Yessum, Montreal is the only consulate that deals with CR1/IR1 in Canada anymore. Vancouver no longer does immigrant visas.

I know! It'll be the same for us. We'll drive to Montreal from Vancouver - eeeep. We're thinking Novemberish for our interview.

I really wish they hadn't stopped Vancouver's processing of immigrant visas.

At the same time - why don't you just wait to move and get your SSN? You don't need an ITIN once you've received your SSN.

The accountant in the U.S requested one for me (I'm the Canadian citizen), but we ended up getting a request from the IRS that I mail back a copy of my Canadian passport to prove my foreign status...
They actually asked that it be notarized with an "apostille," but I guess they don't do "apostilles" in Canada...they do something similar, but it seems like a huge pain and expense...
So I'm just having my photocopy of my passport notarized and sending that in...
Anywaaaaay, point is...you amy want to include this off the bat when you ask for a tax id number...



The IRS won't accept a notary from Canada as they are not a part of the Hague Agreement. We actually drove to Bellingham to get a US notary to sign off on my husband's passport. The apostille would mean that you'd have to get a certified copy of your passport from Passport Canada but it was a pain to do.

I only have a copy of my 2008 filing since I filed late - NVC didn't seem to mind.

You should use the EZ since she has no income, etc. I've filed mine since moving to Canada. It's not going to make much difference to the CO who filed it, just as long as it gets filed. smile.gif It was a bit annoying for me the first time due to my having income here in Canada, but if your wife has 0, you just carry 0's down the entire 1040. Sign and send off.

You only need the last 3 years for immigration. You can't e-file returns filed by US citizens living abroad (I am one). Your wife needs to file a 1040 and a 2555EZ for each year she has lived abroad. It's really easy to do and you shouldn't need an accountant to do it. She also needs to file for an ITIN (a tax ID number) for you.

If she has no slips, then don't bring them. Abroad citizens could still have slips - 401K, IRA, etc. Notice of Assessments would be fine as they list all relevant information.

If you come in to the Canada forum, from time to time, you are going to hear some not so nice things about America and some Americans - and I hope you don't let it make you feel bad, it's not personal.

What you said above, it's really no different to what others have said here about the U.S. - it's not their home (for a lot of them) - just like you didn't feel Canada was yours.


I definitely don't take it personally since it is just the internet. It's just that, as an American, I noticed a *lot* of American bashing in Vancouver during the 4 years I lived there. It is what it is.

I purposely don't post about my feelings about Canada because they're mine, they aren't important to the conversation here, and they don't matter to anyone else. I fully understand why you (not you you) would love it, just as I love the US with all of my heart. I just wish people would realize that every country in this world has crappy things about them and leave it at that.

I try not to take it personally, but as an American I do find the America bashing (not only on VJ but from Canadians I know IRL) a bit sad and can get a bit defensive. I love the US and I love Canada and know that I could be happy living there too. Life is too short otherwise.



Yep, I agree with the life is too short comment. It's why I don't dwell on my time in Canada - I tried it. How many people can say that they lived in another country? Not too many.. It was an experience, an adventure, but one that just didn't work out for us and now we are on our next adventure. Will it last? Who knows.

If he is in line for a refund, you don't need to file for an extension. Besides, you can just paper file the 1040 with the W7 form already. In the space for your SSN Bern, you'd just write "W7 included".

That should be fine to leave the SIN as 0's. I would put on there that he isn't a Canadian citizen or PR. But yes, since it's your first return as a landed immigrant you have to paper file.

Beans, you do not need to file a return in the US since you didn't work at all during 2009.

For Canada, you just need to file the regular T1 personal return and on the front page of the return there is a section where you can put the date you left the country. When you file your T1 return (using something like TurboTax), it automatically does the provincial return with it.

hmm... so after reading this thread, I'm just wanting to clarify for me what is or isn't relevant at this point. I'm more confused, and probably don't have to be. My situation is similar to Danu. I actually lived in Canada for all of 2009 (I arrived in the U.S. Jan 3rd, 2010). So, for my 2009 taxes I just file them normally, yes? Yes, you would file like normal. I could do it online, print, then mail it, I suppose. Would I be able to get my refund in USD sent to my U.S. address, or will they send it in Canadian funds and I'd have to deposit it? It would be in CDN funds and if you have done direct deposit in previous years, that will be done. I still have my Canadian bank account. Could I just get it direct deposited into there still, and cash it out later? Do I have to file anything for the U.S. at all? Not until 2011. I don't see why I would, but who knows. My T4 is going to have my parents' Canadian address on it (according to my employer). Is that going to mess things up if the addresses don't match? I would use your address in Canada for your return. Just put in the section where it asks if you have left Canada with the date you left.

We were married Jan 20th, does my husband file married or single? Single, he would have had to have been married by Dec. 31, 2009 in order to qualify as married. I would've thought single, since his taxes are for 2009, and he was single for all of 2009, but now I'm not so sure.

My wife's interview is on 03/11/10 by the time she get her passport back and then get her ssn it might take 2months, i want to wait until she come's here to file my taxes but i think it going to be impossible before the tax deadline.
Another question i had is can i file joint tax return if she does not meet the tax deadline or do i jus go ahead and file married but single tax return im very confused here, can anyone shed some light!!! :huh:
