K-1 Fiance(e) Visa Process & ProceduresPolice records.
You can go ahead and get them now - they're good for 6 months to a year. Only the beneficiary needs a police certificate.

Honestly, I would do a simple court ceremony and adjust your status from F1 to green card instead of going about getting a visa.

It's entirely dependent on how busy your consulate is. Manila is quite quick, but not 4 days quick.

Hey, what am I? Chopped liver?

I will add one more thing though...if she claims dual citizenship, she will be subject to pay US taxes on her Aus income.

As a US Citizen, she would be exempt on US taxes up to $86,000 USD. She would have to file yearly, yes, but can file for the foreign income exemption.

Are you including passport sized photographs of you and your wife? Other than that, looks good.

She and her friend were taken to the police station for finger prints. Then released to pay citations. the case was closed and my wife received the citation and paid it. She did receive a police certificate. Does anyone think we should fill out another DS-230 before the interview and disclose this just in case?

A citation is not an arrest, that is why there is no record.

It would be helpful if we knew what visa you were applying for.

Usually NVC will email you with the interview date. ABD is the abbreviation of the consulate that will handle the interview. The interview is usually in the country in which your wife has citizenship (sans any PR/visas to other countries for work or school).

His/Her visa timeline says CR1 IR1 blink.gif country is Armenia

Oops?

IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1/CR-1 Questions
QUOTE (Lijo&Sarah @ Sep 7 2009, 07:38 PM) <{POST_SNAPBACK}>
Hi, We are just embarking on this journey! Please help us and set us at ease!

I am a US Citizen married (wife) to an Indian (husband). We both currently live in India. We were married in November of 2007. We plan to submit the I-130 next week in Delhi.

Questions:

Will my FRO registration paper, utility receipts, and affidavits be enough to show that I am living in India. I am on a tourist visa, but have registered at the FRO and can stay in India until 2014. I don't want to be sent to the US to file this.

You can file from India, but you have to send your petition to the US. DCF cannot be done unless you're on a more permanent visa.

After we submit the I-130, what will be our next step?

Waiting. sad.gif Until you are approved, then the NVC step will happen. Read the guides to familiarize yourself with that process.

When should I have the I-864 forms ready to submit? If I know that I cannot meet the requirement, how soon do I need the forms from the joint sponsor? Can I get the forms online now, or do they send them to me?

You can get them ready, but do not sign them until you actually send it. You'll need the joint sponsor's paperwork at the same time as you submit your own paperwork.

How will I be notified? Is it in writing to the address on the I-130 form, or by phone? I'm nervous that I may not receive a vital piece of mail at my current address. Many people talk about communicate via email... but I see no place for an email address on any of the forms.

When you're filling out the forms, there is a place for email to be put in. Otherwise, USCIS is all done by mail.

When I submit the I-130 form, what other documents to I have to present at the same time? (ie... the G-325a, Marriage certificate?, photos, etc...) I have read the instructions for the form, but I'm looking for advice from others.. I don't want to forget something. Do wedding photos get submitted with the I-130, or are they for the interview?

G325A for both you and your husband, copy of your marriage certificate, a few joint bills, passport sized photo for both of you etc. Wait to send wedding photos until the interview.

When should he get the medical done?

I would wait until you get your interview date.

Also... after we get to the US, what will we have to do after arriving (to get a work permit) and how soon would we be able to return to India (and how long can we stay abroad)?

With a CR1 visa, you do not need work permit as you will automatically be a permanent resident upon entering the US. You can return to India as soon as you want - however, you can only stay outside of the US for 6 months or less.

If we move back to India(after a year or so), does my husband loose his work permit? If so, does the whole process start over?

For CR1, you never get a work permit. I would suggest reading the guides to understand fully what you are filing. Otherwise, if you move back to India, you forfeit your green card and will have to responsor your husband if you wish to return to the US. If you do not want to have to worry about where you live, file for citizenship after being in the US for 3 years after he gets the visa.

I-130 Petition for Alien Relative U.S. citizen filing for a spouse, parent, or child under 21 March 15, 2009

As per: https://egov.uscis.g...eviceCenter=CSC

So it looks like their technical processing time is almost 6 months. Since you are not outside of that time frame, there really isn't anything you can do.

Hello. I am sure the following questions have been asked many many times....If you could be kind and point me to the right direction, I will be much obliged.

Questions:

1) When completing the G-325A, I put my job title as "Engineer", however it has changed to "IT Support". Will this cause a problem when I complete I-864 or any other document from this point forward?

No, that shouldn't cause any problems. People change positions, etc all the time. Just put your new title and maybe mention it in your cover letter.

2) When I applied for my wife, I did it as a K3, sent the I-130, then I-129F. Now, I want to drop the K3 and only continue with IR1/CR1. What do I need to do to drop the K3 and just go with CR1?

Ignore any correspondence relating to the K3 and only follow correspondence received regarding the I130 (so NVC).

I am a July filer, so hopefully my time at NVC should come up soon, thank you in advance for taking the time to read it and assisting me.

Go online and pay the bill (if you have a US account)...

So you are telling me that the hard copy of the DS 3032 that the NVC sent in the mail isn't what I need to choose the agent?

You can just use the template here on VJ - you don't need the hard copy.

Yes, and what I was saying is that, I sent them the email with the template on here, but i found out that my wife already received the hard copy from the nvc.. so we filled it and mail it out...
Was it ok??

but yes, they'll mail you the invoice with the IIN and after paying it either by check, creditcard online of by phone... they will send you a receipt notice...

So I assume they will say that i'll be receiving an invoice once my DS 3032 have been received/approve by them?

Yes, you'll receive the IV bill which you can either pay online using a US bank account or by money order.

You cannot pay by phone or by using a credit card.

Yes, the shortcuts really do need to be updated.
I don't understand why some people would rather complain about something, rather than simply correct it.
You're still active with your journey, and obviously active on the board. It would take just a little longer to update a Wiki, so that everyone can benefit from your knowledge and experience, rather than just post the correction/complaint here.
This is an online community...the Wiki only works with contributions from the community.
