Hey friends, I have a quick question

Once NVC has completed the processing of your case and ready to forward the case to home country, how do they inform the applicant? Do they send the letter to beneficiery or spouse in US?

I have submitted all of my documents, requested by NVC in RFE ,3-4 weeks ago but still no response. Does NVC inform applicant once they are done with the processing or not? Is there any website where I can see the status of my application online?

Do you think it's okay to write the country code for my fiances phone number in front of the boxes provided because it doesn't fit the entire number plus the code, or should I just leave the phone number without the country code and make a note in a continuation page that there should be a country code?

Hello, I am the petitioner for my Brazilian fiance. I have gathered everything but I am absolutely terrified of getting an RFE because I want this process to go as fast/smoothly as possible. Does the checklist look good? Do you think it is enough?

 

1. I129F cover letter

2. I129F form + 4 signed and dated attachments (the new form is formatted terribly and I wanted to make sure there were no misunderstandings...)

I was wondering... I graduate in march so I won't be able to get a job until then. I sent the petition for the k1 visa recently. I'm wondering... if I end up having to fill out the I-134 before I have a job, can I get my parents to sponsor my fiance for the I-134? They are okay with this, as I will have a job before he comes here. I consulted a lawyer before and she mentioned this is okay but I'm wondering if anyone else has heard of someone doing this?

Hello,

So far I haven't encountered any problems with the K-1 visa, but tomorrow is my fiance's interview, and I'm very nervous.

All the documents are together, but I'm wondering if our skype records are enough to show proof of an ongoing relationship. We talk everyday over skype for usually large amounts of time. But I was wondering if the documents sent in the petition will also be reviewed at the interview? I sent a lot of photos, and itineraries in the petition. Do those need to be printed again and taken to the interview, or will they already have them?

Hi everyone,

So, me and my now fiancee are just looking into all the Visa options, and everything is so confusing! Im not too sure where to post this topic but, after reading through the guides, it seems like the IR-1/CR-1 visa is the best route? I just have a few basic questions....and I apologize, as I am sure they have been asked a million times. I am from Canada and he is American.

1) Which visa is the most recommended: K-1, K-3 or IR-1/CR-1?
2)If we were to apply for the IR-1/CR-1 after we were married, can I move to the states while it is being processed or do I have to wait until I am actually approved? If not, am I able to go to the US to visit or am I stranded in Canada away from him while we await the approval?
3)Is he able to visit me while we are waiting for it to be processed?
4)Do we have to be married in the US, or can we be married in Canada?
5) Are the parameters for visiting while the visa is being processed after marriage the same for the k-3 and the IR-1/CR-1 Visas?
6)I know this is an american immigration website but just wondering if anyone knows if the process is easier for him to immigrate to Canada than me to go to America?

If you filing for IR/CR1 then select permananet resident.
The A number and The Alien Registration number are assigned if they have been issued a visa/green card before.
If no just put n/a.
To make your process easier and to prevent questions from the uscis for rfe I would get the last name changed after you get married. The super quick wedding might make them question your relationship. Make sure that you have pictures of the wedding no matter how simple it is. Pictures of any and everything well be needed in the process. Also remember to generate a paper trail (letters, cards, phone records, etc.) it will be needed for the interview. Hope you journey is a smooth one.



We will be having our actual ceremony before I get the interview I am assuming, so we will have pictures of that to show at that time. Will that be sufficient??
Also, what if we just said we have decided to not change my name and keep my last name? I mean tons of people do that. We could always not change it right after our big ceremony in february and just wait until I have my actual visa. and say i changed my mind??

Hi guys!!

I am getting married sept 7 and am starting to fill the paperwork for the IR/Cr-1, and had a few questions regarding the G-325a form:
1)We are doing a super quick justice of the peace style wedding on sept 7, but our religious big ceremony isnt until feb 2/13. We just want to be able to get the visa process started. I will not be changing my name until our ceremony in feb. On all these forms do I use my current maiden name, as it will not be changed yet? Or do i use my fiancee's name as I will be changing it in about 6 months before the visa is actually processed?
2)on this form, what is the file number that starts with "a" at the very top right corner?
3)What is the alien registration number??
4) The bottom asks if I am applying for naturalization or permanent residency...what is the difference and what am I applying for? I want a green card that allows me to be a US citizen as soon as I get the visa type of thing.

So, it looks like your plan is to get legally married nowish so you can start paperwork for a spousal visa to the US? It that correct? Then, you will have your ceremony in Feb and have a headstart on the visa, moving to the US a few months later (when it is issued). Correct?

Hi guys.

Ok this might be a long posting, but here it goes. My fiancee is American and I am Canadian. We are getting married by a judge with just 2 witnesses on sept 7/12 in the USA, because we want my Canadian pastor to do the religious church wedding cermony. He cannot legally marry people in the USA. Also, my family needs some time to save up and pay for it. Our religious ceremony will not be until Feb 2/13. I guess it's more a vow renewal as we are already legally married. However, we cannot afford rings right now, so the exchange of those wont happen until Feb 2/12. Now, I wasnt thinking of changing my name until after I recieve my visa (so I guess that would be 5-6 months after my religious ceremony, and like 10-12 months after my legal ceremony) as we don't really want people to know we are legally married on our feb 2 date (our family would not approve)

So, thats the back story, but here are the questions.
1)Is it ok to not change my name until after the visa and just use my Maiden name on the application (lots of people dont change their name), or will that look fishy and not like a real marriage? Or should I just suck it up and change it legally after the legal ceremony before the religious one, to avoid future problems?
2)I noticed on people's timelines that there is usually around 2-4 months between marriage and sending in the I-130 package. Why is that? I mean, it doesnt really seem like you need to get a lot together? Fill out 3 forms, get some proof of bonafide marriage, photocopy some things, get some picture...voila! Is it because of waiting for name changes or what is the scoop?
3)If I am in the process of awaiting a visa still during my religious ceremony on Feb 2/13, will I still be able to travel outside Canada/US for my honeymoon?
4)Will it look fishy that our legal and religious ceremony dates were 5 months apart? I mean, we have TONS of evidnce to support this being a real relationship. We even have a super duper romantic propsal all on a surprise video, cards, letters, email correspondance, phone conversations, skype etc.

I am not too sure about the requirements for getting a new passport in your married name in Canada. Each country has its own set of required documents and maybe someone else can help you with that.

There is no strict rule if you should use your married name or your maiden name (its upto you) but you should use one name or the other in I-130 and other forms (including forms to be used during NVC processing). AFAIK, the Consulate will issue your visa in the name that is in the passport, and if all your immigration applications have your married name while your passport has the maiden name, that could add to the delay.

In short, in your case, if you want to keep your maiden name till the religious ceremony, use the same in your immigration forms. Once you get the GC in your maiden name, and the ceremony done, you can request a name change for the GC (which will definitely cost you money!), but then you will also have to update your passport, drivers license (if you have one by that time) etc. Alternatively, you could hold on to the maiden name till you apply for removal of conditions, and have it done in one go.

PS: We applied with my wife's maiden name, because our primary objective was to be together ASAP! :)

Also, is it totally necessary to get a new passport in my new name? I wasn't planning on going through the process of changing my name until I have my big religious wedding ceremony in February. (We just got married last weekend at the courthouse so we could start the visa process, but we wanted to wait until or religious ceremony because, for us, that is our "true" wedding) Or is it possible to only get a new passport, and not change my name anywhere else?

Okay, I will get a new passport. In order to get that, do I need more evidence than just a marriage certificate to get a passport in a different name? Hi guys!

Ok, So i am about to send in my I-130, and am totally freaking out! I'm so scared I will have filled something out wrong, and it will make the process longer. So, I have a few questions just to make sure everything is good.

1) I JUST got married 2 days ago, so I haven't gotten around to changing my name. However, on all the forms I used my new married name, which I was told on a previous posting I made here, was ok. but, I just realized, on the print-outs of me and my husbands join bank account, my name is listed with my maiden name. I know on the I-130 forms it also has you list your maiden name, so they would be able to put 2 and 2 together I hope. Is it ok that my maiden name is on my evidence for bonafide marriage? (The evidence of a joint bank account)

2) On I-130 there is a question about the address that your and your spouse last lived together, however, we have not lived together yet. We live in border towns, so we just drive to and fro throughout the week. We will not be living together until I actually recieve my visa. So, for this question, I put "N/A-will not be living together until end of visa process." is that an ok thing to put?

3)On form G 325A for my husband, the petitioner, the bottom asks is the form is being submitted with an application for naturalization, permanent residency, or other. Now, he is already a citizen, so he put "other-for my wife to earn status as a permanent resident" Is that an acceptable answer?

Hi

This is a really stupid question, but I want to make sure I do everything right. I read to sign all forms (im just about to send in the i-130) with blue ink not black (because black can result in a RFE.) Is it ok to also fill in the blanks that I couldn't fit by typing on the computer, with blue ink too? Or should thosw be black ink....or does it really matter and Im stressing way too much over minor details? Thanks!

Hey guys,

At the bottom of the G-325A form, it asks if you the form is being sent in connection with an application for naturalization, permanent residency or other. My husband put other -I-130 (as he is already an american citizen.) Do I put "permanent residency" or "other- I-130" as well on mine?

Also, does he sign on my G-325 A where it asks for the signature, as he is the petiitoner? Or do I still sign as it is my info on the form?

But does his signature need to be on every document we send ? Me and my husband haven't lived together, as I wont be moving into the states until my Visa is issued.
Do i just put "None" Or should I give a little bit of an explanation? Example "None-will not be living together until visa issued"

Hi Guys,

On Q#22 on I-130 it says to complete the following if your relative is eligible for adjustment of status.I am not eligible (I am the beneficiary) so, I wasn't going to write anything there. But it kind of looks like its a 2 part question as it asks "if your relative is not eligible, he/she will apply for a visa abroad in _________ _______" SO would I actually leave the first 2 blanks empty, and then actually fill in the city and country for the 2nd? Or do I not write anything at all because the very first part of the question said to complete it if eligible for AOS.

Also, on Part "f" It asks for the signature of the person preparing the form if other than the petitioner. I am preparing it for my husband, as he doesnt have the time, but I am the beneficiary. Now, should I fill this section out? Or should we just pretend that he filled it out (Im just worried about that, as some of our evidence of bonafide marriage has his handwriting, and I have mine on the form..so they might notice it is different.)I am just unsure if the USCIS will care if it was me who filled it out?

For IR-1/CR-1 visa applicants, the only consulate/embassy in Canada that does spousal interviews is in Montreal. You'd have to be doing a fiance visa if you wanted to interview in Vancouver.

So, yes, put Montreal on question 22.

Some good news: you can at least get your medical done in Vancouver as there's a panel physician there.

Hi Guys

I live in Vancouver, and was really excited to find out there is a consulate here. Yay! No extra fees for plane/hotel etc. Anyway, I was just informed that Vancouver doesn't do the interviews, and I would have to fly to Montreal anyway. Is that the case?
Also, if yes, on Q #22 on I-130 it asks what consulate I will be applying at if not eligible for AOS. I was going to type in Vancouver, but should I be writing in montreal? Or can I leave it at Vancouver?

You probably won't get an RFE if they're obvious abbreviations. But, I'd suggest for the I-864 and DS-260, not to do it.


The only thing was St. for street, and Dr. for drive. Hopefully that is very obvious. But, I won't do it for the next forms.
If I cant fit a full word on an online form that I can print it out and write it in before I scan it, then what??

Once you start talking out the process, it gets a lot easier (in my opinion). Also, writing out the steps helps a lot.

If it's possible, write the entire word out. It may cause confusion otherwise and I would hate to see you (or anyone else) get an RFE/checklist for something so silly.

Since you'll be filling out the DS-261 online, no, there's no reason to ever do the DS-3032 as the DS-261 is the EXACT same thing, just online.

It'll probably be a few days after getting your case number before you can log into the forms portal, so you'll be sending the optin before you can fill out the DS-261.

Are you referring to the Chinese-specific EP wiki? Things are a little different for them. But no, just scan the two photos, no changing sizes. I didn't need to for mine.

No, the DS-3032 isn't included in the optin email. That's for those in China. For Montreal, there's actually an online form for the DS-3032 called the DS-261.

Although it states to use all capitals, I personally didn't on any of the forms. And I had no problems whatsoever.

As for EP, yes, it's still optional for Montreal. What's NOT optional though is the online forms. The DS-261 and DS-260 are REQUIRED for those going though Montreal.

I would suggest EP, not because it goes any faster for those in Montreal, but just because it's nicer. You don't need to worry about mailing (save money on postage!) and you don't need to worry about sending your originals/certified copies of documents. Plus, you'll get an email when your case is complete; only those in EP get this.

I suggest you read the wiki I linked in my signature below. It explains EP and online forms for Canadians.


I have already been ALL over your wiki...That is how I found out about EP. Thanks so much for all the info! Ok, well it sounds like EP is the way to go. I just read this other wiki and it started talking about having to change all kinds of file types and sizes on your passport photos before they were scan-able and stuff. I thought it sounded super high-tech and confusing. Can we just take our passport photos and simply scan them as is? Im assuming that is ok for the regular, paper documents and forms as well.

Also, sorry to ask a million questions, but I have you right here. If we chose to opt in for EP, do we still need to send the DS-3032? That part really confused me!

Yes, use capital letters as instructed by the USCIS and fill it out electronically for clarity.

The way I read this is that you have to do the EP if you're filing with Montreal? But it does seem nice that you can send emails vs physical mail and bring your originals to the interview vs sending them in the mail and being concerned about someone else losing them.

Hey guys!

I just sent in my I-130 package and it should be arriving at the USCIS today! very nervous!
Anyway, I am not wanting to get everything ready to go for the I-864. I noticed on the USCIS website, it says that it should be filled out in capital letters. I looked at an example form here on VJ, and it wasn't in capitals. Just wanted to know if it mattered if it was in capitals or not?

Also - I know I am not at this stage yet, but want to know anyway - I will be doing my interview with the consulate in Montreal. So, I have read that I would have the option to opt in for EP. Just wanted to know if this was recommended? Does it make the process go faster, or is it just as quick to send all the info to NVC by overnight mail? I was reading about EP, and it kind of seems like it would be more confusing than just regular mail.

Hi there,

So i am currently in the I-130 stage of the IR-1 Visa, my petition is still at the initial review. Now, I obviously want to get down to the states to be with my husband ASAP. I am wondering if it is possible to apply for a work visa while in the IR-1 process so that I can go live down there with him and work? I know Canadians can stay in the states for 6 months anyway, so I can't see that being an issue...or would this totally mess by the IR-1 Visa? I'm not sure if I have to stay living in Canada through the whole IR-1 process.
