Hi all, hate to burst your bubble but your 180 days STARTS from your first NOA1...they don't care when you mailed it, when they received it or what the priority date is. As you can see by my timeline, in about 10 days, we'll be past processing time. There's couples from June & July in line even before me. The K3 seems to slow everything down. If you've gotten a touch on your I-130 AND I-129F on the same day, that means that they've paired them together. In hindsight, I wish we would've either filed for K1, then got married as I would've been there already before Christmas, or filed ONLY the I-130. The majority of those people that filed one or the other have been approved already, interview and all is done. That would be my advice if anyone asked "if you did it all over again, how would you do it?"

Can someone please tell me what the minimum amount of income my husband would have to have based on the most recent guidelines? I have the document but I think I'm thinking about it too much & making it out to be harder than what it is! sheesh! It's for a household of 3 in total, Jim, myself and my son...I do believe for K3 is 100% and CR1/IR1 is 125%...also, on the document, would this be gross or net income? thanks very much!

I just thought of that today...that is exactly why but there's a bunch of us where NOTHING has been even touched for MONTHS and yet others that applied after us are getting their I-130's approved (and I-129F is cancelled)! We paid the $355 where others paid a lesser amount! They at least had a choice of which to pursue & we don't! We're stuck & because we aren't outside of processing times, not a damn thing can be done. This is even after the fact that this was THEIR instructions! Typical bureaucratic bull@#*!

You're welcome! This is the blurp from the Consulate's website in Vancouver Canada:

"When a fiancé(e)/spouse enters the United States in K status, she/he must have with them their passport containing the visa, the sealed packet of documents provided to them by the Consulate at the time of the visa interview, and the chest x-ray provided to them at the time of the medical examination."

Best to check with your Consulate as things seem to be changing all the time...can't keep up! Good luck!

No vaccinations are required for the K3 visa but you will need your vaccination records and any needed vaccinations in order to adjust status later. So, if you have no records, it might be less expensive to get the vaccinations in your home country. Up to you.

For me the process seems to be going much quicker with K3 and going thru the Vancouver Consulate...already had the interview date by the time the NVC mailed us anything having to do with the CR1 process! You have to account for the extra work thru the NVC as well as the waiting time at the Montreal Consulate. The time waiting for the K3 or CR1 interview at Montreal may be the same, can't see it being any different for any visa...you would have to factor in the time the NVC takes. If you're out east anyways, I would go with the CR1...we didn't go that route due to the waiting time at the Montreal Consulate. I SO agree with pushbrk...in hindsight (and we all know it's 20/20!), I would've done the CR1 process ONLY as the K3 slowed down the process big time! I'm sure the I-130 if filed alone, would've taken only around 4 months for the NOA2...then the extra wait for the NVC process and consulate would've made up for the time that it's taken us now...as per my timeline, it will be a total of almost 11 months...we could've gone the CR1 route in that time AND I'd have my EAD when I got there! IF USCIS pushed a CR1/IR1 thru as fast as a fiance, there wouldn't be any reason for K3 to even exist, then there wouldn't be a problem. People are UNDER THE IMPRESSION that a K3 will be faster...they are choosing this route to be reunited with their family as fast as possible...the fact remains that it is no longer a faster process. Everyone is better off to either file I-130 only OR not get married until after the K1 process is complete.

CR1 gets a green card without applying to adjust status but K3 doesn't. Is that discrimination? Of course not.

If a spouse needs to work immediately upon US entry, then they should obtain an immigrant visa, not a K3 non-immigrant visa. Fastest isn't always best and isn't always fastest either.

At least that information is dated Feb 2008, doesn't pertain to ANY sort of K visa, just non-immigrant VISITORS with visas.
Canadian K1 visa holders are getting the stamp, asking for it or not...it is automatic. That is what I'm saying about discrimination. Thank you for clearing that up tho about the SSN & marriage in some states...that makes sense but I don't think it's a valid reason.

Hi, my husband & I were going to go thru with the CR1/CR2 process as that is an Immigrant Visa that enables me to work when I get there. This route takes almost twice as long (stats right now) therefore he would have to apply for an I-130 for myself AND my son, one for each person therefore individual I-864's as well. We have changed our minds due to this process taking so long, just want to be together so now we will be applying for a K3 visa which is a Non-Immigrant Visa. I will have to apply for work authorization after I arrive in the US.
It all depends upon which Visa you will be applying for...only one I-864 if only one I-130 filed for your wife, kids would be listed on the I-130...
Family Based Immigration has an excellent link on their site regarding all that with step-kids...sure cleared it all up for us, unfortunately I can't post the link but it's under I-130 Petition - Alien Relative(USC) & I-129F Petition for Spouse (USC)! good luck to you!

Yup, my husband just called CSC & they told him to wait 90 DAYS before even calling now! What a bunch of #######! so, what if they "lost" our application??? that means that due to THEIR negligence (that WE are paying increased fees for!), we could be apart that much longer??!! Last week they had posted at CSC that they had applications up to Aug 14th input, now they changed it back to Aug 7th! Gee, I wonder why people try to immigrate illegally!! I am most definitely emailing USCIS-COMPLAINT@DHS.GOV & hope that others will join me! That's why Mr. Gonzalez is making the big bucks, right? He should have his ### fired!

Hi all, I think that the situation is this: they are just grabbing app's off the pile, not even looking at the postmarked date whatsoever...remember, kelzm mailed their app after us & already has their NOA1...
If you sent your app to the wrong place, they're not going to know until they open it, then they'll forward it to either CSC or TSC (if it's the I-130/I-129F).
USCIS updates their "annoucement" every Friday usually. I have added my email to their website to be informed of any news regarding anything added to their website. I do check frequently, hoping that some new news will be added, always being disappointed in the end.

this is like a ####### shoot, never know what's going to come up...good luck to everyone...

I have heard of others doing this recently but I don't think it's officially advised anywhere. If we were to do it again, we would file them together....we've been waiting I believe 48 days now for our NOA1! Something that should've only taken approx. 11 days! Good luck to you!

3) Let's just say all of that goes quickly (yeah right) and he gets an interview in Vancouver then moves to the U.S., can we still continue on the CR1 route, or will he be forced to adjust status in the U.S.? It would be nice to keep the CR1 option open and just fly up to MTL whenever he is scheduled an interview.

I know this is a waste of my thinking and time but I am so sick over this CR1 #######.

It only states (from the USCIS website, instructions for filling out the I-130):

Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage)

This can be in legible hand-writing or typed but must be signed in blue ink, so that it doesn't look like a photocopy. This is all I did & I sent in two plus wrote my own 3 page single spaced letter explaining how we met, etc. Jim & I both signed it. Hope this helps!

A tidbit of info:

On January 19, 2006, NASA launched the New Horizons spacecraft on a three-billion mile mission to Pluto to conduct a five-month study of the dwarf planet in 2015.

This means, it will take 9 years for the spacecraft to reach Pluto...betcha that's even faster than dealing with USCIS! lol...just thought I'd share that with my VJ buddies!

We got our NOA1 for the I-130 on Sept 22...we had waited 51 days...mailed our I-129F in early October...today is 70 days for the whole process and no NOA1 yet for the I-129F. What you said & asked was exactly what we were thinking! I think we're gonna end up in another backlog at each stage! From reading VJ members timelines, I'm thinking we're gonna have the I-130 process (CR1) getting WAY ahead of the K3 the way things are going.

Hang in there! It was 51 days for us before we got our NOA1 for our I-130...you're at 47....shouldn't be much longer! Keep the faith, you'll be on your way soon! Don't ever give up hope...I know they're slow...worse than turtles! Say a prayer!
