If this is the case, unless they pay attention (which I highly doubt) if there's dependents under the age of 16 involved, we'll be screwed as we didn't send in an I-130 for my almost 16 yr old son! If they cancel the K3, then we would have to apply for yet another I-130 for him and pray that they push it thru to catch up to my I-130! There's more things to worry about for us as we don't know what happens when my son turns 16 in May...will they want him to have his own medical, etc? It's bad enough that we had to wait 51 days till our I-130 NOA1, the whole thing will end up taking over a year if this is the case. We hoping to move to California in the summer, hoping that things work out so that my son can start his grade 11 at the beginning of the school year. This is just a mess! I guess it seems to depend upon WHO is making that decision & what mood they're in that day... not following any sort of process set out as nothing says that they've put a fork in K3's!

Absolutely, I'd be on the phone in a heartbeat asking for a Supervisor, contacting my congressman as well as the Ombudsman and any other person/association that could possibly assist you. The problem is that sometimes the IR1/CR1 could possibly take longer than the K3. Thanks for posting, good luck to you & your husband.

Please help Visa Journey members! We are DESPERATE for answers! People that have applied for the I-130 visa AND the K3 (seems like after July 30, 2007) are automatically getting their K3 visa application cancelled for no apparent reason! I am absolutely devastated as my husband (USC) sent in my I-130 application on August 7th, we waited 51 days for our NOA1, then submitted the K3 application. We are HOPING to have our NOA2 for K3 by the end of March but now, I am almost having an anxiety attack just thinking about it. Please read:

I talked to CSC AGAIN today and asked specifically about the cancellation of K3's. I was told that YES, K3 applications are now going through an "administrative closure" after the I-130 is approved. It started late last year, I was never given an exact date. Those of you whose K3's are now with the NVC were perhaps processed before this went into effect. I don't know. What I do know is that it isn't worth filing the K3 visa application and may slow you down.

This is a post from a Visa Journey forum member. The problem is is that it will cost a lot of money and even MORE time (which is the most precious) to then submit an I-130 for my son, then have it catch up to my I-130, then to fly all the way to Montreal for the interview (approx. $1500 for 2 of us) rather than Vancouver for the K3, as well as hotel accomodations. It is more important for most filers to be together sooner & have extra expenses on AOS, rather than the money gained from employment as soon as we enter the US.

WE ARE BEGGING YOU TO PLEASE HELP US WITH THIS SITUATION ASAP....MANY PEOPLE HAVE ALREADY HAD THEIR K3 VISA APPLICATION CANCELLED! THIS IS FRAUD ON BEHALF OF USCIS!

not to worry, I have flown to see my husband 4 times now and I've never had a problem. I take copies of all our documents that we've submitted for a visa as well as my rent receipts, letter from employer, my son's school enrollment form, bills, anything that shows a tie to Canada...so they know I'm not planning on immigrating illegally. The worst one is Calgary, but if you're flying directly to LA from your airport, you shouldn't have any problem. I plan to be completely honest if they ever ask WHO are you visiting in the US...NEVER give them more info than necessary. If they ask what your purpose is, I always say just visiting and that's it. I'm always calm, never letting them know that I'm actually nervous as they can possibly turn you away. Have a great time in Australia!

The second time I was denied, they didn't directly tell me not to enter until I had a visa. I was given a VERY stern scolding from the guards, but no mention of not coming across until I had a visa in hand. They DID take my picture and fingerprints both times I was denied. I'm scared I would end up with THREE denials (especially if they strongly advise against trying). But, like I said...if they give me any hope whatsoever, I might try. If I do get refused, I will deal with it politely, turn around and not give any trouble.

My hubby's great-grandfather has been very sick the past couple of years, and we so desperately want him to attend the wedding. I wondered if I should try to get documents to show his illness to help our case at the border...but somehow, it feels like I'm exploiting his illness and makes me feel like a slimeball sad.gif

Mountain...it seems that filing for I-129F is holding things up for those of us that applied for both after July 30, 2007. Hindsight is 20/20 and if I was doing it all over again, I would've only applied for the I-130 for myself and my son and left it at that. I now find out that thru the Montreal consulate, I can beg them for an earlier interview date so that my son gets into school at the start of their school year! You may need someone from Columbia to answer you. Good luck!

Don't read too much into it, someone could just be glancing at it OR someone could actually be doing something with it! It would be nice to be able to get the hopes up but to be on the safe side, you don't want them crushed...

Hi Rich, YES, I CAN relate! The only difference is is that my son is almost 16 yrs old. His father barely has anything to do with him but yet says "no" just to spite me, has NOTHING to do with his son or actually wanting to keep him here due to their relationship. I have had a legal consultation and after our trip in March, my son will make a decision as to what he wants. At that time (I'm sure he'll want to move) I will have my lawyer send him a letter with my son's intentions. If he still thinks that he can beat the court system (as they weigh their decision 95% in favour of a 16 yr old wants are) then so be it, I'll fight him no matter what the cost. I'm sure he'll change his mind after he gets legal consultation as he's tighter than skin on a wiener! If it's gonna cost him any money, he'll back down.
I'm sorry that you're having such problems! I feel for you! Unfortunately, no matter how you get it but you would have to get his signature for your daughter's passport as well... ugh, it's all so nasty!

Well put Badspeller! That's EXACTLY what's happening & there's only a handful of us that are in this predicament! I say "just approve us for one or the other & let's MOVE!!" I've got a 4-6 month wait for an interview in Montreal PLUS have to send in an I-130 app for my son & WAIT AGAIN for it to catch up!

Hindsight is 20/20...if we would've known how much this K3 was going to stall things (as I see many whose I-130 app was processed in a few months without the K3 in the mix) and now, it will possibly be cancelled anyways, we would've just sent in I-130's for myself & my son. I pray that they take note of the fact that I have a 15 yr old & there's no I-130 for him. Can't imagine how long it will take if we have to yet send in an app for him then do even more waiting for it to catch up to my I-130! The thought is almost unbearable really, especially when it took 51 days for them just to open the I-130 envelope! Interviews in Montreal are approx. 3x longer (for the I-130 visa) than Vancouver (I-129F visa). Pushbrk is a plethura of information & has been there & back...follow his posts as he does his homework...
Does anyone know if we could cancel the I-129F while it is pending which could possibly lead to a quicker NOA2 for our I-130? We'd then send in an I-130 for my son & hope that they can possibly match them together...thank you...

Word has it that the I-129F is being "administratively closed" so in hindsight, I wish I would've known & just stuck with the I-130...we probably would've had our NOA2 a long time ago. The choice is yours to make though. Best wishes to you!

My son will be 16 in May, I KNOW WHAT YOU MEAN! I told him that if he didn't want to go then he will be moving in with his Dad...believe me, life is not near as good there. I am taking him to California in 3 wks so he can see what it's like AND meet his step-dad and step-brother for the first time. Remember, be a FRIEND to him, NOT an authority figure. Mom needs to put her foot down with him & tell him if he doesn't want to go, he can move RIGHT NOW! That would be the day MY son would tell me where our future is at! Good luck, they can be monsters!

PS...make sure you talk to him about this when he has a full stomach (I know, it's a constant meal going on here)... they're in a MUCH better mood after they've eaten!

Who has your case? CSC or VSC?

Also consider carefully the K-3, for the most part the CR-1 visa is taking only slightly longer than K-3. The K-3 is NOT work authorized so cannot get JOB, SSN or even a driver's license until they have EAD or Green-card. EAD take 90 days or mor to get, and AOS costs 1010 to file for the green-card + additional for child.

CR-1 results in green-card issued upon entry.

Lastly there have been many posts lately on this board of people having USCIS canceling the K-3 in favor of the CR-1.


YuAndDan: By now, everyone knows the cost and I don't know how many times you have posted this. Most people going thru this journey KNOW the costs involved. It frustrates me to no end, as for my son and myself to have I-130's, you have to add in the cost x2 for medicals (fly to Calgary $200 x 2), let alone the cost for TWO of us to fly to Montreal (approx $600 - $700 each) as well as hotel stay, meals and the cost of the visa. On the other hand for me to fly to Vancouver for the K3 visa is only maybe $250 and a very cheap hotel rate. Figure out the ENTIRE cost of everything needed for a CR1 visa as compared to a K3 visa, it's not much at all. Also, some embassys take MUCH longer to schedule the interview...Montreal: 4-6 months and Vancouver: up to 2 months. After all the waiting, the majority seems to prefer being with their spouses sooner...in our case, I prefer less cost AND less wait. I can still drive as I'm not a permanent resident until I get my AOS so I can drive (just like everyone else) on my Canadian driver's license. My husband didn't want me to work as soon as I hit the ground anyways..taking some time to adjust to the move and our new surroundings. I wish that you would understand that people on this site are more interested in being reunited ASAP...have you ever heard ONCE, anyone complaining about the cost?? NO! It's all about TIME!

Hi, I would like to introduce myself. I am a 31 year old male from the USA. My girlfriend is 38 and from Thailand. She has 2 children. We are tossing around the idea of marriage. I am not sure I am posting in the right forum but here goes. I have known my girlfriend for almost a year now. I met her during my travels through Thailand. She is not a bar girl. She has a job working at her brother in law's noodle business. She does not make very much money though, so she does not have much in terms of assets. I have been to see her in Thailand twice since meeeting. Right now the only way I get to see her is when I fly over from the States to see her. I plan on moving there to teach when I finish college. I work full time while attending school so I am running short on time to come visit her. I probobly have upwards of two years of school left. She wants to come see me here in the States and I want her to come but she cannot get a visa. We love eachother very much and plan on getting married one day anyway. I am traveling to meet her in Bangkok this thursday. I was wondering what exactly we would have to do if we were to get married during my stay. I will only be staying for nine days. We are not a hurry to get anything done. I will return alone and I was just wondering if we can complete the process with her there and me here or if anyone has any better ideas I'm game.


Red: The timeline is much better (faster) getting a K1 visa (fiance) it seems lately...maybe some couples dealing with Thailand can help you out there regarding the embassy & how long it takes to get an interview there. Good luck to you!

That is the key! Tell her to bring EVERYTHING in her carry-on that proves her ties to her country. I take my rent receipts, car lease agreement, my son's school enrollment form, letter from employer, past 3 paychecks, bills, you name it. Now I take all our copies of I-130 & I-129F...
I've been asked if my trip was business or pleasure...I answer pleasure and that's that...I also take off my wedding rings & stick them in my pocket...just to make sure they don't ask "where's your husband"? Tell her to NEVER offer up more information than absolutely necessary but be prepared to tell the absolute truth if asked...

PS...I'm on my 4th trip to the US in 12 sleeps (but who's counting) and I've never had a problem...some POE's are worse than others...

As pushbrk said: "That section is for the US Citizen to write the names of any children of their foreign spouse. If your husband is the US Citizen, he does not list his children. If he is the foreigner, he does, no matter where they live."

Absolutely, as per I-130 directions: "Please read these instructions carefully to properly complete this form. If you need more space to complete an answer, use a separate sheet(s) of paper. Write your name and Alien Registration Number (A #), if any, at the top of each sheet of paper and indicate the part and number of the item to which the answer refers. If you do not follow the instructions, U.S. Citizenship and Immigration Services (USCIS) may have to return your petition, which may delay final action." Here's the link: http://www.uscis.gov.../I-130instr.pdf Print and read thoroughly...provide as much info as possible when it comes to proving a bonafide marriage.

Not sure about the Transfer Notice as I'm sure you didn't receive it due to USCIS error! You may have wanted to add a note on your cover sheet that you never received it...
