QUOTE (Mononoke28 @ Oct 27 2009, 01:34 PM) <{POST_SNAPBACK}>
The tax return is the 1040 (or similar form) but it is not valid for immigration purposes without the corresponding W2 forms that are needed to file taxes. You need to submit copies of both. If the W2s are not available then a tax transcript is your next option. As Malrothien said, you can get them for free by calling the IRS.

Diana

So do we send the original W2 and 1040 to NVC? or a photocopy is fine? From my understanding, you can only request a copy of 1040 and not an actual W2 from IRS.

You request a tax transcript, not a copy of your 1040.

We actually don't automatically get tax transcripts like you get Notice of Assessments here in Canada. Americans have to order them (for free) from the IRS.

I meant CR-1 in that case. I've never really understood the difference. We did not exploit any loophole that I am aware of.

CR1 = Less than two years of marriage, requires removal of conditions, 2 year green card
IR1 = 2+ years of marriage, 10 year green card

Hey all... I was told by my senator that my case for my wife (k-3 and Cr-1) can't be adjucated yet because my "background investigation" is still open... what is the difference between background check and background investigation? How soon does this typically take? Should i be getting worried, or begin preparing for a super long wait??? I know my case is still in processing timeframe, but is this something i should be concerned about or stay relaxed?

The actual email from the congressional liason for CSC to my senator is as follows:

"The processing of your constituent's case has been delayed. A check of our records establishes that the case is not yet ready for a decision, as the required investigation into the background remains open. Until the background investigation is completed, we cannot move forward on the case. These background checks are required to be completed on all applicants who apply for the immigration benefit they are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If your constituent does not receive a decision or other notice of action from us within 90 days, you may contact us again"

Any input would be greatly appreciated. I don't want to go through the USCIS horror stories you might have or still going through... Cause I feel for the people who have gone through this I don't know how you guys have slept through the night or stayed sane through it.

I am greatly surprised that your senator actually inquired with USCIS given that you are well within the posted time frame for adjudication.

Still waiting. I think those 10 people who already received their NOA2 must be special such as military spouse, government offical or expedited case due to illness or something like that. I know that my case is normal so I guess it gonna be at least 5 months from NOA1.

Not the case here, I don't know anyone in USCIS, we have no special circumstances, etc.. I received NOA2 in 9 days.

IR-1 / CR-1 Spouse Visa Process & ProceduresSafe to create a BARCODE for DS3032???
QUOTE (Pooh and Piglet @ Aug 1 2009, 07:41 PM) <{POST_SNAPBACK}>
Do you think Fedex-ing (overnight) the DS-3032 with a bar code might be faster? or at least the same? Overnight fees are no issue for me after waiting all these years. Hard copy documents are "stonger" tham email. I tend not to trust email or automated systems after my experience wth USCIS. Both cases were data-entered once at the beginning but never touched or updated in any way. So far it seems that my NVC case is following in the same footsteps. Not in AVR yet after 9 days. (Monday will be 11) Looks like I will need to be speaking with a person. I see a timeline with NVC number the next day after USCIS. How is that possible? Please verify that any successful email of DS-3032 was done without an attorney assigned.

Also, do you think there is any link back to the USCIS system or that they get a hard copy and start from scratch? I am starting to think that my system problems at USCIS are spilling over to NVC.

A lot of people have emailed their DS3032 successfully on this site. Lgg was the latest one that I know of. NVC operates completely differently than USCIS - they seem to be with it. It took 9 days for my case to be updated on the AVR. The average is around 9-15 days. You shouldn't worry yet.

BTW -- Even if you do decide not to keep using your attorney, nothing about the $$ figure you mentioned makes me (as an attorney) think you paid too much (not without details stating that the lawyer did nothing or did a ####### job). I read a recent survey stating that average hourly fees are more than $300 x hour. (I know mine are much higher).

That being said, attorneys are expensive and you should not spend the money if not necessary and/or worth it. (How you decide what is "necessary" and "worth it" is up to you. For example, a person earning more than $300/hr would actually LOSE money by doing the forms herself.) And, it sounds like it is no longer worth it to you.

I have theories behind why -

We have already proved to anyone that our relationship is real and true - I immigrated to Canada from the US to marry my husband. We have, in a sense, been pre-approved. I made sure in my cover letter for the I130 to alert them to this.

My husband's last name is rare. There are only two people in Canada with his name - him and another man.

I do wish everyone here a quick and speedy visa process.

Hi Malrothien

I think the fact that you're living together, and have been for some time, also makes things easier. My husband and I have never lived together, have no shared assets (believe me we tried), etc so anyone looking at our case has to spend more time on verifying the validity of the relationship...and the fact that you're together now during filing, well, you're a jammy so-and-so tongue.gif You must have been over the moon to get it so quickly! I must admit I thought that when CSC/VSC received applications they sorted them into country piles, so to speak, and then processed them in that way...but now I see it's just one big pile!!!

Hehehe. We've been living together now for almost 4 years (all in Canada). I literally freaked out when I got the email. It was entirely unexpected. I thought that they arranged applications by month received then worked from oldest to newest. Who knows!
