I am wondering if they will continue with the K3 process where there are kids named on it as these people weren't anticipating having to pay the fee for the I-130 for kids....on a K3/K4 visa, they have 2 yrs to do that (the length of time b4 it expires - at that time, you can send in the I-130, 485, 765 & all other necessary forms, all together - that is what I was told as I have a 17 yr old that has K4 status). I am thinking that the petitions that come in AFTER Feb 1, 2010, must be for the CR1/IR1 process, K3 would not be an option after this date.

My wife has a friend who came here on a K-3 visa almost 2 years ago and in August her visa will expire. The problem is her husband doesnt want to renew her visa, she keeps asking him about it but he either doesnt want to talk about it or he tells her he wants to file for an extension. She is feeling her husband just wants to control her and there are other things that point to this that we dont want to go into.
The question is what are her options if he wont file the papers for her extension?

Rick...did they go thru the AOS process? so then she'd be either a Conditional Permanent Resident or Permanent Resident? that would give her a 2-yr "green card"...

To make things easier for dual citizenship guys, all you have to do is make sure your Canadian passport is kept updated...if you let it expire, I understand it takes some time to "reactivate" it, much easier to just keep renewing it.
If Jim & I were considering coming back to Canada, after all this US Immigration is done, I would start with the Canadian Immigration process ASAP. I work with Immigration Consultants who work with employers & they say that the process here is just as lengthy as in the US (unlike what they tell you on their website). You just never know what the future brings so be prepared earlier rather than later! Good luck everyone!

As per my conversation with a very knowledgeable CRA employee, you file with the CRA for Can. Income earned, and with the IRS for US income earned, they cannot be on the same tax return, simple as that. Now, if you made Canadian income while living in the US (such as working for a Can. company, getting paid in Can. funds) then you would still have to file with the CRA. She told me that one currency earned is only applicable to THAT specific country. I would call the CRA & ask to speak to someone that is knowledgeable in this area just so that you know for sure. CanadaUS Citizen to bring car from USA TO Canada
We are going to be going thru something similar....I am selling my car soon, as the lease is up in May. Jim (hubby) has a Tahoe that he doesn't drive so we will be shipping it here from California. I just did a search online for car carriers, contacted about 5 of them & they all emailed me quotes. The best one I got is less than $2,000...cheaper than driving it 1800 miles & no mileage put on the vehicle. In the long run, we will save $$. He will add me to the insurance and there won't be any problem as it can be in SK for 3 months at a time. If I have to, I'll drive to the border at that point, into the US, turn around & come back.

Does anyone know why the K3 spouse can't get EI as opposed to a K1 fiance? Neither are able to work until they go thru AOS so why should a fiance take precedence over a spouse? This baffles me but then again, its the government we're talking about...

Ok, I just called Sharon with the Commissionaires in Saskatoon here...I explicitly told her that it was for Immigration to the US...that I will be MOVING...she said it's the same process...they send in the info digitally (fingerprints and all no matter what) and I get the digital fingerprints back with the Police Certificate attached within 2 wks...the RCMP in Saskatoon do not do ANY background/criminal record checks/police certificates. She does them all the time for Travel Waivers, she told me to remind her when I go in tomorrow that it is for Permanent Residence in the US so that she can code the request properly as it's all done electronically. Thanks everyone!

PS...I just thought of something...does anyone know if my 15 yr old son (will be 16 as of May 23rd) needs to get this done as well? or is he still a minor...not sure of the age, 18? then he would've needed it done as well? ugh...all these questions!

Hi Carla & thank you again flames...yes, the Commissionaires here take care of it. I knew that as I spoke to them a couple months ago...just getting ahead of the 8 ball...the local Commissionaires office takes your fingerprints for $75 cash, sends it to Ottawa (I do believe) and within 2 wks they send you the results. Yes, I was amazed that the RCMP doesn't look after that as that's where I started calling & asking questions.
I received info (via email) from the consulate as to what my doc needs to be an approved Panel Physician. I forwarded it to him, he is thinking about it. Won't help me tho, I'll still have to go to Calgary...will be calling Dr. Viljoen's office tomorrow to see if they can do the physical now, then once I get the letter that I needed this done, fax it to them, then pay to have them send me the results.
I simply cannot WAIT to be "home"...it really is home thru and thru...Jim and I just want to start our life together...NOW! lol... My son is really excited too and discouraged that the wait has been so long! He's turning 16 soon and at least has realized the opportunities he will have over the next 2 yrs...people pay thousands of dollars to go to California and he'll be right there to see & experience it all! After high school, the choice is his, all doors open!

Hi Flames! Thank you for your reply...I will be calling the Commissionaires tomorrow, thank you for the link on another post. I have talked to them already & know that it doesn't take much time, really, especially with a clean record. I do know that the doc in Saskatoon has retired from doing the medicals for the US Consulate...I forwarded the info to my doc to see if he was interested...my last conversation with him the other day, he wasn't sure as he does not profit for medical purposes..that was his statement. I will be flying to Calgary for it, unfortunately. At least flights to Calgary thru WestJet aren't much.

I know that if I have to, I can contact the Consulate & see if I can move up the interview due to the fact I am taking my 15 yr old son with me & he needs to get settled & registered for school in Ventura, CA.

I'm in Saskatoon, grew up in Choiceland (was there for 18 yrs, Sasktoon for 23 yrs)...know PA very well as my grandparents & relatives live(d) there...thanks again...keep in touch!

Hi all...anyone that is/has recently gone thru the K3/K4 process, we would appreciate your answers...

We just got our NOA2 for our K3 so it should be (hopefully) at the NVC shortly. From what we understand, the NVC is quite prompt at getting the app forwarded to Vancouver.

What we're wondering is if I can NOW apply for the criminal record check and book the medical (or try to have it done soon) or do I have to wait for forms from the consulate to accompany the requests (for the dr appt as well as the record check)??

Your responses are greatly appreciated!

Hi all, just in case someone else needs to know, I emailed the Vancouver Consulate as there's not much info out there regarding K4's. My almost 16 yr old son will be coming with me to the US and I couldn't find info for him other than the Consulate will require the DS-157 for him (as well as the other forms) but all that other stuff, no answers anywhere...my reply back from them:

Does he need to have medical done?

· Yes, required by all applicants for K visas.



As well as Police Certificate?

· Yes, for all applicants over the age of 16.



Do we need permission from his biological Dad? (Joint custody, I am the primary custodian-Mom)

· Yes, you need a notarized letter of consent from the biological father.

K1's and K3's fill out the exact same paperwork and go thru the same process....K3's are SPOUSES, not just fiances...why do we have less rights that a fiance...no offense but I am offended by the process. Hmmm...not too sure about taking the flight the night before, I'll be talking with Jim about this more...as you're right, the next flight doesn't leave until 10:55am....I just think that getting a hotel room and having to check out at around 11am seems ridiculous to have to spend even more $$...as we all know, this visa process is getting costly but then again, if we miss our interview time, who knows...it does state on the Consulate's website that if you are delayed due to flight issues, you show up the next day at the same time (from the website: http://www.amcits.com/nvars.asp) "If an applicant is unable to make their visa appointment due to Flight Cancellations or other weather-related problems, there is no need to reschedule the appointment. Just appear at the office where the original interview was scheduled on the next visa processing day or as soon as new travel arrangements can be made. The applicant should be prepared to explain and verify the reason for the delay." Thanks everyone!

Hi all, trying to decide what flights to book for the interview date. The interview isn't until 1pm so Westjet has a flight leaving SK at 6:20am, arriving 8:30am Vancouver time which will be perfect. I would appreciate advice from anyone that has gone thru the afternoon interview, at approximately what time did you get out of the Consulate?? How long approx does it take to get to the Consulate from the airport via cab? cost? can I take a small purse seeing that we're not staying anywhere that we can store items...unless the airport has lockers??

As per my checklist for my K3/K4 visa, this is what it states:

DOCUMENTS FOR ACCOMPANYING CHILD/CHILDREN: Your child/children, if uner 21 and unmarried, may also receive a visa. Each child must have all the documents noted above (my note: does NOT say you need the 156 for them, 156K for myself, 157 (if male & over the age of 16)), except for police certificates if under the age of 16. YOU MUST SHOW THAT YOU HAVE SOLE CUSTODY OF YOUR CHILD(REN). IF YOU DON'T HAVE SOLE CUSTODY, YOU MUST OBTAIN A NOTARIZED CONSENT STATEMENT FROM THE CHILD(REN)'S BIOLOGICAL PARENT.

I do not have sole custody so I got my son's "dad" to sign him off and had it notarized. Good luck!

Hi all... seat sale is now gone on the returning flight the day (total flight is $1195.60) of our interview so we can fly back home the next day at a cheaper rate ($994.00) but need to find a cheap hotel room as we're only sleeping there (my son & myself)...the flight leaves really early the next morning...Days Inn has a minimum charge of $231 for a basic room...I am not familiar at all with Vancouver so we need something close to the Consulate...maybe should just sleep at the airport! ugh! any help would be greatly appreciated...thank you!

Just as a note -- the receipt delay is on the I-130s. The I-129f seems to be progressing a minimum of 2 months ahead. We filed our I-130 on August 15, no NOA1 received yet. Filed our I-129f on September 16, and received our NOA1 on September 18.

Still no check cashed on I-130 as of yet. By the way -- they were both sent to the same processing center -- Vermont.


Hmmm....I don't understand as you start with the I130, then when you receive your NOA1 from that, THAT is when you submit your I-129F with a copy of the NOA1....I'm confused....lol....

Leedenzz....go to the Guides section at the top of the page and the CR1 Flowchart...print it off and post it somewhere, so should your husband, so both of you know what stage is next....
With that NOA1 (or I-797 they have in the top right corner), there will be a number on it that starts with WAC or similar followed with a bunch of numbers....you can go to the USCIS website, create a profile then add that case to your profile, then you can log on whenever you like to see when they've "touched" your case....it keeps you updated....

We all know we're in for a long wait now so that's no surprise, we can all deal with that....if the NOA2's take 6 months, so be it but if we get them earlier than that, that will be a bonus! We got our WAC # from the back of Jim's cheque, took a few days before he received the official NOA1...give it a few more days Savz. Did you create an account on USCIS? You'll receive emails then whenever your case is updated...congrats by the way...I know we're all pulling our hair out waiting and this was supposed to be the "short" wait! This is gonna push everything back so now I'm thinking 4 months at least before the NOA2! Keeping fingers crossed that NVC is quicker! Best of luck!

Kinshi..Have the same problem sometimes with .pdf forms.
Print the blank forms out and fill it in by hand..


Hi...make sure your Adobe Acrobat is updated...you might want to try uninstalling then reinstalling the program. They say this could be the problem. If you have a program on your computer that highlights the fields, this may be the problem as well as I know the Google Toolbar has this option.

If this issue is foremost in the voters minds for the upcoming election, would it not make sense to send out letters to your Senator Congress rep whoever at this point? I am only suggesting this for the people that would like to take this route, again, however we deal with this issue is totally up to our make up, but this is really aimed at the outspoken peeps, like GOGO, HOHOHO, GREG (xxx) and a few others.

As you can probably tell by my rantings early in the morning I do seem to be quite vocal as it seems to make me think I made a dent somewhere for someone. Let me keep thinking that please, dont bash me for trying, but I cant just sit back and wait for another quote from USCIS that is different from the one that the poster before me got on the backlog and what is going on.

All I want is for a fairshake for everyone. Not just me, but all involved in this journey. If it takes long, then just tell us ok listen up mates, you all are sorta screwed for the next 18 months, but dont tell me a different story each day, i.e, meaning ok you should have a receipt in one week and then the next one saying you cant do that, its wrong. Why cant we just draft a manual for these people in which it states clearly the facts? When speaking to USCIS and whether it may be a CSR or Immigration Officer, I cant but think while they are talking, are they just winging it to get me off the phone or playing some war games on the computer (sorry bad joke there). To be concise in giving out information here to people that JUST WANT THEIR LOVED ONES WITH THEM SOON is not too much to ask.

Good Luck all in whatever way you to choose to deal with the wait. At least I can write for all of us here and mean it with every fibre I can muster.

Hi all, I've found that many VJers want to stand up to USCIS but most are afraid as they may be blacklisted if this is the case. We all know that none of us want to wait any longer than we have to this is why I emailed Ellen Degeneres and Oprah asking for assistance...informed them of this website, take a look at the frustration we deal with and incompetence of USCIS. I urge every VJer to email these talk shows and maybe we can get some action after all, television is the highest form of getting our message out there and with their faithfull audiences, maybe this could lead to something. Thank you & good luck to everyone!

Hi all, I've been reading thru some posts & see that some have gotten approval of the I-130 even after applying for the I-129F...
My dilemna...I have a 15 yr old son that of course, we didn't send in an I-130 for him as we also app'd for the I-129F... the way things were going, the I-129F's were being approved faster than the I-130's... what if they decide to approve my I-130 and NOT the I-129F for K3??
I'm getting freaked out the more I think about it & definitely don't want to share this with Jim (hubby)... any thoughts? greatly appreciated! Thank you!

CONGRATS JULY!! I just knew that you'd be getting yours any day, Jim got the official NOA1 in the mail today too! isn't it GREAT?!! What a huge relief, eh? Like a ton of weight off the shoulders! We were thinking that ours possibly got lost or something...would have to wait 90 days & start all over again. Was getting disheartening, wasn't it?!

Hey all! Mailed I-130 on Aug 7th and got NOA1 # from the back of Jim's check that went thru today!! Haven't yet received the official NOA1 but at least we know we're finally on our way! Took 45 days for them to approve it and 51 for us to find out! NOA1 is effective Sept 22...good luck to everyone! Wow, what a load off!
