A couple days ago it was 80F here...and in Saskatoon, SK it was -69F with the wind chill! brrrrr....glad I'm not there anymore! lol had 41 winters, that was enough for me! honestly, feels pretty weird to be wearing shorts in the middle of January!

I guess maybe sending in a copy of the SSN policy document that includes the info about K-1s having work auth. for as long as their visa lasts, which is 90 days. It's iffy if we actually have work authorization, some US bodies think we do, some don't.

I don't know if you can appeal, I am sorry they decided to be crusty about it.


That's what I told my husband about it...according to SSA he is authorized to work (he even has the SSN card), so I don't know what the lady at EI was thinking. He'll call again in the beginning of the week with the SSA document in hand, ready to send to them. It's almost moot now, the I-94 expires in the middle of December. blink.gif


He should be able to still get EI backdated to when his I-94 was stamped...if you're having issues with somebody telling you different, ask to speak to Donna at the 1-877-486-1650, she knows her stuff and she knows the difference between the visas!! You'll probably have to fax in the I-94 to 1-613-969-4017...whoever your hubby spoke to doesn't know #######...if he just called the regular EI number, that would be more than likely why he got that answer...good luck!

Your employer HAS TO have the ROE to you in 5 days, that's law (I worked at an employment centre so we had to know these things). Generally, a ROE must be issued within five (5) calendar days of the interruption of earnings or the date the employer becomes aware of the interruption.
You can apply online for EI as well as fill in your "cards" online: http://www.servicecanada.gc.ca/
When EI gets your application, they will automatically send you cards in the mail (takes sometimes 2 weeks to receive them) and a "PIN" number. You can easily change your PIN by calling the toll free number (if the one they issued does not work). Getting cards does not mean you have been approved to receive EI - I got cards & thought that I was eligible until the website said the usual "we are processing your request, we hope to have a decision by Aug 14, 2008"...blah, blah, blah...I got a call today saying that I wasn't eligible...I was hoping that someone inexperienced would approve my app. Anyways, once to create a profile thru Service Canada, no need to mail anything, do it all online.

It's the US making the rules against K3's...not getting the temp work auth...EI's hands are tied as they only issue funds to those that have the stamp on the I-94. The directives to USBP is coming from the Department of State, in turn USCIS is involved there as well. I've done my homework.

I just got off the phone with Donna from EI Interstate Claim Dept (1-877-486-1650), she said that it's the US making the rules regarding K1's and K3's becuz we're going thru the US POE... if I get the stamp then by all means, I'll be getting EI... huge discrimination issue against K3's and the US gov't... if I don't get it, I will definitely be contacting a lawyer... this would cost the US gov't millions if not billions of dollars as I do believe they would have to follow the statute of limitations... reimburse all K3's that were denied EI backdating 6 yrs plus the current year...

Either way, I'm gonna be politely begging for a stamp, if they say "no" then I will tell them the snowball effect this has... gotta wait to get driver's license, SSN, no EI, etc...

No, it's not, if you would've read back a bit, you would've read the document that Gala posted...K1's are able to get EI no matter if their I-94 is stamped or not...K3's don't get it unless they beg, borrow or steal a stamp...and that would be few & far between chance.

Wow Gala...that is awesome information! Really conflicting tho between the USCIS & Canadian EI...they say there's no discrimination...ya right...
You have to really wonder why they made such a rule...a K visa is a K visa, bottom line, they should all be treated the same...you and I still have to apply for AOS & EAD...all that fun stuff...I just don't get it!

Why aren't there many POE's following this? I am going to be copying this off & taking it with me to show them at the POE...I'm also going to be contacting this lawyers office to find out their source of info...can you imagine if this is correct and there IS discrimination between fiance & spouse...how much that could cost the Canadian gov't?

Btw Gala, I would've made sure I got the gals name & ask for a copy of this "rule" emailed/faxed to you to CYA...

Is this true? From what I'm reading in this thread, basically you need to have had an EAD stamp at one of those few and far between POEs (not mine when I entered on K1), mail a copy of your I-94 with that said stamp to EI in order for them to deem you eligible because that proves, "Yes, she is actively looking for work and this stamp proves she is ready, willing, and able to as soon as she finds a job within her expertise and level."

So no EAD stamp in your I-94, no EI?

They are extremely strict but there are no consistencies, remember... this is government we are dealing with. You are not guaranteed EI tho...both K1 and K3 are non-immigrant visas and EAD must be applied for. The only way one can receive EI is to get a stamp on your I-94 at the POE or hope to God someone screws up on your application and approves it.

I am sorry for your circumstances...as the beneficiary, I remembered exactly when I had to mail in my app to remove conditions when I got my Conditional GC. Your husbands employment is based on his status, which he no longer has therefore, he is working illegally. I hope & pray that no one checks his employee file. Also, he should have only a temp drivers license based on his status as well...I know I have to mail in the extension letter to the DMV along with copies of my passport, etc. No drivers license = no insurance. Make sure you make triple copies of everything you send as I'm sure this application will mean an interview. You have been ill and yes, he's been busy BUT he should have known better...if he loses his job due to being here illegally, I'd hate to think what would happen to you financially and physically! Make sure HE sends in absolutely everything possible and HE writes the best letter of his life! Good luck to both of you!

Hey Mike...as per "Processing Times", the link on VJ top of page, it says approx. 402 days for the CR1...that's the way that we WERE going to go as it would allow me to work as soon as I got there but now we are going after the K3 for a spouse as it's only around 182 days! You would then file the I-129F as soon as you receive the NOA1...if you've already paid the fee for the I-130, you don't pay for the I-129F.

No Elvis, it doesn't go to California...you sent it to the right place and as of Sept 14th, they've completed the input & processing for app's received up to Aug 5th only. You have awhile to wait unfortunately...from the USCIS website:

Elvis...they have to approve your I-130 petition, then send you an NOA1, it is then sent to the NVC (National Visa Center), once that is approved, you'll receive an NOA2, your petition won't be going to California. This is taking a VERY long time...our I-130 should have been received in California on Aug 9th or so & we still don't have any NOA1...we can't even inquire unless we don't receive anything in 90 days! I know it's hard on all of us, we're all trying to be patient. Go to the top of the page to 'Guides' section...read up on the Flowchart...you'll be more familiar with the process. Read & educate yourself as much as possible as it's a long, gruelling process with tons of paperwork & fees. Good luck to you!

They're now telling us to wait 90 DAYS before inquiring! Over a month of waiting for us! I just shipped off an email to: USCIS-COMPLAINT@DHS.GOV ..."expressed" my concerns! That's the reason for the fee increase right, to make for more efficiency in the process?! WE are paying these people...I strongly recommend others to join me in the email! we were so perplexed, it couldn't be the visa, it was toooo fast! we had called every day and they said nothing! we then began to worry they were returning the passport without the visa due to another miniscule problem.... so he rescheduled delivery for the next wednesday and it turned out to be the magic ticket!!! a beautiful pass to enter the US legally as my husband!!! oh what joy such a simple piece of fancy paper can bring! so we flew him out 2 days later and we are soooo unbelievably happy to be together forever. never going to be apart again!!!!!

just wanted to say thanks for all the wisdom we have acquired here and all the helpful people to listen to our stupid questions. VJ truely helped us figure the small stuff out, and without it we'd still be apart moaning about how horrible immigration is.

This sound very scary to me.

My wife and I just got married and she is back home in Japan and still working. She plans to come here for a visit around Thanksgiving.

We sent in the I-130 and will send in the I-129F after we get the NOA. However, what are the rules for her entering the US before everything gets approved.

One other thing, Vermont received the I-129F exactly 3 weeks ago and I still have not received any notice and they have not yet cashed the check. Should I be worried?




She probably will not be able to get a tourist visa, but if she travels using Visa Waiver, that shouldn't be a problem.
I am also here on Visa Waiver, second time since this immigration process started.

Well, I am headed to California on Sept 29th to see my husband...the Border Patrol Officer can turn her away IF they feel she might immigrate illegally. I know I am taking any proof of my ties to Canada such as my son's school enrollment form, rent receipts, proof of employment (helps if the supervisor writes a letter stating she has taken holidays/vacation time & will be back to work on a certain date)...make sure she doesn't say anything more than what they ask...if they ask "are you travelling for business or pleasure"...you answer "pleasure" and if they ask WHO she's visiting, then she needs to be truthfull...if she starts telling them about the visa process & shows them proof that she'll be returning to her home, I think she'll be fine. I've heard more positive stories than negative. There is a CHANCE that she can be denied entry but she needs to stay calm & just go with the flow...good luck to you!

Hi sharif...click on the Guides link at the top of the page...there is all the needed info there... IR1/CR1 visa (Immigrant Visa - sometimes takes longer but she is able to work) or K3 Visa (Non-Immigrant Visa - apply for work authorization after moving to the US, work auth takes 2-3 months), you need to decide which route you're going...the flowcharts are great! Jim & I printed them off & have them hanging on our walls so we know what's coming next...good luck!!

Thank you for your prompt reply. We were contacting you regarding preventative measures...BEFORE we get to this state. You don't understand! You cannot call unless your case is outside of processing dates & if you do call, you NEVER get correct information! PLEASE CREATE A PROFILE ON VISA JOURNEY AND READ THE HEART-WRENCHING STORIES!! All we want is to be united with our loved one(s) and USCIS doesn't follow ANY sort of legislation as no one is enforcing the rules! They have NO due process and are getting away with it! MANY people have had their K3 visa applications cancelled due to the fee waiver (changes in effect July 30, 2007) and NO ONE IS HELPING US. WE are begging you to please do something!

Their last reply:
Thank you for your suggestion. Again, we regret that you are having such difficulties and we are looking into the K-3 visa process. You may also look up current processing times on the USCIS website at www.uscis.gov.If your case is outside current processing times, USCIS instructs applicants to call the 1-800 # for a service request. If your case is within processing times, there is not much that a customer service representative can do. Our office is concerned if you are having difficulties with USCIS National Customer Service number. If you call again and are having difficulties, please note the officer, date, andtime of the call and email us at the address again. We understand that you are frustrated with the delay. There you have it, in black & white! Another government organization who doesn't give a #######...just making all of you BELIEVE that they're doing something!

you can download a virtual pdf printer (just type that into the search) and then when you want to print it, choose the virtual pdf printer and check off the box that says "print to file"...then you can save it....good luck, hope this helps...
