K-1 Fiance(e) Visa Process & ProceduresForeign Fiance flipping out...
I think if anyone is truly honest about it, will agree that moving from your home country and starting a new life (even if it is with the most amazing person in the world) is a little or a lot scary.

The only thing familiar is the one you love. :luv:

It is so important to reassure, express how much you love them, tell them your hopes and dreams for your future together, and FIND out what their dreams are. Then help them plan these. If everything seems like an unknown, that is scary. Maybe you might check into English speaking courses. Work out a budget for schooling or find info for job searches. You can only decorate for just so long.

I'm Canadian and familiar with the US and will travel back and forth yet I WILL MISS the close proximity of my friends and the ability to just hang out in all my local places. I have done the research and have plans for my new life there and I'm looking forward to this opportunity and joyful life, with my best friend and partner.

Shes has anxiety and I think this is NORMAL. Let her vent and reassure, reassure, and reassure some more.

all the best to you both!

K-1 Fiance(e) Visa Process & Proceduresdivorce papers certified or not?

My boyfriend, who is the petitioner for our I-129F has been married before.
Does he need to get certified divorce papers from the court or can he just photocopy the papers that he has?
The instructions state "give copies of documents showing that each prior marriage was legally determinated" and "Unless specifically required that an original document be filed with an application or petition, an ordinary legible photocopy may be submitted."
So I would say a photocopy would be enough, but I read on the RFE Master list, that some people got an RFE, saying to send in certified papers. Did they maybe change the rules in the past?

Get a certified copy from the court. i sent an original for electronic Processing but it didn't have a court seal on it. i got an RFE for that so went down to the supreme court and they said the US government want an original certified copy with a seal on it. don't take a chance on the dreaded RFE!

Its nice to see someone who is honest and seeking help, it takes courage to do this on a public forum. Its a large weight for you both I'm sure. I have no helpful advice other than to seek some legal counsel and I hope there is someone out there who has access to that info in the US for you and your family. Honesty will serve you well!

I hope things will work out in the best way for all of you.

K-1 Fiance(e) Visa Process & ProceduresPreparing for Interview
Hi,

The panel physician makes the decision according to the government website. What if the applicant has a history of harmful or violent behavior?

Applicants with any history of harmful or violent behavior resulting in injury to people or animals, or harm to inanimate objects must provide information that will allow the panel physician to determine if the behavior was related to a psychiatric or medical problem, or to drug or alcohol use. Harmful behavior includes attempted suicide or self-harm, no matter how minor in nature.

If the panel physician had the information and gave him an okay then he obviously felt that medically he is fine. Having letters from his physician was a good thing.

All the best!

K-1 Fiance(e) Visa Process & ProceduresDo we have time?
Hi,

Canadians and the US have had an amicable relationship so I think we thought ( we did ) it surely won't take too long. A lawyer told us 5-6months at the most. Well Cr1 journey for us took 14 months. There was a problem with an RFE for a passport photo that was lost somewhere. Also a hiccup in the EP processing. If we had any concrete plans we would have been up s$it creek so to speak.

I hope you plan carefully and hope that MONTREAL SPEEDS UP!!! June case completes are still waiting for an interview.

All the best to you and your future partner. This should be a stress free journey !!

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
Do you have telephone records as well that may help proving your relationship. What about gas bills, restaurant bills, etc. on a credit card for your trips to visit.

Usually on digital camera's if you haven't deleted the images on the CF card the date and time remains allowing you to print that.

How about printing emails if you have saved them they have the date on those as well. Also text messages can be printed....

Hope this helps!!!

By the way keep track of your border crossing you will need those dates later:thumbs:

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

We received an RFE for lack of evidence, travelling to and from Canada no passport stamps, travelled by car so no boarding passes. Sent receipts, photos, engagement ring receipt too, not good enough. The only border document I have is a "temporary importation" that I filed with Canadian Customs to bring the ring into Canada the weekend I proposed (I didn't include it in the petition). It has my fiancee's name and is stamped and dated by Canadian customs. I have some other supporting evidence to submit and will try to write a better explaination as to how our relationship was established. I don't know if I should just submit the new documents or send all the evidence again new and previously submitted? The letter also stated that I should submit "film dated" photos, we sent photos that were not printed with the date. Should I have the photos reprinted and include the date if possible? They are digital photos so it maybe an option to have the date if the camera was setup properly. Maybe it would look "doctored up" to do that now. I going to send a couple of letters from people who know as as a couple and have seen us together. Don't know what else I can do, any other ideas?

I understand that you're worried about your package arriving. There are many of us who filed over a month ago and haven't heard anything yet either. It's hard when you have no idea whats going on! Hopefully we'll start seeing some NOA's for that timeframe soon and we can feel better knowing that our process has started. Hang in there smile.gif

Thank you for all your help!

DS 3032 is your Agent of Choice which you assigned someone to do the rest of your documents with you and usually the spouse that is in the US side because it does shorten the case in days. You can do that one online using the benificiary's e mail account e mailing it to the NVC.

So, is this form sent along with the packet of "IV Information"...?
(And does this form still apply if we're both outside the US...?)

Again, TIA...you're information/advice if VERY helpful:-)

Okay, so I just checked out those threads...and surprise, surprise...am even MORE confused now! :-)
I'm just not sure how much of those guides apply when you file DCF...?

My husband is American, I'm Canadian and we live in Vancouver, Canada.
We filed our I-130 via DCF at the US Consulate in Vancouver for a CR1 visa.

We were given a form right away that says "Your immigrant petition (I-130) has been accepted -- what happens next?"

It says we will be sent a case file number from Montreal and a packet of information. It says there will be a DS-230 part 1 included and that this should be filled out an mailed right away.
At the bottom of the form there is a section titled "Reminder on Domicile for the Affidavit of Support (I-864) "

Looking through the threads poste above, I see references to an "NOA2" etc...I have no idea what this is...?!
Maybe I don't need that since we filed DCF...?
Also, is it possible we would start the recommended steps in those threads part-way through since we filed DCF...?
(For example, I have no idea if our case goes through NVC...or just Montreal...?)

Sigh.
Sorry to be so confused...but any help is appreciated crying.gif

Thanks:-)

My advice is research, read the guides, wiki, and forums. Search answers on VJ or post your question when lost. (i personally searched and searched first. lol)

The guides really help and the instruction on the petition gives you everything. I followed the I-130 guide & the K3 guides on VJ. I also managed to talk to someone from the Blaine/Vancouver border patrol. Since I couldnt access the US phone numbers, i called the border and the lady that I talked to sent me a bunch of info (some from VJ) and it was also helpful that she had to do the immigration process for her husband previously. So, I had the inside scoop from a border patrol. I am glad to forward her email to you if you'd like. Also, i do not find the Vancouver Consulate very friendly on the emails. They always give me answers I already know and they are never clear or only have 5 word answers. That's how i started spending more time on VJ.

i received both approval on the same day recently. So now, im just waiting for docs from NVC and currently gathering my documents so there arent any last minute worries. do not stress out and be patient. I think i was too hyped up with moving that i read too much info and started worrying. lol. Im almost done with all my documents.

Since you're in vancouver, here are links that helped me out during my journey from Vanc and currently moving to washington:

1. Take a look at the guides (not sure if you are k1/2/3) and/or CR1/IR1(i followed every single step and i never received RFE)
2. check out the flow chart
3. If you are having problems with the forms, check the EXAMPLE forms
4. Once you have approval notice:check out LingChe Shortcut on wiki (i find it more helpful that James shortcut)
5. Info on Vancouver Consulate: http://www.visajourn...p;cty=Vancouver

Good Luck!

I'm so sorry! I just saw this post now...not sure how I missed it!

THANK you so much for your advice...
My husband and I actually went to the Vancouver US Consulate yesterday and filed our I-130! Whoo-hoo!

If you don't mind me asking, what are the next steps I should be getting ready for...?
I think they'll be sending us a DS280 (or something like that) and then I'll have to get a medical, police checks etc...
BUT I am confused about the I-864... do they send this form as well....?
Is there a place on this forum I can look (sorry, am still new and having trouble figuring out where everything is) to see what the I-864 asks and what tax forms needs to be filled out...?

Sorry for all the questions...But TIA for you help:-)

The more supporting DOCUMENTS you have and better preferred the less DELAY you will have. I was done with my paperworks from NVCand case was completed in 25 days... that's 2 RFEs, 1 holiday and alot of patience. I think the record was 11 days that went through NVC. All certified and original documents you have is better to make copies of everything you mailed. Try to get at least 2 Certified copies of evrything as you may be better off than only having one. Goodluck... I got my Interview schedule on APR 21... dumping the K3 as I paid the CR1 already. GOODLUCK!!!

You will NEED the ORIGINAL BC OR THE Certified Copy of your BC in order to continue with you progress. You may have misread that part...if one don't have BC then how they are going to verified that's the proper person. If you don't provide BC along the way then they will ask for the RFE (Record of Evidence), your case will be delay until further documents received. I hope this helps...

Thanks so much for your help!
I actually got an e-mail back from the Vancouver conuslate today (i know, weird! kicking.gif ) and they said if we're filing in person at the Vancouver consulate we need the BC...apparently if we were mailing it in we wouldn't need it...at least not right away. We'd obviously need it at some point though:-) I was just hoping to get the I-130 filed right away...instead of waiting another month and a half for my long-form BC...

Hi there,

I've just read over the supporting documents needed to file with the I-130 outlined in this pinned thread...
(It's somewhere in the "how to assemble the I-130 packet" info I think...)

On the list here, it has crossed out the intended benefiary's birth certificate and notes that this documet is no longer required..
However, in an e-mail I received from the US Consulate here in Vancouver, Canada, it lists this as required...
(granted, that e-mail was from a couple months ago...)

Does anyone know which one is correct..? wacko.gif

(I am the beneficiary...My Husband is American. But I would rather NOT have to wait to order a long-form birth certificate, which would take who-knows-how-long to receive, before filing the I-130... I want him to file the I-130 sooner than later:-))

Thanks in advance for any help!

The AR-11 appears to be only used if I am living in the U.S. and I am in Canada still. Do we still use it or another form, or will they do it over the phone through customer service? I am assuming the Consulate in Vancouver will change it over the phone, however, at what point can they change it? Do they have access to our file now before it has been approved?

Right now they're taking weeks to open emails and 30 business days from that opening to do anything bout the information.  NVC is extraordinarily slow right now.  Average time through is 55 days including expedites. :(

The IV bill is taking a full 30 business days from DS-261 submission to be notified of invoice (and then another week to be invoiced).

Yes and they seem getting slower everyday. I was hoping I will be done with NVC by now but I still have long way to go they way things are moving.

Hey,
Welcome to the forum
To see when your case has been "touched" go to www.uscis.gov click case status online in first page, then click to register. Follow the prompts and make sure you sign up for email updates. Where it says last updated, there is usually a date. The date changes when your case has undergone some kind of internal processing. It means, someone looked at it or it was moved from somewhere or something. It's usually an indicator that yoru case will be approved or you will ge RFE, if it has been touched repeatedly. GOod luck to you.

Thanks a lot. I just registered and saw that my case was touched last time on Aug 12,2008. Lets see what happens next. Good luck to u too.
