booster...I needed a Tetanus booster...the lab screwed up and didn't do the MMR test therefore I had to get another one at Dr. Viljoen's office that cost me $60!!) then went back to my doc 2 weeks later and got the results to give to the doctor at my medical.

Good luck! Feel free to ask if you have any other questions...I'll try to help as much as possible!

K-3 Spouse Visa Process & ProceduresGardasil Vaccintation? Required?
I do believe that females between the ages of 14 to 27 are supposed to get the Gardasil...I would just call the physician where you will eventually be getting your medical & see what they say. Good luck!

K-3 Spouse Visa Process & ProceduresTime to complain to CIS Ombudsman?
QUOTE (gogo @ Sep 11 2008, 06:23 PM) <{POST_SNAPBACK}>
hey Jen.. how are you doing? I see you are almost all done with your journey now.. good.gif congrats on not giving up.. yeah, we are a bit over 500 days now.. and the lawsuit's time is almost up (in my signature) and at about 14 days left (out of 60). they have 60 days to respond back (with another 30 days extension), but over 95% (I checked too, made an account with PACERS - the whole court system.. they have all the cases from everyone who filed) succeed and end in "voluntary dismissal" by the plantiff (mainly because USCIS doesn't want to admit they were wrong in the 1st place).. Also, they use an excuse like : "We already finished your case and you have no reason to continue, so the lawsuit is moot".. something to that effect.. so they make up plenty of excuses not to look bad..

We are well, thank you gogo...hope you & the Mrs. are as good as can be expected, considering! Your story breaks MANY hearts on VJ...I always look you up to see how things are coming along for you two! Many prayers, always! I am soooo sorry you are going thru such extreme hell! I commend you & your wife for not letting them get the best of you & your relationship...love always prevails!
Yes, the waiting game yet again for the EAD...just wanna be working so badly! But I tell ya, the house hasn't ever been so clean & the neighbors are ready to give me an award for the yardwork! lol...just trying to keep busy & occupied...Jim LOVES all the cooking & baking too!
Wishing you & Mrs. Gogo all the very best...once again, many prayers are going out to you & your beloved!!

hugz....

K-3 Spouse Visa Process & ProceduresTime to complain to CIS Ombudsman?
Hey guys...they have 180 days to NOA2...that starts when the last NOA1 is dated, not before that. Yes, all of you are getting the same canned response via email that all of us got. If you reach the 180 days like so many of us did (I do believe gogo is at over 500 now!), THEN you can do something about it. They won't pay attention to you, actually, no one will until you hit that magical mark! Search 'gogo's' handle and read what him & his beloved have gone thru and STILL nothing done!
You need to hang tight...the squeaky wheel doesn't always get the grease. The Ombudsman won't do anything, if you need to contact anyone, focus on Vermont Senators, Congressmen, the media THERE. When we were going thru our hell, I contacted every single talk show/news show and no one replied, maybe the odd canned response.
Good luck!!

K-3 Spouse Visa Process & ProceduresTime to complain to CIS Ombudsman?
I wish you guys luck, really do! We went thru the same thing last year, waited over 180 days for our NOA2! Check out my timeline!
Emailed the Ombudsman 3x and to no avail...they just send you a "canned" response but I am hoping for all of you that it's changed. It's typical bureaucratic bullsh*t! It is SO hard to just sit and wait...waiting game, over and over and over. Now I'm waiting for the AOS & EAD! ugh! They're all scratching eachothers backs in there & no one cares, they really don't...let me rephrase that...ONE person cares & that's the woman that got us our NOA2 for the I-129F the day we called...and to this day, it's still not updated on the USCIS website! still says pending so we didn't know until it came in the mail.
Hang in there everyone! Wishing all of you the VERY best!!

K-3 Spouse Visa Process & ProceduresContents of letter from USEM
QUOTE (cieloazul @ Sep 15 2008, 07:49 PM) <{POST_SNAPBACK}>
Hello,
My wife received the notification letter (for visa interview) from the USEM yesterday but it only referenced K1/K3 visas even though we intend to apply for K4 visas for our children. Should the letter have included a reference for the K4 visa? The I-129f did include the children.

You may want to look into the website: http://manila.usemba...v/wwwh3024.html

I know when we got the interview letter, it stated that it was for K3/K4 visas. Do not hesitate to contact them.

Good luck!

K-3 Spouse Visa Process & ProceduresCheck, Money Order or Cashier's check ?

Sending the I-130 on Monday with the $355.00 ... suggestions on best way to send payment?

Also, the I-130 form says send it to a Chicago address ... but I was understood that there were only 2 processing centers now ... California & Vermont. I guess Chicago re-directs the petition to the right center?

Thanks for your input ...
Steve

Yes Steve, send it to the correct Chicago address (depending where you live) as they will forward to the appropriate office. My husband sent payment by check...any way you want to do it is fine but that seems to work well. That way you know when it was cashed instead of trying to track anything else. You can view the # from the back of the check, online banking too.

Good luck to you & yours!
