Yes Steve, send it to the correct Chicago address (depending where you live) as they will forward to the appropriate office. My husband sent payment by check...any way you want to do it is fine but that seems to work well. That way you know when it was cashed instead of trying to track anything else. You can view the # from the back of the check, online banking too.

TONS of us can surely relate! For K3, took us 11 months but there's MANY that have waited much longer! I know it's ridiculous...remember though, they have 6 months (180 days) from the date of the LAST NOA1...that means that if you filed an I-130, the NOA date basically doesn't mean a thing! If I would've known that when we were going thru the process, we wouldn't have filed for K3! Good luck to all of you waiting...our hearts go out to you!

No, you're still employed with your company so list them - EI is not an employer, yes you can enter n/a for your husbands middle name, yes, enter unknown.

I don't think so but the instructions are vague and well - I'm paranoid! lol Also the filing fee that I pay at Scotia Bank - do I pay it for both of us or just myself? It really doesn't say and well I don't want anything to screw this up! We've waited three years to be together...
I know what you mean as my son is 16 and there's no real directions regarding kids. I went the K3 route & I had to pay for my son as well as myself, at Scotiabank (they interviewed him for about 30 seconds - no word of a lie - and it cost around $1000 to get him there for that!)

When my son and I went for the interviews, he was asked some basic questions regarding if he's looking forward to his new experience, what kind of relationship does he have with his bio Dad, if he likes his step-Dad, that was about it...cost a lot of $$$ and it took no more than 30 seconds! ugh! Serendipity...Have you called USCIS?? Your 180 days was Jan 10th! If you get some uselss *ss on the phone, just say "thank you", hang up and try for the next one...someone will eventually help you! That's what we did and we got our NOA2 right then and didn't even know it until I was back in Canada! (I was in the US when we called & it got approved that minute!) Good luck!!

To the OP: Is there a reason as to WHY you want to go thru the immigration process? I know that in California, NO ONE can ask anyone if they're LEGAL...as long as a person can show a SSN, legal or not, that's all that matters! If I were the OP, I would wait it out...for the KID'S SAKE! It's not safe for them to be in Mexico...that is the MAIN FOCUS here people...it's what's best for the kids! Btw, TONS of employers in Canada are involved in the Foreign Worker's Program...they are BEGGING for workers, especially in Saskatchewan...damn cold BUT, good working conditions and the employer is responsible for finding their workers affordable housing....many pay their workers rent as they're in such desperate need of employees! I really wish they'd get the word out to these people looking for a better life...for more info visit:

You have to file separate I-130s even if you do a K3/K4. Better by FAR just to go for the CR-1/CR-2 and forget the K3/K4.

I experienced this myself....as advised, just stay with the CR1/IR1 process...when you submit the K3/K4 paperwork, the wait starts all over again basically putting the CR1/IR1 back to square one (they have 180 days to approve the application). We could've had our visas 2-3 months earlier if we wouldn't have sent in the K3/K4 applications. Submit the I-130's for them together and go thru that process. Good luck to you!

Don't worry...my hubby couldn't be there with me either, not a problem. Yes, he will go to the Consulate in Sydney. Tell him to take evidence of a bonafide relationship...pics, emails, cards, whatever he has between the two of you. The adjudicator asked to see the pictures, that's about all. When we went for the AOS interview, he wanted to see EVERYTHING. Good luck to you and yours!

IMO, if I was to do it again, I would've stuck with the CR1 process...you file your I-130, then they have up to 180 days to approve the application...if you file the K3, the 180 days starts all over again...even tho I got stuck in the summer of '07 mess, I still would've gone the CR1 process...take a look at some timelines to see how the processes are going now. It also depends which Service Center you're dealing with, California or Vermont. Good luck!

Definitely contact them & let them know that you aren't in need of the K3 interview & that you're following the road of the I-130 (IR1/CR1 process)...you're much better off that route. It doesn't take much to call or email the consulate to let them know so they can book someone else's appointment for that time. Good luck to you.

They are separate applications therefore, separate fees. We paid the $1010 for myself and now that I found a job (finally!), we will be sending in my son's I-130 as well as AOS which will be (as long as fees haven't changed) $355 + $1010. NEXT MAY?? You have 10 months...I don't think I would apply for an extension...check out my timeline. We filed in July for AOS, had greencard in December, so 5 months...I think you're pretty safe. If I was you, I'd follow the flowchart: http://www.visajourn...amp;page=k3flow. If you don't, who knows what could happen to your petition but if you're willing to take that chance & have the process take EVEN LONGER, then go ahead and submit the I-129 paperwork. I don't think there is any real instructions as it is used for K3 and K1 petitions. From what I read:

"USCIS has been administratively closing the I-129F upon approval of the I-130. USCIS, however, is currently reviewing the I-129F/K-3 process."

If I was to do it all over again, I wouldn't have gone the K3 route. That 6 month window starts the day of your NOA1 from your I-130...if you submit the I-129F, the process basically starts all over again. It is your choice though. Good luck!

I do believe that she must sign the form herself, it is much like an avidavit. She can fill it out herself, print it and mail it to you as that is what most of us have done for these processes.
Also, I thought that the I-130 is the first application you turn in, but for some reason after reading some posts on here, I have also seen that the I-129F can also be turned in at the same time. Can anyone verify this? K3 visas: you only need the I-129F, the I-130 is for the CR1/IR1 process, what most people have done is apply for both, kind of like a race. From what I'm reading lately is that there really isn't such a thing...the I-129F is more than likely to get cancelled by USCIS and they follow the CR1/IR1 process. In my opinion & because I've been there and done that, I would just file the I-130 and follow that path - less confusion and easier process - less $$ in the end as well. If you file the I-129F, then receive the NOA1, that's when you would file the I-130...at the time that they approve the I-130, THAT'S when the 6 month window (how long they say they have time to approve the I-130 - then the waiting time you had with the I-129F is out the window!) starts. But then, that is your choice.
In addition to this, the I-130 asks for affidavits. I have affidavits, one from each of my parents, stating that they acknowledge the marriage and I play on having them notarized. However, my spouse in El Salvador only has their father near to them and he stated and signed a form, acknowledging the marriage. Is it necessary though, for it to be notarized? A copy of his national identification card (DUI) from El Salvador is attached to the affidavit he wrote.

Finally, would anyone like to elaborate upon how long it would take for my spouse to be given the K3 Visa if I begin the process and turn in the I-130 application on October 5th? I have been told by the lawyer who performed our marriage in El Salvador that it would be six months. He stated that it would not take as long as other countries, where there are many more applications pending, because our case is being filed from El Salvador. Every place is different and MANY people on here have done it on their own, it really isn't that difficult, MANY people have complained about their lawyers costing a lot of $$ and taking so long! Every country and every case is different so no one can really tell you how long it would take, unfortunately. You can only look up timelines from others from El Salvador and think that it MAY take as long.

Are you talking about affidavits from friends/family about YOUR marriage and proving that it is legitimate? All I had were 2 friends do a little write-up about my husbands and my marriage, how we met, how often I visit, etc. If he is divorced, he needs the Divorce Decree (the legal papers). It doesn't say anything on the G-325A to attach a pic....just on the I-130, you need to attach ONE pic of each person, a G-325A for each person as well. That's correct regarding the birth certificate...just the US Citizen must submit it, it doesn't say anything regarding the beneficiary's b/c. I put the pics (make sure you lightly print full names on the back of each) in a ziploc bag & stapled that bag to the form. Good luck!

Was the visa a K1? Yes, you have to wait for the EAD in order to get the SSN - I would take a certified copy of the marriage certificate with you when applying for the SSN, fill the app out in the married name. You can apply for a new passport at any time with a name change as long as you're willing to pay again. good luck.

We called the USCIS on October 19 to upgrade the petition, they sent an email asking to fax the naturalization which we did !! Since then, we didn't hear anything from them ! no confirmation letter received ,, online status is still unchanged!
When you call USCIS they keep telling you have to wait 45 days before making any further inquiry!

Yes, that is it...be VERY prepared that the K3 will be cancelled and the IR/CR1 will be moving forward. Make sure that your spouse has all the required vaccinations!! it can be costly if it has to be done by the Physician (approved by the Consulate)...start gathering ALL documents for the I-864, the more the better and less worry later on. Make sure you have everything!!...

Pre-Interview Forms / Items:
1. Completed and signed OF-169.
2. Completed and signed Of-230 Part 1 and 2 forms.
3. I-864 Affidavit of Support Form along with past 3 year U.S tax returns (or transcripts) and any other financial documents required.
4. A copy of intending immigrants biographic page of passport(s) including expiration date.
5. Original or certified "long" birth certificate. *
6. Original adoption decree. (if applicable)
7. Marriage certificate. (if applicable)
8. Divorce decree(s) or death certificate(s) (if applicable)
9. Police certificate(s) **

You can email the Embassy: consularcairoNIV@state.gov That is questions regarding a K3 visa....make sure to enter your case # in the subject line...I would also ask them to direct you to who can answer your questions regarding a tourist visa. When travelling, make sure to take plenty of evidence that you will return to your country, ie: rent receipts or mortgage papers, utilities in your name, bank statement...anything that will link you to your country.

Please follow the guide: http://www.visajourn...page=i130guide1 , it is extremely helpful! follow all directions very carefully. If you're getting married, you file AFTER the fact...if you want to bring her over here as a fiance then get married here, you file for a K1 visa.
The CR1 visa is a conditional visa where you would have to apply just before the 2 yrs is up to remove conditions...it is for a couple that is married less than 2 yrs...
A K3 visa is basically being phased out & will take longer....I went thru this process before they started this. If I was to go thru it again, I would most definitely do the CR1 visa...

my husbands packet 3 was sent out on Dec. 8th, but to the wrong address (we just found this out on NYE) - I emailed the Embassy in London with the proper code to update the address. I believe we have already taken care of everything for the packet 3 because our attorney sent us the checklist and documents and we sent them back in to her. Is there any need to worry about him not receiving packet 3 because it was sent to the wrong address or is it more or less just a guidance packet of forms and documents to gather prior to the interview?

Secondly, my husband received an expedite from the Embassy in London and the NVC in the US sent our file to them on Dec. 22 - any idea as to when he may get his packet 4 and/or interview? The Embassy has not entered it in the system as received yet even though it was sent on the 22nd (but this is probably due to the holidays.) I'm hoping the expedite approval will help him get an interview a bit faster than normal...but I have no idea!

I met my wife through an Indian matrimonial website and am now waiting for her I-130/129F K3 to get approved (I'm a US citizen of Indian origin and my wife is Indian). Just wondering if anyone on the website has met their spouse through such websites and applied for K3 visas (would specifically like to hear from Indian folks who met their spouses through websites like shaadi.com or jeevansathi.com or indiandating.com) and what your experience has been through the approval process. My wife and I had a relationship (online, phone etc) for 2 months, realized we loved each other and wanted to get married and did so. When I sent the I-129F in, I sent them all the info - starting with acceptance notices of when my wife accepted my initial contact through the matrimonial website, all phone records proving our relationship during our "courting" period, a whole slew of our emails and chats showing evidence of our relationship, receipts of -1800 Flowers of flowers that I sent her etc etc. So wondering what people's experiences have been in similar situations.

All, Would moving to a new house and change of address will cause a delay in filing and updating cases? (In my case, I-130 and I-129F for wife's K3). Has anyone had any experience with this? Do you have to report the change of address? can you still keep permanent address the same (especially if you're only moving 2-3 blocks away)? I know that FBI checks are done for security checks and I'm wondering if getting a new utility bill with the new address would show up on their "grid"? Anyone have any experience with this?

No, being married to a US citizen does not entitle her to live or work in the US. To work in the US she'll need a work visa, typically requiring being sponsored by a US company, - which can take up to a year to get. Work visas are becoming increasingly difficult to come by with this economic situation.

K-3 Spouse Visa Process & ProceduresWHAT IS MY STEP-SON FILES AS ON AN I-130?

The K visa for spouses *may* provide a major benefit for older stepchildren. Until now, a US Citizen would file an I-130 for the foreign spouse, and separate I-130 petitions for each child or step-child. Stepchildren would only be eligible if the marriage took place before the stepchild's 18th birthday. The revised I-129F will automatically include all children under 21, with no separate petition required, removing a major disparity between current K1/K2 and spousal immigrant visa processes. However, Although a separate I-130 petition is not required for the children to obtain a K4 visa, an approved I-130 petition is required before they may be approved for Adjustment of Status to permanent resident. The I-130 petition still states the U.S. Citizen petitioner may not file for a stepchild, unless the marriage took place before the stepchild's 18th birthday. This detail must be addressed, in order to prevent an older stepchild from moving here on a K4 visa, yet being denied approval of the I-130 petition.

You are correct, you must file an I-130 for your step-son as my husband had to do for my son....yes, more money! ugh...you can file all forms concurrently. Good luck!

I am wondering if they will continue with the K3 process where there are kids named on it as these people weren't anticipating having to pay the fee for the I-130 for kids....on a K3/K4 visa, they have 2 yrs to do that (the length of time b4 it expires - at that time, you can send in the I-130, 485, 765 & all other necessary forms, all together - that is what I was told as I have a 17 yr old that has K4 status). I am thinking that the petitions that come in AFTER Feb 1, 2010, must be for the CR1/IR1 process, K3 would not be an option after this date.
