K-3 Spouse Visa Process & ProceduresTransfer Notice
Not sure about the Transfer Notice as I'm sure you didn't receive it due to USCIS error! You may have wanted to add a note on your cover sheet that you never received it...

K-3 Spouse Visa Process & ProceduresTransfer Notice
QUOTE (immillpind @ Mar 19 2008, 12:16 PM) <{POST_SNAPBACK}>
In the I-129F package list on VJ it states a Transfer Notice, but i didn't receive any, is this normal?

Also I am including 1 photo during my time in India, and perhaps phone logs, is there anything else I should consider including, or should i not even include those items?

Where did you send your I-130 application? From the Guide:
"Effective December 3, 2007, all petitioners filing stand-alone Form I-130 are encouraged to submit their petitions to the Chicago Lockbox instead of a USCIS Service Center. I-130 petitions filed with the Chicago Lockbox will be routed to, and adjudicated at, the appropriate USCIS Service Center. This routing will be based on the petitioner’s place of residence in the United States. You will receive a notice in the mail indicating what Service Center your petition was routed to.
Petitioners who reside in AK, AZ, CA, CO, Guam, HI, ID, IL, IN, IA, KS, MI, MN, MS, MT, Nebraska, NV, ND, OH, OR, SD, UT, WA, WI, or WY are encouraged to file their stand-alone Form I-130s with the Lockbox using the following address: USCIS P.O. Box 804625 Chicago, IL 60680-1029
Petitioners who reside in AL, AR, CT, DL, FL, GA, KY, LA, ME, MD, MA, MI, NH, NJ, NM, NY, NC, OK, PA, Puerto Rico, RI, SC, TN, TX, VT, VA, U.S. Virgin Islands, WV, or District of Columbia are encouraged to file their stand-alone Form I-130 with the Lockbox using the following address: USCIS P.O. Box 804616 Chicago, IL 60680-1029

Provide AS MUCH PROOF OF A BONAFIDE MARRIAGE as possible. I included our own story, 2 avidavits from friends (could ask family members to write something), pictures, names joint on bank account, any bills you may have with both names on them, anything and everything. You don't want to get an RFE as that just holds things up...more is better than not enough.

Good luck!

Hello All,
I filed a I-130 To Chicago Lock Box : Jan. 24, 2008 received N.O.A. Feb 23, 2008
Sent I-129F to VSC 02/25/06 Received N.O.A. March 01, 2008

Been checking on line USCIS Case Status and the date changed for I-29F Petition "Last Updated" 03/18/08 in the morning and by afternoon dated 03/19/08 What does that mean??? wacko.gif Two date changes in one day? Why??
Thank you for any assistance in this matter.

Paris Heart heart.gif

same thing happened to a lot of us...just pairing the I-130 and I-129F together more than likely. Any time someone "touches" your file, it generates a date change...could be just moving it from one pile to another, etc...I had 3 "touches" in a row when they paired mine and nothing since that time in October...don't mean to burst any bubble but don't get your hopes up too high...they work very slowly...

K-3 Spouse Visa Process & Proceduresyour opinions, PLEASE?
I'm in the same situation as Elbereth...my husband called & couldn't reach anyone other than the person that answered the phone with the grade two education! I'm afraid that the 180 days start when the I-129F was received...it cancels out the 2 1/2 months of waiting for the I-130's NOA1...sometimes you're lucky (such as the January filer that got approval of both I-130 and I-129F) and sometimes you're just not...unfortunately, I used to be happy for my family of VJer's that received approval, now I'm angry and turning bitter...no one dare even ask my husband! A USC of 50 yrs and that's what you get...can't even have your family united! K1's are getting faster approval than a WIFE! ugh!

QUOTE (Paris Heart @ Mar 22 2008, 10:39 AM) <{POST_SNAPBACK}>
Hello,
Could someone tell me what is a Letter of Non-Military service is. States it is necessary for interview at U.S. Embassy in Paris, France. I know about the Police Certificates needed, but what is a Statement Letter of Non-Military service and where do you get it. I saw it on the Embassy section on this website for required documents for interview. Could it be this was a requiment at one time, but not now?? The U.S. Embassy Paris does not mention this Letter only police certificates for required docs and forms.
Please advise.
Thank you,

K-3 Spouse Visa Process & ProceduresComments on the K-3 Situation
Nope, you just sit tight and wait for the I-129F NOA2...could be 6 months from THEIR received date (of your I-129F) before that happens...it's a gamble but your choice to make....that means June then NVC then Consulate...not sure how fast things move there at your Consulate...possibly check others from the Phillipines that have gone ONLY the I-130 or I-129F and see what their timelines are. I bet it's faster to go with I-130 but do the homework...

K-3 Spouse Visa Process & ProceduresComments on the K-3 Situation
I've been doing a lot of reading on USCIS & possibly will be sending this information onto Congressmen, Senators, White House, Office of the Inspector General, & the useless Ombudsman (worth a shot):

In the Adjudicator's Manual:

-nothing stated in the Administrative Cancellation of Certificates, Documents and Records
-Form I-129F, Petition for Alien Fiance states it is for when a petition for K-3 status based on an immigrant petition is filed by the same US citizen husband or wife
-no revised filing instructions of I-129F for K3/K4 visa (which is still being offered)
-the purpose of the I-129F form includes K3/K4 visas for petition

This all may be redundant but proves that everywhere I looked/searched, there is NO documentation...as stated in JustWaiting's posts regarding the K3 process. Wishing/praying for all of us in this predicament based on THEIR instructions!

Hi JT...I'll be on my 4th visit in a couple weeks since we started this...I've never had any problem getting across the border, no questions asked at all pertaining to WHO I'm visiting. I always go prepared tho, ALL documents in my carry-on...all ties to Canada as well as copies of I-130 & I-129F showing that we're doing it legally.

As per the other questions, I definitely know that we're still within processing time but the fact that people filing BOTH I-130 & I-129F later than us AND getting approval for BOTH is the question I would like answered. Even the fact that they're getting touches...I wish we were in the same boat. We haven't had a touch since October...ugh...

Ok, so this is my first time actually adding information into the forums, here goes nothing smile.gif.

I thought I'd post my data and details out there and see if others have had a similar experience or at least can show some better advice. And maybe my details can help others smile.gif.

I call myself an 'August filer', only because my I-129F was filed in August. My I-130 was filed all the way back in June!! I guess in all the hurry, I forgot to read the part where I needed the G-325 forms for the I-129F forms again (I didn't make photo copies sad.gif ), and I had to have my wife mail me here info all over again.

Anyways, something really interesting happened to me a few days ago. I called USCIS on Thursday and they finally admitted that my case was outside there processing time (including +30 days). They opened up a Service Request and and said that the CSR official who was holding our case would get in touch with use if they needed further information, they even took down my cell phone number ohmy.gif , very surprised by that, indeed. Since then our application has been touched twice!!!!! This is the first time since last August that (I'm assuming) someone eye-balled our paperwork. Very exciting (also shows my desperation)!!!!

Below you'll see our information in more details. I'm still a little confused about this term 'touched'. I'm assuming that it applies to USCIS updating there 'Updated' date on there web portal and only that? Anyways, I created a different entry 'Called' for the times I called them smile.gif.

That's GREAT! Who did you talk to?? As per gogo's instructions, my husband called today & asked to speak to an "officer" but she had NO clue as to what he was talking about! He even mentioned that an October filer got approved already but she just kept repeating that they are working on July! He got so frustrated that he hung up! If I want answers, I'm going to have to call when I'm there in 2 weeks! sheesh!

Good luck to you! Wishing for an approval soon for you!

Guess that explains the touch on Friday! Now I just have to wait for the official NOA2 letter from CSC right? Then send that and copies of all other documents on to my wife?

Jim and I called USCIS on Apr 3rd (as I was in California) and the first guy we got was a dunce, couldn't be bothered to even listen to us! So we politely said "thank you" and called again (the RFE line). There's soooo many answering the phones that everyone needs to keep calling till they get someone that does their job! The next call we made was to Officer Mangan...awesome lady! We told her the scoop, 6 months to the day that they had received our I-129F and no NOA2 or anything...she put us on hold and said she'd check. She got back on the phone & said it was with an adjudicator right now. I started talking & told her the anxiety we were having as we have a 6 week window to get my son into school there (by the time he's done school here & when it starts there). She put us on hold again, then came back online & said that she would email the adjudicator our concerns. Low and behold, Jim got the mail today & our NOA2's were there! I thought they were RFE's as our status online hasn't changed still (kinda concerned about that so if anyone has experienced this, please talk to me!). So, NOA2's for both effective April 3, 2008! I'm in absolute shock and amazement! Thank you to everyone for sharing info and experiences on VJ! Good luck to everyone! El...your hubby could get yours in the mail soon!!

Your guess is as good as anyone's...do you want to waste the time in case they're both rejected and then have to resubmit? No where does it state to file them concurrently... it's a crapshoot... good luck...
