Why the others are sending something to NVC?

You could be mistaking the CR1/IR1s who are sending info off to NVC. K1s do not need to send anything off to them, so hang tight. smile.gif

Awws I thought we need to send something to NVC ahehehe.Good to know we're not.
Thank you for the reply and God bless you always!

I think what you are seeing are people who are having a problem getting the approved cases to NVC and they have been told to send a copy of their NOA2.

The affidavit of support and everything else is needed at the interview.

Awws ok aheheheh just worrying 2 much here...
Thank you for the reply and Good luck on your interview!

QUOTE (ZeeNusah @ Nov 1 2007, 09:15 AM) <{POST_SNAPBACK}>
NVC just assigns you a case number and sends your approved petition to the embassy. Then they send you a letter saying they forwarded your petition.

You don't send anything to them no0pb.gif

Awws thank you for the reply...

Umm there's really no need to send the Affidavit of support or anything??? Why the others are sending something to NVC?

Hopefully by March crying.gif

Anyway, we don't have a problem about the co-sponsor thing anymore bcoz he owns a business and also he found another full time job but he didn't able to include his new job to the 129F form because he just got it. What should we do about the new job??? PLS. HELP...thank you. helpsmilie.gif

Keep paycheck stubs....and be sure to have copies of them for your interview.(This shows current income) If your interview is after the filing of the 2007 income tax, make sure you have a copy of what was filed w/ the IRS.

Good luck,

Oh so we don't need to do something...we just have to show them that my fiance can support me. Like pay stubs, IRS , w2 and bank statement of his business and his own bank account. Ok dokie thank you very much for your reply.I hope to get our NOA2 soon....God bless you always and Good luck also.

You should get a letter from his employer stating his salary, whether the job is permanent, when he was hired etc. This along with supporting paystubs will be good evidence of current income not shown on past income tax returns.

Ok thank you for the info aheheheh so here is the list of my supporting documents for the Affidavit of Support.
Pls. tell me what is missing helpsmilie.gif

-I-134 Affidavit of support (Notarized)
-Recent pay stubs (Business & the other job)

Even tho USEM says they are not "fond" of co-sponsors. I've yet to see anyone put on AR because of using one if all the paperwork is correct.
Doesn't mean it hasn't happened tho.
Some people who didn't qualify financially on their own were put on AR and advised to get a co-sponsor.

So do u think it's ok to have a co-sponsor?
Opps sorry but what is AR mean? My mind is being retarded ryt now because i am so worried. cray5ol.gif

Looks good but keep in mind, from what I read Manila tends to be hard on the us of a co-sponsor, and sometimes refuses to accept a co-sponsor, the general rule for K-Visas is only one sponsor, and the sponsor should be the petitioner.

Are your fiancee's assets enough to make up the difference between 125% poverty line for 2, and income?

Assets are counted at 1/3 of income. So for example if income is short of 125% povertyline by 1000, then 3000 in assets are needed.

Only a few weeks recent paystubs are really necessary.

Your list is very good for financial evidence.

Oh that's 2 bad :-( cray5ol.gif ...Now I'm so worried. Why they won't accept co-sponsor or joint sponsor? His mom is willing to help us as a second sponsor.

I will talk to him about the assets and all. crying.gif

K-1 Fiance(e) Visa Process & ProceduresCO-SPONSOR PROBLEM...
I have two questions:

1.) First, my fiancee is self employed but the problem is he's still cannot met the 125% poverty line.He said he just started the business and so the income is not that big.So we're getting a co-sponsor and his mom is willing to do it.Now is it ok to have a co-sponsor? I've heard that in the Philippines they don't accept a co-sponsor?

2.)Second, I wanna know if it's enough for the Affidavit of support?

Sponsor
-I-134 Affidavit of support (Signed & Notarized)
-3 Years Tax transcripts from the IRS for past 3 years,
-W-2 forms for the last year's ITR and Recent only.
-Photo copies of past 6 months pay stubs up to a few weeks before the interview.
-Financial records such as bank statements for the business accounts as proof of self-employment.
-Business licensed

For the Co-sponsor
-I-134 Affidavit of support (Signed & Notarized)
-3 Years Tax transcripts from the IRS for past 3 years
-Photo copy of IRS form 1040, and W2s for past 3 years
-Letter from the employer stating annual salary, including beginning date of employment, type of work performed and that is full time, and wages or salary paid provide the best evidence of current employment.
-Photo copies of past 6 months pay stubs up to a few weeks before the interview.
-Bank statement.

Can you pls. tell me what is missing to be enough for the Affidavit of support?

It would be a big help for us to give us some advice.... helpsmilie.gif crying.gif

Well people my Gf just emailed me and said she just got the packet from the US Embassy in Manila. Her interview date is on November 29th and the interview is on December 6th. I am so worried now because she is in the process with the NSO to get her Birth Certificate so that she can get her passport. So my question is how can we go about rescheduling the medical and interview. Can I call or email the US Embassy in Manila to do this? Please let me know what are the steps to reschedule the medical and Interview. I have case Manila case number that came with the letter I received from the NVC back in September....I need to know what to do ....She only as 6 days until the medical......

Thanks Aagin

ok interview date for nov 29 or medical ? does she have problem in NSO bc ? u can call the manila embassy to resched her but the resched will take 2 to 3 months depend on wat reason , so its better to expedite everything if u can guys , try to call the 301 - 2000 local 5184 or 5185 ask them wat u can do in ur situation .

Well according to the packet she received from the embassy. The medical is on November 29th and the interview is on December 6th. The problem with her birth certificate is that her last name is spelled incorrectly. So she has to get this corrected with the NSO. I am in panic mode now. I really did not know there was issues with her birth certificate until the end of last month. If i have to wait 2 - 3 months...Then I have no choice... My question is there a number I could call to get her appointment rescheduled? Or is it better for her to do the rescheduling herself.. Please let me know guys...I need to call my baby tonight and let her know what to do....Thanks for all your help.

I just want to let you know that I had my Birth Certificate corrected because my Middle name is spelled incorrectly too like Avela is supposed to be Avila. It's just a very simple and little mistake and it took 6 months to get it right.Well if she lives in Manila she better go to NSO and constantly follow up the BC because they are so so slow. In my situation it got me so mad but i can't do anything about it because i have to follow their BS system.I think she should tell the NSO to make it faster because she is going to have an interview.Anyway, i wish u all the best. Take care and God bless you always!

P.S.
She will file her Birth Certificate to get it corrected in the local NSO office but the local office will send it to the Main NSO office and that's in Manila. So she better start filing now and prepare her BC supporting documents.

If he can't meet the 125% poverty line then he needs a co-sponsor but Manila is frown of that as what they said.
Also I read Manila tends to be hard on the us of a co-sponsor, and sometimes refuses to accept a co-sponsor, the general rule for K-Visas is only one sponsor, and the sponsor should be the petitioner.I'm really sad that the other countries accept co-sponsor but rarely they accept in Manila.... This is what my fiance will prepare for the Affidavit of support:
He owns a business and also trying to find another job to meet the 125% poverty line...

My Fiance = Sponsor
-I-134 Affidavit of support (Signed & Notarized)
-3 Years Tax transcripts from the IRS for past 3 years,
-W-2 forms for the last year's ITR and Recent only.
-Photo copies of past 6 months pay stubs up to a few weeks before the interview.
-Financial records such as bank statements for the business accounts as proof of self-employment.
-Business licensed - proof of self-employment also.
-Bank statement - Personal Account

->and when he get the other job he will include also the:
-Letter from the employer stating annual salary, including beginning date of employment, type of work performed and that is full time, and wages or salary paid provide the best evidence of current employment.
-Photo copies of past 6 months pay stubs up to a few weeks before the interview.

His mother = Co-sponsor
-I-134 Affidavit of support (Signed & Notarized)
-3 Years Tax transcripts from the IRS for past 3 years
-Photo copy of IRS form 1040, and W2s for the past 3 years
-Letter from the employer stating annual salary, including beginning date of employment, type of work performed and that is full time, and wages or salary paid provide the best evidence of current employment.
-Photo copies of past 6 months pay stubs up to a few weeks before the interview.
-Bank statement - Personal Account
-Birth Certificate
-A letter from her that she will really support me.

Well I hope that information will help you what to do if not then i would love to talk to you about it if you like.

sounds like its hard to get a co-sponsor... is it really a must to have a co-sponsor if petitioner shows very low income? how about documents like his life insurance papers, money in the bank???

Yes it is a must because it's one of the requirements to meet the 125% income. If you fail to prove that you can support your beneficiary then they will deny you.

No, it is not a must. If he can show significant monies elsewhere (stocks, savings, etc), then he may not need a co-sponsor.

I guess you are right but USEM look closely to the income level requirements and they want to see how much money that comes in your hand every whole year so if you fail to show that you can't get 125% income then i guess you will fail but im not sure about that... i just hope not coz i am also like her.

Anyway, i wanna ask something if its ok coz i am also in the same situation like her and so as what i read in the forums that Manila is not fond of co-sponsor thing so now i wanna know if his income cannot meet the 125% requirements...can he use his money savings to meet the 125% requirements? I hope to hear from you or if there's anyone out there who is willing to help me what to do helpsmilie.gif. Thank you in advance and God bless you always!

That's BS! They accept them ALL the time.
The story they don't accept them came from a virtual interview from a CO in Davao years ago.
Still is snowballing!

I wish it is BS! It's unfair to us here in the Philippines that will use a co-sponsor because other countries do accept that.

Well, you know, if you do get an RFE, just send it back asap. It shouldn't put your petition behind too much, maybe a few weeks or more.
Do you have your Birth certificate, the long form? If so, make a copy and send it to your sweetie now, just in case, that way he can just pop it in the mail.
Good Luck!! rose.gif

Yeah that's what we're gonna do sad.gif ....thank you again.Take care and God bless you always!

You won't get an RFE if he didn't send your items. You will present them at the interview.

This isn't necessarily true. In fact, there was a poster here last week who got an RFE for NOT including a copy of the beneficiaries birth certificate. It can happen.

To the OP, Best of luck to you, I hope you don't get an RFE either!!! smile.gif

Agreed. I've also seen a couple of people received RFE for not inluding the BC for the beneficiary. It's one of those hits and misses depending on who's the adjudicator for the case. I truly hope that you will not get an RFE for this. Good Luck with the process and for a speedy approval. good.gif

You can file any time before the April 15 deadline. You will just need and the required forms from your employer(s) to fill out the tax returns.

Thank you for the reply random man....I appreciated it so much.Anyway...how long can he get his ITR transcript after filing ???

i have read about the transcript. is it needed, i thought just a copy of the 1040 was good enough, and i was also going to inc the previous 2 yrs as well

Hello wizardfitz! I'm really sorry because i don't have any idea...All i know is if you have transcript u dont need a 1040? I'm not sure but I hope there is someone out there who can clear this out and answer our questions.Pls. anyone out there ??? Pls. pls help us.Thank you again and God bless you always!

i found this on the 864 instructions
You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income taxreturn for the most recent tax year.
If you provide a photocopy of your tax return(s), you mustinclude a copy of each and every FormW-2 and Form 1099that relates to your return(s).
so i am gueesing its either copies of the 1040's and the w-2's or a transcript from the IRS

No need to guess when you go to the source. The above is exactly correct. Just make a copy of everything you send to the IRS including W2's and/or 1099s and send it instead of a transcript if there isn't time. I suspect you can get a transcript within about three weeks of filing. Just call the IRS and ask them.

PUSHBRK & WIZARDFITZ, Thank you so much for the reply....it means so much to us...Take care and God bless you always!

BEFORE tax, the number you put on the affidavit of support is gross income before taxes and deductions.

Thank you YuAndDan biggrin.gif ... But i just wanna know in his Income Tax Transcript is it needed that it still shows above the poverty line after deductions? Or it's ok that it shows below the poverty line after deductions in his Transcript? LoL I'm confused now.

Tax transcript will show Gross income.

I really dont have any idea about what it will shows in the Tax transcript but i'm just worried and wondering if the deductions will show in his income tax transcript and if it really shows then it will be below the poverty line if deductions is included. wacko.gif helpsmilie.gif

Your gross should tell you if your above or bellow Poverty line.. Not net.

Thank you for your reply too Roserick biggrin.gif .... But what i meant in his Transcript is it needed that it shows above the poverty line after deductions? His income tax is above the poverty line but when the deductions is included like insurance it makes it below the poverty line unsure.gif.

PhilippinesCulture, misunderstanding, or just plain used?
It doesn't sound like she used him at all. It sure sounds like a failure in communication though. I can understand the OP wanting to make a more stable relationship/situation for when she gets there with the kids. Imagine this...she gets there with the kids and he goes away for long periods as a truck driver...that will put a lot of stress and strain on both parties. I can also understand that she was upset about the approved I-129F being cancelled. I think in the long run, the OP's plan is a better plan as he wants to ensure that the relationship will be on better footing once he is better off financially and that he will actually be there for them instead of being away for long periods.

If they do care for each other very much, then they really need to talk things through and really buy into whatever plan they agree on and be prepared for the long haul. If either of the party isn't willing to do that, then they need not kid themselves and go their separate way. I really do hope they work things out.
