It doesn't sound like she used him at all. It sure sounds like a failure in communication though. I can understand the OP wanting to make a more stable relationship/situation for when she gets there with the kids. Imagine this...she gets there with the kids and he goes away for long periods as a truck driver...that will put a lot of stress and strain on both parties. I can also understand that she was upset about the approved I-129F being cancelled. I think in the long run, the OP's plan is a better plan as he wants to ensure that the relationship will be on better footing once he is better off financially and that he will actually be there for them instead of being away for long periods.

If they do care for each other very much, then they really need to talk things through and really buy into whatever plan they agree on and be prepared for the long haul. If either of the party isn't willing to do that, then they need not kid themselves and go their separate way. I really do hope they work things out.

There is nothing to worry about. Since the Naturalization Certificate is what is being used as proof of citizenship, it is okay to send a photocopy. It does not make sense to send an original of such an important piece of paper.

Im a bit confused coz Underneath the certificate says that making a copy of it is punishable by law, so incase its needed what am i going to do?...make a copy of it?...

I think you are confusing the I-134 and I-864. The I-134 is a requirement by USEM to get your K-1 Visa approved. Then, once the beneficiary is in the US and you get married, you can file for AOS. One of the requirements for the AOS process is the I-864. Hope this helps and good luck on the rest of your journey.

I just want to address this topic to all who went through the interview at the US Embassy Manila... I am little bit confused about the I-134 Form which is the Affidavit of support. Is this really needed to be shown to the Interviewer here in US Embassy .....because I read in the USCIS site that

Affidavit of Support For Fiancé(e), Spouse, or Child as a "K" Nonimmigrant

"If your relative is either a "K-1" fiancé(e), a "K-3" spouse, or a "K-2" or "K-4" child of fiancé(e) or spouse, you do not need to submit an affidavit of support at the time you file your Form I-129F petition. Instead, you should submit an affidavit of support at the time that your fiancé(e), spouse, or child adjusts status to permanent resident after coming to the United States."

PhilippinesPreparing I-134 before NOA2 arrives

Is there anything specific I should know about the process in the Philippines regarding the I-134 I need to prepare for the K1 visa? I am waiting for NOA2 but want to be prepared in advance as much as I can.

My income is well more than enough to meet the poverty guidelines. So, I was only going to use my income on the form to qualify and not list any stocks/bonds (don't really have any), bank accounts, or real estate. To prove this income, I am planning to send:
- Last 3 years of IRS tax transcripts ("original" but that doesn't really mean much since its a printout they send me, and not signed or anything like that).
- Photocopies of last 3 years W-2 forms. If someone thinks it necessary, I could have them notarized as "true copy". But, I really don't want to send those originals since I can never get replacements again.
- "To whom it may concern" letter from the HR department saying the basics about my current employment. I'll send it with their original signature, and wait until after NOA2 so that it is current.
- 3 "pay stubs" after NOA2 (so that they are also current). I am only paid electronically, and the pay stubs are emailed to me, so this is basically a printout of the emails they send me. They of course look easy to fake since it is just monospaced text from an old mainframe computer that sends these out. I wasn't planning to sign these or get them notarized, since I'm not sure what that would mean.
- And, of course, two signed (not notarized) copies of the I-134, with my original signature.

Is that all? Note that I wasn't planning to send bank account info since my understanding is my income is high enough to qualify. Also, I am not sending the actual tax returns for the following reasons:
- I filed electronically so all I have is a PDF I can print.
- Those would require original signatures, and they were filed jointly with ex-wife. There is no way for me to retroactively locate her and convince her to sign those.
- It would be redundant, not necessary (as far as I understand), and quite frankly mostly meaningless since those would be easy to forge and don't really prove I actually filed those returns.


And, I just mail all this stuff to her and she takes it to the interview (doesn't mail it anywhere first), correct?

Comments please?




This is exactly what I intend on sending. The only difference is I will add an addendum to include my retirement pay from USAF to my salary since it is not covered on the I-134. I've read a lot here on VJ that the IRS transcripts are the best to send since it officially reflects that you did file you taxes and they are only about 3 pages a piece. Hope this helps!

Relax a minute, ok? I recommend you read every single post on the first 4 pages of this forum, then start asking questions. Why? Because you will find that most people on here mean very well, but sometimes, things come across wrong when typed and you can't see/hear their faces. And you will not always agree with all opinions you read here, so you just have to sort thru that.

Nothing wrong with being young, in love, and poor. In fact, the majority of us started out that way. You have a long road ahead of you, trying to be together in the US, and it will be expensive, too. I would say that $5,000 is pretty close to the end amount of money you will spend, but it can be spread out over a year or more. There is an initial fee of $455 just to file a petition (I think this cost actually went down after we filed last August, current fees are on the USCIS website), there is a medical fee of $213, there is visa fee of $350, and that is just to get approved visa. And then there is the cost of a plane ticket, typically around $1,000, airport taxes, CFO fee, the cost of a marriage license, then filing for Adjustment of Status (AOS), around $1,070, and that should be done ASAP after getting married. And as mentioned, none of this includes the costs of food, travel, and lodging to and from MNL.

Yes, it is expensive, but you don't need to have all the money at once, you can either save it up and have it set aside, or just pay as you go. But it would be really bad to pay for an application, and an exam fee, only to not have the money for the visa fee. So I say save at least $2,000 before you apply, or at least know you can have it saved by the time you will receive your visa (this can take from 2-5 months). Once you get your visa, you only have 6 months to get to the USA. And once in the USA, only 90 days to get married. So there are time constraints.

As I said up front, relax. Everyone here is on your side, we are all doing the same thing, but you are new here, and your question is a hard one to answer. You will figure it all out, and most here will be helpful. Lots to learn here, and as TCO said, you will grow in the process of learning. Wish you the best on your journey, but I hope you take my advice and read a lot here. As you read, you will have many questions, but if you keep reading, all of them WILL BE ANSWERED, I promise.

This is sort of on a case-by-case basis because it will depend where your fiance is from. So, you're looking at airfare if
she isn't from Luzon. Room and board when doing her medical, miscellaneous fees for the documents she has to gather.

The two fees that are concrete now is the Visa fee which is $350.00 and the Medical is $213.35 for 15 years and older
and $185.35 for less than 15 years old. Only you can really do a somewhat accurate estimation.

Co-sponsors on a K-1 are allowed by the USEM on a case-by-case basis. I've personally read on VJ about a couple of
people who were in the same situation as you are. Both were students and have just graduated. They got immediate
relatives to co-sponsor them. Both got approved. It is really up to you to choose which path is best. Good luck!

I know that...

K-1 holder can file a I-765 in 2 instances:

  • To obtain an EAD prior to AOS Processing in which case the EAD expires at the same time as their I-94 so it's pretty much useless.
  • In conjunction with filing I-485 to receive EAD before they get their Greencard which will allow them to work a few months earlier.
As I said, if the K-1 holder is authorized to work by simply have a K-1 and valid I-94 then why would they even be included in the instructions for the I-765 (EAD Application) instruction as they wouldn't need to apply for an EAD in the first place!

Do not mistakenly think that when applying for SSN and the form used allows you to check the box "Legal Alien Allowed to Work"
is your authorization to work. This is not the case. You will get an SSN card which has a notation "not valid for work without authorization.
" This authorization is obtained by filing the I-765 by itself (it will cost $380 and it is a waste of monies) or by filing it with all the other forms
when filing for your AOS and the fee is waived.

Call them every other day. That is what we did until we got the manila case #. We also emailed them. After 34 days we got the case #.
A couple of days later, we got the email, too with the pertinent information. I scanned it and sent it to Patty in case she needed it.


Don't worry, once you have your case #, the rest of the journey goes as fast as you want it to go. Good luck!

Hi everyone! My fiance' called NVC and they said our case was already forwarded to US Embassy here in Manila last October 11. When will I expect the visa to arrive? Do I need to call the Embassy to asked if they already received my case? TNX


Your visa will not be arriving at the USEM in Manila, rather, your approved petition will. It takes about 4-5 business days for your
approved petition to
get to USEM via DHL.

Did you get your MNL case # from NVC? If you did, you'll be able to proceed with the what your fiancee now has to do to get the visa.

Here is what we did a little over 2 months ago:

Call NVC after about a week or so and and make sure you talk to a live person. Be sure to have your USCIS # (it starts with either WAC or VAC), petitioner's name & DOB, beneficiary's name & DOB. Ask if they've received your approved petition from USCIS. If they have, ask them for the manila case # and when it was shipped to US Embassy in Manila. It takes about a week for your approved petition to get to Manila through DHL. If not, not a big deal, but call them every other day until you get the information. You can also email them at
]NVCINQUIRY@state.gov[. On the subject line of your email, put the USCIS # and on the body of the email, put petitioner's name & DOB and beneficiary's name & DOB on the body of the email.

While awaiting for your manila case #, your fiance should already be gathering her Birth Certificate, NBI Clearance, CENOMAR, Police Clearance if she worked overseas for more than 6 months from the country where she worked, Annulment (if applicable). You as the petitioner should prepare I-134, employee letter, pay stubs, and tax transcripts for 3 years (you can order tax transcripts from IRS website for free), evidence of ongoing bonafide relationship, money remittance, and anything else that proves a genuine relationship, and then send it all to your fiance as she will need these things for the interview @ USEM.

When you obtain your manila case #, you can pay the visa fee through BPI. Be sure to have your passport when paying for the visa fee and keep the receipt. Wait til the next day and schedule your interview online. You do not have to wait for the eligibility letter from the USEM. Otherwise, you will be waiting for awhile. When you are scheduling online, you'll need manila case #, passport info, and the receipt # from BPI. Give enough time in between interview date and when she plans on getting her medical done when scheduling. There is no need to schedule an appointment for medical since it is walk in. You can register through the SLMEC and fill up the registration online and this will save you an hour and a half. if you don't fill it up, they will make you fill it up on the spot @ the clinic.

A CFO sticker is needed to be affixed to your fiance's passport. If you do not have this, they will not let her board the plane. This can be done in advance and once you have the visa in hand, you can go back to the CFO office in Quirino Avenue and obtain it. Or, you can wait until visa in hand and then attend the CFO seminar and get the certificate the same day.

We finally got our MNL Case number last week after calling NVC multiple times. Now I'm sort of confused where to go from here on...

Do we wait for the appointment letter from the Manila Embassy (We only received our NOA1 and NOA2 paper form in the mail as of now) or can we...

1. Go ahead and pay our visa fee at BPI in a few days... then I assume after I pay and wait at least a day for the payment to enter their database... I then can go online or call to setup an visa interview?

2. St. Luke's Medical... Can we go ahead and do our medical after we pay our visa fee? Or do we wait for the appointment letter from the Manila Embassy? I'm getting conflicting advice... I've read some saying that we need our appointment letter and others saying we only need to bring our passport and a copy of our NOA2. Which is correct?



I'm kind of in a rush to get our visa interview, because I plan to be there along side my fiancee during her visa interview... and need to set up our interview ASAP so I can purchase my plane ticket in advance and make arrangements.

We took a calculated risk by buying the ticket for September 2 as soon as Patty was approved on August 16. Of course it helped that
we were in Manila and elected to pick up the visa @ 2go branch in Mall of Asia. Visa in hand by August 19. Prior to us paying for the
ticket for San Francisco ($625.00 one way w/ 1st time immigrant discount), we already got in contact with a travel agent and put a
hold on a ticket. In the end, it turned out ok and the plane wasn't even full! Good luck!

I was there for Patty's interview. You are more than ready for the interview. The hardest part is waiting. For the actual interaction with USEM personnel
between biometrics, initial screening, and actual interview with the CO, it only takes about 30 minutes tops. I hope you are picking up the visa from one
of the 2go outlets in Manila. We picked up Patty's at the 2go outlet at the Mall of Asia. We had visa in hand within 3 days.


Be confident and good luck! It should be a breeze since you the petitioner will be there.

Thanks, that is a really good explanation.. I just have a few questions though. After I (the petitioner) gather the affidavit of support, do i send it back to the philippines for my fiance to bring during the interview? And also, how do we pay through BPI? Is there an account # they have or something like that? thanks


Yes, you send it to her via DHL or FEDEX or LBC. I used DHL to send Patty documents to Cotabato. Have your fiance go to a BPI branch
and make her payment there. Make sure she has her passport. Make sure she tells the bank teller it is for a K-1 visa payment ($350.00)
and what ever the conversion rate is for that day she will pay in peso.
