1. Have you ever violated the terms of a U.S. visa? No, because she never had a visa
2. Or been unlawfully present in the United States? No, because of the exception for minors
3. Or deported from the United States? No, she has never been deported

Though your concern is highly understandable, I completely agree with other posters here who stated why bring trouble where there isn't any. Whichever decision you make on answering the question, I recommend to be prepared in documenting it through some sort of affidavit or statement of facts...just my two cents

That is correct! If you make above the poverty level based on how many will be in the household is good enough. Make sure you get an employment
letter from your company stating the position, salary, and whether your position is full time or part time. Don't forget to send a couple of month's worth

It is a good idea to bring it with you. It really depends on the CO interviewing you. In our case, when we were interviewed last August 2011, the CO actually asked for copies of money remittances. So, the rule of thumb is be prepared for anything and everything. It is better to have it available when the CO asks for it than not having it. Good luck!

Yes i asked them bout it,,actually i received an email from them saying what are the requirements needed,they were the one who gave me a form to fill up but cant send to them..Have to send it at Jordan Embassy in Tokyo,Japan sending it by EMS(DHL,FEDEX) coz they are only processing visa and legalization of documents(authentication).The process would take about two months because it is being done by monthly diplomatic pouch. From Japan it will be sent to the Foreign Ministry in Jordan then back to Japan.


The requirements for Police Clearance are as follows:

  • Written request letter indicating the time spent working in Jordan and must be signed
  • Completed police clearance application form (kindly refer to attached)
  • three (3) pieces of recent passport photos
  • Clear photocopy of passport, all pages (colored or scanned copy)
  • Return envelope with applicant's complete mailing address

My fiance just paid the BPI for her K-1 Visa this morning. I called to schedule her interview and the automated system said we need to complete the DS-160 online before scheduling the interview. I thought for scheduling we just needed the MNL #, Passport ID #, and receipt # from the BPI. Is this something new with the online DS-160?


Whoever told you that, they are wrong. Let them know you're a K-1 visa. DS-160 doesn't apply to K-1s. You need DS-156, 156K, & 157. Call them back!

Thanks for the response. Yours is a tough situation. I am sure you've already consulted with an immigration lawyer. Whatever you decide to do, keep in mind, that the USCIS have a lot of resources at their disposal when doing their investigations. I really do not see a way around the 10 year ban when the overstay is discovered. Good luck on your journey whether it is in the USA or outside of USA.

He divorced his spouse (also not a USC) who originally came with him in 98. She was from the same country. So, he would never have qualified to adjust status based on his previous marriage.

I agree with pushbrk on this one. Using common sense, yes it is preferable to have pictures together to supplement your primary evidence. Is it required IAW the instructions for the submission of the petition...no! But, if you absolutely have other primary evidence you can include in your petition such as hotel receipts with both your names on it, flight itineraries with both your names on it, boarding passes with your names on it (even better if you sat beside each other) then you'll be fine. I did file my I129F petition with 5 pictures in addition to the primary evidence aforementioned. If I did not have pictures, I would still be comfortable submitting it because I have the primary evidence required...ultimately, it is up to you to make that decision...just my two cents...oh, double check and triple check everything before you send the petition! Good luck to you!

There was a discussion regarding this question on the I-134 form and about half of the responders elected to write down exactly what they intend to provide and the other half followed the VJ sample form. There was no mention of negative effect from either group. So, it is a matter of preference. I myself will follow the sample form as it has been proven countless of times to work.

If your fiance meets or exceeds the poverty guideline, there really is no need to submit other evidence, though some elect to include other supporting evidence for their peace of mind. I will use just my salary and military retirement pay in support of theI-134 form. I am going to include a letter of employment from my company (on company letterhead) stating the date and nature of employment, salary, as well as 3 months worth of pay stubs. Hope this helps!

For Question 11 on the I-134 form, the example form states to leave the boxes blank (I intend, do not intend) and in the line below type in N/A K1 visa process for permanent residence.

In reality, my fiance will be footing the bills (and i can contribute a little from my savings) till I get a job, and then, we'll split the expenses. What should we write?

Also, my fiance's current salary meets the poverty guidelines and we also have 2-3 tax forms to prove it. Do we still need a little from the bank stating how much he has in his account?

For the purpose of getting an approved visa after your I129F petition is approved, an I-134 affidavit of support is needed. Once, you're in the US and files for an adjustment of status (AOS), an I-864 affidavit of support is filed. it doesn't matter who your sponsors will be at that time, but this is what the instrcutions on I-864 states regarding the sponsor's obligation:

Your obligation to support the immigrant(s) you are sponsoring in this affidavit of support will continue until the sponsored immigrant becomes a U.S. citizen, or can be credited with 40 qualifying quarters of work in the United States. Although 40 qualifying quarters of work (credits) generally equate to ten years of work, in certain cases the work of a spouse or parent adds qualifying quarters. The Social Security Administration can provide information on how to count qualifying quarters (credits) of work. The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful permanent resident and departs the United States. Divorce does not end the sponsorship obligation.

Take care of the I129F petition first as this will take anywhere from 4-6 months on average. All the interview stuff will come after you're I129F is approved. You must have a lot of patience when going through this process. Good luck on your journey!

My fiance and I plan on scheduling as soon as we're able to. Then, plan everything else based on the interview date. She plans on going to Manila (she has family in Bulacan) about 3-4 weeks prior to the interview to collect birth cetificate, NBI clearance, school transcripts,& CENOMAR. Then, do the medical exam a week prior to the interview. Oh, she doesn't have any vaccination records either...:( She'll just have to get them. She just got her passport renewed, so she is good to go there.

Right, there are no more papers to send to the Government. The USEM will receive your entire package from NVC. Right again in that it will be a huge pile of stuff your fiance will bring to the interview...:) But, when the CO says you are approved, that pile will feel oh so light...:)

God willing, I will try to be there for my fiance's interview.

I don't imagine there would be a medical exam problem... she's in good health except that she has no vaccination records (she had them, but the doctor died). I'll go check out that Facebook group, thanks for the tip... she's traveling now (to pick up passport actually) so she won't be able to join right away.

In general, should we schedule the appointment the instant it is possible to do so? Then, continue collecting papers that she'll need and hope we can complete it all in time? (I would expect we could if it takes 2 months to schedule.) I don't want to hold it up just to collect papers. And, just so I understand, from this point on to the interview we don't have to mail any forms back to the government, right? She brings that huge pile of stuff to the interview?

From what I've seen, it averages about 2 months after NOA2 for the Visa to get approved provided all goes well. Things can get delayed if for example there was an issue with Medical Examination. Allow for about 2-3 weeks for your apllication package to get from NVC to USEM. You can only make an appointment for an interview once the USEM inputs your case in their system. If you haven't done so already, Have your fiance join the Pretty Ladies (VJ) group in Facebook. When searching for the group make sure to include the (VJ). It is a group of Filipinas going through or have gone through the same process. Members there provide a lot of great info regarding the process. Right now, people trying to schedule interviews for USEM are already getting early August to mid August dates.

Thanks for the links; somehow I missed those. I recognize some of the questions there from long ago when they were part of the old k1 visa newsgroup.

I'm a bit confused by how long it is expected to take once I get the NOA2. I'm seeing confusing and conflicting information, one place saying interview is scheduled 24 days later, another 3 to 5 months. Huh? Minus the time it takes to come up with documents and mail things (should be less than a month), how long after NOA2 should I expect that we can schedule the interview for?

Your timeline is very similar to mine except mine is being processed by CSC. I continue to gather information pertaining to proof of ongoing relationship from when I filed, which was April 1 until NOA2 is received. These things are chats, video chats, money remittance (if any), receipt for sending a "Balikbayan" box (you will find out about this trust me...:lol: ), and anything else you can use which proves you have a genuine relationship.

I made a duplicate copy of the I-129F petition I sent to USCIS. I plan on getting the letter from the employer when NOA2 is received. I will include about 3 months worth of paystubs with the employer letter. I will also then include the completed I-134 (tax transcripts included) and an my updated letter of intent to marry. Once I have all the additional documents, I will send the entire package to my fiance via DHL to Cotabato city (Mindanao). The only originals I have are what I used to prove we've met the past 2 years such as boarding passes & hotel receipts. The rest was photocopy of my Naturalization Certifiate, photocopy of my passport where all the information is and the page where the entry/exit stamp for Philippines. The K1 guide does a good job explaining the I-129F, but there's not much there for what happens after that. I'm not sure exactly what to expect. I know there's an I-134 form and a bunch of stuff I need to do for that (and the fiancee brings all this to the interview, right? i.e. I don't mail the form directly to anyone else?)

What else can I reasonably do before I get the NOA2? I just requested a couple certified copies of my birth certificate, in case she needs to bring one. And, I requested last 3 years of tax return transcripts (I suspect that's better than the unsigned PDF printouts from when I filed my taxes online). I'm not sure what else I can do, since some things need to be current. e.g. letter from employer is pointless if it is 6 months old, etc. so I have to wait on those things. The guide also said I'd need to send "originals" for everything I previously sent with the I-129F, although I'm not sure how much really would be "original"... most things I send in is printouts from online these days so I can't get any more "original" on most of the documents I sent. And I'm certainly not sending my original passport which I had sent photocopies of with the I-129F (that's why I requested certified birth certificates, since I can send those instead of passport).

Because you did not attach the notification form, the USCIS won't have your cell phone # and email address, so, no you won't get notified via text or email. Give it two weeks for the hard copy notification to arrive. I received mine about a week after I was notified via text & email.

I really need your help. My I- I 29F petiton got denied due to lack of evidence. I got an email from USCIS
saying"our Case Status:

Decision On May 17, 2011, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of May 17, 2011, please call customer service at 1-800-375-5283 for further assistance. During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision."

We got the letter and the reason why it got declined was due to lack of information, it's frustrating because I called them before submitting my petition and I was told to submit just the I- I 29F form ( that's it, I asked them 3 times) Anyway, on the denial letter, it say's we have an option to appeal and to submit additional information like (proof we met, forms etc)and to $600 fee. Should I refile again instead of submitting an appeal? I heard filing an appeal would take longer. If it's possible to refile, what do I need to do with the initial petition? Do i need to cancel it and send a I- I 29F petiton form? Please advise. Would appreciate your feedback

Generally every month I send my fiance money using MoneyGram. The website allows me to print out a receipt with detail information of each transaction. This includes the name of the person receiving the funds, date, time, transaction number, amount, country sent to, my bank card last 4 digits and name of sender. Will this be consider appropriate to include my initial K-1 Visa application?


Not a mandatory requirement for the initial petition. It is more of a proof of on going relationship which is required when the interview comes up. However, more petitioners include all the evidence they have with the initial petition. It is called front loading. I included this very evidence you're talking about myself on my initial petition. Better to have too much than not enough evidence. Hope this helps.

Also, this isn't frowned upon unless it was the other way where the beneficiary is the one sending money to the petitioner. Then, it is absolutely a red flag since it makes it look like the beneficiary is paying the petitioner for the green card. Just my opinion.

I just wanted to share...Yesterday I learned that I passed our diplomate board exams in ophthalmology. Then today, I learned that my fiance and I finally have our NOA2. I hope our blessings just keep on coming. Being with him is the only thing I've been waiting for.

Anyway...I would just like to ask though. My son is a US citizen. Should I also fill out a DS230 form (application for immigrant visa and alien registration) for him too? it's just that the instruction states that i should complete one form for myself and each member of my family who will migrate with me.

With your son being a US Citizen there is no need to fill out any forms for him as he is free to travel with you as long as he has a US Passport.

It depends on you or your fiancee on how quickly you can get an interview date. You'll have to wait until your package is received at USEM and entered into their system.

I essentially used my cover letter which listed everything included in my petition as my checklist and went through it one at a time. I did this at least 3 times. The second time I went through it, I found a couple of things I missed. The third time, I was confident I covered everything. Now, I am in the waiting mode like a lot of VJ members. Good luck!

Just wanted to find out if people think when dealing with the Manila Embassy. Is there an advantage going with a K-1 visa service, if so which ones are the best or should you jsut file it yourself? I have noticed from others time lines that many get approved in 4 or 5 months while average is 8 months or longer.

Just looking for any advice on best way to file for it to run smooter and to be approved as quick as possible.

I don't really see any advantage using a K-1 Visa Service Company. All petitions go through the same process whether it was put together by a Visa Service Company or put together by you. Plenty of petitioners here have filed for their beneficiary via K-1. If you have the patience to read the excellent guides (go to the top "Guides") here for a couple of days or so, you will have no problems putting the necessary documents/forms/evidences together yourself. The requirements are pretty straight forward.

VJ is an excellent tool also for questions you may run into as there are plenty of knowledgeable people here. Interaction you will have with the USEM is when making an appointment for your beneficiary's interview and the actual interview itself later on in the process.

Depending on the which Service Center your petition is assigned, your petition may get approved a bit sooner or a bit later. The average is 4-6 months if your petition is straight forward. Some have gotten approved in less than 4 months and some after 6 months.

I filed for the petition myself in this way I had full control of preparing the necessary documents/forms/evidences instead of relying on someone else. If and when the petition is adjudicated and approved is entirely up to the USCIS as we are at their mercy.:( The waiting part is the hardest part of this entire process. Plenty of patience is required, but it is all worth it in the end. Good luck on your journey! :D

DHL is quick but way too expensive for her. My work schedule is also really hectic this week for me to find time to send her money. She'll use LBC to get it here. Still pricey but not nearly as much as DHL and it will still be here quickly.

Make sure you include VJ when searching in Face Book. Thanks you two for your replies so far. Letters of intent from each sounds fine. I'll just use the template off of VJ for each of us. As for an original signature, I submitted a printed signed PDF copy of the G-325a from my fiance and that seemed ok. I'll wait and see if anybody else has advice on that. Snail mail between here and the Philippines before July 22 seems feasible but iffy.

Even though it will take a little bit of time, I guess I'll input the date stamps on my photos just to be safe. A small sacrifice for a large reward :yes:


My fiance used DHL from Cotabato city to send me her documents and application pictures using DHL and it got to me in 5 days.

We have just about the same timeline and we got approved 6/24/2011

Hi everybody...so an RFE came in the mail. I see it as good news that our application has been looked at :innocent: Before I explain the RFE requirements please bare in mind I found VJ.com after I submitted my I-129F. Some of the requirements, after reading VJ, I know should have been there already. So....

1. Intent to marry (both by petitioner/beneficiary). I know VJ has a sample copy online. Can I send a copy of that to my fiance (filled out with the proper info of course)? She can print, sign, and email a copy back to me with a quick turnaround. Secondly, can we use one letter of intent signed by the both of us?

Separate letters of intent are needed. I've always read here on the VJ site that original letters of intent are submitted. I am not sure if a scanned/pdf letter of intent is acceptable. Hopefully someone else can chime in. I sent originals myself.

2. Circumstances of meeting. I guess they want a little more detail about how we met. Not a problem for me.

A paragraph or two with enough details should suffice. You might as well sign and date it, too.

3. Copy of my passport with pages of stamped entries. Again, not a problem.

I provided a copy of the information page and where the entry/exit stamps.

4. Evidence of meeting within last two years. I have numerous photos of her and I from when we met this past December/January. However, in the RFE it says "film-dated photographs. My photos, which are now on my computer, do not have the date-stamp on them. Will that be a big deal? My computer does tell me the date/time in which the photos were taken. I can go so far as to insert them using a program, I guess :blink:

Mine did have date stamps and taped them on a blank copy paper and I added captions to it as where, when, and who were in the photographs. You can also write the info in the back of the photographs you will print out. It would even be better if the pictures you include matches up with hotels/places you visited while in the Philippines...for example, i provided pictures when we were in Samal Islands Davao, Coron & Puerto Princesa Palawan, and a night out w/ family in Manila.

Thanks for your help in advance. Never thought an RFE would be this exciting, but after waiting for months without any word or reply at least it's something! I can barely contain myself, hahaha!

In the Philippines, the overwhelming majority of petitioners are men who are significantly older than the female beneficiary. It's extremely common and not contrary to local social customs. It isn't a problem. Don't worry about it.

Does anyone know of any other websites or groups where I can get detailed info on filing a K-1 Visa in the Philippines?

Have heard the Manila Embassy is much harder than most places in the world. I knew nothing of the process. When I went to the philippines I did not save anything or take enough pictures together with my finacee. Currently changeing carrer. So very worried on how to document the relastionship and to prove finicial support is enough when I am just starting back to work. Don't have any taxible income for last 3 years.

Looking for any helpful websites and groups on the net that takes about peoples experience with the manila embassy.

It is a group of Filipinas who are going through or have gone
through the process and can give you great advise specific to the US Embassy in Manila. I think, they are up to 300+ members already. Good luck!

I received a text message and email Tuesday morning stating that we are approved and the NOA2 letter was sent out Monday 06/27/2011. I assume I should be receiving that today in the mail. What should I be preparing now in this stage? From others I have heard I need 3 pay stubs from my employer. My employer no longer gives us the paper form since we can access this information online. Would a copy of my online statements work in this case? Or should I contact my employer to see if they are able to give me an official pay stub? Also, concerning the tax forms I need to submit. I file my taxes through turbotax every year and print my tax document off for my records. Would this copy be acceptable for the tax document requirement? Or should I contact the IRS to get my official tax information. In addition, as far as the bank account and savings information, is there a certain amount that I should have in my account? Thanks for any information anyone would have regarding what my next steps are after receiving my NOA2. My fiance and I appreciate it so much!


Our timeline is similar. We just got approved 6/24/2011. Have your fiance join the Pretty Ladies (VJ) in Facebook. When searching Facebook, make sure you include VJ. It is a group of Filipinas who are going through or have gone through the process. They provide a plethora of information specific to US Embassy Manila. They've even created a DOCS file where you'll find information on what to do after receving NOA2. What we're wating to do now is to get the Manila Case Number from NVC. We should have this end of week or early next week. There is no need to wait for the Packet 3 to get to your fiance. I've heard it takes awhile. Once you have your case number, your fiance can get her medical exam done ($214.00 fee), pay the Visa fee through BPI ($350.00 fee), and gather her documents such as Birth Certificates, Visa Pictures (have plenty), CENOMAR. NBI Clearance. She'll also have to attend the CFO seminar which is a sort of a briefing for a Filipina marrying a foreigner. Once she's done with CFO, she will receive a sticker (this sticker is important as they won't let you board the plane without this). Again, please have her join the Pretty Ladies (VJ) and she won't feel allalone as she will be guided throughout the process. This is just from the top of my head, so, I may have missed something. My fiance is planning to get her medical done July 25 & 26. For interview, we plan on scheduling it for third week of August and I will be there for the interview and take her home to California.

The NVC dose not get bypassed. All approvals go through the NVC and then assigned a unique case number AKA Manila Case #. The NVC will then
mail your approved package to US Embassy in Manila. The NVC has slowed down a bit on lately on mailing packages to embassies. I say give it about
3-4 weeks for the package to make it to Manila. If it gets there early, great! I will be calling the NVC late next week to get the Manila Case #. We were
approved 6/24/2011.

If you haven't already done so, include a cover letter which you will essentially use as a Table of Contents. You can use this as

a checklist of sorts to identify what you have included with the petition. Double check and triple check everything. See the link
