You do not need ANY receipts. NONE, NADA, ZIP -0-. Throw ALL of them away if you want. You have passport stamps, boarding passes and lots of photos. If you wish to add ANY receipts to this, even a trolley ticket, it is your option but it is NOT necessary. You need to establish you were there and you were together. THAT is all. You do not need a detailed itinerary. There is NO requirement you stay in a hotel, eat at a restaraunt, go to Disney World or anything else. There is a requirement you MEET IN PERSON, that is ALL. This meeting can be for 10 seconds, take a photo, thank you goodbye.

You could SWIM to India, meet your fiancee on the beach, have a phot taken with some sort of date evidence, and guess what...you qualify!

Have a good time, your visit will generate its own evidence, keep your travel documents and take photos.


Gary is 100% right. We never used these things either, just the photo's, boarding passes and things of this nature...no receipts of where we stayed or where we ate, etc.

Should the photocopied pages of my Passport be labelled in some way? For instance should I sign and date each photocopied page? Should I label each page with a title or explanation of what the document is.


What you could do, (though absolutely not neccessary), is to attach your boarding passes to the photo copies of your entry/exit stamps. Just to make it a more convenient and easy reference for the CO.

Yes i am going with mani to the interview its just if they will let me into the embassy mani went into the line with me and then when the security guards told him he could not go in he waited outside with the other ppl waiting for family. It is the strongest evidence that i am there and tat he carries my passport with him for interview if they don't allow me for some reason not to enter..how would that look if they would not let in a US citizen into the US embassy haha i would be sitting outside on the curb waiting.

i am also going with mani to his medical and we wll be making sure that dr fills out everything.

i really am hoping for our interview appointment very soon! on january 9th our petitions expires.


Tasha, they 'will' let you in, but being allowed to sit there right beside Mani as he's being interviewd is another story. One person that went to the interview at Delhi with her SO told me that she was interviewed as well and separately too! Right after her SO was.

Then there's also Lauren (catknit) just recently who was let in without any problem.

And yes, you 'are' a USC and it would not be ethical or wise as far as I'm concerned for a US Embassy to not allow one of their own in the doors. So no, you won't be sitting outside on the curb but you should still give the PP to Mani to show to the CO, unless of course you have the gutso to walk straight up to the counter with him. If you 'do' that, they will probably just ask you to go sit back down.

Oh, The applicants don't go into a separate room. There are a row of windows that the CO's stand behind...sort of like a drive up window at a bank. This is protection I suppose from crazy angry fiancee's who's sweeties don't get approved. devil.gif

Also, I've been in there myself to get my no objection letter from a CO, then afterwards I described the area I had to go to and Hemant said it sounded just like the same area he was interviewd, windows and all.

I don't think you're going to have to wait an entire month to get your date. Most likely you'll get it in two weeks at the most.

This info may be a little late, but my petition was sent back too. The USCIS received it on Feb 4th, 2009 and Re-affirmed it on June 5th, 2009. Don't give up hope.

Wait till you hear something from USCIS. If you decide to go with a CR1 or K3, whichever the case may be, make sure you've formally withdrawn your K1 petition first.

We talked about a lot of the things we see here on VJ and I was trying to remember all the "usual questions" I read about and pin him down for some answers. I also have asked him if he will give an "official interview" for VJ. He said he will check out the site and I will call him later this week. So, anyway I will try to cover what we discussed, he was quite frank and direct in his answers, not rude, not at all, but he knows his stuff and answers without hesitation. It turned into an impromtu and fun "interview" with me trying to remember all the hot button issues I see on VJ

I told him that the number ONE and number TWO "complaints" I see are Why is the VSC taking so long and why can't we get through to you guys?

Why is VSC taking so long, what happened? I was approved in 58 days!: We had problem with labor last year and lost many workers, we hired more last November and it took some time to get them trained. Some of the petitions were sent to California and we also assign people to different tyopes of visas. They will concentrate on one tyoe, get behind on another and then shift many people back to the other type. Lately we have shifted many, almost all, adjudicators to I-129fs, so that should make people happy. They will do that until they get caught up. Summer is a busy time for I-129fs, usually about June we get slammed with them. The winter or early spring is the slowest time for I-129fs, but then it depends what they have everyone working on also.

OK, why can't we get through to you? The 1-800 line is useless. Those are contract employees and they are trained to select answers from a menu of 14 answers. They pick which one is best for your question. There are thousands of visas being processed at any time and everyone is special and everyone has special circumstances and if we had direct lines we weould do nothing but field requests by petitioners to give them priority, we just can't do it. How would you feel if your petition got bumped because some woman called and cried on the phone and then her petition got moved up ahead of yours. We simply have to operate in a way that avoids any chance of fraud, corruption or unfairness.

So what about some people get approved ahead of others? Sme petitions have problems or delays, we do not hold back others for this. If an adjudicator has problems, he puts that one aside or sends an RFE and goes on to the next. The next one may be clean and gets approved right away, in just a few minutes, they adjudicate 15-20 petitions a day per person, and the ones with problems may wait weeks for the petitioner to respond to the RFE, or maybe it is a name check they are waiting for. Petitions are assigned as they arrive, when we are working on those petitions, but they do not go out the door in the same order they came in.

G-325a, Signed or Unsigned? Unsigned.

WHAT? Ok I have seen the memo but lots of VJ members got RFEs for unsigned G-325s, what gives? They do not have to be signed,they can be signed at the consualte interview. Some adjusicators haven't read all the memos, we get hundreds of the things, and maybe they make a mistake. If you want to be sure there is no mistake, sign it. Or send a letter expalining why it is not signed and request it be signed at the interview. Do you have that memo?


It is on the VJ website somewhere You can print a copy of that and send it with the I-129f and G-325a.

Fiancee intent letter? Signed or unsigned? Signed.

What about a faxed or emailed signature? When I was adjudicating, if I could see a signature, I accepted it, but many adjusicators will not. Signed is better.

Lawyer or no lawyer? For what?

Enough said. Now a hot issue, a very controversial one. There seems to be a trend in some countries of foreign men marrying American women and the women are considerably older. There is always a question if this is a problem. It never seems to be a problem for older men/younger women (My wife is 13 years younger, his wife is also considerable younger than him) Is it a problem? For us, USCIS, no. "Free to marry".

What about the consulates or for AOS or I-751? Consulates do what they do, it is not USCIS, some of them are bastards. Kiev is easy, they approve everyone (laughs), they used to be bastards but they got easier since they first started doing those in 2005, before then you would have had to go to Warsaw, you know. For AOS if they can prove they are legitimate we do not care about age but anything that is "not normal" for the culture will draw suspicion. They probably will not get a no questions asked interview (I had told him our AOS was "no questions asked")

What about birth certificates, some people have trouble getting them? This is a problem for us also. Some people, especially our younger staff, think all the world is like the USA. I remember one, when I was in the Kansas City office, the beneficiary was from Viet Nam, she was born in 1954 there was no birth certificate. The CO asked me about this and I looked at the file. I said "Do you know what was going on in Viet Nam in 1954?" She looked at me, straight faced and said "What, their computers were down?" wacko.gif If a birth certificate cannot be obtained they can usually get something from a church, a village official, something, and send that with a letter of explanation. Or just their passport and a letter explaining the situation (this applies to AOS more than I-129f as beneficiary birth certificate is not required for the petition, but I wanted to ask anyway, it seems a common question here)

What about extra documents? Proof of relationship? We don't need it, only that they have met for the fiancee visa.

What about the consulates? Consulates do what they do, as I said, some are bastards. They get whatever we get when it is sent on. I can't tell you what NVC and consulates do, I know some are terrible and some are really easy, but I do not know all the details of each. Kiev is easy, western Europe is easy, Nigeria is horrible, but you would not believe the scams from Nigeria, I get jaded. I am surprised a lot of them get visas and then we have to deal with them.

I have to ask for a collegue, Ecuador? Bastards.

What about changes? Are there any in the works? Is Obama ouching you guys to work faster? I am not sure Obama knows we exist. There have been no changes and no pressure other than the usual workload and shifting things around. I do not expect any immigration changes in the next year or two, at kleat not in rules or amnesty or anything like that. I do expect FEE INCREASES within the next year...across the board.

How much more? I cannot say, that is not my area, I just hear talk.

He added, "We try not to deny petitions, people really get angry and make lots of trouble. Denials usually come at the consulate or maybe AOS or sometimes even with the I-751. If we deny someone we need good reason, if they meet the criteria, we will approve it, they just have to give us what we need to approve them."

So how can I speed up my petition? laughing.gif You can't really. If it gets to be too long and if you can get a congressman or senator to call, that will get some action, but half the time those guys dont'' call or they do and the petition has only been there 3 months. Sometimes one falls through the cracks, gets overlooked, we are human. A congressman can get through and get them to dig it out if it has been too long, but I wouldn't call that "speeding it up". That's a fix for whn it is too slow.


we talked for some time more, about 5 hours altogether, briefly interrupted by Alla every now and again who had her own questions about the I-751 procedure which I posted in that forum, about VJ and other topics (his Navy days) He said he will check the site and gave me his home number. He said "call anytime but not 3 in the morning" I asked about an interview or answering prepared questions, he said possibly, he will check the site. He said many internet sites are advertisement for immigration attorneys or instructing people on how to pull scams, I assured him he would be very pleased with VJ and he thinks it is great that there is a good site for information and advice. (he never heard of VJ before this)

I can also say, that speaking to him, I heard so many of the same buzzwords or advice that I have seen right here, this is really a great site with some great folks giving some really great info.

K-1 Fiance(e) Visa Process & ProceduresPAID status on payment portal then NOT PAID when i checked this morning

Good day pjv and to all VJ members out there. The same situation happened to me with the payment portal, except it was the Visa Application fee that was rejected 2 days after it showed paid. Turned out it was my husband's mistake, a typo on his account number he input in the payment portal.

 

The problem now is that we have sent out my DS230 with all my Civil Documents, the Cover sheet with the barcode, and the payment receipt!

 

I sent an email to NVC and they advised me to attempt to make the payment again. So I did, however, the system did not accept it because there was "an active payment" on that bill!--turned out to be a system error which was cleared after another exchange of emails with the NVC. 

 

To make the story short, my husband decided to make the payment through the alternative route--by money order through overnight postal service to St Louis, MO. After 2 days the system reflected a PAID status.

 

Now my concern is, a week has past since I have sent my DS230 and civil documents before my Visa payment got through because of all those paid-rejected-paid-rejected-paid status. I read somewhere that the Visa fee should have been paid before sending the papers...

 

1) Does NVC ever throw papers away if they receive DS230's without the Visa application fee paid yet?

2) Do I need to send my DS230 and Civil Documents all over again?

 

Its been business days (technically one week) since we have paid my Visa Fee and have not heard from NVC yet. I have sent an email a few days ago to make a follow up but unfortunately have not received any response yet. A bit restless and uneasy. Please advice! Thank you very much.

Keeping busy is the best advice... as long as I am doing something it help the time fly... Perhaps try to find things to do to make life easier for your fiance before she arrives... find a store with similar cuisine, find places where she can enjoy her hobbies... etc...

Lawyers are often wrong.

He is using the USCIS timelines which are worthless, they list the oldest case in the system. Unless your case becomes the NEW oldest case, it will be shorter. Be happy you are using the Kiev consulate. Their time to interview once the petition is approved is lightning fast! Get you interview documents done NOW because once Kiev has your case (usually about three weeks after NOA2) you can get an appointment in as little as FOUR days! DO NOT wait for packet 3 to be sent from Kiev. Ukrainian mail is so unreliable it is possible your fiancee will never get them. Download the forms and instructions from the consulate website and get them ready.

Hope I explained this right. I file my paper work on March the 30.So if I go by what other poeple have told me, we should be getting close to getting the first part done.

But I know some people take a lote longer.

If you can show that you recently graduated and a history (a few months at least) of income, any reasonable IO should accept that. But they are not all reasonable, so it depends on who you get.

The reason they have these guidelines in place is to make sure that the USC has the minimum means to support their fiancee/spouse while they are in the process of securing their work papers which can take 6+ months, depending on how soon after arrival you get married.

Have you thought about how you will support him if you are not able to find a job quickly, since you don't meet the minimum amount required? I know this is hard to hear, but maybe think about postponing filing the petition until you are in a better position financially.



I have job offers lined up, so that's not the issue. I will have more than enough money to support us, till his green card is through ,etc. It just more an issue of since my tax returns don't show i make much money in the past (because of being a student). My new paycheck stubs will be more than sufficient amount to cover us,

My fiance and I will be filing our i-129 in the next few weeks. I'm graduating college just now, so if I get a sufficient job before his interview, will that be sufficient for satisfying the i-134? even though My past few years, I havne't made enough since i've only been working part time and in college full time?? also, My parents individually don't make enough to be a co-sponsor, but i believe together their combined income may be enough (they file taxes jointly) , could they , as their household, be the co-sponsor?? any help would be appreciated, i literally am so upset right now , stressing, trying to figure this all out!! I just want to get the ball rolling, so we can be in the same stinkin country , finally.

Yes, use your LND number to make interview appointment, you don't need an appointment for a medical. Not sure how it works in his country, in my fiance's she just showed up no appointment for medical. Long wait it'll be a fun day for him I'm sure. He could probably get medical here though, I could be wrong but it would simplify things later when you adjust status.


I know with the London consulate, you have to complete a medical exam before they will schedule your interview.

I received hard copy of my NOA2 today. (only 2 business days after electronic notification!) I am just curious once I have my LND case number from the NVC, can he book a medical? I understand it still needs to get to London and logged into their system. I'm thinking If we book it for like 2 weeks out? would that be ok? the fiance is coming over on holiday and we're hoping for him to fly out on april 10th. So if we get the LND case number this week and booked a medical for like the 9th of april , do you think that is sufficient time? I figured 2 weeks from LND number assigned, + 3-5 days for medical results to arrive at the consulate , should be ok ? right? we just want to get his medical done before he leaves for the holiday. That way after holiday its just a waiting game for his interview!

Have you contacted the Embassy about this? My fiance who is still in India had to get one from both, a local background check from all the places or cities he lived from the time he was age 16 and the PCC from the local Passport Office. I would contact the embassy there to find out for sure, but I think you may still have to have both.

You shouldn't get paranoid, it is typical that not everyone gets their passport always during the same time frame as some other person did.

BUT...there was a case just before yours that was approved and the persons husband called the embassy everyday over a week. The Embassy kept saying they sent it to VFS and the VFS kept saying they hadn't gotten it yet. Eventually he, the husband got to talk to an American at the Embassy and they got it straightened out. They said that apprarently they had 'forgotten' to send it out and his wife finally received her passport with the visa stamp.

She will still need to supply an I-184, but she can have a co-sponsor as long the co-sponsor is an American citizen such as a relative or friend.

I'm not 100% positve, so do your research, but she can list her assets such as stocks, CD's (certificates of deposits), etc.. She may also be able to claim any cash income she may have as long as she has proof like bank deposits. She can write a letter explaining where the cash income comes from, ie., rental income from providing room and board to local students and clergymen which is non-taxable income, or babysitting, etc., etc.

All in all, a good co-sponsor that shows a decent income would be best to compensate for her own lack of income and even if she does have sufficient income, a co-sponsor wouldn't hurt. It would not only show fiancial support, but support for your relationship as well..

Well, they obviously got some sort of notification that the law was changed, it can't just be on heresay alone. Ask them to provide you the proof if they refuse to do it. Or find someone who knows someone who can find out for you. An attorney would not be a bad place to start either.
