IR-1 / CR-1 Spouse Visa Process & ProceduresIf I did EP, do I need to bring 2 passport pics to the interview?
I am just confused as to if I should go out and get new passport pictures for this, or if it is ok as I scanned them and they received them?

Thanks!

Middle East and North AfricaAnybody Has A Fiancee/Spouse From KSA?

Assalaamu'Alaykum Wa Rahmataullahi Wa Barakatuhu Earthy,

I hope this finds you well. Getting permission from the KSA government is only when a non-Saudi spouse is trying to enter the KSA legally as a spouse/family member. That's the only time when you need permission from the government. For CR-1 you will not need the permission of the KSA. Your entry is for USA, not KSA.

Receiving the permission from the Saudi government is very difficult. Unless, your family has some great tides with the royal family or interior secruity, I just do not see getting a grant from the government happening anytime soon if you are seeking permission from the KSA government.

I am still waiting on mine. Let's just say, the embassy here in America told us, since we married without their (KSA) permission, it will take at least 3 years for them to even look at our case. I think they are hoping our marriage will be dissolved by then. But this is KSA procedure before I can get a proper visa to visit my in laws. Allahu'Alaim.

If you follow the procedure for the CR-1 visa, insha'Allah, you will be just fine.

feeimanallah.

~Saudiwife

Assalamu Alaikum Saudiwife,

Thanks so much for the info and reply. It helps such a bunch. We plan to not ever get the premission and just wait until he becomes american citizen (3 years of marriage) inshallah since we plan to go through that process and just enter into Saudi Arabia when hajj comes or even there should be possible way to see your relatives even tho your not Saudi citizen when applying for family visa in Saudi. Because they shouldn't be allowed to do anything because he will be american citizen when we go up together to finally be able to meet his family. There should be no such reason for Saudi government to cut off ties to his own family even if he will be foreign himself in the future. Anyway thanks again! :)

I cant speak for everyone or for the government. I think it would be up to you both and your future plans.
Does it affect the immigration process, I don't think so, it is something to do with the Saudi government not the US government. We did not go through the CR-1 visa, so I cant speak for that.

I know the permission is a headache and I can tell you it was a nightmare for us too. :bonk:
best of luck

Thanks for the reply. :D Makes me feel much better that I'm not the only one and more relieve when I do the CR-1 in the near future. I just find it really stupid to get the permission and really ridiculous how hard they do make it on people who do want to live in Saudi as well or just to see the families. We should have freedom of choice to who we want to marry not the governments as long as it's in the law of the Islam and this is not one of them. So sad for people who are going through that... :( I hope one day it changes and make it light on people inshallah.

Dose that mean your really need to get permission from Saudi Arabia first before marrying even tho you don't have it when going through the CR-1? Even tho I understand you can't live or go to Saudi Arabia together without there permission or you'll get such a huge fine.

Me and my husband (Saudi) thought it be best if inshallah when we get through the CR-1, AOS, then Citizenship inshallah. We would go up to Saudi Arabia together to actually meet his family finally as US citizens through the Saudi family visa or when we do Hajj. Since I won't be able go there nor can his family go out and see us because his family is so big. Everyone takes care of each other of getting around and doing errands or take them to school. Nor do they have the income to leave work that their trying to support there families up there.

I just don't want to get into trouble for not getting the permission when doing the CR-1 visa process, which is such a long process and a stupid one to make it hard to marry foreigner nor is it worth it because most of the time they just trash the documents. You must be rich and know such high people.

My husband is not even blood Saudi, but his grandfather is moved over to Saudi Arabia from Thailand when it was so easy back then to get citizenship from Saudi by knocking at your door. But not anymore. Sorry for going off topic. Just always worried about the permission thing. Nor do I see anyone on VJ who are Saudi talk about it who is going through immigration process and fearing it. Or how they deal with actually trying show pics of the families together and proof and such. When it's hard to go there or even in the US on a tour visa.

Of course it's easy to go to a third country, but not with families and can't with friends because for us we don't mix genders.

Middle East and North AfricaFeeling a Little Sad...
Oh and forgot to say this part and it won't allow me to edit in the last post.

I know when my husband told his family all about me and that we are seriously in love and wanted to marry. Straight away they were actually thought he was kidding and were in shock because he a person who's show no affection towards girls and always serious all the time. But his brother who was with him when they were in school in Jordan when I first met my husband saw the changes in him. Like his laughter and such and would go yelling about how is brother is in love.

His family accepted me the first moment he told them about me and is always telling them about all the time and showing pics. Met his parents through Skype when I was in Jordan with him. They bought me so many gifts and for him too and celebrated our marriage by having a fest, even tho we weren't there.

His dad speaks english, but his mom dosen't. I mostly talk to his mom more. Even tho I don't know much arabic and she trying to learn english we talk basic and is funny when were trying to understand each other lol.

I have no doubt they would will accept your marriage inshallah once you get to know them little by little and they for you as well through you and your husband.

Middle East and North AfricaFeeling a Little Sad...
I know exactly how you feel so much want to have babies and have a family together for so long now. :( We been going through the long distance relationship for about 4 years now with so much patients and hardships of trying to be together physically and settle down.

I wonder if you can both go close to a country where Saudi is and have the family come up to you guys? Just a thought. I've only visited in Jordan when he was studying at that time. Went up there for 9 months first time and then a month last year. Went vacation in Dubai, UAE and Egypt for the first 9 months so I could come into Jordan again since they only allow visitors to stay up to 3 months at a time max. Not much time physically together, but it's so expensive especially when I was working when he's studying as well. Plus to save for the whole process for almost going on 2 years now and finally he's back in Saudi with his family having a job now. Tho it doesn't pay well, but it's doable to save for trip to US to visit me and my mom and to save towards the CR-1. ^_^

So we know how hard it is to go through what your going through. Just have patients, Allah is always with you and would never do something you couldn't handle. Be strong for each other. Everything is a test for a reason. Or you may come up with a plan or such, even if he goes alone to Saudi how about using Skype? Skype will be your best friend with web calling and such. It's the greatest thing. Feeling you little bit there and seeing the family and the baby. Hope everything goes well inshallah.

Yes, when you get to NVC stage their going to ask for a mailing address on DS-260 form that will be filled out online. My own husband has P.O Box in Saudi Arabia for mailing so I used that when I filled it out for mailing address and filled the resident address his actual address for where he lives. Tho throughout NVC stage I've been so far, they've sent everything to both me and my husband emails of anything about our case. I hope this helps. happy.png

Probably not- but it helps to point out you didn't "dump her" as soon as you got citizenship so you could marry someone from your home country.

Thanks for the explaination.

Don't worry you will get approved, we got married 3 months after his divorced was final and they approved us 74 days of waiting. Stay positive :)

Wow. That was a quick approval. Is your husband a natural born citizen or did he get his citizenship through marriage? Thanks for the info.

IR-1 / CR-1 Spouse Visa Process & ProceduresIs my petition going to be denied?
Hello,

I'm getting ready to submit a petition for my wife but have a concern that it may get delayed or even denied because I got married two months after my divorce was final. Here is the situation:

1- I got my US citizenship through marriage to US citizen. My marriage lasted 5 years and two months. I got my US citizenship in 2012 because I was married for 3 years at that time.

2- my first marriage was real and my USC spouse wanted the divorce. We had a child, joint bank accounts, always lived together, assets, insurance, etc.

3- I wasn't planning on getting married initially but after I was seperated and before my divorce was final I met a girl in Jordan and we kept talking on the phone everyday after I came back to the states, we loved each other, and decided to get married.

4- finally, we got married two months after my divorce was final.

My question: is my petition going to be delayed or denied based on the facts above, should I include a cover letter to explain this with petition, or just wait and explain things if they ask? Any feedback would be appreciated especially from people who had similar experience.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuick question regarding translation?

Can you take the documents back to the translator and have them sign an attestation statement?  If that's not possible, then I would suggest having another third party that is fluent in both languages look over the original and translated documents and if the translation is accurate, have that 3rd party sign the attestation statement.

It's not possible at this point to take it back. Can I just translate it myself and add the attestation statement? I'm fluent in both languages just used the translator to save time.

Is there any kind of statement from the service that states the accuracy of the translation they performed?  If so, then then such a statement can be included.  Attestation statements do not need to be word for word that you see on the USCIS website.

No there is no such statement on the documents. It just says certified translation.

I used professional translator to translate my marriage certificate and decree of divorce, the translated documents don't have the certification statement required by USCIS. Can I certify the documents myself by just stapling the certification to the translated documents? Or only the person who translated the documents can do that?

Agree with Darnell your husband obviously entered as a visitor with no intention of adjusting status but if he changed his mind and want to adjust status from the US the option is there.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about Expedite Criteria?

I know one reason to qualify for expedite is severe financial loss. Currently I'm paying ~$10,000 a year for daycare so I can work and finish school. My son from my previous marriage is 3 years old and he's living with me most of the time and his mother is 3000 miles away so she really doesn't seem very much (I also can't send him out of the country to live with my current wife). My wife is a housewife and having her here in the state would save me the $10,000 I'm currently paying for daycare.

I know most of you pays for daycare as well but paying that much for daycare when your spouse is housewife and not a student or employed is a waste of money in my eyes. DO I qualify for expedite based on the above info? any thoughts?

Call USCIS for 21st times and tell them you are NOT adjusting status (I assume you aren't) and the beneficiary can NOT enter the country for interview. They got something wrong.

Yes you can send everything you originally sent but it will be up to the immigration officer to decide if that's enough or not. I'm in similar situation but the only difference is I filed right after the 5 years waiting period was over. Still waiting on I130 approval.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I qualify for expedite under financial loss?

Im wondering the same thing.  I have paperwork coming for a request to expedite.  I called and spoke to Tier 2.  I need him to come here and be employed while I am on maternity leave or I will have no income.  My pregnancy is quite high risk.  Also, the fact that people can't mind their own business and are telling his boss that he is married to a USC.  That doesn't fly very well over there, plenty have gotten fired for the same reason.   So we're just counting the days before that happens, then he has nothing.  I have plenty of money while I work, and hopefully enough to save for leave...but I def can't support him and his house also if he does get fired.  This whole thing pretty much sucks, and good chances are the request will be denied, but like everyone said, it doesn't hurt to try, it doesn't cost a penny....so heck yes...I say do it.

If your pregnancy is high risk, you can also request for expedite for medical reasons.

Good luck!

Most people call and then fax documents.

Just wondering what documents you have to support unavailability of child care?

Unavailability of childcare will not be exactly why I need to request expedite. There is more to it in my opinion than just putting the child in daycare. So I'm not going to provide any documentation for this.

What are you petitioning .  If you just got divorced did you marry again  ?   They are going to look at a quick marriage closer

I'm a USC petitioning for my wife CR1. My first wife wanted a divorce in April 2013 then divorce was final in October during that time I met someone and we got married in December. I know they will look closer at this giving I got my USC through my first marriage that lasted just over 5 years. But as far as I know, I done nothing wrong to worry about.

What evidence do you have to support the unavailability of day care?

Can not the other Parent help.

.

The Other parent lives 2000 miles away unfortunately. Regarding daycare availability I looked in the area and no daycares are open on weekends.

I think not.  Lots of people go thru the same thing.  What I think you need is a nanny.

I tried just don't seem to find a reliable one plus my son goes to daycare 5 days a week while I work.

What doesn't make sense I seen someone on VJ got approved for expedite because he was going to lose one week worth of pay ($600 or something) but it was for a fiance visa.
