Given that you are eligible for the 10 year green card through the IR1 visa, do not even think about the K3.

You know that sounds like a question that a professional CPA could tell you. I'd give one a call and ask them.
I am leaning more towards the advice MsSheka is saying. Technically your wife wasn't in the usa last year, and you haven't applied for a tax id for her....

You can paper file the 1040 as married along with the ITIN application even if she wasn't in the US.

For paying with money orders - wait until you have both the AOS and the IV bill so you only have to send one package (two money orders with the fee bills attached) to the US.

I paid with a money order from Canada as I did not have a bank account in the US. You do not need to call NVC.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravel to USA while i-130 interview pending?
There are MANY people on VJ who have been in that situation, Ad. The same applies, you must show intent to return to Canada and proof of that.

You are allowed up to 180 days per year. With that, it is entirely up to the border guard if they will allow you in for that length of time.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravel to USA while i-130 interview pending?
Yes, you are able to enter into the US while your application is pending. You must show ties that you are to return to Canada - employment letter, lease agreement, latest bills, things of that sort.

I am a Canadian LPR, American USC, and filed at Vermont. We originally were going to go the K3 route since we lived in Vancouver, but USCIS had other plans for us.

If you do decide to file Stateside, file in Vermont. :)

IR-1 / CR-1 Spouse Visa Process & ProceduresTouched ?

While I agree with Malrothien that you shouldn't base hopes on touches, it does mean that something is happening..which means an approval at some point or an RFE to fix issues. I prefer touches to silence any day...

Not necessarily - touches could be the file moving to another desk or going back into the file room. There has never been any official confirmation of what a touch really is.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 NOA2

Mal,
No need to state the obvious, My Husband and I already are aware of everything there is to know about what a "touch" represents.
We're here on VJ, like everyone else, to receive hope and continued positive feedback on specific questions that we have.
Although facts are good to learn, I did not ask what you had given.
and while I know that each case is different, it is a comfort to know that there might be timelines out there that have similar patterns as mine.
There is no need to crush the spirit with your technicalities... with that said, i will still wish you good luck with your specific journey

****Everyone -
****If anyone else is out there reading this forum, that has a timeline showing 2 touches prior to receiving a NOA2, please reply to my post.
I would love to learn more about your specific journey and create an environment for us to all come to that will help us all wait during this part of the process.

Thanks again to everyone who has responded and given both my Husband and I continued faith during this waiting period.

My post wasn't necessarily directed at *you*. Yes, it is nice to have hope and faith during this journey, however, it isn't good to put false hopes into things that don't really mean much.

Touches *do not* mean that you are in for an approval. Touches simply mean that your file was scanned into the USCIS system for various reasons: someone working on it, it being moved, when it was first accepted.

There are many on VJ who didn't have a single touch prior to being approved.

All birth certificates are copies, so that does not matter. What they want is the birth certificate that lists the parents names on them.

Malrothien -- I think you are missing something. The birth certificate we sent already lists the parents names. (It also lists everything required on the official docs.) As per wikipedia, a "long form" is "an exact photocopy of the original birth record." What we sent them is not a copy of the original...

No, I am not missing anything. There is most likely a translation problem going on here.

You also never mentioned that you had already sent a birth certificate that lists the parents name.

I'm not going to argue with you regarding what a long form birth certificate is. I know quite clearly what it is.

I seemed to have answered my own question :-) or am I missing something?

But yes, you must supply the long form birth certificate and the marriage certificate.

Whoops, haven't changed the profile status. (Actually, I can't seem to figure out how to change it.)

No when you say "must" is that something official? As per here:

http://travel.state....08.html#docreqs

All it says is that the birth certificate must state the names of the parents (I'm assuming that's what a "long" form is). However, it doesn't say anything about the marriage certificate...

Yes, you just need to scroll further down the page to:

http://travel.state....8.html#marriage

And yes, the long form of a birth certificate includes the names of the parents.

'domicile' isn't evaluated except on Interview Day at the Embassy/Consulate, and 'during the process' - any data is gathered by NVC , to pass along with the casefile - not 'evaluated' for pass/fail at NVC. Sorry.

That is incorrect. NVC DOES evaluate domicile - my second RFE was for proof of re-establishment of domicile.

They are not required to, but if an immigration officer suspects you may stay, they may issue an I94.

"Visitor" would be appropriate - am not 100% certain about Canadian crossings as to whether or not there is an I-94 or similar Arrival/Departure stamp in his passport though.

When he drives for some reason they dont stamp his passport. He's flown twice and had it stamped both times, but not when he drives.

That's really strange. I guess it's just based on where you cross at and how firm they are?

My husband, a Canadian citizen, has crossed the border about 150 times via car. Only once did he receive a stamp, and that was when he flew to Maui. They usually only give stamps if they are suspicious of you.

I was implying that it is about the same. It did answer your question.

No need to be a jackass on the upper forums.

Also, if you checked out the Canadian regional forums, there is a 108 page post about K1's waiting for an interview in Montreal. http://www.visajourn...howtopic=160083

There are still June people waiting for interviews.
