I would wait because you need to make sure that everything is well updated as dates are concerned. As far as emails, phone bills etc goes, you can definitely have all that ready but when it comes to certain documents with signatures and dates, you want to wait until you have a date. You want to keep everything as updated as possible smile.gif

I'm assuming this didn't happen too long ago. You need to call the police for one. I'm sorry that this has happened to you. You need to contact your embassy for assistance for sure. Tell the local newspaper. This shouldn't happen to anyone. But you are better off going back to your country and working, apply for a different visa which allows you to come back legally but you are not able to stay.

The last thing you need is more problems than you already do in your hands! sad.gif rose.gif

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

First off, I am not happy to hear that comment made about coke bottle figures and not being able to meet women or men online. My fiance and I have been together for a while and we are in communication all the time. We just KNEW! Now I feel as if we've been together forever even though we don't see eachother all the time. I admit Philippines is awesome. My mom works with a lot of the filipina ladies. BUT you can't hate on the internet just because you got yourself a lady over in the Philippines.

I would say, report her however you guys met. Even if you can get their authorities involved [in her country] I would take every step I can to stop her from doing this to anyone else. I'd give USCIS a call anyway and see IF you can do anything otherwise...take everything else you can smile.gif

And for the finishline, yes you can find yourself beautiful and coke bottled figures on the internet if that's what you're looking for. But go for the heart first. If she was sincere, she wouldn't have you sending her $ like that. Go for a real woman who likes to be taken care of but can hold her own. But I wish you the best of luck and stay strong! I hope you learned a lot from this experience but don't give up on love cuz it's out there. Just let it come to you when it's time smile.gif

So..I made it into the US! Currently Im in Florida visiting my fiance. Im extending my plane ticket until the end of March and we'd like to apply for the K1 visa while Im here. I crossed the border by land on a shuttle bus and took a plane from Seattle to Florida. When I return to Canada Ill be waiting out the duration of the application and wont be coming back to the states until after it is approved (really hoping it doesnt take a year or more :S). So my question is, what do I write on the I-129f form where it says: "If your fiance is currently visiting the US complete the following...he/she last arrived as a .." It then asks for the arrival/departure I-94 number, and "date authorized stay expired, or will expire as shown on I-94 or I-95" When I crossed the border I filled out a form only asking for the address Im staying at, my flight number and amount of goods Im bringing in etc. How can I fill out the I-94 number if I dont know it or have one?? I had to hand in the form at the border as did everyone else, and I was not given a date I had to leave by nor was my passport stamped, the officer didnt ask many questions. Any advice or tips as to what I should do or write? Im worried that Im screwed now and cant file for the K1 while Im here! Do I have to return to Canada before I can apply and spend even longer away from my fiance!?

EXTRA: There is only one place in BC that does the exam.  They may have a nurse check you to see if you're a girl but it's not an actual physical exam in that sense. When I talked to another CR1 who had the exam there she didn't even have to change into a gown.  The doctor felt her stomach and listened to her heart beat.    

 

(BTW, you SHOULD find a gyno once you move and get that done.  I was 22 when I had my first scare with cervical cancer which was ONLY detected by having my pap done.  It was caught pre-cancerous but very close to going beyond.  I had to have some special procedures afterwards and a bunch more paps, but now I'm very religious about it.  Every year without fail!  My mom has a hysterectomy at 38 even with yearly exams.  My doctor was male and honestly, he was gentler than some female doctors I've had.) 

Thanks for your reply! Doesn't sound like the exam will be too bad, I've been so nervous about that haha. You're right, last time I was at the doctor they suggested I get that done soon. My mom also had a cervical cancer scare not too long after I was born.

 

 

I just wanted to address a couple of things for you.  I?m not sure about your expenses so much as we are a CR-1/CR-2 however the police certificate we got from the Commissionaires.  They were cheaper for me than the local police department ($37.50 each) and fast (2 business days).  I believe they?re good for a year.  

 

The medical - you need to either obtain your vaccination record and get your boosters and/or titre tests done.  Dr. Cheema?s site has a list of required vaccinations on it for you.  For our medicals which we had in Toronto, the nurse just lifted the gown up a little and peeked for girl parts.  No touching, just visual and very quick.  My teen said the nurse seemed more uncomfortable than she was about this part.  I?m thinking Vancouver will be similar.

Thanks! The price for the certificate is not bad, I thought it'd be a lot more for some reason so thats good. I guess if they are good for about a year I might as well go ahead and get it so I'll be prepared for the next step.

Like many others I was transferred to the Texas service center. NOA1 is Jan 17 and my fiance just got the letter of transfer in the mail. (Didnt get any email updates though.) We've yet to see any approvals and it seems like VSC has moved on with the petitions that stayed behind. I'm worried all us transfers have just been shoved in a corner to collect dust :/

Still hoping for the best, praying there are approvals soon... So while I wait on my NOA2 I'd like to start getting things ready. Be prepared for whats next. I've looked at the costs to be expecting

4. How can someone be a co-sponser for the affidavit of support? My fiances mom is willing to be, so does he just fill out a form and include tax returns and his mother do the same?

5. What does my fiance mail to me once we get our NOA2? Affidavit of support, new signed letter of intent to marry, Copy of I-129f package...what else?

Also one thing I'm worried about is the medical. I know there's only one clinic in BC to do it and I believe the doctor is male, and apparently the medical test has a physical exam as well?? I've never had that done and I don't exact feel comfortable with someone looking at my *ahem* parts

I had to send them a letter from my employer PLUS one from my mother's employer too along with 3 years of taxes for each of us. Human Resources should take care of it for her-I can't imagine a company having a strict policy on confirming employment! Maybe talking to her to explain how important this is and that she really needs to ask for it. It has to be on a company letterhead too. At least this is what I was told from the person handling my paperwork. It would be awful if you sent them everything BUT that letter and they wrote you back saying they needed it-then you would have lost time in this long process.

Yeah I cant imagine either...but he's saying his mom can't get it. He has no one else that can sponsor us and hes hoping this long list of paper work that she needs to provide doesn't scare her off from doing it. Without this we're screwed. Apparently the co-sponsor also needs to provide copy of their birth certificate or passport bio page, to prove they are a citizen? My fiance was telling me the W2 provides everything that confirms employment and salary and that a letter shouldn't be needed. I don't know I'm just getting worried, I need to be prepared for the interview so we aren't denied :( I'm so happy we got our NOA2 but this is all so stressful. I wont feel better until I have the visa in my hand and I'm on the plane heading to my fiance!

Gathering stuff after just receiving our NOA2. We need a co-sponsor and my fiances mom has agreed to be one. He explained it all to her. She said she wouldn't be able to get a letter from her employer because they have a "strict policy". I'm not sure if shes just saying this because she doesn't want to ask. I'm hoping this wont be an issue because without a co-sponsor we wont have a chance of being approved, my fiance makes just under the required amount. He would be able to provide everything needed for the affidavit of support, his mom can provide everything but an employer letter. (tax returns, W2, paystub) If it was really an issue they could always call to confirm?

Any help anyone could offer or personal  experience would be great, Thanks!

DS-160 is not for K-1. Go to Embassy link and look up Canada then pick Vancouver or Montreal to get links/instructions to Packet 3!

Because you didn't get an RFE, I would assume you're safe without having a copy of the paperwork. I also didn't keep a complete package and luckily am at the NVC stage. I got a Case # within 1 day of the petition arriving at NVC. However, the case is still "under review" and I will be on Day 13 business days at NVC now.

Please correct me if I'm wrong, but there is no info on the USCIS website about whether you can or cannot visit the US while I-130 is pending, right? I saw on one of the wikis posted by Captain Ewok (I think that was the name?) that those applying for IR-1 (which I am) are not supposed to visit?

From what I've seen posted here, it looks like some have been admitted, and other denied, and that it just depends on the officer you get.

We haven't sent in the I-130 just yet (hence no timeline) but we will be very shortly once we get all our paperwork together. By the time I visit, the package should be in their hands.

Not sure if the following info will help at all but if you know/have xperienced this, please let me know.

I'm Canadian, married to American for 2+ years.
POE will be Pacific Crossing (BC to WA)
I'll just be visitng for the weekend.
I can get a letter from my employer saying I'm due back at work on Monday.
I'll be taking the bus so will have a return ticket.
I'm on a month to month for rent but can show I paid for the month.

My husband just became an American (he's originally from Australia) last month and I'm in Canada. I decided to post here rather than the Canada forum b/c it's specifically for IR-1.
My husband got his green card when he was a teen but apparently his dad's company lawyer dealt with it all so this frustration is all very new for him happy.gif

So i'm canadian, married to an american citizen, haven't yet started the whole cr1 process. But I will be seeing an attorney for it in july to file the 1-30 gathering most the documents together now. I have been wondering about the medical stuff.

Required Vaccinations

1.Mumps;
2.Measles;
3.Rubella;
4.Polio;
5.Tetanus and diphtheria toxoids
6.Pertussis;
7.Influenza type B;
8.Hepatitis type B;
9.Varicella; and
10.Pneumoccocal.

I have been wondering do I really have to get all those shots? saw that list and i'm fairly certain that most the shots have given out as a child you would only need to get them done once. I'm sure I will have to get the hep b and the tetanus, but I find this whole process confusing as hell..
has anyone from canada who married an american got all of those done?


I had all of them done in the past for travelling and stuff, except the T-Dap (the one that includes Pertussis). I just got that done the other day at the travel clinic. For some reason there was no record of me ever having my Hep B (even though I know for sure I had it done in my teens) so I had to get a test to see if I had the antibodies, which I did.

Bottom line, yes. You do have to get all of these shots, or if you've already gotten them, you need to prove that you've had them and that they are still "valid". Yes, it's a huge pain but so is this whole process... Good luck!

I ask because we were told that I'd have to interview for my Canadian PR but that interview was waived. Does that ever happen with US immigration? Also, if he does have to interview, can I go to the interview with him? Is the visa issued at the end of the interview or sometime later?

I'll try to make this as short as possible. My husband (Canadian) and I (USC) started the US immigration process shortly after getting married fall of 2003. Fall of 2004 we applied for Canadian immigration for me, since I was almost done (I thought) with grad school and was nearly ready to move to Canada. I immigrated to Canada Dec. 2004, a month later we finally got his I-130 approved. We've just let the I-130 sit, since we wanted to live in Canada. but I'm still in school in the US, splitting my time between Canada and the US, and it looks like we'll need to move back to the US at least for a few years while I finish school and start my career. The I-130 is still good, we got a letter from NVC saying that if we don't do anything by June 2007 it will expire.

So, I'm just trying to get back into the immigration mindset. Where do we go from here? Should we send the two things that NVC sent us (I-864 fee and Choice of Agent form) back to NVC or should we switch to DCF? We live in Calgary so going to a US Consulate is really easy, would it be useful to go talk to someone at the consulate? How long will this process take-months or years? or at least how long till my husband could work in the US? (his job is not NAFTA eligible)

Your foreign husband's income is outside of the US and won't continue in the US? Then it can not be counted.

Your current income is sufficient? That is the main factor. If your most recent year's income is not a true reflection of your regular earning pattern, your past returns can be submitted to show you *are* a sufficient earner. You may include an explanation of last year if you like.

Your school documents *can* be included to show the strength of your current situation.

AFAIK, the new I-864 guidelines stipulate that an IRS-generated tax transcript precludes the need for the physical W-2. And no, you don't need to wait til Jan07 to get '06 W-2s.

I'm sending in the I864 fee Monday, but am worried about the 125% income. As I understand we can't use my husband's income, correct. We have filed joint US income tax returns since 2003, does that change anything? Last year I was in the middle of immigrating to Canada and only was able to get part time contracts, so only made $8500. Other than last year, I've made above the 125% since 2001 and will be above again this year. I'm in grad school and my job is an assistanceship, I have an official letter from the university guaranteeing my assistanceship for the next 3 years. Can any of that be used to show that I actually will be able to support him? Or do we just have to wait to send in the I864 until I get this year's W2? We don't really have anyone that we could ask to joint sponsor with me.

Ok I talked payroll and they can give me a 1098T which shows that my tuition is taxable income. Most of my relative are missionaries and make less money than me, so I'd have to go pretty far out on the family tree to find someone to be a joint sponsor. So, what happens if we try this without a joint sponsor? my husband has a history of employment in the US, would that combined with my just barely enough income satisfy the requirement?

oh and I only worked part time last year because I was in Canada waiting for my Canadian PR to be approved. so last year's tax return is way below the minimum. 2003 and 2004 I made well above the minimum because I hadn't started grad school. but my only assets are my car and brain

ok just looked at the income requirements again and now I'm not sure if I make enough money. I'm a grad student and my stipend is just under $16K which isn't enough. But I also get my tuition paid, which I have to pay taxes on, so will they count that $4,500 as part of my income? The confusing part is that the tuition (or taxable benefit) isn't printed on my pay stub, it just shows up on my W2s and isn't even seperated out. what to do?

ok those dates that you gave-the one year letter saying that everything would be tossed in a year-makes me think that you are in roughly the same place as we were. our first letter from NVC was 6/2005, the second "if we don't hear from you..." 6/06.

I'm not exactly sure how long it took to get out of the review process. The hubby sent in the DS3032 in July-I'm not exactly sure when cause I'm also apparently really careless and shouldn't be treated with respect, or oh wait i have a life and job. Yondrak can kiss my ###.

Anyway, we were in the field all of Aug, then I had to come back to school, I think my husband got back to our house in Canada in mid-sept. When he got home there was a new DS3032 and a new AOS fee bill. We hadn't ever paid the AOS fee, but there was something in the warning letter about all forms and fees being forfited. So maybe filing the DS3032 in July just restarted our process and didn't really count?? I dont' know, he resubmitted the form in Sept. Then he was in the field again for 3 weeks and when he got home the IV bill was there.

sorry I don't have exact dates, but I don't think that you can really hurt the process by calling every once in a while to see how things are going. If a month or so goes by you/your husband might try talking to your senators/congressperson. Part of the long delay of our I130 getting approved was Nebraska lost the file, my senators office was really nice and helped me find out what was going on within a few days.

as an aside, have you checked if you can work under NAFTA? My husband's job isn't NAFTA approved but lots of jobs are. That may help with the 125%. I feel your pain in that too-grad students are also below the poverty line. totally sucks trying to find someone to co-sponsor.

my experience with an old i130. the story: we started the whole application process for an IR1 for my husband shortly after we got married in fall of 2003. For various reasons, most of them unknown to us, the i130 didn't get approved untill March 2005 3 months after I immigrated to Canada, so we just ignored it. we didn't get the first communication from NVC until June 2005. Then this summer, we got a letter from NVC saying that it had been a year since they heard from us and all forms and fees from the NVC process were thrown out. If we didn't respond within the next year the entire process, i130 approvial I assumed, would be tossed. Since I'm still in school in the states, we've picked up the application and everything seems to be fine. sent in the choice of agent and got and returned the AOS and IV bills. I've gathered from this that you just have to do some part of the application-like choice of agent-to keep the application alive.
