I sent in a copy of our marriage certificate, copies of the first bank statement to the most recent, same for both our credit cards, copy of our lease agreement, a copy of our rental insurance agreement, and an affidavit from my father (who was at our wedding). I also wrote up a timeline in our cover letter about our relationship and my immigrating to Canada to marry my husband.

I honestly don't believe it was the additional information we sent in that did it. Not to mention, a lot of couples wouldn't have as much - we've lived together for almost 4 years (married for 3.5 of those).

Wow, congrats on it going so quickly! We got our NOA1 on April 17, 2009 and just got our NOA2 back on our 2nd anniversary (Aug 11, 2009)!! Now waiting for the NVC contact. I was wondering, I see lots of people knowing their stuff was "touched", how do you find this out??? Thanks and best of luck on the rest of your journey!

IR1 is the same type of visa as the CR1, the only difference is that with an IR1, you get a 10 yr green card, rather than a conditional 2-yr with the CR1.

It means they 'touched' your file. Any time a file is physical touched, they scan it into their system as such. I had an initial touch, then a touch after approval. That's it.

We filed DCF in London. Husband is USC but living in UK and had never filed US tax returns. Didn't know he needed to. He had to file 3 years tax returns as minimum before we had the interview. We were asked for them, even though all of our financial proof was on assets, rather than income. So my advice would be to file the missing returns late, just so you are up to date with all tax returns. That way, it won't come back to bite you.

Thanks for the advice. I have already taken the steps and filed for the time that I was here. Like your husband, I really had no clue that I needed to still report to the IRS as I am a resident in Italy. As you know, they dont let you do anything without having to inform them. I really dislike it. However, I will play by their rules if it means getting this taken care of.



IRS filing rules are based on citizenship, not residency. This enables you to continue to vote and have recourse in the US while outside the country.

This is just another reason why using a lawyer will usually screw up your case.

I would suggest mailing both the original marriage certificate and original birth certificate to NVC with a simple cover letter stating what you are sending in response to the RFE.

Funny enough - I received a written email (not a generic letter!) this morning from NVC:

"Dear Sir or Madam,

Your inquiry has been received at the National Visa Center (NVC).

The NVC has received the Agent of Choice selection. The Immigrant Visa
Application (DS 230) processing fee bill will be sent to the designated
agent (petitioner) on the case. The fee must be paid according to the

I just called NVC to see if the AVR had updated for our case at all. The message said: "The Immigration Visa Fee Bill letter has been generated on August 6, 2009 and will be sent within the next few weeks."

However, that was the day that the AOS Fee bill was generated. I'm a wee bit confuzzled.


Hrm - checked the online payment system, it appears they have generated the IV bill! It's current status is "NOT PAID".
