Hello All, I'm new to this VJ and find this site is very helpful. I'm so grateful to find this site before I make another big mistake. Here is my story:

I met my bf online when I was working in Hong Kong in 2008. I was born in HK and moved to Canada with my family in 1993. I'm a Canadian and my bf is an American. This June 2009 I decided to quit my job in HK and moved back to the North America soil so that I could be closer to my bf and meet him more often. Our original plan was I moved back, then I stayed in US for couple months and then get married. However, things ain't working out as easy as we thought. I have been travelled back and forth US without a returned ticket couple times without any problem. But this time (this week) I was refused entry to the USA for the reasons that a) I did not have a returned ticket; cool.gif they found job resume in my suitcase; c) I have no Canadian ties, ie house, mortgage, bills, rent, job etc. The CBP officer said to me that I needed those evidence in order to let me in and I will need them every time I try to enter USA. So I was sent back to Canada. My problem is that I do not have a house in Canada as I stay with my parents. I'm now at the stage of looking for a job in Canada. And it makes no sense to rent a house without a job.


I talked to my bf and we thought that may be he would petition a K-1 fiance visa in order to get me in. My question is: if my K-1 visa got approved and I am going to USA under K-1 visa, do I still need to show the evidence of Canadian ties? Coz as far as I know, K-1 is a non-immigrant visa and as long as it is a non-immigrant visa you need to show ties to your home country.

When your K-1 is approved and you go to enter the US, you will be entering the US with the intention of moving there permanently and adjusting your status to that of permanent residence. In actual fact, once you enter the US, you will be completely UNable to, without badly screwing up your life, return to Canada, for a minimum of 2-3 months [until you have an AP document or Green Card in your hand]. Ties to Canada would be completely beside the point :)

If someone was denied entry to the US with a K-1 visa in hand, it would be for a reason completely unrelated to having immigration intent. The K-1 visa is what allows you to have immigrant intent. I don't know why someone would be denied, but inadmissibility due to possession of controlled substances is the first obvious thing that comes to mind.

I wouldn't worry about it. The worst thing you have to fear at the PoE will be a cranky border officer. If you've got the visa, then you've done everything right to that point, and the PoE should be a formality. Worst realistic case scenario is a long, tedious formality. Don't worry about it :)


Thank you. That's exactly what I was told couple month ago by some senior members here and their answers made sense to me. K-1 visa is non-immigration visa with immigration intention. I was just getting anxious and paranoid when I read the thread about the member who had the K-1 on hand and still got denied at POE. May be I need to re-read his thread and understand why he got denied. Being finger printed and detained 4 hours at POE was a really horrible experience. :huh:

It's not a big issue but now that they flagged you with "prints and pictures' along with the date and reason for denial, that will pop up when they scan your passport, be sure you have your ties to Canada ducks in a row next time!


Hi I got denied in Oct last year due to lack of ties to Canada too. By then I just moved back from Hong Kong to Vancouver with no job and no house (I stayed with my parents). They told me to try six months later and show them ties.

My question is now that my fiance has submitted a I-129F petition and we have just started our long journey. However, I still have no job and no house (still staying with parents) but I'm selling on ebay. So what if when my K-1 visa is approved but I still have no jobs during these couple months and I'm trying to enter USA with a K-1 Visa? Will I be denied of entry for the reasons that I have no ties to Canada? I read from someone's thread here that he got denied at POE even though he had his K-1 on hand. I'm very anxious. What should I do to prepare? Thanks!

It's okay to visit and yes the CBP has final say. Make sure you have your return ticket and lots of document to prove your ties to Canada. It won't affect your K-1 application in case your are denied; it was told by the CBP who denied my entry back in Oct 2009. My petition got approved last month and I passed interview this month. Good Luck!

You should visit Canada Portal where many of Canadian VJers have similar situation.

She can visit on B-1 while the K-1 is processing. However, she will need to show proof that she intents to return. This could be anything from lease agreements to a letter from her employer.


Yes it is doable but the CBP has final say even if she has a valid B-1 visa.

I'm the petitioner. My fiance lives in Toronto and I'm a US citizen who lives in Chicago.

I need to get a passport stamp as my proof of entry to Canada.

The denial notice says that The petitioner did not submit information regarding the circumstances under the petitioner and beneficiary met to establish the relationship. Further, no documentary primary evidence was submitted regarding when and where the petitioner and beneficiary had personally met.


Do you keep emails or sms for the pass two years? Skype, Yahoo Messager, SMS etc. In my case, I only sent two pictures with tones of daily SMS copies and boarding passes that Aaron and I visited each other.

I'm not sure aboout the Appeal and I will leave that to other VJers who have that experience.

Airline email confirmations are not evidence of actual travel. Passport stamps, boarding passes and receipts in country ARE evidence of actual travel. That's what's needed.


I do agree with you that passport stamps, boarding passes and receipts are strong evidence though.

To OP, if RFE is asking for passport stamps and if you do have one, that should be good. Credit card statements/receipts showing accomodation at hotels, dining @ restaurants etc to show that either one of you have travel to meet each other could be a source too.

Did you book your air ticket online? Do you still keep the email confirmation from airlines that matched your dates of travel?

Aaron and I had visited each other few times before we filed but we did not keep all boarding pass stubs coz we had not planned to step forward at that time. What we sent was air ticket confirmation emails from airlines, one boarding pass, some movie tickets matched the dates of presence. Our photos were not "film-dated"

I could not show ties to Canada so they sent me back and barred me for six months. It happened in Oct 2009. Then my fiance visited me in Dec and we decided to file I-129. Back then I did not have a job until April 2010 so I could not show tie still. I had to wait till I had few pay stubs to show CBP.

I just said goodbye to the one I love after a amazing 3 weeks together. The plan is that I wont see her for nearly 6 months. We both are finishing school and she has a lot of wedding planning to do. We're currently in the K1 proces (September 2010 filers) aiming that our wedding will be on Augst 6. 2011 and me leaving to be with her in July.

Now Im really down with that time that we have to be apart. This is the longest we havent seen eachother, herefor almost 4 months. Now my question is to see how long other people havent seen there beloved ones, hopefully it will make me feel better.

I could not see my then fiance, now husband, for six month due to refuse entry by CBP. It was tough but hang in there. My husband always told me that it seemed long but it worth it when you look back a year from now.

If you were born in USA you can send a copy of your birth certificate (front & back). You may also send copy of your valid, unexpired U.S. passport issued with a validity period of at least five years. You need to copy all pages of your passport.

We're using the template provided on the site for the letter of intent. Should we add anything to the template in terms of the body of the letter? Or is what's in there enough?

The real question is which address do I put in for the USCIS service center? Do I put in the Dallas Lockbox address? Or should I assume that since I live in California, that our petition will be sent to CA and use that direct address?

Are you including your Letter of Intended with you I-129F application? All application should be sent to TX now so I would put whichever address that your I-129F sending to.

I used the exact body paragraph on my letter (change the names of course).

Yes some countries require you to show cause to obtain a police certificate. Your fiance will get a letter from the US consulate (I think it's packet 4)and she needs to show this when she applies for the police certificate.

I lived in Hong Kong and Canada. It took me only one day to get one in Canada but almost two months for the Hong Kong police certificate.

If you are a citizen of the Philippines and is currently on a working visa in Canada and you quit your job, you have to return to the Philippines. What have you been doing in Canada for the last six months? Better make sure the Cdn govt doesn't know about this or you'll be in trouble?! Did you manage to find another job in Canada? It probably won't affect your application as riblet has indicated because you're the beneficiary, not the petitioner. No worries, but I would sort out the employment issue asap.

lil mama - I cross the border frequently and wonder when it will be my turn to produce my ties to Canada. I keep a thick file in my car just in case. Glad it didn't get too complicated for you other than the I-94.

I do believe that your only options are Montreal or Vancouver for the K1. Good luck with the filing!

The bottom line is you don't have any 'easy' options or solutions. You won't be able to simply have your girlfriend live with you while you are in college for an extended period of time, if that's what you were hoping to do.

Immigration and the rules around it are serious business and although your heart is in the right place you still have to understand the proper steps you will need to take. That goes for you, me and everyone else on this site.

Enter his legal name exactly how it appears on the passport. But if certain documents include the complete name and others don't, then you need to explain in a separate sheet of paper and make sure you include the paper in your table of contents. So they are not confused and send the package back to you.

Thats a tough question and things might have changed since I was there almost 4 years ago now. But Nebraska was lagging behind at that point also. Management really was pushing a numbers game as far as adjudicators cranking out as many as they can. I also see that the NSC has a new Director (who used to be the Omaha District Manager). He's a good man.

An Adjudicators job performance is based on several factors. 1) how many files (petitions) you process everyday 2) number of applications "kicked back" because you made a mistake and they shouldn't have been approved and 3) attention to details and how many errors you make. Management gets a report on each Adjudicator (we all have a individual ID #) showing the total # of petitions processed, number kicked back and how many errors we made. They can call this up anytime and we wree required to keep a daily tally of the work we did. When performance appraisel time came around, you would discuss your individual performance with your supervisor.

Thats one of the reasons why you might see that your application was "touched" several times ona given day but no change in status. The adjudicator began working it (touch), went to lunch (touch), came back from lunch (touch) and finished reviewing it and sent it off to be processed (touch). Its touched when it goes back into the que and etc...

Keep in mind everytime a file changes hands whether its signed out to an Adjudicator or some satff person, its gets "wanded" ino the system so they can track who specifically has the file. Each file has a scannable bar code. Sometimes you'd be working a file that has someone else working another compnent of the file or one of the family members. We would alwaystry to keep family members together and approve them at the same time.

getting back to the way it works,

If at any time you weren't processing enough petitions you would usually be talked to by your supervisor. Generally, this was only if there appeared to be a "trend" in your productivity. Everyone has days when they could process a lot vs. other "slower" days. A lot depends on the complexity of the petition you were working and some other "bean counting" tricks you could use to keep your #'s up. Everyone is trained on certain petitions first and progresses to the more complicated ones. This way they have the more experienced Adjudicators working the more difficult petitions like the 485's etc...

Do "touches" really mean an NOA2 or RFE is coming soon do you know

Typically, I imagined that they would send RFE's right away. But we were touched July 9th and now we get an RFE on Oct 15 sad.gif But I'm sure it's nothing major. You all should be getting approved any day now smile.gif
