IR-1 / CR-1 Spouse Visa Process & ProceduresRFE question
QUOTE (YOUTOO @ Jun 2 2008, 06:12 AM) <{POST_SNAPBACK}>
Does anyone know from experience what happens to a file once a RFE letter is sent?
Is it on hold, but still in the loop? In other words, I have responded to the item that
NVC wanted, it has been delivered. Will they pick up processing where my file was
before, or am I at the end of the line again?

Yes, it's on hold and still in the loop. Once they receive the information they were requesting, they'll continue on with your file from where they left off.

IR-1 / CR-1 Spouse Visa Process & Procedureswhy so long?
Don't panic yet. They get more visa applications this time of year. Last year, before the fees went up, it was really bad. I sent mine in 5/29 and got the NOA1 on 8/9! If you sent a personal check, you can look at the back after it's been cashed. They put your case number on the back of the check and then you can track your progress (or lack of it at times) online. The NOA1 isn't very important any way. You can always call after 90 days like I did and request the NOA1 if you never receive the hard copy by mail. The most important one is the NOA2 and that's going much faster this year than last!

Hang in there, you have a long journey ahead, but not as long hopefully as most of us had last year! good.gif

Congratulations!! I hope the time passes quickly for you both. It's nice to see you're finally getting closer to the end of this whole process (they sure don't make it easy on us, do they?)

IR-1 / CR-1 Spouse Visa Process & ProceduresJapanese hospital process
If she doesn't have shot records, they can test her blood and tell her what she'll need. My husband couldn't find his and when he went to the doctor (she can only got to one on the embassy approved list) they gave him blood test and he only needed one shot. The list of doctors is sent with packet 3 that the US Embassy sends out.

K-1 Fiance(e) Visa Process & ProceduresApplication receipt number

I sent in my I-129F petition and just had the check cashed. I'm trying to find the case number on the back, but parts of the check are poorly stamped and unreadable. There are some numbers that I can read, but none are 13 digits long, which I believe is the length of a case number. Can I just call USCIS to get my case number? I wanted to ask first before navigating their phone maze.

They cashed my check a month ago and I have still not received anything in the mail, so I called to check the status. I couldn't read the number very well on the back of my check, so I told the gentleman what I thought it might be and he said that it was correct. If not, he would've transferred me to someone who could get me the correct number. He was very helpful and I wasn't waiting on the phone for very long. Good luck! :)

K-1 Fiance(e) Visa Process & ProceduresNewbie question

Yep, besides that you can go to the timelines page and add your timeline, to be entered into the site's statistics page.

Thanks. I added it to the timeline section previously, but wanted to add info under replies/posts. However, I did check through the gov website & I don't see where mine's ever been "touched". They apparently sent it from Nev to Ca at some point and have no idea when that happened and then cashed the check on 6/18/07.

I see on most everyone's post/reply that there is a timeline list as to when things are sent/rec'd/touched. I just found a post that shows how to check for touches, but where is this listing below a reply or post generated from? I thought it would be in my profile, when when I tried to list it there, nothing happened..humm Any help would be appreciated, thanks :star:

Yah, I say attach one for each copy too.

That was really fast! Thanks.

Okay, I'll attach 4 copies of the extra sheet. What do you figure about how to package it?

This maybe? A paperclip holding:

G-325A p.1
extra sheet
G-325A p.2
extra sheet
G-325A p.3
extra sheet
G-325A p.4
extra sheet

And leave out G-325A p.5 because it's just the instructions... yes?

Thanks to everyone.

Please click on the K1 Guides the the top of the home page and also look at the sample pages available. It'll tell you what's needed and how to package everything including the order of the pages and attachemnts. Good luck!

**Keep all of the G-325A pages together and put any additional pages for that form behind them. List at the top of the attached page what form it goes with and what number question or statement it pertains to.

K-1 Fiance(e) Visa Process & ProceduresIs visiting the US during K-1 Visa in Process allowed?
QUOTE (DMZOCT2005 @ Nov 7 2007, 05:02 AM) <{POST_SNAPBACK}>
Hi, I'm the FIANCEE of DMZOCT2005.
I'm so happy that you guys are all saying that there is nothing to worry about on visit my fiance in US.
BUT, do you think I can still pass the immigration even my tourist visa got reject before?
Does anybody passed the immigration after the tourist visa got reject??

Thanks for your help!!!!

DMZOCT2005(fiancee) helpsmilie.gif

I wouldn't say that there is "nothing" to worry about. I know of a few who tried to come for a visit during the process and were rejected at the airport and sent back, but some have no trouble at all. Each case and approving officer is different. Being that they denied your tourist visa already, they may deny entry based on the same findings...not enough ties to make you go back to Japan.

I haven't heard of anyone having trouble getting their K1 visa approved due to being rejected on entry to the US, but it's up to you to take the chance.

My fiance and I decided to wait until the process is over and he moves here. It's hard to be apart, but we have the rest of our lives to be together.

Good luck smile.gif

K-1 Fiance(e) Visa Process & ProceduresHow to speed up the K-1 Visa process and Rejction at POE
QUOTE (DMZOCT2005 @ Nov 7 2007, 08:42 PM) <{POST_SNAPBACK}>
Hi All,
We feel our K-1 Visa process is a little delayed/slow. We are entering the 5th month and still no change to status at the USCIS, the Vermonth Office. I've tried calling the Customer Service telephone#, but it's an automated response. Also, I already contacted my local Congressman's office and they are trying to assist (they said they've gotten no replies back, but will keep trying). What else is recommended that we try?

Also, if we risk my fiance flying to america to visit (short term) during the K-1 visa in-process, but an agent at the POE denies her, who pays for the flight back to her homeland (Japan)?

Thanks again for the replies. We are new to this, and this website is great. We truly appreciate everyone's insights and opinions. good.gif

Unfortunately, right now both VSC & CSC have long 5-6 month processing times. If you got your NOA1 5 months ago, you'll probably hear something very soon. It's hard for us to tell because you didn't fill in a timeline. And, as msu17 stated, she would have to pay for her return flight if denied entry. As I stated in the other forum you started, you have to decide if you want to take the chance or wait a couple of months. Every POE & officer are different. Good luck good.gif

god bless us to our journey,

Please create a timeline, this will help with estimating how long it'll take, it's only an estimate though. Congrats on receiving your NOA1, but the longest wait and most important wait is for your NOA2. They've just started with people who filed in June about a week or so ago, so good luck good.gif

Thanks, that part we knew. The problem was when he asked about getting it (he's a Japanese National) they asked what type of certificate he needed and when he mentioned it was for a K1 visa, they said there are a few types of certificates. I'm sure it will say in the packet once we get our NOA2 and it is forwarded to the embassy there, we thought we'd try to get a head start on it since we knew we'd have to wait a couple of weeks and he has next week off work to do some running around if need be. I just thought that maybe someone here who has been through this phase could tell me which one it is (as the embassy in Tokyo charges to ask questions either by email or phone). Thanks for your help.

K-1 Fiance(e) Visa Process & ProceduresWhat to do on errors on the I-129F & G-325A
I agree with Fwaguy. I would wait. If you get an RFE, then send only what they ask for. The only time you'll get an RFE is before the NOA2. I also agree that your case could be with an officer at any time now, so rather than confuse the situation and have what you send them misplaced, wait to see if they send an RFE.

Just my opinion smile.gif

QUOTE (DMZOCT2005 @ Nov 29 2007, 06:48 AM) <{POST_SNAPBACK}>
Hi hi!! everybody.

I have some questions about Tranlation.
My fiance and I are not sure if we have to ask a professional pple to translate our forms for interview.
Can we just ask some pple around us who is NOT professional?

Also, how's the interview in U.S?
I know after I moved to U.S, we have to take other interview for greencard..(In the future!)
Does it require a professional translation in U.S??
If so, It might be better to ask a professional ..since we need to ask in the future anyways.. unsure.gif

Does anybody know??
THanks!

In Japan, you are required to have a professional translate your documents. Having friends or you yourself translating is not acceptable. It will state in packet 3 that you receive from the embassy which documents pertaining to your file will need to be translated. Good luck.

It definitely takes longer to get ready for everything if we go trough the process in the end of the year and the begining of next year.

Btw...do you know the phone number for calling DOS?

Yes, it's in an earlier post I sent to you 1-202-663-1225 Option 1, then option 0 to speak to a visa specialist.

That's awesome!
Did he filled out his forms for medical check?
I have already printed out those 4 of the forms but we don't know if we need to write something there.

Thanks for letting us know we should bring original for interview.
We were not going to ...since they might take it.
You are right. Maybe we should bring both original and copy...

Have you already applied for an interview yet?
Do you have to wait until your fiance got ready for everything?

My fiance tried to call NVC today, but he said the line was too busy and couldn't reach the pple there.
Hmm...

Yes, take both copies and the originals..they will keep the copies, but the originals are proof and will not ask to keep them. Apparently there was a change recently and you have to have the police certificate and medical exam clearance papers in hand now before you can get an interview appointment. MY fiance will go back to the hospital next Tues morning to get his shots if he needs any and then go pick up his police certificate, Then he will make his interview appointment. I guess there were problems when people were setting up interview appointments and not having all of their paperwork/exams done, so they changed it.

It's difficult to reach NVC, that's why I also suggested calling DOS (Dept of State) They have all of the same info as NVC and they're easier to get in touch with.
Good Luck! smile.gif

He said the medical check went well considering he doesn't have his shot records. They took blood to test to see what he's had and he'll go back next week to get any shots he may need and they'll give him his paperwork. He said they were extremely nice. He ordered the police certificate in Saitama (where he lives & I used to live) and they said he get it in 7-10 days. You have to have the packet from the embassy to show before you can order the police certificate.

You can use the same proof that you used for the I-129f and you should take all originals with you to the interview in case they ask to see them. You keep your originals, but they may want to see them and give them the copies smile.gif

DMZOCT2005, looks like maybe most of your questions have been answered, my fiance and I are in the middle of all this now. He is at his medical appt right now (they're a day ahead for those looking at my timeline) My case was lost by CSC for a month but you filed at VSC and as stated earlier (I think by Marta) VSC sends them out as soon as approved where CSC doesn't. Yours should be on it's way to the embassy already. Try calling NVC and select to speak to an officer or better yet, call DOS (202)663-1225. They are very helpful and can tell you if NVC sent it to the embassy already.

Good luck and Congratulations!!

Thanks for your help.

As I stated on the other thread you started where you were confused about it being for a tourist visa...I replied that it was info on the K-1, so I'll try again smile.gif

Go to the tabs above...you can choose either "Embassy Info" or "Reviews", select Japan from the drop down list and read the reviews from people who have already had their interviews. Yes, your fiance can go with you. But from what I understand, he should NOT answer any questions unless they ask him specifically. The interview is for you...they want your answers, not him to answer for you.

I hope this helps. Let me know if you're still confused. smile.gif

K-1 Fiance(e) Visa Process & ProceduresMailing our cases to NVC...
You can also call the Dept. of State (DOS) after a few weeks to see if NVC has it. The number is (202)663-1225. It's sometimes easier to get through at DOS than NVC. As stated above, you'll need to wait a few weeks at least. After 4 weeks, and being assured by CSC that my case was sent to NVC on Nov 6th, I later found that either CSC or NVC (each said the other) had "misplaced" my file. It was finally found 10 days later.

Congrats on the NOA2!!

K-1 Fiance(e) Visa Process & ProceduresI-129F Documentation Question
QUOTE (thefish7 @ Jan 31 2008, 06:29 AM) <{POST_SNAPBACK}>
Does the I-129F part of the process require a birth certificate or family registration for the alien fiance? I don't see anything in the FAQ, but a Japanese language website seems to indicate that that is the case.

Since my fiance just went through this in Japan, here's the deal:
They need a copy of the USC's birth certificate included in the I-129f packet.
They need a copy of the fiance's birth certificate with traslation for the interview. The translation must be done by a professional translator. You're not allowed to do it yourself or have friends do it for you. You should take originals of both with you for the interview in case the interview wants to see it. They will not keep it, but may want to review it. They didn't ask to see originals at my finace's interview earlier this week, but while he was waiting, he did see that another person was asked for originals.

Hope this helps smile.gif

K-1 Fiance(e) Visa Process & ProceduresUs Old Folks
I'll give you a hug too {{{{Krikit}}}} (hugs) When I moved back here (my stepdad passed away and my mom needed help), I gave up my good paying job with long vacations, good benefits and most of all, had to leave my fiance. Made me really hate it here when I moved back. I couldn't find a good full-time job (high unemployment area) for nearly a year. I worked as a substitute and then got a good position running a federal grant program for the school district. All was going well, I bought a house and we were talking about him moving here, then the district ran out of matching dollars for the grant and they shut the program down sad.gif Here I am a 1 1/2 years later working 3 jobs..all in different fields (1 full-time & 2 part-time) to keep up with what I had.

Not really a sad story, just seems like lots of changes. I've already had several major life changes to this point, so what's a few more smile.gif

I love where I live and the new friends I've made here, but I think, like you, I'll always miss my friends and the life I had in Japan and I know it'll be the same for my fiance when he gets here.

They say the only things for certain in this life are death and taxes...I think change should be added to the list! smile.gif

Keep your chin up, all in all, life is good good.gif

K-1 Fiance(e) Visa Process & ProceduresUs Old Folks
Nice topic with interesting stories. I'm 46 and my fiance will be 33 in a couple of weeks. We've been together for just over 12 years and I lived in Japan for 15 years. I've been back in the US for 4 1/2 years now and he's decided he wants to try living his life some place new. I really miss living in Japan, more so than I ever missed living here in the US and I've told him that if this doesn't end up being a situation that he's happy with, that'll I'll happily move back to Japan. It's been a long, hard 4 1/2 years apart with him just visiting here 5 times since I left. The last time I saw him was Thanksgiving 2006. The reason it's taken so long is that his parents (father) do not want foreigners in the family. He also has a very good job with the gov't there. It's taken him a long time to decide what's really most important in his life. It's a lot for him to give up; family, friends, good job and his lifestyle. I know he has anxieties about coming here, especially finding a job. His English is very good (although he didn't really speak any English when we met) and he's done lots of translations (mostly verbal) for people in his office as well as others in nearby offices as he works with Americans.

I raised both of my kids there and they're in their early 20's now. We all get along great and they're just as anxious as I am for him to come here.

I agree with most other posters here in that I don't think age has much to do with it as there pros and cons to both. Some say it's easy to pick up and go when you're young and for others it's just as easy when a bit "older". It depends on your situation and what you feel is most important in your life and what you're going to do to make the best of where ever you are. To me, as long as I'm with the one(s) I love, I can make anything work and I have. smile.gif

Congratualtions on your NOA2!! kicking.gif kicking.gif

The USC should follow the guides here on vj and prepare the I-134 package to send to the beneficiary if that hasn't been done yet. (Sorry, I'm not sure which one of you posted this question.) In the meantime, the beneficiary in Japan can get the birth certificate and have it translated by a professional (the embassy will not accept translations by friends or family that speak/read/write English) Once package 3 from the embassy is received by the beneficiary in Japan, the police certificate can be ordered and the medical exam can be scheduled.

Good luck! good.gif

Any advice would be appreciated.

I wouldn't worry about it. Our NOA2 was dated 10/18 & valid until 2/17 and we didn't need an extention. Considering my husband made appts a few weeks into the future after receiving package 3 from the embassy so that he could take time off work, it was a concern for me too, but it was no problem and DOS said that if an extention was needed, there would be no problem. Did she make an appt with a doctor on the embassy's list? You're not allowed to use any doctor, only certain ones. Good luck! good.gif

Hey, just had super idea! Maybe I could get VSC to push our simple application threw for $ 10,000.00 cash and a years supply of donuts. What do you think ? good.gif innocent.gif

They don't do donuts (that's for police officers, not immigration officers!)...offer up some of the drugs if they weren't all taken away!

Your fiancee is not "technically" allowed to come to the US while the K-1 is pending

I'd have to disagree with that. Many people travel here while the K1 is in progress and it's perfectly legal to do so. It only becomes a problem when the POE officer thinks there might be intent or if you cannot prove enough ties to your own country ...or ummm if you take advantage of it like we did! whistling.gif

To the OP... A cruise certainly is a wonderful experience. I'd find one that is sure not to leave the US! wink.gif

I didn't say it was "illeagal", and you're right, many people are allowed to enter, but on the other hand, many are not. It's up to the individuals to take the chance. But the OP's quesion of traveling outside the US without having the AP or green card is not allowed. If someone chooses to do it, then they'll have to deal with the consequences. Kind of risky if you really want to be with your SO. For most of us who have now finished the long K-1 process and have waited a very long time to be with our SO's, it isn't/wasn't worth the risk. If the OP is prepared to deal with being separated after marriage for however long it takes to have a K-3 approved, then go for it. Then he/she also runs the risk of having the K-3 denied for not following the instructions on the K-1 that clearly state travel outside the US is not allowed until you receive the AP or GC.

Does Japan being a part of the Visa waiver program have any bearing on this situation?

If my fiancee is technically allowed to come to the US while the K-1 is pending, shouldn't she be able to re-enter the US after a 5 day cruise with the same ease?

Sorry if I'm being thickheaded. headbonk.gif

As someone else has stated, the visa waiver program is for tourists and business travelers, not those planning to immigrate. Your fiancee is not "technically" allowed to come to the US while the K-1 is pending and there have been several posts that I've seen here on VJ from Japan and other countries, where the fiancee was denied entry and sent back home while the K-1 was pending, it's up to the officer at the POE to decide. It is risky just trying to visit while the K-1 is pending because you never know. My husband and I would love to take a cruise, too, but we're waiting. I couldn't get time off from work right after the wedding anyway, so we're taking a simple honeymoon locally next month and saving the cruise for later. We just wanted to be together and it certainly wasn't worth the risk to us for something that we can do anytime. Good luck, but my 2 cents..don't risk it! good.gif

We did not track our package because I had never have any trouble that express mail doesnt reach its destination. My fiance is now looking for the receipt. I was stupid for trusting USPS too much. Yes we sent a money order and he will go to the bank with a receipt next week to check. We will start preparing another package, and meanwhile perhaps we will receive NOA1. If we dont get anything by the end of this month (means it has been more than 3 months) , we will mail another package.

We were not cautious to begin with so that was our fault. next time we will track every single step.

now is the time our patience is going to be tested. I will try to think positive!

thank you everyone for messages

Sorry to hear about this. If you sent it by USPS Express, look for your receipt. If it wasn't delivered in the time frame posted, they have to refund your money. Also, when you find the receipt, you can track it online even now and it'll tell you the date, time and who signed for it. Express mail is always trackable online, but not first class unless you pay for certified mail, etc. Go to this site if you find the receipt and see what it says:
http://www.usps.com/...kandconfirm.htm

Good luck good.gif Our package was lost (misplaced) by either CSC or NVC (both said the other lost it) last October after we got the NOA2, so I know how you feel.

K-1 Fiance(e) Visa Process & ProceduresJapan Police Clearance
QUOTE (lokashadow04 @ Jun 15 2008, 07:01 AM) <{POST_SNAPBACK}>
Irene lived in Japan off and on for about 10 years. She went to the Japan Embassy to get the process going but was told that she needs a special form from the US Embassy to put in the request. Does anyone have any idea where we might be able to get one prior to her interview? Also her last time in Japan was 10 years ago and teh only place tahts recorded is on the ds-230. Do they always ask for that form? Any suggestions ill be greatly appreciated.

When you file for a visa, the US embassy will send you all of the necessary forms. In Japan, there is no way to obtain a police certificate without the document from the embassy. After you receive the NOA2 from the service center (either CSC or VSC), they will send your approved case to NVC who will then forward it to the beneficiaries home country. Once the home country's embassy receives the pkg from NVC, they'll send the forms to the beneficiary.

Hope this helps.

I sent my packet in on May 31st and got my NOA1 in the mail on June 3rd biggrin.gif My check was cash on the 4th.
Could there be a mistake as small as not signing your check or you sent it to the wrong place? I use confirmation to track my packet which helps alot. Good luck in getting your NOA1 soon!

Hello! I checked my Bank again today..... and USCIS cashed the Check today!!!! I'm just happy to know they got the packet!!!!!!

everything is confirmation from here on out!!!!!!! no NOA1 yet, but my main concern was making sure they got my I-129F Packet!!
