The Texas Lockbox is where all petitions are sent and they are distributed as needed after initial review. The theory is this will keep the workload even at the various service centers and cases moving. Again, that's just a theory.

Sent the package April 1, 2011. April 5, 2011, received electronic notification that our petition has been received at the Texas Service Center and is in initial review. They also noted that the package was forwarded to the California Service Center. Is this standard operating procedure for the USCIS? I was just wondering why I wasn't just instructed to send to the California Service Center since I am from CA.

Theoretically, you only have one original of your divorce decree. A "Certified True Copy" is simply a copy of your divorce decree which is stamped and embossed with the courthouse's seal. You can get the certified true copy from the courthouse you filed your divorce for a nominal fee. I got 3 copies myself at $15.00 per copy. One copy I sent with the I-129F, one copy for my I-129F duplicate, and one for future use. I hope this helps...Posted Image

If using strictly USPS you mail to the P.O. Box. If using commercial carriers (i.e. UPS, FEDEX, DHL) you mail it to Lewisville TX. I don't think it makes a difference. I sent mine USPS priority flat rate mail on April 1(Friday) and they received it April 5 (Monday). Then was forwarded to California Service Center. I am from California by the way.

I am assuming the amount you mentioned is the 125% of the poverty line. If that is the case and you are having to worry about the I-134 filing, then have your husband to be get a co-sponsor for the I-134. That maybe the right thing to do. I maybe wrong on this, but they won't be asking for tax return copy until you are here and you file the AOS. And again when you file the AOS, you can have a co-sponsor then. I hope this helps and also get some more feedback to your concern.

The question that matters is:

Exwife US citizen or did you apply visa for exwife? If exwife US citizen you have a minor red flag on case that you will need to explain but shouldn't be a major problem.
If Exwife not US citizen and you brought her here on a K1 or CR1 visa, then you have a nightmare scenario ahead of you.

Here is the scenario:

-Found out the ex-wife is seeing someone else Jan of 2009. Tried to work it out, but to no avail.
-Oct 2009 the ex-wife moves out.
-Apr 2010 I tell my ex-wife I am filing for divorce
-May 2010 I meet my Fiancee and have on going relationship
-Jul 2010 I file the divorce papers
-Oct 2010 I visit her and spent 3 weeks w/ her and we got engaged
-Mar 23,2011 the divorce is final
-April 1, 2011, I filed the I-129F, CSC, (in review status)

I have read a post by someone who got their Visa denied because the CO said you cannot be married and engaged at the same time.
I believe the beneficiary was from Colombia. Is this a standard operating procedure for CO's or does it depend on the beneficiary's country?

Any insight is appreciated. I just can't believe you would be denied for that reason even though you've been separated.:help:

The instructions on the I-134 itself tells you what you need to submit. If you look at the sample form that VJ provides, it is just the income, and property owned (house). I plan on using my income with a letter from my employer and Savings Bank Statement. The only time they ask for a tax return is if you are self employed.

Thanks for the reply. It is declared on my tax returns just like it was income. My question still remains. How do I identify it on the I-134? The categories they have listed on the I-134 does not cover it. So, I was thinking, add it to my salary, i.e. $90,000 (salary) + $20,000 (Retirement) = $110,000??? Then I attach the 1099 as well as ITRs???

?Retirement income along with 1099(s) should be reported on your tax returns?

I just recently filed for the I-129F. I just want to be prepared as much as possible when the big day comes.Posted Image How can I add my retirement income from the US Air Force? Can I just add it to my current salary on #7 first line of the I-134 and attach the 1099 I receive as documentation?

:wow: Sorry to hear you had to pay $35.00 per. When I got my certified true copies, it included the marital settlement agreement. So, I sent the whole thing...I did not want to take a chance...:D I am in Solano County by the way

Geeze this county cost me $35 per copy and I'm in Nor Cal too! I also had to pay for a different copy of my "Restoration of Name" because the box on my Judgment wasn't tic marked by my Attorney at the time of Judgment! That was only $15 I think. You're lucky because yours was much less!

They [USCIS] doesn't care, nor need the Settlement Agreement btw, because that is not the document that says the Petitioner is free to marry. They want to see the final Judgment signed by the Judge. Our K-129F was just approved with the Judgment of Dissolution (colour copy/signed by judge, court certified, etc etc etc) and we did NOT get an RFE. I thought I had to send in all the pages too but a friend of mine who is Family Lawyer and had also gone through the USCIS as Petitioner was who helped me with this. Anyway, I think it's only 2 pages I sent in.

I am also divorced and filed for my I-129F April 1, 2011. I am from the Bay Area/Northern california. I obtained 3ea "Certified True Copy" of my divorce decree from the courthouse where I filed for my divorce. This simply means the courthouse clerk signs, stamps & embosses the divorce decree with the courthouse's seal. The cost is minimal. It cost me $15.00 per. I included one with the I-129F, one for the duplicate copy of my entire I-129F, and the other one for future use. My divorce decree included the Judgment which was 2 pages and the Marital Settlement Agreement (essentially an agreement on how you and your ex wanted to settle everything), which was anothe 8 pages. Hi all...I'm new to the forum, great place for info and advice first off all =) On March 30 I received the NOA1 and they said my forms are being sent to the California Service Center. Looking online my timeline for the NOA2 looks to be 5 months. Anybody else have earlier or later waiting times?

In the meantime, I want to give my fiance some information she herself can start preparing before the interview at the Embassy in Manila. She lives in the province. Our ultimate goal is to be married by the end of this year; small family wedding only.

You may or may not get an RFE regarding the photocopy of your divorce decree, but if you do, you are ready to respond to it and send them the entire copy. Their only concern is that you are legally to free to marry your fiance.

When you send a duplicate copy of your entire I-129F file to your fiance, make sure you send her the certified copy in case they ask for it when her interview comes up. Good luck!

If I was in your place I would send whatever you got from the courthouse. I have read on previous posts before that the individual received an RFE because all they sent was the judgment which was 2 pages. I am also divorced and when I got certified copies of my divorce decree, it contained the judgment (2 pages) as well as the marital settlement agreement. I included the entire copy when i submitted my I-129F. You are correct as your divorce is final. Their only concern is you are legally free to marry.

We use a video capture software to take screen shots of our Skype Video Chat. I will then print these for when the interview is set as proof of on-going relationship.

Money coming from the beneficiary to the petitioner is one huge red flag! It makes it look like the beneficiary is paying the petitioner for immigration purposes. Money coming from the petitioner to the beneficiary is looked at differently. Especially if the beneficiary is from a third world country and is poor. K-1 Petition is expensive, thus, the petitioner has to send funds to the beneficiary to pay for all the miscellaneous expenses incurred during the entire process. I hope other VJ members can chime in.

Can you explain your answer more please? We probably will decide against the money transfer receipts but I'm still a bit curious myself. Thanks.

Money order or personal check is just fine. In my case, I used a money order. I sent it April 1, 2011 and got notified electronically (by text and email) on April 5, 2011. A week later I got the hard copy by mail. If you are sending to the Texas lock box you can track the package through USPS website.

I agree and check all your documents two or three times before sending it in. Though, this may take a couple of hours or so, it will save you a possible RFE in the long run. If you follow the guides here in VJ, you will be fine. Good luck on your journey!
