For those of you doing the legal part first and the "wedding" later, has anyone gotten any flack from naysayers? I have gotten a few people who say I am commiting fraud if I get legally married and do not consider it my wedding. It is not like I am going to hide the fact from anyone, although I probably will not go out of my way to tell people outside of close friends and family. For me, even though we will be legally married, it will not feel real until our religious ceremony when we say vows in front of all our family and friends. I do not think it is fair to let the government control when and how I chose to do my wedding, or how doing the two events separately ccould be construed as fraud. Thoughts?



My Fiance didn't like the idea at first. He was/is concerned that we'll feel fully married after the legal marriage, and the celebratory wedding many months later will feel less "real" and important. Basically that we'll miss out on the full wedding experience by cutting it in half.

I think we may very well feel fully married after signing the paperwork, but the other will still feel rich and meaningful in its own way.

If you haven't already, you should check out the the blog A Practical Wedding. They talk about all kinds of ceremonies on there and have a really great attitude about making your wedding be what you and your partner need it to be.

I say if you're getting flack, stop bringing it up. It's nobody's business but your own.

That is our plan as well: Legal marriage right away when the papers come through (we hope by July!) and a ceremony in Spring 2010. Who wants to plan a wedding while we're living in different countries? Not me.

Hi All,
I moved to the US in July, got married a couple weeks later, filed for AOS a couple weeks after that, got an RFE, etc, etc. Can't believe we've been living together almost four months. It feels longer than that, and it feels like just yesterday I was waiting and waiting.

We finally got an AOS interview date (late November in San Bernardino, CA), and I'm back here trying to figure out if it's safe book holiday travel back to Canada a week or two after the interview. Seems like I should be getting my AP doc in the mail within the next two week, according to schedule, except that AP documents seem to be sort of all over the place in terms of when people get them. As for the interview, there's no guarantee of instant approval.

Once again, uncertainty is the most challenging thing about the whole situation.

Funny -- we did our civil ceremony the same day as you!

Just a note to everyone about getting a head start on the AOS paperwork: Do it. I had looked it all over before I left Canada to make sure I brought everything I needed with me, but I didn't start filling out any of the paperwork until after we had our civil ceremony.

If I were doing this again, I would start filling out those PDFs right away. It ended up taking us 10 days after we got married to get the paperwork sent out. That may end up being a bummer if it takes the current average of 4 months to process, as we were hoping to visit my family in November, and may not be able to till December.

Have been living in the US ten days now. Just back here to look up some AOS details. We're planning to get our marriage license in the next couple days.

The first little while has been, for us, both very challenging and totally delightful. Plan to go really, really easy on each other for the first little while, especially if you haven't lived together before. I had some tears about leaving home when I first got here, and felt too overwhelmed, the rest of the day, to make any decisions about anything (where to eat, what to do next).

It's a big deal. We are reading to each other a lot and watching movies and he has been making me delicious meals. One of the best things about being here for keeps is that we don't have to spend every minute together, if that makes sense. We can take time out for ourselves without feeling like we're wasting part of a precious visit, and we both feel a lot better and more balanced for it. It's exciting figuring out how we want to do things, what our routines will be, hashing things out -- not always smooth, but exciting. And touching, all day -- amazing!

My visa was approved today!!

My interview was at 10 am this morning, at the consulate in Vancouver. There were four K1 people that day, total, and we got to chat most of the morning which was nice. One had applied in October, and the other two in December, I believe. All of use are moving to small towns/the country, which I thought was interesting.

I only brought what I was instructed to bring in the email from the consulate, nothing more, and I just brought it in a file folder, which was good because they take it all apart as soon as you get there. The interview happened at the counter, not in a private room. They didn't ask to see any of the "evidence of ongoing relationship" that I brought. Very friendly staff. They agreed to let me pick up my passport mid-week rather than have it sent by courier.

I got there around 9:40 and was out by noon. Much less gruelling than the medical!

Ok everyone..I am starting to panic a little. We have yet to receive packet 3 but in the meantime we are working on gathering all of the pertinent documents. The problem is my fiance can not find a copy of his vaccinations given in childhood. In this instance, can he just get the required vaccinations at the medical? I am worried because I do not want this to delay our case..we have already waited long enough! Any help would be much appreciated! Thanks all!


You can also have blood tests done to verify past immunizations, if you don't have the records. Which might be cheaper than getting the immunizations done again.

I just want to clarify the packet 3 contents which we mail/ fax back to the embassy). Can the packet 3 documents be filled out only by the beneficiary ..or does the petitioner need to contribute or sign some papers for packet 3?

is there a checklist of packet 3 forms that we can use..i really want to prepare packet 3 now as I will be out of the country in a couple of weeks.

And after packet 3 is sent back to the embassy, the embassy will mail packet 4 to the beneficiary (with a date for the interview?)

I hope i have this right..! :help:


For the Vancouver consulate:
Most of the items you have to prepare are to be brought to the interview (criminal record check, immunization records, 156 & 156k). Packet 3 has the full details of these, but some of them take time so you should find the checklist and start working through it now.

The only things you have to mail/email/fax back to the consulate when you get packet 3 (which is just a 1 page letter with a link that anyone can access) are forms DS-230 and the checklist. The checklist asks you to indicate that you have everything ready for the interview, which I don't yet, but I will by the time I have my interview (didn't want to wait till I had it all in hand to book the interview, as I'd then be waiting another month!).

If you email the consulate right after you fax those two things in, they'll email you the link to the site where you pay your fee and book your appointment. That address is all you need from packet 4 (which is just a single page letter -- and I got it today, the day after I faxed my forms in).

Re: vaccinations:

the woking medical clinic in vancouver has the most straightforward breakdown of the vaccinations that I've seen so far, on their web page. Not sure if the same list would apply for people outside of canada, but perhaps other clinics have good web pages too.

also keep in mind that vaccines taken within less than 6 weeks of interview will not count


Where did you read that? I haven't come across that -- the Woking clinic just says to arrange to get immunized before your medical, and to bring the immunization records with you.

I faxed in my checklist today and got an email back from the consulate in Vancouver. I love those guys! I paid the fee on the website and booked my interview: June 24.

They had earlier appointments (the earliest was May 31 -- 20 days from today), but I want to make sure to leave enough time before the interview for that danged australian criminal record check to get back (and enough time after the interview to get my passport back).

This move is getting so close I can smell it!

Just got my packet 3 letter from the consulate today. Things are moving fast!

Things I'm working on:
- Printing out packet 3 forms and getting them ready to fax back.
- Getting a criminal record check from Australia (spent a year there). They say it takes 30 days to process, plus mailing time. Am a little worried this is going to be the thing that slows everything else down. Have to get fingerprints done locally and then mail them to Oz.

- Getting a varicella immunity blood test, to see if I need the chickenpox vaccination or not. Takes about 5 days. Then:
- Getting the other immunization I need. Then:
- Scheduling my medical

- Getting passport photos taken
- Getting my local criminal record check done

- Hustling my fiance to get his affidavit of support and our co-sponsor's affidavit together and in the mail

Already ordered my long form birth certificate -- that only took a couple weeks.

Do you have a guess as to the reason that your got your NOA2 early? special circumstances? used a lawyer? just good plain luck? I really hopeful that all the january filers will start to hear now.


No lawyer, no special circumstances. My best guess, after a well-organized package, being from a low-fraud country and pure dumb luck, was that our names are unique enough that maybe the name search was particularly easy (although I've had a name change, which adds complexity, so that theory probably doesn't hold much water).

My mistake, that page applies to the CR-1/K-3 people. I had to go back and read the guides again, several times, and the web page for the US consulate in Vancouver, to clear that up.

So: I was right on about ordering the long form birth certificate, getting immunizations (just one, in my case. the woking medical clinic in vancouver has good instructions on their web site), and a police check. But all of that is to be gathered and brought to the interview, so I have lots of time. I was particularly confused about the I-134 affidavit of support form, which the CR-1 people submit to the NVC – but we don't! We just bring it to the interview.

Phew!

I've spent so much time reading this stuff, and I still get tripped up!

Someone requested an update on next steps, so here goes.

My next steps are: ordering a long form birth certificate for myself, getting a police record check, getting the medical done, and some passport photos. My american husband-to-be needs to work on the affidavit of support form for himself and our co-sponsor (he is a full time student right now).

In about a week we should be able to call the NVC and get a case number, which will allow us to submit forms electronically. Looks like people get from NOA2 to interview in about two months.

I am SO busy with work and packing up my house in the next few months, I don't know how I'm going to squeeze the next round of paperwork in there too, but I'm so excited about being able to get married sooner than we planned!

Called my fiance, called my mom -- wanted you all to be the third to know.

Hi all,

I went down to the US for a 10 day visit over spring break. I just got back and wanted to let you all know that my first post-filing border crossing went fine.

I brought a letter from my employer and a mortgage statement, as well as a copy of the NOA. The officer asked me where I would be staying (with my fiance). He asked if we would be getting married in the US, and I said we had filed for the visa. He confirmed that I wouldn't be getting married on this trip (definitely not) and that's it. Didn't need to show any of my documents.

I always take the train across the border, which in my experience is a particularly low-hassle way to cross.

On the way back into Canada the guard asked me if I make this trip often and if this is the usual length of my trip. Not quite sure what that line of questioning was about from the Canadian side, but I said yes to both and he didn't ask anything further.

It's all a bit of a mystery to me still -- what are they looking at on those screens, anyway? Do the dates of all my border crossings show up?

Ahem. According to Wikipedia: A binder clip, or a banker's clip or foldback clip, is a simple device for binding sheets of paper together. The term bulldog clip is used in the United Kingdom to describe both this invention and an older device with the same function, which is stronger and has rigid rather than folding handles.

(To make things even more confusing, the wikipedia entry has a photo of a binder/bulldog clip with the letters ACCO on the side. Perhaps ACCO is just a manufacturer?)

When I was preparing our K1 petition packet, I looked everywhere for photos of how people put their applications together, and I couldn't find much. What I did find looked like overkill: fancy pink binders with stickers and sleeves for photos and tabs all over the place.

It was hard to visualize how to organize the application in a simple, straightforward way until I went through the process myself. So I thought now that we've sent ours in, I'd post a photo and hopefully help others.

To attach everything, we used binder clips (we didn't have easy access to the recommended ACCO punch when we were ready to mail the packet) and paper clips for the passport photos. The evidence of meeting photos are attached to the side of the other documents with a mini binder clip-- that's what we had on hand, and it seemed more secure than a paper clip. (And by the way, that's a picture of us at his brother's wedding, not our wedding!)

I had a table of contents on the cover letter, and another more descriptive table of contents on the "proof of meeting in the last two years" and "proof of ongoing relationship" sections.

I am the beneficiary, but I have been doing the research and we put the packet together while I was visiting the US.

One thing that caught my eye while researching, reading forms etc, is on the I-129F it says this at the bottom of page 2:

Note: (Designation of a U.S. embassy or consulate outside of the country if your fiance(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)

I'm (the beneficiary) in Canada at the moment, and will be for another two or three months, then spending some time in the US, then going home to NZ in June. It'll be the consulate in Auckland New Zealand that I want it processed of course. I wonder if I should contact them to find out if they are likely to accept it or not?

The other thing I noticed, the VJ guides say to include photos and other evidence that we've met with the I-129F. But officially on the USCIS site (that I can find) and on the form, and their guide for filling in the form, it makes no mention of including this.


That sounds like it is from the direct consular filing notes, which are for PETITIONERS living outside of the US, not beneficiaries. However, getting in touch with Auckland sounds like a good idea.

Photos are secondary evidence (since the date the photos were taken is unprovable) but most people include a few. Dated financial records, passport stamps and plane/train/bus tickets are primary evidence. There are lots of posts that go into more detail on this elsewhere.

Firstly thanks to all who contribute to the site - it is unquestionably the most detailed, helpful info available. We're just beginning the journey and it's comforting to see everyone else who have been successful... and continue to support those going through it.

A question; I hope I'm not putting this in the wrong section or missed something in the guides... innocent.gif

Our families are thrilled that we're engaged and looking forward to a big wedding. However, my understanding is that no plans should be made until Visa is in-hand... and we must get married within 90 days of my arrival. I also want to start working as soon as possible so must file for AOS/EAD straight away.

If we do a civil ceremony just the two of us and have my name changed (taking his) on the marriage certificate, can I still go by my maiden name until after the proper wedding? I plan to apply for my AOS/EAD/AP, SSN, drivers license etc in my maiden name (which will match my passport)... then change everything using our marriage certificate later?

Is that dodgy? I suppose we'll just have to explain to the minister at our proper wedding that we have a license from ages earlier? Can anyone think of any holes in this plan?

Hi there,
Sorry, another newbie question.

My fiancé is living in the Northwest but moving to Jacksonville, FL in March. His parents live in Daytona so we want to have everything sent to them in the meanwhile, so correspondence isn't lost in his move.

How should I indicate that? On the forms I'd like to put their address as his, but we obviously can't claim that as his residence. Is there somewhere to show a different mailing address that I missed, or should I include an attachment? I don't want to delay any longer to file until he moves... I'm ready to lick the stamp!

Any advice please? Thanks everyone!

We did the exact same thing except for a K-1 and the Adjustment of Status.
Fiancee came down from Canada on a K-1 and we had a civil marriage the next day to get the paperwork going. We'll have a regular family wedding later.

She is still using her maiden name with no issue.

With the way things are these days I don't believe the name change is too big of a deal.

For example, we were informed that it is now legal for the man to take the woman's last name or you can also legally combine both of your last names into a single super transformed last name...which seems ridiculous.

(This was all just to prove the point that the "official" last name change is really not that big of a deal and can happen anytime.)

Only big setback would be that I would have to travel to Montreal for the interview, which is clear across the country for me. The consulate in Vancouver no longer handles CR-1 cases. Grr..

I've heard back from the lawyer's office, and based on the assistant's own research and a quick opinion from an attorney, the conviction WOULD be grounds for disqualification for the K-1... He said an option would be to apply for a waiver from the Attorney General or Secretary of State, given the exact circumstances of the charge.

He also brought one other thing to my attention: I was completely unaware of the I-130 and the spousal visa. Would this not be an infinitely better route for my fiance and I to take? I would travel to the US (hoping the border officer permits me entry at the POE with the intent to marry and return) and get our marriage certificate. I'd love to have an actual ceremony, but that's not an immediate option; maybe at a later date...

As far as I can see, there are no questions or concerns about convictions on the I-130. Am I right?

Just called the office of a US Immigration lawyer in my area. They seem to be a very reputable firm, and their top lawyer is a member of the American Immigration Lawyer's Association, so that makes me feel a lot better.

They were very nice and let me ask my questions over the phone, which was very helpful, since I really can't dish out $300 in consultation fees right now. He took my info and said one of their attorneys would look at the charge (I provided the actual criminal code) and get back to me.

I feel a little better, but my stomach still won't stop turning. :(

Brand new member here.

So my fiance and I are past the "brainstorming" part of petitioning to get me the K-1, and now headed towards actually filling out the forms and getting everything together. This is so daunting for the two of us, but after visiting this site, I have a feeling most will be relatively easy to cover.

Except one.

In December of 2010, my then-boyfriend (now my fiance, United States) came to visit me (Canada). He flew here without a return ticket, which much have sent up a red flag with customs. They searched him, thoroughly. Right down to his laptop. And guess what they found - old pictures of his then-seventeen ex-girlfriend that he had forgotten to delete. Their view on it? "Posession of child pornography." He was detained, charged, sentenced to 14 days jailtime here in Canada, and deported. I was devastated, yes, but nowehere near as much as he was. That one, tiny mishap of forgetting to delete those photos earned him a five-year ban, a criminal record and his name on the sex offender registry.

But in Canada. So this is where I get confused. He has had background checks done for job interviews since going back home, and everything came up clear. The conviction clearly only applies to MY country.

How could this possibly affect his I-129F petition and does he need to check "YES" towards any convictions? I'm terrified that if he doesn't, we'll be denied for not being honest.

I'm going to be in the same boat soon myself, so I'd love to see some more replies as well.

I'm Canadian and once my US fiance and I learned about the I-130 petition, we decided that this would be the best way to go. I'm beyond excited to be his wife and actually have a chance to plan something of a nice wedding, but what if I'm denied just days before the wedding is scheduled on my way in..? That terrifies me.


EDIT: Also, if on the chance that you are denied entry, can you try to come back at a later date? How soon can you try again..? Or will they never let you in for that purpose and be forced to file for a K-1?

Section C is calling for "Jane's" information. The area of the form you are wondering about is a continuation of asking for information about "Jane" from the previous page. Therefore, since "John" is "Jane's" husband, "John's" information would go on that line.

I was looking at the I-130 example form:

It states that John Smith is petitioning for his wife Jane, however down in part C it asks for "information about your alien relative" and they've got John's information.
Shouldn't it be Jane's?

Just wanted to clarify - as it confused me a bit while looking at the example form and I don't want to make a mistake when it comes to actually filling out my own application.

& Inky, the Vancouver website implied that all other applicants (non citizens or PR's) are processed in Montreal.

I've been snooping around this forum for a while and reading everyone elses questions - but i've never actually had anything to ask!
Well, except for now.

I'm an Australian citizen living in Vancouver, Canada on a working holiday visa - however I just read on the Vancouver Consulate website that they will not process K-1 visas unless you are a Canadian citizen or permanent resident.
I am neither of those, so they're saying I need to use the Montreal Consulate.

The U.S. Consulate General in Vancouver processes fiancé(e) (K1) and spouse (K3) cases for citizens of Canada, or aliens who are Canadian permanent residents. Applicants must also be residing in British Columbia, Alberta, Saskatchewan, Manitoba, the Yukon or the Northwest Territories. All other applicants in Canada are processed at the U.S. Consulate General in Montreal.


My question is - would I actually need to go to the consulate for anything other than the interview? If it's just a once off trip where I actually have to go in person I can handle that, but otherwise I'm probably going to have to head back home and do the whole process from Australia.

Please advise?
