K-1 Fiance(e) Visa Process & ProceduresTips of Filing I-129F NEED Help

Use the guides pointed out because it is what helped me tremendously.

If you haven't already done so, include a cover letter which you will essentially use as a Table of Contents. You can use this as

a checklist of sorts to identify what you have included with the petition. Double check and triple check everything. See the link
for a cover letter sample. Good luck on your journey as it is only beginning.

K-1 Fiance(e) Visa Process & ProceduresFollowing up with the National Visa Center (NVC)

Hello VJ-ers!

I want to send out an inquiry to the NVC to follow up with them to see if they have received my NOA2 and if I can obtain my case number so that I may follow up with the Manila consulate when necessary.

I went to the NVC site, and it states to send and inquiry you have to put your case number. To my knowledge, I don't have a case number.
Advice anybody?

Samples?

Help?!

K-1 Fiance(e) Visa Process & ProceduresNOA2 NOA2 What do I do-What do I do?

Yeeeeeeeaaaah. Well We received our NOA2 in 120 days. We are very happy for that. I'll be going to be with my Fiance next month for an entire month. I'm hoping maybe we can go to the medical and the interview together.I was wondering what do I do next. How and when should I contact NVC? Do I ask them for a case number or something. And when my Fiance's case is forwarded to the Embassy, what info do I need to schedule an interview appointment? I know the majority of the process and the requirements, but these questions that I have are the missing links that I need to know. So if anyone could just give me some advice it would be much appreciated.

And to all of those who have not received your NOA2's yet or those who are stuck in hard times with the whole process, may you see all the way through to the end of the tunnel so that you and your loved ones are together forever. God Bless.

Mike

It is amazing what a little research through this site can yield. This subject has been asked a thousand times over. Here is a thread
I found discussing what to do after NOA2 specific to the Philippines.

K-1 Fiance(e) Visa Process & ProceduresNOA2 approval notice!!

what do we do next after receiving the NOA2? do we wait on the consulate to send us another letter so we can call an set up a medical exam and interview?? let me know what's the next procedure guys??? thank you so much!! do i send her a copy of all the paperwork like bank statements, tax returns, payroll stubs etc?

This link will get you what USEM essentially sends out to the beneficiary: http://photos.state.gov/libraries/manila/19452/public/Revised%20K1%20Instruction%20Packet%20_3__rtf2_001.pdf

Most of the things on the list can be done without waiting for the Manila Case # such as gathering Birth certificate, CENOMAR, NBI CLearance, Police Clearance if your fiance worked outside the country for more than 6 months, medical exam. To pay the Visa fee and schedule an interview, you will need the Manila Case #.

Good luck!

P.S. By the way, I noticed that on your profile, you identified the Consulate as being in Armenia???

K-1 Fiance(e) Visa Process & ProceduresFinacial hardship expedite? Is it possible?

I was also wondering about this myself. K-1 process will cost anywhere from $3K - $5K up to the adjustment of status. Then not be working for a few months.
According to the OP, she is in dire need financially. I don't see how expediting it could alleviate the financial situation, especially in today's economy???:bonk:

Maybe wait until you're in better financial footing before filing???

I actually forgot to answer the main question. Here is the criteria for expediting an application:

Expedite Criteria
All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS
If you have already filed your application or petition:

You can make an expedite request by contacting the National Customer Service Center (NCSC) at 1-800-375-5283. The NCSC will take a "service request" and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.http://www.uscis.gov...00045f3d6a1RCRD

Financial expedite? What would getting him here faster accomplish? He won't be able to work when he gets here for at least 3 months. How will you support him if you're not working and on public assistance yourself?

Don't worry about it, we work so you don't have to.

It doesn't matter much. You can put the Dallas Lockbox address if you want. Your application will be routed to the appropriate Service Center.

When I went on USCIS to see instructions how to do the whole process by myself it says to just fill out the 2 forums, I-129F and the G-1145. (I understand also other things need to be attached like photos and birth certificates ext.)
Why do I get the feeling that this isn't the only thing to be sent out in a package. When I looked at example forums there are typed letters I need to write, and more forums then what is listen on USCIS.

Help so confused.

Also if I didn't want to go through with this process, how do you start the process to get married to our fiance in their country? I don't even know where to look from there.
Thank You

Get started with the guides on top of the page. There are guides for the K-1 Visa and the CR-1 Spousal Visa. There is even a comparison of the two.
Then use the sample forms to complete whatever forms you need. Whichever route you choose to undertake, get all the required documents together.

Double check and triple check everything! Once you think you have a handle on the required documents you will submit, post it here on VJ for feedback.
Plenty of members will help you out and give you outstanding advise.

It is amazing how much you learn just by reading the guides and the sample forms! Member here are very helpful, but, they wouldn't want to spoon feed
information either. So, spend a couple of days reading up and become intimately familiar with whatever route you want to pursue. I think the K-1 is a bit
faster, but definitely more expensive than CR-1.

no? they throw it away. Thats what the cover letter is for you put the contents list in the cover letter.

Posted ImagePosted ImagePosted Image

I used the Cover Letter as if it was my Table of Contents and put the documents in order they were listed on my Cover Letter. If there were multiple pages
that pertained to an item listed on the Cover Letter, I used a paper clip to hold it together. Other than that, I did not do anything excessive. We were approved
in 80 days. The most important thing is submitting the required documents, especially the meeting within the 2 years prior to you submitting the petition.

It was also suggested by another Tier 2 Immigration Officer that if we file the petition to re open along with another copy of the original supporting documents the day we receive the letter they can reopen the case using the original I129F filing date and we could still meet the deadline.

Personally, I wouldn't put a lot of faith on what Tier 2 personnel from USCIS tells you. This is obviously a very important matter.
Please consult a reputable immigration lawyer. Just a suggestion.

don't wait for the packet but follow the instructions on NVC letter stating how long it will take to forward them to the embassy once your case arrive at the embassy, wait for few days to have your case in their system then you can pay the visa fee and schedule your interview appointment and have you medical done before the interview date. Have your NOA2 letter (original and copies), passport (original and copies), 4- 2x2 pictures. This would help you http://www.visajourn...am-walkthrough/

Good Luck!

Overall very good advise. However, you can proceed to pay the visa fee now as long as you have the manila case #. Wait for a day and then schedule your interview online. You will need you passport info, manila case #, and your receipt # from BPI when scheduling for your interview online.

You do not have to wait anymore prior to your approved petition to arrive at the USEM. FYI, you can track when your approved petition was shipped to USEM through DHL. Ours was shipped 7/28 and it in o its way to USEM. DHL it looks like they are averaging 5-7 business days of delivery to USEM.

We got our manila case # on 7/27, Patty paid the visa fee, and by 7/28 I scheduled for the interview on August 16. There were still plenty of slots for August when I scheduled the appoinment.

K-1 Fiance(e) Visa Process & Procedureswhats the fastest way to get in USA
As Inky pointed out, study the comparison for the K-1 (fiance) visa and CR-1 (spousal) visa. Ultimately, they both take time. The better term to probably
use is shortest amount of time for you to get to the US. As a couple of VJ members have pointed out, there is nothing fast about getting a visa regardless
of the path you and your BF take. Read the guides for a good couple of days or so and then talk it out with your BF and decide which path you want to
take. Once you decide, read some more...Posted Image and start putting the required documents together. If and when you are stuck, post here on VJ for guidance.
There are plenty of knowledgeable members here that are more than willing to help. The VJ forum will essentially be your lifeline. I for one am grateful I
found this site. Having said that, please read and study the guides. VJ members are very helpful, however, they will not spoon feed you the information.

K-1 Fiance(e) Visa Process & ProceduresI-134 Question 11: Intend or Not Intend?
There was a recent thread here on VJ where the consular officer at the U.S. Embassy in Manila gave a beneficiary a bad time during her interview because her petitioner had checked the "do not intend" box. If I remember correctly, her K-1 visa was approved anyway.

Hopefully, petitioners will refrain from checking the "do not intend" box...big no no...Since the petitioner filed for a K-1 visa, it is therefore understood that it is your intention to marry the beneficiary and that you will provide all support necessary...maybe some other members can provide positive feedback on what the result was with checking the "I intend" box...I myself will follow what is in the example form as I've said before because it has been proven to work countless of times.

VJ members, chime in if you've had positive feedback with checking the "I intend" box...then, maybe, VJ can update their sample forms.

DOnt do online scheduling coz its waste of time.. ask your fiance to call for you for your interview just take few minutes you will get interview date. as long as you have MNL case number. you need that on your medical and the appointment letter.

I respectfully disagree! It is not a waste of time. I am not sure why it did not work for you, but it worked for a lot of other people. It was actually quite easy. It only took me 5 minutes and then it lets you print out your appoinment letter. Having said that, you can schedule online or by calling the USEM. Both ways work.

Also for the medical do I need to send her the original noa2 or will a copy work? If I understand correctly she will need the noa2 plus the case number. I never received an email and still haven't received a nvc letter with the case number. I called and they gave me the MNL number.

Thanks so much for all of your help everyone!

CFO you can do last or do it when you actually have visa in hand so you don't have to come back. If you do the CFO now, you'll have to come back ang get the sticker. Obviously, you'll have to complete the medical and pass it and then do your interview. Most people schedule their interview about a week after their medical. Scanned NOA2 is perfectly fine. That is what I did. You are fine with the scanned NOA2 + Manila Case #.

Get your fiance to do her NBI clearance now. But, if she is in manila, she can go the the NBI outlet branches at the SM mall and she'll have it the same day if no hits on her name. See links below!

You'll need to gather your supporting documents to prove on going relationship, the affidavit of support or I-134, tax transcripts for 08, 09, 10, letter of employment, pay stubs, updated letter of intent to marry. Send it to her once you have all of it. Better yet, go there and hand carry the documents and be with her at the interview.
