K-1 Fiance(e) Visa Process & Procedures2 NVC Letters Received
The same thing happened to me. I received two letters that were identical except for the dates. I don't what the reason was, but I wasn't concerned and it wasn't a problem.

K-1 Fiance(e) Visa Process & ProceduresIs that NOA2 form?

That is actually the letter that comes after the NOA2. When USCIS approves your petition they are supposed to notify you with a NOA2 and then send the petition to NVC. NVC sent you the letter to let you know that they received the approved petition and will forward it to the Embassy.

I'm not sure why you haven't received an NOA2 yet, maybe lost in the mail, but the good news is that your petition has been approved and is on it's way to the Embassy. Start organizing your evidence and preparing for the interview.

Good luck!

In addition to that... if you haven't received NOA2 yet, you probably should call USCIS and let them know. You need a copy of it for AOS, and if they think it's your fault, they charge you several hundred bucks to replace it.

Good point. I should have been more thorough in my answer.

Hi, i was reading the post and said something about timeline? what kind of timeline are u talking about? is there a specific form to fill in this timeline how the couple meet? I sent my I129F package in 10/21 and received NOA 1 in 10/27. So.... i guess i just have to wait... I also read something about packet 3, what is that? and when will i expect that... thank you

the timeline is in relation to this website. it will calculate estimates of your approximate expected waiting time using the processing times of other users from the website.

Actually, what I'm refering to is a different timeline altogether. Some Embassies, HCMC being one of them, will ask for a chronological timeline of the relationship as part of the evidence. I basically wrote a list of all important dates during our relationship and injected paragraphs at certain points to give a more complete description of our relationship. I included how we met, how we communicated, when I sent gifts, when I visited and what we did. Prety much all the personal details that are not included in the timelines associated with our profiles here in VJ.

Good luck!

The I-134 is not part of the Petition and is submitted at the interview. I did not have anything notarized for my petition. My cover letter included the same statement about photo copies being exact duplicates of the original documents. The only things I had notarized during the entire process were the I-134 and my timeline of our relationship, both of which were submitted at the interview.

A note about the timeline and other forms of evidence of the relationship: I did not include any evidence of our relationship in my petition, only evidence of having met in the past two years. Our case was approved, but I would strongly recommend including any evidence of your relationship that you have now with your petition, including a notarized timeline. The reason is that in many cases the CO may have already made a decision on your case before the interview. In our case, the CO already had the pink slip filled out before the interview and signed it after asking a few questions and looking at our photos. He never looked at any other piece of evidence at the interview. So, any evidence you can provide before the interview is very helpful. The timeline is not included on any checklist. I had read about couples having to submit one at the interview, so, I emailed our Embassy to inquire about this. I received a standard reply that timelines are requested on a case by case basis at the time of the interview. I wanted to avoid any possible delays, so, I sent a notarized timeline for my fiancee to have at the interview just in case it was requested. It was not, but I still recommend doing so. Better safe than sorry.

Good luck!

Every Embassy is required to accept co-sponsors. So that is not a problem.

Sorry, not true. Try telling that to the HCMC Embassy in Vietnam.

I hate to be the bearer of bad new, but $14,000 is the poverty level for a 2 person household. The requirement for sponsorship in this case is actually 125% of that figure, or $17,600. So, yes, you will need a cosponsor unless you have assets with a value of three times the amount you are short. If you are short $3,600 in income, then you will need to show proof of having at least $10,800 either in bank accounts, real estate holdings, investments or a combination. Keep in mind that this will only give you the minimum requirements, but is probably not a safe margin, since Consulates don't always follow the letter of the law.

I passed only showing income of $20,000 in 2007, but I did submit paystubs for 2008 showing an income of $35,000 as of the date of our interview. Whether those paystubs were even considered, I can't say. My point is that more than $17,600 would be advisable.

If you can't use a cosponsor and don't have assests to offset your lack of income in 2007, what about your 2008 income? You said you got a new job this year. Will your income in 2008 be sufficient? I'm not sure exactly what your options would be, but maybe you can delay your interview a few months until you can file your 2008 tax return and use that instead of 2007's. I know they may ask for 2 or even 3 years of tax returns as proof, but the bottom line is that if you know you don't qualify now, there is no point in having your case denied and having to start over. At least you MIGHT(emphasis on might) have a chance by delaying your case until you qualify.

I'm just thinking outloud here. I'm sure someone else will have some more information than I can give you.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresHas anyone ever sent in an ADDENDUM?
No, it can't hurt and I'll tell you why. YOU ARE NOT GOING TO SEND AN IMPORTANT ORIGINAL DOCUMENT WITHOUT AN RFE! You didn't send any important original documents with your petition, so, why would you do it now? What you are going to do is send a photo copy of the original document along with a cover letter that states, "Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.", just like you did when you initially filed your petition(don't forget to include your case number, ie: WACXXXXXXXXXX).

Of course things can happen after you submit your petition that might impact your chances of success. That's life, s**t happens and no amount of preparation is ever going to change that. Is there a good chance that your addendum will make it into your file? Maybe not, but there definitely is a chance. Regardless, you will have the originals to present at the interview if necessary. So, what will you have lost besides the postage you spent sending in the addendum?

Straight from 'pending' to 'approved'. No touches. Don't worry, it's still early for you. Be patient.

K-1 Fiance(e) Visa Process & ProceduresVisiting within last two years...is 1 time sufficient?
My fiancee just passed her interview yesterday in HCMC. I have visited her twice but only once before I submitted my petition so the only evidence the CO had before the interview was the one visit. He had the pink slip filled out before the interview so could not have taken the second visit into account.

By no means am I suggesting that one visit is all it takes. I'm just saying that it is possible, but depends on the individual case. The important factor is how convincing your evidence from that one visit is. To simply say, 'one visit', is grossly oversimplifying the situation. What happened during the one visit? How long was it? What kind of evidence can you supply from the one visit? Especially photos, which in my opinion are way more convincing than any amount of chat logs or emails.

Also, I would recomend posting your questions in the Asian Forum only because Thailand, like Vietnam, probably has a higher burden of proof than other countries

Good luck.
